5.1 MARSHALL ROAD DUPLICATION ( NORTH TO )

KEY ISSUES

• Marshall Road, between Beechboro Road North and Drumpellier Drive serves as an important link between the Urban Growth Corridor, Tonkin Hwy and the Malaga Industrial Area.

• Traffic counts conducted in September 2019 indicate that 12,844 vehicles per day travel on the single carriage way. Due to recent road upgrades, urban growth and the future Metronet rail line, traffic volumes are anticipated to shortly exceed 15,000 vehicles per day, warranting duplication of Marshall Road.

• The first stage of the duplication is the proposed upgrade of the intersection at Marshall Road and Beechboro Road North to a dual lane roundabout, for which $2.5M has been recently received from the State Government. Further stages are to be proposed and costed following the completion of detailed design and planning. There is $1.1M on the 2021/22 capital budget to progress the project to a construction ready state including detailed design, service locating, utility relocation and planning reports.

• City officers have completed the 15% concept design and undertaken community consultation for the proposed works. Sixteen responses were received of which there were four objections, four neutral and eight in favour.

• Responses of support focused on items such as; the upgrade improving safety, reducing traffic congestion and improving pedestrian/cyclist accessibility.

• Responses in objection raised concerns with loss of land, requests for right turn movements, impacts to property rear access, changes to boundary access restrictions and a request for traffic lights instead of a roundabout.

It is recommended that the Council resolve to proceed with the construction of the roundabout at the intersection of Marshall Road and Beechboro Road North at a cost of $2.5M as provided by the state government, proceed with the detailed design and planning for the duplication of Marshall Road between Beechboro Road North and Drumpellier Drive at a cost of $1.1M as included on the 2021/22 capital works program, and continue to update the Long Term Financial Plan with the proposed costing and staging of the project as further detailed estimates are conducted.

BACKGROUND

Marshall Road is classified as a District Distributor A, providing a high degree of connectivity to primary and/or other distributor roads. It serves as an important link between the Urban Growth Corridor, Tonkin Hwy and the Malaga Industrial Area.

Traffic counts conducted in September 2019 indicate that 12,844 vehicles per day travel on the single carriage way. Increasing traffic on recently constructed major connecting roads such as Drumpellier Drive and NorthLink Stage 2 has further increased demand on Marshall Road. Congestion is a regular occurrence during peak hours and is expected to further increase with the urban expansion of surrounding suburbs and completion of the Metronet Morley to Ellenbrook line. Traffic volumes will shortly exceed 15,000 vehicles per day which is the traffic threshold where duplication is recommended.

The City intends to stage the duplication over several years. The first stage of the project is the proposed construction of a dual lane roundabout at the intersection of Marshall Road and Beechboro Road North. The City recently received $2.5M from the State Government for the construction of the roundabout, which is intended to commence in 2021/22 to coincide with Metronet’s upgrade of Beechboro Road North.

The timing of further stages has yet to be determined. This will be proposed following the progression of detailed design and approvals to obtain detailed cost estimates and prepare a suitable funding approach, for Council’s consideration through the Long Term Financial Plan and Annual Budgeting processes.

The City has completed a 15% concept design for the duplication of Marshall Road between Beechboro Road North and Drumpellier Drive in Bennett Springs. Prior to progressing to detailed design, the City has consulted with the local community.

DETAILS

In April 2021, City staff undertook community consultation for the Marshall Road duplication, with letters being delivered to adjacent frontages. Additionally, a 'Have Your Say' page was set up on the City’s website and was also advertised in the local newspaper, to target the wider community. As part of this consultation, sixteen responses were received of which there were four objections, four neutral and eight in favour.

The responses of support focused on items such as; the upgrade improving safety, reducing traffic congestion and improving pedestrian/cyclist accessibility.

The objections received are summarised in the table below, with full statements provided in the attachments.

Concerns Officers' Response

Loss of land. • The City has as far as practicable designed the duplication and proposed roundabouts to minimise requirements for land acquisition whilst balancing geometry and alignment to current design standards.

• City staff will liaise with property owners regarding any land acquisition once extents have been refined.

Impacts to rear • Some of the properties along Marshall Road have rear access access of properties onto Marshall Road. At this stage the City does not anticipate the duplication will impact the access, however in the event where an access will be impacted the City will contact the property owner to discuss alternatives.

• West of Bennett Brook the second carriageway is to be constructed north of the existing road, which avoids the properties of concern.

• Properties with rear accesses should have appropriate development approval for the secondary crossover.

As per the above comments, staff will work to address comments where appropriate through the detailed design process, however generally City staff consider that the project should proceed due to the anticipated traffic generation and network implications.

City staff therefore recommend that Council resolve to proceed with the detailed design for the duplication of Marshall Road in 2021/22, in order for staff to seek relevant approvals and determine estimated costs and an appropriate funding strategy for the project. The cost and timing of future proposed stages will be reported to Council for approval via the Long Term Financial Plan and Annual Budget processes.

