ACTION: Proposed rule. SUMMARY: This proposed rule would address any undue regulatory impact and burden of the physician self-referral law. This proposed rule is being issued in conjunction with the Centers for Medicare & Medicaid Services’ (CMS) Patients over Paperwork initiative and the Department of Health and Human Services’ (the Department or HHS) Regulatory Sprint to Coordinated Care. This proposed rule proposes exceptions to the physician self-referral law for certain value-based compensation arrangements between or among physicians, providers, and suppliers. It would also create a new exception for certain arrangements under which a physician receives limited remuneration for items or services actually provided by the physician; create a new CMS-1720-P 2 exception for donations of cybersecurity technology and related services; and amend the existing exception for electronic health records (EHR) items and services. This proposed rule also provides critically necessary guidance for physicians and health care providers and suppliers whose financial relationships are governed by the physician self-referral statute and regulations. Background A. Statutory and Regulatory History Section 1877 of the Social Security Act (the Act), also known as the physician self-referral law: (1) prohibits a physician from making referrals for certain designated health services payable by Medicare to an entity with which he or she (or an immediate family member) has a financial relationship, unless an exception applies; and (2) prohibits the entity from filing claims with Medicare (or billing another individual, entity, or third party payer) for those referred services. A financial relationship is an ownership or investment interest in the entity or a compensation arrangement with the entity. The statute establishes a number of specific exceptions and grants the Secretary of the Department of Health and Human Services (the Secretary) the authority to create regulatory exceptions for financial relationships that do not pose a risk of program or patient abuse. Section 1903(s) of the Act extends aspects of the physician self-referral prohibitions to Medicaid. For additional information about section 1903(s) of the Act, see 66 FR 857 through 858. This rulemaking follows a history of rulemakings related to the physician self- referral law. The following discussion provides a chronology of our more significant and comprehensive rulemakings; it is not an exhaustive list of all rulemakings related to the physician self-referral law. After the passage of section 1877 of the Act, we proposed rulemakings in 1992 (related only to referrals for clinical laboratory services) (57 FR 8588) (the 1992 proposed rule) and 1998 (addressing referrals for all designated health CMS-1720-P 9 services) (63 FR 1659) (the 1998 proposed rule). We finalized the proposals from the 1992 proposed rule in 1995 (60 FR 41914) (the 1995 final rule), and issued final rules following the 1998 proposed rule in three stages. The first final rulemaking (Phase I) was published in the Federal Register on January 4, 2001 as a final rule with comment period (66 FR 856). The second final rulemaking (Phase II) was published in the Federal Register on March 26, 2004 as an interim final rule with comment period (69 FR 16054).

The latter is often referred to as the Stark Law in recognition of its legislative creator, Congressman Pete Stark (D-13th Calif.).     Anti-Kickback, Stark and the Affordable Care Act As the Affordable Care Act continues to reward enterprises such as Accountable Care Organizations that (i) improve the health experience of patients, and (ii) operate efficiently by reducing costs, a health care practitioner should not lose sight on schemes that could run afoul of prohibited self- referral or anti-kickback laws. Since 1972, Congress prohibited practitioners from entering into “kickback” arrangements if such arrangements involved a paid referral that related to the Medicare Program. As enforcement of the anti-kickback law has expanded to include self-referrals as a prohibited activity, the anti-kickback and self-referral laws now cover the Medicaid and Tricare Programs . In fact, 2016 is expected to be a busy year with respect to enforcement of Stark and Anti-kickback violations. As the year continues to unfold, it is important to be reminded generally what (i) anti-kickback and (ii) self-referral means in the ever changing economics of providing health care. In general, the anti- kickback prohibition or specifically Section 1320a-7b of Title 42 of the United States Code prohibits any person from: (i) knowingly and willfully (ii) soliciting, receiving, offering to pay, or paying any (iii) remuneration (including any kickback, bribe, or rebate) in return for (a) referring an individual to a person for the furnishing or arranging for the furnishing of any item or service for which payment may be made under a federal health care program, or (b) purchasing, leasing, ordering, arranging any good, facility, service, or item for which payment may be made under a federal health care program.

One focus of this legislation, the Patient Protection and Affordable Care Act (PPACA) as amended, is improved health care fraud and abuse enforcement. PPACA, among other things, creates new health care fraud enforcement tools and expands upon the types of prohibited conduct. This report provides an overview of some of the more commonly used statutes used to fight health care fraud and abuse and discusses some of the changes made to these statutes by PPACA. Title XI of the Social Security Act contains Medicare and Medicaid program-related anti-fraud provisions, which impose civil penalties, criminal penalties, as well as exclusions from federal health care programs on persons who engage in certain types of misconduct.     MMS STARK LAW ISSUES BRIEF 1 Basic Introduction to the Stark Law This Issue Brief is the first in a series addressing the federal prohibition on physician self-referral, commonly referred to as the Stark Law.1 The goal of this series is to educate physicians on the basics of the law and provide practical guidance on its application to phy- sicians in various practice settings. This first Issue Brief will orient the reader by providing an overview of the Stark Law prohibition and its various component parts. This will be followed by subsequent Issue Briefs that will go into more detail on the Stark Law’s most commonly relied upon exceptions, the key elements of the compensation exceptions (e.g., fair market value), the benefits for group practices under the Stark Law, the considerations relevant to physicians in private practice, faculty practice plans and hospital-affiliated group practices, and finally a discussion on the continuing relevance of the Stark Law in today’s alternative payment world. As the law is heavily dependent on a series of defined terms, these terms are indicated in bold and italicized for ease of reference for the reader throughout these Issue Briefs. Meghan Cosgrove is a partner in the Health Care Department at Barrett & Singal.
