1 Project Synopsis - Project No 01-0186

Wider Objectives: Promoting the Transport Corridor Europe Caucasus Asia (TRACECA) in order to develop and improve trade within the region as well as the integration into the international economic structure (access to world market).

Specific Project Objectives: Facilitate the co-ordination of the TRACECA Programme and its cohesion with other regional community-funded initiatives, other donors and improve information and communication channels via dissemination to the beneficiaries.

Outputs: The following outputs will be provided:

A Co-ordination of TRACECA-programme components and of TRACECA activities with other related programmes and community-funded initiatives is supported and supervised.

• Regular funding of Permanent Secretariat and National Commissions is ensured

• Communication network and information system is established.

• Regular annual IGC meetings and 2 PETrA steering committee meetings as scheduled.

• Regular meetings with Transport Authorities and other high level transport-related decision makers have taken place.

B On-going and scheduled TRACECA-projects are co-ordinated and future activities are programmed.

• Assessments of project reports are made.

• Programming for next periods is in time and in line with EU-guidelines and rules and co-ordinated with other investors and financing institutions.

C Investments are facilitated through establishing and maintaining excellent contacts with international financing institutions and other potential investors.

• Contact to donor organisations is established and maintained

D Feasibility Study shows the past and actual competitive situation and the future prospects of the TRACECA transport corridor.

• Feasibility Study is based on updated traffic data base and presents a clear image of the impacts, chances, risks and challenges of TRACECA.

E Information on TRACECA activities is readily accessible and TRACECA - programme is well perceived and aware beyond directly involved stakeholders and beneficiary countries.

• Until the end of the project there are two new TRACECA brochures, 1 updated TRACECA map, up to 6 posters and 7 quarterly issued magazines with about 12 pages each available and distributed among stakeholders. TRACECA Co-ordination Team Progress Report III May 2003 8

• TRACECA and PETrA web-pages are redesigned and updated at least 4 times during project duration, in cases of special events there are additional updates in between.

2 Summary of the project progress since the start

2.1 Coordination of members/beneficiaries of the TRACECA Programme

New Project Offices have been set up in Odessa and Tashkent. A Network of Local Contact points has been set up in Caucasus, in Central Asia and for the Black Sea Region.

Close contacts with National Secretaries/National Commissions have been organised in all TRACECA Member States and a monthly report scheme introduced.

The Permanent Secretariat has prepared and organised with the assistance of the co-ordination team a Working Group Meeting in Ashgabat (February, 2002), a Working Group and the Second Annual Meetings of IGC TRACECA in Tashkent (April, 2002), a Borders Harmonisation Evaluation Workshop in Baku (September, 2002) within the framework of the project “Harmonisation of Border Crossing Procedures” (HBCP), the three Workshop Meetings on Rail and Maritime Tariff Policy (June and October, 2002 and April, 2003) and a Road Transit Fee and Tariff Working Group Meeting (November, 2002) in Baku within the framework of the project “Unified Policy on Transit Fees and Tariffs” (UPTFT), the two Working Group Meetings of National Secretaries and Legal Experts in Baku on January, 2003(Annex 1) and Tashkent on May, 2003 (Annex 2) within the framework of the project “Common Legal Basis for Transit Transportation” (CLBTT).

The coordinators in Odessa and Tashkent as well as the Team-leader have participated in conferences and meetings in their regions (e.g. Fifth International Exhibition-Symposium on Shipping, Shipbuilding and Port’s development; Ministerial Conference in Kiev “V. Pan-European Transport Corridor – operational improvement and further development”; the 6th Steering Committee (SC) meeting of the Development of the BS-PETrA (Black Sea- Pan-European Transport Area) in Odessa; ”1. Europe Day in Ukraine”; BAKUTEL 2002 conference, TRANSCASPIAN 2002 & TRANSCASPIAN 2003 exhibitions in Baku, The 1st International Transport Conference and Exhibition on I&S Transport in the Caspian and the Black Sea Countries in Istanbul; Regional Co- operation Workshop in Tashkent organised by the Konrad Adenauer Foundation and the Speca Project Working Group on Transport and Border Crossing Facilitation in Almaty). In Central Asia the co-ordination team has participated in the Regional National Co-ordination Unit Meeting, held in Bishkek January 31st, 2003. In January 2003 and May 2003 the co-ordination team was engaged in missions of the Task Manager. The January mission was in Uzbekistan, Kazakhstan and Kyrgyzstan, the March mission was in Odessa in order to participate on the 6th BS PETrA SC meeting, the May mission was in connection with the IGC TRACECA working group meeting of the National Secretaries and connected with field visits on the road Samarkand – Karshi and the cotton Terminal in Buchara. The co-ordination team assisted in the before mentioned working group meeting. All contacts are attached in Annex 3.