City staff also recommend that Council proceed with construction of the roundabout at the intersection of Marshall Road and Beechboro Road North in the 2021/22 financial year, in order to coincide with Metronet’s upgrade of Beechboro Road North. The State Government commitment of $2.5M is anticipated to cover all project costs for the roundabout works. It is noted that the upgrade of the intersection is required for safety and capacity purposes whether or not the duplication proceeds.

CONSULTATION

The City has recently received $2.5M from the State Government for the construction of the Marshall and Beechboro Road North roundabout. The 2021/22 capital works program also has $1.1M of municipal funding budgeted for progressing the Marshall Road design to a construction ready state, service locating, utility relocation and planning reports.

The total project cost is difficult to estimate at this time until detailed planning has been undertaken due to the project variables, however it is likely that the duplication will be in the vicinity of $30M. A construction estimate for the project will be formed off the detailed design with staging and figures reported in the City’s Long Term Financial Plan for Council’s future approval.

We have had no other information provided to us about this Proposal from the City in regards to this Project.

4 Resident Support One of the worst roads in Perth, so dark and unsafe. It's about time we get upgrade this road. As a taxi driver in Perth for 20 years and living in Swan shire I have seen lot of people overpassing and speeding and this is probably best news for all locals.

5 Resident Object I'm the owner of lot 74 and very concerned about the roundabout at the intersection of Marshall and Altone Rds. Firstly I've already fenced off my property with colourbond fencing and reduced my back boundary by 6m. Within I've built some aviaries and chicken coops along with some trees and it looks like the roundabout is going to go through a large corner of it. Secondly I think Altone Rd can stay a single lane but be widen up. Cause if you increase it to double lanes it would increase traffic which would be unsafe for the children in the area. I've recently had a car crash into the light pole in the corner of my house which is still yet to be replaced. 6 Resident Support Should have dedicated turning pocket for eastbound traffic turning right into 211 Marshall Road and access within the median strip for vehicles leaving 211 Marshall Road to be able to turn right and carry on eastbound towards Dayton.

7 Resident Support Please ensure footpaths are constructed as part of the works. Please add pedestrian lighting (or lighting from the street lights) for the footpath, to ensure this can be used safely at night time. Please add street lighting as this portion of Marshall Rd is very dark at night time. Request that a new footpath is included to connect Marshall road and the road/footpath at Driftwood Way.

9 Resident Object There are many concerns but firstly like myself and other owners that back onto Marshall Rd we need access to the back blocks at all times. How will the road affect our entry? And the walkways will need to build walls for security reasons and the noise that will be brought on by more traffic. Maybe there should be traffic lights and not a roundabout or an option to leave road as it is. Its fine the way it is, spend money on better things.

10 Resident Object We act on behalf of Numeruno Pty Ltd and Swancave Pty Ltd, being the owners of Lot 102 on the corner of Marshall Road and Beechboro Road North in Bennett Springs.

Our client’s property is currently vacant, however there is an intention for the property to be developed for Commercial purposes upon the implementation of further development of the broader locality.

Our clients have received correspondence from the City of Swan dated 14 April 2021, seeking comments with respect to proposed works relating to the proposed Marshall Road duplication in Bennett Springs. This correspondence is submitted as an OBJECTION to the proposed works.

It is relevant to note that our client’s property currently has an access restriction across an 8.5 metre wide truncation on the corner of Marshall Road and Beechboro Road North and across a 32.0 metre wide section of its Marshall Road frontage. The remaining 59.38 metre frontage of our client’s property to Marshall Road is unencumbered and has unrestricted access. It is understood the access arrangements to Marshall Road were agreed in (circa) March 2000.

More recently, our clients have received a request from the City of Swan seeking to acquire a portion of the frontage of the land for the purposes of facilitating the Marshall Road widening. Whilst the acquisition process has been agreed ‘in-principle’ by our clients, the City at no time in its approaches referenced any intention to alter the access arrangements to Marshall Road. Upon receipt of the draft Deposited Plan, it became evident to our clients that in addition to the road widening, there was also a proposal to further restrict access from our client’s land to Marshall Road.

The proposed access restriction to Marshall Road that was not communicated at the time of the ‘in-principal’ agreement for the road widening, is not acceptable to our clients and as such, completion of the road widening process has stalled.

Document Set ID: 6771429 Version: 1, Version Date: 09/07/2021 There have been numerous communications with Ms Liah Ale and Mr Peter Lewis-Affleck from the City of Swan in relation to this matter and, more recently, there have been communications with Mr Finn MacLeod in relation to road design matters. These communications have been on the basis of seeking to work in a cooperative manner with the City of Swan to allow the proposed roadworks to proceed without detrimentally impacting upon the access arrangements for Lot 102.

In our most recent communications, we were advised that, whilst funding has not been secured for the road upgrade works, the City would be progressing with a design solution for the road upgrades and that our clients would be included in consideration of any design refinements with respect to the proposed works. We are extremely disappointed that it appears the City has progressed design works to the point where public comments are being sought, notwithstanding that the significant issue of retaining the current access rights for our client’s land to Marshall Road have not been resolved.

