COUNTY OF MAUI WASTEWATER RECLAMATION DIVISION

A. GENERAL INFORMATION

The United States Environmental Protection Agency (USEPA) and the State of Hawaii Department of Health (DOH) filed two lawsuits against the County of Maui, Civil Nos. 98- 00622 SOM and 99-0064 (3), alleging violations of Federal and State law. The County of Maui entered into a Consent Decree with the USEPA and State DOH. The Consent Decree was filed November 8, 1999 in U.S. District Court pursuant to the Clean Water Act.

As a requirement under the Consent Decree, the County is required to submit to EPA and the DOH quarterly Consent Decree Compliance Reports. The quarterly report includes steps taken by the County to develop and implement the various goals, plans, programs, procedures, schedules and budgets required pursuant to the Consent Decree.

This is the thirty fourth quarterly report being submitted under the approved final Consent Decree. The Consent Decree was approved by the Court on November 8, 1999. This report covers the period October 1, 2007 to December 31, 2007.

Summary of major accomplishments during the last quarter:

1. Sewer Line System Analysis and Rehabilitation Program Completed video of the medium priority sewer and about 25,000 feet of low priority sewer was turned over to the County by the contractor in September/October and placed on a master hard drive in October. Analysis of video is currently being completed. This quarter over $6.2 million dollars in rehabilitation work was awarded for lines identified by the high priority CCTV investigations.

2. Fats, Oil and Grease (FOG) Control Program During this quarter pretreatment staff completed the inspection of 173 food establishments within the County of Maui. In the ever changing roster of operating food establishments, approximately 96% of the businesses have completed Appendix H sizing and plumbing plan approvals.

3. Sewer Line System Preventative Maintenance The maintenance collections crews completed 14,333 lineal feet of periodic system flushing. This makes the three (3) year total over 740,000 l.f., or 70% of the five (5) year goal.

4. Information Management Maintenance Connection software was implemented which centralizes the database for all assets and all preventative and corrective maintenance activity (work orders etc.). This includes every manhole, gravity collection line, force main, equipment at pump stations and treatment facilities, and mobile equipment/vehicles.

1 B. SPILL REDUCTION ACTION PLAN

B.1. SEWER LINE SYSTEM PREVENTIVE MAINTENANCE (Section VIII.B)

1. General Information:

This plan is intended to provide a guide for the Collection System staff. The plan outlines the approach that the Collection System Program is using to meet its current objectives and how the program will grow to meet demands in the future.

2. Schedule:

The plan is 100% complete and was submitted to EPA/DOH on December 15, 1999. This plan was approved by both EPA and DOH on May 8, 2000

3. Actions during last quarter:

In line with the Consent Decree requirement of a complete system evaluation and flush within a five year period and an annual goal of 211,000 linear feet per year, the County continues to perform sewer system preventative maintenance (weekly/periodic) in identified potential problem areas while also showing a gain in system wide evaluation and problem correction. The following table summarizes system line flushing and manhole inspection accomplished during the last quarter and year to date.

In January of 2008, the County enters the fourth year of a five year cycle. 438,020 l.f. of system flush was completed in 2005 and 273,157 l.f. in 2006. Including footage for 2007 over 70% of the five year goal has been completed in three years. Maui County continues to direct the necessary resources toward the preventive maintenance aspect of the sewer system. The elimination of recurring spills, reduced number of spill events and volumes on gravity lines are both indicative of the success of our approach and the dedication of staff to the overall effort.

2 B.2. PERSONNEL TRAINING (Section: VIII.D)

1. General Information:

The County of Maui is required to provide training to all appropriate Wastewater Reclamation Division Personnel on the consent decree requirements, as well as spill reporting procedures.

2. Schedule:

The County submitted its training plan to EPA and DOH in December 1999. It was approved May 8, 2000. Since that time the County has completed initial training of appropriate personnel as well as refresher training.

3. Action during last Quarter

The Wastewater Reclamation Division determined a schedule for refresher training on the Consent Decree for employees throughout the division. Training/refresher training will commence in January of 2008.

3 B.3. FATS, OIL, AND GREASE (FOG) CONTROL PROGRAM (Section VIII.E)

1. General Information:

The Consent Decree required the County to continue to develop and implement a FOG control program that would require the installation and proper operation and maintenance of grease interceptors. Requirements include the following:

a. Enact an ordinance requiring the installation of grease interceptors at any commercial activity with the potential to discharge FOG into the collection system.

b. Provide sufficient resources to implement, monitor and enforce the ordinance.

c. Conduct grease interceptor inspections at each Industrial User (IU) required to have a grease interceptor at least once every year for the first two years and once every eighteen months thereafter.

d. Continue to take enforcement actions against non-complying IU =s.

2. Schedule:

December 2002 All food establishments to be permitted. (Completed)

December 2003 All food service establishments in compliance with Appendix H interceptor sizing criteria.

