Art. 2º - Todos os produtos entrarão em licitação sem preço. Art. 3º - A arrematação far-se-á pelo maior lance. Art. 4º - Os produtos a serem licitados estarão à disposição dos interessados a partir das 17:00hs. do dia do leilão no Tattersall ou antes nas cocheiras dos respectivos vendedores, informações na agência Pró-Horse (11) 3814-1844/9977-2512. Art. 5º - É facultado aos interessados fazer exames técnicos de sua confiança os produtos a serem licitados antes do leilão, portanto são INACEITÁVEIS quaisquer reclamações posteriores. Art. 6º - O vendedor e a agência jamais poderão ser responsabilizados em hipótese alguma ou por motivo nenhum, por qualquer alteração ocorrida no estado dos animais ou por risco de acidente, trans- porte de volta ou nos locais de permanência dos mesmos, que correrão por conta e risco exclusivo do comprador, após a arrematação. Art. 7º - Os animais após a arrematação voltarão para os seus locais de origem e deverão ser retirados no prazo de dois dias a correr da data da arrematação. Art. 8º - As vendas serão realizadas em parcelas, e os lances subsequentes serão fixados pelo leiloeiro no início do pregão. Art. 9º - Foram dispensados os necessários cuidados para que o catálogo esteja correto mas a Agência Pró- Horse, os vendedores e o leiloeiro não respondem por erros ou omissões do mesmo. Eventuais correções feitas durante o Leilão prevalecerão sobre o catálogo. II - DOS COMPRADORES Art. 10º - O comprador terá que efetuar o acerto total ou de entrada, e taxas durante o Leilão, no próprio Tattersall ou até o dia útil seguinte, na Agência Pró-Horse (9977-2512), assinando os Títulos correspondentes, para assim cancelar a Nota Promissória, assinada no ato da compra, e as condições de pagamento são: CONDIÇÕES DE PAGAMENTO: I - 15 parcelas sem juros com uma de entrada no ato e as outras 14 (quatorze) parcelas vincendas a cada 30 dias sem juros e sem correção, mais as taxas de praxe do leilão; II - 12 parcelas com desconto a ser anunciado; com uma de entrada no ato e as outras 11 (onze) parcelas vincendas a cada 30 dias sem juros e sem correção, mais as taxas de praxe do leilão; III- 7 parcelas com desconto a ser anunciado; com uma de entrada no ato e as outras 6 (seis) parcelas vincendas a cada 30 dias sem juros e sem correção, mais as taxas de praxe do leilão; IV- à vista com desconto a ser anunciado, mais as taxas de praxe do leilão. Parágrafo 1º - Os compradores que não estiverem cadastrados ou aqueles cujos cadastro não forem aprovados, terão que efetuar o pagamento à vista com direito ao desconto de 15% (Quinze por cento). Os interessados em obter financiamento deverão apresentar à Agência Pró-Horse, cadastro para apreciação até 48 horas antes do Leilão. Art. 11º - Os compradores deverão pagar as seguintes taxas: 1º - 6º (seis por cento) sobre o valor do arremate. 2º - Transferência de propriedade no Stud Book Brasileiro. Art. 12º - Aos compradores compete ainda: a) assinar no ato da compra Nota Promissória no valor correspondente ao preço de aquisição, mais as taxas devidas para pagamento e com vencimento contra apresentação e que deverá ser paga ou substituída, o contrato de financiamento. III - DOS VENDEDORES Art. 13º - Pagar às despesas do Leilão, dividido pelo número de animais, mesmo para as vendas anuladas, mais a taxa do Tattersall de 0,5 % (meio por cento) esta para o Jockey Club de São Paulo. Parágrafo 1º - No caso de abertura de parelhas, o vendedor pagará por 2 lotes. Art. 14º - No caso de não apresentação do animal inscrito, seu responsável deverá pagar o rateio das despesas e taxas de 6% (seis por cento) calculadas sobre o preço médio do leilão. Art. 15º - Apresentar o animal inscrito, no dia e local designados, devidamente encabestrados acompa- nhados de seu respectivo cavalariço, carteira de identidade e exame negativo de AIE dentro do prazo de validade do mesmo, exigido pelo serviço da Veterinária do Jockey Club de São Paulo. Os animais deverão estar no Tattersall até 17:00 do dia do Leilão. Art. 16º - No caso de defesa ou Forfait, o vendedor terá 2 (dois) dias úteis para efetuar o pagamento após o prazo, incidirão multa de 10 (dez por cento) e juros legais do mercado sobre o débito. Art. 17º - No caso de defesa a taxa de comprador de 6% (seis por cento) terá que ser paga também pelo vendedor. IV - CONDIÇÕES FINAIS Art. 18º - O animal arrematado será entregue pelo vendedor mediante a autorização por escrito da Pró- Horse e que dada imediatamente após a regularização da compra, correspondente ao vendedor a responsabilidade de manutenção do animal de 1 (um) dia subsequentes à arrematação. A partir do 2º (segundo) dia inclusive o valor das despesas de manutenção, ficarão por conta e risco do comprador em cujas cocheiras o animal estiver alojado. a) Eventuais problemas decorrentes da não retirada dos animais são de exclusiva responsabilida- de do comprador. Art. 19º - A palavra do leiloeiro no decorrer do leilão está credenciado a alterar, complementar ou retificar estas normas, bem como as informações que constem nos catálogos de venda. O Leiloeiro reserva- se o direito de não aceitar lances por pessoas que a seu critério não julgar responsáveis, sendo o seu julgamento soberano. Art.20º- Fica estabelecido ao Foro da Cidade de São Paulo, para eventualidade de qualquer pendência judicial. Art. 21º - Após o prazo de 2 (dois) dias úteis, caso não tenha ocorrido o acerto do comprador, o vendedor poderá aceitar ou não a anuência da Agência Organizadora, e substituição do comprador. Art. 22º - O vendedor não poderá inscrever neste Leilão, animais que tenham qualquer compromissos com terceiros (alienação, embargo judicial, etc.), portanto, caso isso ocorra, o leiloeiro e a Agência Pró-Horse não poderá ser responsabilizada em nenhuma hipótese, por problemas que possam surgir, tampouco em vendas efetuadas por telefone, apesar de todas as medidas preventivas que são tomadas.