In considering the proposed design as attached to the City’s correspondence of 14 April 2021, we note that it appears a greater amount of land would be required from our client’s property beyond that which has been previously contemplated. Furthermore, we question if the proposed geometric design of the road will allow for retention of the existing access rights into our client’s land. The plans provided have insufficient detail for our clients to consider the impact on its land, however, it would appear that the proposed road design has not considered the requirement to retain the existing access rights. In light of the above-mentioned concerns, our clients have no option other than to strongly oppose the proposal. Our clients are of the firm belief that they currently have a legal right of access to the land from Marshall Road and that the loss of the existing access rights will have a significant detrimental impact on the land. We request that the design of the road alignment is reconsidered and that the City confirms the access to our client’s land (from Marshall Road) will not be restricted as a result of the future works.

We trust that the above position is given serious consideration by the City and that a revised Design Concept is prepared for the road widening arrangement.

11 Resident Support 1. Overall, we support the proposed layout which will contribute to the improvement in traffic safety on Marshall Road and adjoining local roads. 2. In regard to the intersection at Cheltenham Street, we would like the addition of a left slip lane for the northern carriageway to allow for the safe left turn for traffic turning into Cheltenham Street, without this there is a potential for rear-end crashes as we do have a lot of traffic turning left at this intersection coming to our property which would slow the east bound through traffic, cause frustration leading to crashes; 3. the concept plan shows that the proposed northern carriageway will be impacting land within our property. We would like to know this how much land may be needed for the upgraded road as we are looking at developing a master plan for our property to support the increased use by our members/community. 4. What are the timelines for the design and construction of this proposed Duplication; and

12 Resident Neutral I am writing on behalf of the Roman Catholic Archbishop of Perth, being the landowner of Lot 13 corner of Marshall and Beechboro Roads Whiteman, in relation to your recent correspondence (attached) regarding the proposed upgrades to Beechboro and Marshall Roads.

I note that Lot 13 is shown as Lot 811 on the concept plans provided by the City of Swan.

The landowner has a number of concerns relating to this project and its potential impacts on Lot 13/811. Further information is requested, in particular detailed engineering drawings.

Based on a preliminary review the following questions have been raised:

• The Department of Planning Lands and Heritage is proposing to acquire additional road reserve from Lot 13/811 to allow for these upgrades. Please provide further detail showing the alignment of the upgraded road with the proposed new boundaries for Lot 13/811 (to be re-defined as Lot 350). • We request the proposed finished levels of the upgraded roads in relation to Lot 13/811 levels please be provided for our review. This matter is of particular concern to the owners. • How do these works relate to the proposed Metronet upgrades to Beechboro Road? • Please show the proposed alignment of services to be reticulated or relocated along both frontages • Will the footpath along the north side of Marshall Road be extended along the Lot 13 frontage? • Where are bus stops proposed to be located? • Please provide more detail on proposed drainage design. • We request more detail of the nib access into Lot 811 off Marshall Road.

While the above represents a preliminary review only, it is anticipated that the City of Swan will have further information available for discussion as the concept plans are further refined.

13 Resident Neutral I have recently seen proposals for an upgrade of Marshall road to Dual carriageway. Marshall road is a commute for me via cycle. Unfortunately the condition of the “shared path” is in terrible condition making it unusable on a bicycle. Meaning I have to ride on the road. Is there plans for a dedicated cycle lane as in Drumpellier. I feel this would increase people from the Dayton/Brabham area cycling. Because as of now the alternate is going through multiple sets of lights and along the Reid path.

14 Resident Object Providing feedback on the proposed Marshall road duplication plan. We currently live on rainbow crescent and enter via the Altone road/tattler way roundabout. The amount of times we have had near misses at that round about where people are not slowing down and giving way to their right is ridiculous. It’s got to the point where we actually have to stop and give way to traffic that has decided to fly

This is only a single lane road so I can imagine what will happen with dual lanes on Marshall road and roundabouts. There have been a few negative comments re the flow of traffic and slowing down peoples trips, however I think it would be a lot safer having traffic lights.

Obviously one opinion won’t make a difference and traffic lights probably cost more than roundabouts. This could be a place the city could also place cameras to increase our security and make our community safer

15 Resident Support I've read about you making Marshall Rd bigger and better which is great but whilst your doing this can we add in a footpath as well? People need to be able to walk safely from Dayton to the bus stops, the cafe and even to Altone Rd. People with wheelchairs and prams need a smooth surface. At this point it's dangerous for anyone.

16 Resident Neutral We have received a high number of devotees requesting to accommodate a slip road to 211 Marshall Rd Bennett Springs heading north to Altone Road. Due to the high volume of visitors to the temple it is our kind request to accommodate the slip road in the proposed upgrades to Marshall Rd.

Please let us know if you need confirmation of numbers requesting the slip road.

Also the current plan does not allow for the right turn into the temple or out of the temple. This has a potential to block (overwhelm) the Altone road roundabout due to the sheer number of devotees exiting the temple almost all around at the same time.