December 2005 All food service establishments in compliance with Title 14, Chapter 14.21A.080 of the Maui County Code.

3. Actions during last quarter:

a. Annual grease interceptor and kitchen inspections were conducted. The approximate total number of food service establishments connected to the sewer system in Maui County is now 540. Total inspections this quarter numbered 173. This included regular inspections (159), follow up inspections for installations and corrections (8) and miscellaneous inspections (6).

b. Grease interceptor size based on Appendix H of the UPC is at 96% of the total facilities being inspected. Attachment “A” lists the establishments, last inspection date and their respective grease interceptor sizes.

c. Work is continuing with the County =s Management Information Systems to verify that all food service establishment data is correct all inspection results are up to date and reporting is automated in the County =s master permit system (KIVA).

d. No additional Notice of Violations (NOV =s) were issued in the quarter. A listing of the NOV status for non-compliance with the grease interceptor upgrade program is included in Attachment “B”. A summary of the status is as follows:

e. Eighty-four (84) discharge permits were issued (or renewed) to during the quarter.

f. Review of grease interceptor sizing/plumbing for facilities not connected to the County of Maui Sewer, initiated by the EPA and State Department of Health, is ongoing. Sizing approval was not given to any (0) of these facilities during this quarter.

5 C. INFORMATION MANAGEMENT (Section IX)

1. General Information:

The County of Maui purchased new automated reporting system (ARS) software from CarteGraph called ASewerView @ and AWorkDirector @ in October 1997. Subsequent training was conducted on site by a manufacturers representative. Implementation of the new software was delayed while the County used in-house personnel to develop the map overlays for the Sewer View program.

During 1998, in-house personnel developed preliminary map overlays to run the SewerView software. During negotiations of the final Consent Decree, it was determined that a new County wide mapping system with more details and capabilities would be needed. This included a requirement to provide a new manhole numbering system that would be compatible with future GIS implementation as well as with use of the Work Director Maintenance work order software.

In December 1999, the new ARS was used to generate work orders for one section of line in the Maui 100 Subdivision, Kihei area. Work orders were generated and field personnel provided field information/inspection results for updating. This was a pilot implementation of the ARS.

2. Schedule:

a. August 2001 Begin implementation of the ARS for Lahaina, Kihei, Lanai and Molokai areas.

b. September 2001 Complete mapping revisions.

c. October 2001 to January 2002 Input GIS database information into the SewerView software program for Lahaina, Kihei, Lanai and Molokai.

d. November 2007 Implemented new Maintenance Software throughout entire division (Maintenance Connection)

3. Action during last quarter:

a. The division has implemented a new asset management/preventative maintenance system that includes all of its assets. The program is web based and incorporates all scheduled and unscheduled work orders, callouts and preventative tasks. All linear assets (collection lines, force mains and manholes) treatment plant facilities and equipment, pump station sites and equipment, reclaimed water lines and appurtenances are tracked in the system. GIS was upgraded and is an integrated with the new ARS.

6 D. SEWER LINE SYSTEM ANALYSIS AND REHABILITATION PROGRAM (Section X)

1. General Information:

Under this program, the County is required to minimize infiltration and inflow, inspect all wastewater lines for corrosion, cracks and exfiltration and provide for adequate hydraulic capacity. The program will be conducted in three phases and will result in the development of a rehabilitation plan (Phase III) to address those issues found in phases I and II. Phase I has been completed. Phase II is the current ongoing activity.

Phase I: During this phase of the program, the County will review existing data to identify potential problem areas. This analysis will be based on the evaluation of spills, pipe material, age of system, flows, terrain evaluation, maintenance records and other factors. In addition to this analysis, the County will develop a mapping system that will provide a consolidated countywide map of the entire collection system. Included in the map creation, the consultant will develop a systematic manhole numbering system that will also assist the County in using the Information Management System more effectively.

Phase II: During this phase of the program, the County will further investigate and analyze problem areas according to the needs identified in phase I. This investigation will include a determination of system integrity and other identified problems through the use of generally accepted engineering methods.

Phase III: This phase of the program includes determining a rehabilitation plan based on the Phase II investigations. The report shall include cost effectiveness, project identification, priorities, and costs. The plan shall provide for the rehabilitation of all lines before the end of their useful life.

2. Schedule

a. Preliminary Sewer System Problem Area Analysis (Phase I)

Wailuku-Kahului was completed in June 2000. All other areas in Maui County were completed in June 2001, well ahead of the 2004 Consent Decree target date. This accelerated schedule gives the County the ability to utilize the data gathered during this phase to develop a phase II program on an island wide basis instead of individual geographic areas. It will also aid in the development and implementation of the dynamic model required in the Capacity Evaluation Work Plan.

