Philip Wright and Clifford Victor Fish (“the proprietor”) applied to register the following trade mark (hereafter referred to as “the mark”). Application date: 30 March 2011 Publication date: 29 April 2011 Registration date: 8 July 2011 2. The mark was registered for the following goods and services: Class 9: Apparatus for transmission or reproduction of sound or images; recorded media; downloadable electronic publications; compact discs; digital music. Class 16: Stationery; printed publications. Class 41: Entertainment. 3. On 4 September 2013, Chris Raynor, John Raynor, Graham Wyvill and Carlo Santanna (“the applicant”) filed a notice of invalidation against the registration. The invalidation is on the basis of Section 3(6) and 5(4)(a) of the Trade Marks Act 1994 (“the Act”). 4. The applicant claims common law ownership in the goodwill in a business known as PAPERLACE trading in the goods and services covered by the mark. They claim to have used the mark as their group name continuously since 1983. Therefore, they state that there would be a misrepresentation to the public which would result in damage to the aforementioned goodwill. This would contravene the law of passing off. 5. The applicant also claims that the registration should not have been registered since it was filed in bad faith.

SURFING FOR PUNKS: THE INTERNET AND THE PUNK SUBCULTURE IN NEW JERSEY by AARON ROBERT FURGASON A Dissertation submitted to the Graduate School-New Brunswick Rutgers, The State University of New Jersey in partial fulfillment of the requirements for the degree of Doctor of Philosophy Graduate Program in Communication, Information and Library Studies written under the direction of Professor Linda Steiner And approved by ________________________________ ________________________________ ________________________________ ________________________________ New Brunswick, New Jersey October, 2008 ABSTRACT OF THE DISSERTATION SURFING FOR PUNKS: THE INTERNET AND THE PUNK SUBCULTURE IN NEW JERSEY BY AARON ROBERT FURGASON Dissertation Director Professor Linda Steiner This study examines the influence of the Internet on the punk subculture in New Jersey. Previous research by academics on the effect of the Internet on popular music has centered on the impact of Napster and peer-to-peer networks on the distribution of recordings (Alexander, 2002; Ayres & Williams, 2004; Bishop, 2004; Daniel & Klimis, 1999; Fox, 2004; Mardesich, 1999; & Oberholzer & Strumpf, 2004). However, unexamined is the influence of the Internet on a specific music subculture, punk. This is important because the subculture is occupied mainly by youth engaged with both the Internet and punk music. The Internet's influence on the punk subculture is a particularly important area of study because the Internet alters how participants in the subculture (punk fans, bands and independent labels) communicate with one another, as well as changes the distribution of punk artifacts and information. ii Central to this study is the history of the major labels' dominance over the distribution and promotion of punk music, a domination examined via critical political economy theory.

  • Writing Songs and Writing a Record: Inside the Composition of an Acoustic Pop Album
Writing Songs and Writing a Record: Inside the Composition of an Acoustic Pop Album. By Greg Arnold BA (Hons.) MEd. Submitted in partial fulfilment of the requirements for the Degree of Doctor of Philosophy (Music) University of Tasmania November, 2013 DECLARATION This exegesis contains no material which has been accepted for a degree or diploma by the University or any other institution, except by way of background information and duly acknowledged in the exegesis, and to the best of my knowledge and belief no material previously published or written by another person except where due acknowledgment is made in the text of the exegesis. This exegesis may be made available for loan and limited copying in accordance with the Copyright Act 1968 Signed: Greg Arnold Date: November 13, 2013 ABSTRACT This project is a study of the author’s creative practice as a songwriter, record producer and performer of mostly (but not exclusively) acoustic pop music. This project has been pursued though performance and composition and is documented in the folio of recordings and the accompanying exegesis. The folio of this submission is weighted at eighty per cent and the exegesis at twenty per cent. It involves the creation of a new studio album by The Swamp Dandies. For this album the author has been songwriter, vocalist, instrumentalist, arranger, engineer and producer. In recognition of the interdependence of component stages, the exegesis provides an analytical narrative account of the entire compositional journey of the album from pre-tracking songwriting through to mastering. Utilising reflective journals and participant interviews undertaken throughout the process it documents and analyses the deliberate and “intuitive” creative methods involved in all of these tasks.