Participation in the event dedicated to the 1 Europe Day in Kiev on 17 of May 2003. Presentation of the TRACECA Coordination Team Project both for experts and public visitors on the TRACECA stand National Secretary of Turkey was changed and new one was appointed

Financing support to Secretary General, Executive Secretary, National Secretaries and Permanent Secretariat has been ensured until the end of November, 2003 under the request of the European Commission stated in the Addendum 3 and 4 of the Contract. The financing of Secretary General, Executive Secretary and National Secretaries for the period from November 2002 until July 2003 is being covered out of the TACIS TRACECA Project “Common Legal Basis for Transit Transportation”. The most important topic during the reporting period were the missions with Afghan High Ranking Officials in Kabul for the purpose of informing Afghan Officials about the importance of accession to the Multilateral Agreement (MLA) for Afghanistan in the field of closer regional cooperation aimed at the development of international transport in the framework of the TRACECA Programme (Annex 4).

The three so called “New Generation Projects” Common Legal Basis for Transit Transportation, Harmonisation of Border Crossing Procedures and Unified Policy on Transit Fees and Tariffs are under execution by involving the National Secretaries of the IGC TRACECA in national working groups. The projects Pre-feasibility Study for a New Railway Link between Ferghana Valley, Bishkek and Kashgar and Central Asian Railway Telecommunications are finalised and the reports are distributed with the help of the co-ordination team. The project Customs Facilities at Central Asian Road Border Crossings is in another project extension phase.

ToRs for six new projects have been completed and the tender process will start in June, 2003. ToR for the project Review of Railway Rehabilitation in Central Asia (including links with other transport modes in Central Asia) has been drafted (Annex 5).

The National Secretaries of the TRACECA countries could be convinced to obtain statistical data for various TRACECA Projects. Especially the situation in Ukraine could be managed with the help of the National Secretary.

A TRACECA Information day in Brussels has been organised in July 2002 and a Power Point Presentation on the development of TRACECA has been performed.

A second TRACECA Information day in Brussels has been organised in September 2002, at the request of DG TREN.

A Power Point presentation of TRACECA Programme in the “1-st International Transport Conference and Exhibition on I&S in the Caspian and the Black Sea Countries” in Istanbul (Annex 6) and in the “2-nd Azerbaijan International Transport and Logistics Exhibition – Trans Caspian 2003” in Baku has been done.

In addition to that the co-ordination team was heavily involved in the strategy discussion about the future of the TRACECA Projects and the programming activities.

Based on a new strategy published in TACIS Regional Co-operation: Strategy Paper and Indicative Programme 2004-2006 a proposal for TRACECA Project Identification has been developed. The criteria of selection are: • Improvement and development of the TRACECA Corridor including implementation and development of the Multi Lateral Agreement (MLA) • To link the TRACECA Corridor with Trans-European Networks (TEN’s) • Increase intra-NIS trade flows via TRACECA Corridor • Leverage IFI investment and the involvement as private sector • Improve safety, security, economic and environmental performance in different transport modes

The transport sectors involved are the road, maritime, rail and air transportation as well as the transport legislation and transport regulation. It has to be pointed out, that the air transportation additionally has been included in the TRACECA Programme. This proposal is attached as Annex 7 to this report and has been approved by the Task Manager.

2.3 Co-ordination of Other Donors/Financiers/Investors/Associations

Co-operation with IFIs / Donors/Investors is established to create synergies and avoid duplication of efforts. Regular meetings were organised with the representatives of IFI’s (EBRD, WB, ADB, UN ESCAP). In addition the internet publications of the Donors/IFIs are used to receive project information.

This co-operation has made it possible to manage the participation of the TRACECA Project “Harmonisation of Border Crossing Procedures” in a common training activity of the United Nations and the USA for the Termez (Uzbekistan) border crossing to Afghanistan.

A meeting with freight forwarders was organised in Frankfurt (April 2002) in order to introduce the most favourable conditions for the Transport of Humanitarian Goods to Afghanistan through the TRACECA Corridor. Various meetings have been held with International acting Forwarding Companies, Ports and Container Operators. Especially with the Management of the Odessa Port Container Terminal (Operated by the German situated Hamburg Port Consult (Mr. Battermann) , the Klaipeda State Seaport Authority and the Block-train Operator POLZUG – Silk Road Express permanent contacts have been established.