D. SEWER LINE SYSTEM ANALYSIS AND REHABILITATION PROGRAM (Section X) (continued)

4. Action during the last quarter:

a. The CCTV work of all Medium Priority lines was completed in June 2007 and all video was turned over to the County in September 2007 for review. Some repair work has already been completed from the information gathered. The County is preparing the required report to summarize the findings of this CCTV work.

b. The bid documents for the Front Street Rehabilitation project are being prepared. This project was identified in the Rehabilitation Plan (Phase III Part 1) for the high priority sewer and has FY2007 funds approved in the amount of $1.5 million.

c. The County awarded the South Kihei Road Rehabilitation Projects as identified in the Rehabilitation Plan (Phase III Part 1) for the high priority sewer. Construction of this project will begin in mid 2008. There is $5M available in FY2007 funds and $1M in FY2008 for these Kihei projects.

d. The County is continuing to prepare the bid documents for the Vevau Street/Puunene Ave. Rehabilitation Project in Kahului, as identified in the Rehabilitation Plan (Phase III Part 1) for the high priority sewer. There is $500K available in FY2007 funds for this project.

e. The County is continuing to prepare the bid documents for the Kaanapali and Kahoma Rehabilitation Projects in Lahaina, as identified in the Rehabilitation Plan (Phase III Part 1) for the high priority sewer. There is $1.5M available in FY2007 funds for this and other projects.

f. The approved FY2008 budget includes funds for additional rehabilitation projects. (Kihei $1M, Lahaina $500K, Central $1.5M). Projects will be chosen following the award of contracts for items c, d, and e above.

g. The County is reviewing lines and preparing maps for Phase II Part 3 (Low Priority lines). About 25% of the lines were included in the Medium Priority CCTV project and the videos are under review. The balance will be placed out to bid in 2007.

h. The Rehabilitation Plan (Phase III Part 1) for the high priority sewer was submitted to USEPA/DOH for approval on March 20, 2007. No response has been received to date.

i. Schedules were updated for the analysis and rehabilitation plans for the High, Medium and Low Priority lines. These schedules can be found in Attachment AF@.

j. Funds have been allocated in the proposed budget for rehabilitation work for fiscal years 2008 thru 2013. Specific projects will be developed in the required Rehabilitation Plans.

E. LONG TERM WWRF & PUMP STATION PLANNING, REHABILITATION, REPLACEMENT & EXPANSION

E.1. LONG-TERM SYSTEM REVIEW WORK PLAN (Section XI.40.a)

1. General Information:

a. The County is required to provide a Long-Term System Review Work Plan for systematically identifying when pump stations and wastewater reclamation facility =s equipment or fixtures will reach, or are reaching, the end of their useful lives. Based on this work plan, a schedule will be developed for continuously evaluating the condition (structural integrity, corrosion damage, mechanical condition, etc.) of pump stations and WWRF equipment or fixtures.

4. Action during the last quarter:

a. The County completed its initial 20 year Long Term Rehabilitation, Repair and Replacement schedule and submitted it to EPA/DOH for review and approval in December 2000. EPA accepted the submitted plan.

b. The County of Maui last updated its 20 Year Long Term Rehabilitation, Repair and Replacement schedule in 2005. It was used in implementing item c below.

c. During the last quarter, the County of Maui implemented a new Asset Management/Preventative Maintenance system to track equipment location, asset status and history. This system automatically issues, tracks and records work orders for preventative maintenance, repair and replacement of assets as well as unscheduled work. This encompasses all equipment, facilities and linear assets.

11 E.2. CAPACITY EVALUATION WORK PLAN (Section: XI.40.c)

1. General Information:

This plan will provide the County with the ability to systematically and continuously monitor and evaluate the capacity of all critical points within the collection system and wastewater reclamation facilities. Additionally, a dynamic modeling program will be developed to monitor the hydraulic capacity within the collection system for the Island of Maui.

The plan consists of three main areas:

• Building Permit Applications • Collection System Capacity Monitoring • Pump Station Capacity Monitoring

2. Schedule

a. Implementation of the plan has been initiated with the Building Permit Application program fully operational and functional.

b. Pump Station Capacities:

3. Action during the last quarter:

Pump Station Capacities - The 2006 update to the Pump Station Capacity Plan was completed in early 2007. The next update will be occurring in late January so peak flows are captured during the winter rain and high occupancy tourist period. Past information and the new updates are integrated into the CIP planning documents through FY2030. Current Capital Improvement Projects (CIP) that will address these facilities are listed below: Note that the County is currently processing its FY2009 budget for project approvals (copy attached in Appendix “G”).

Dynamic Modeling - During this quarter, the consultant finalized the model and the first run was completed. Some key lines were identified and the model was used as a basis for project reviews. Training for County personnel to maintain and run the model is scheduled for February 2008.