2.4 Global Feasibility Study

The feasibility Study of the TRACECA Corridor is a matter of priority. Work on the Global Feasibility Study has been progressing well. The first mission of the short-term expert took place in March, 2002, the second mission took place in June 2002, the third one - in July 2002 and the fourth one - in October 2002. To present the study in time additional capacity from the home offices have been mobilised.

2.5 Dissemination

Dissemination activities have been implemented: • The TRACECA Logo has been updated two times. • The dissemination materials have been published. • Restructuring and redesign of the TRACECA Website has been performed. • Activation of the new dynamic website has been performed. • Regular (5 times) update and maintaining of the Website has been done. • BS PETrA website has been reregistered, completely redesigned and updated. The owner is the Steering Committee. • Redesign and finishing of the TRACECA Image Brochure has been done. This brochure has been distributed. • The TRACECA life magazines have been published and distributed 5 times

2.6 Project Management

In order to clarify the project’s intervention logic during the course of this project, it was found necessary to reorganise the structure of the Coordination Team:

The Supervisor of the Permanent Secretariat is the new Team Leader, and there are two regional coordinators in Odessa (Black Sea Region) and Tashkent (Central Asia).

In addition and at the request of the European Commission the financing support to National Secretaries, General Secretary and Executive Secretary has been extended till the end of November, 2003.

In order to prepare the TRACECA new strategy (2004-2006) AIDCO has decided to launch an evaluation for the TRACECA PROGRAMME (to cover the period 1998-2002). The Evaluation took place and the Co-ordination Team has accompanied the evaluators in the following states: Armenia, Azerbaijan, Georgia, partly Kazakhstan, Kyrgyzstan, Turkmenistan and Uzbekistan as well as in a later stage Moldova and Ukraine. The TOR was drafted in close cooperation with the Task Manager (Annex 8)

In the Monitoring Report for Baku dated October 21, 2002 and prior to that in the Monitoring Report on the Inception Phase it was highlighted that the Commission Service has been advised to request the contractor to develop concrete indicators/scoring systems for the selection of projects and a manual on basic requirements for preparation of proposals.

The National Commission of the Member States of the Basic Multilateral Agreement is in charge for the preparation of proposals for new projects. Since the beginning of the co-ordination activities the project proposals have a form containing the basic requirements / selection criteria. (See completion report of the Project “Inter-Governmental Commission for the Implementation of the Multi-Lateral-Agreement” - Axis 1999). This document has been updated in line with the new TACIS Regional Cooperation – Strategy Paper and Indicative Programme for 2004 – 2006.

3 Summary of the project planning for the remainder of the project

3.1 Coordination of members/beneficiaries of the TRACECA Programme

The information possibilities of the TRACECA Co-ordination team – as per TRACECA Information Day in Brussels (July 2002) have been further developed and used in various events. It is planned to give this opportunity to other interested parties as well. Interested parties in the respect are the transport industry of the EU States, officials of the TRACECA Member States and their organisations, the Ambassadors of the EU Member States in the TRACECA countries as well as International Organisations.

Initiatives for the overall TRACECA programme will be continued like: TRACECA Visa, TRACECA Hotline, TRACECA Coefficient, Protocols on Sea and Road Transport. For these initiatives the Permanent Secretariat and Team of specialists will assist in preparing proposals and co-ordinate the different approaches of the TRACECA Member States. The Co-ordination Team will advise and give assistance to stream the process until its implementation.

To attract transportation of Humanitarian Goods to Afghanistan through the TRACECA Corridor will be one of the important topics for the next planning period. Within this framework a number of initiatives will be continued such as: reduction of transport costs, improvement of procedural requirements, and harmonisation of these procedures.

The financing of the Permanent Secretariat and the National Secretaries will be continued till the end of November 2003.

Co-ordination with National Secretaries will be continued.

Close contact with EU-Delegations and all other parties connected with the European Commission will be continued.

Contacts with other Aid-Organisations of the European Commission (Phare, Meda) will be established during planned visits in Rumania, Bulgaria and Turkey.

Co-ordination with BS-PETrA has been established and will be continued in the scope of the support function towards Steering Committee. The 7th SC meeting is scheduled for the middle of September 2003. Co-ordination with SC of Pan-European Corridor IX, southern branch, will be strengthened further in context with the tasks to link TRACECA with Trans-European Networks (TENs).

3.2 Coordination of TRACECA Projects

The current TRACECA Projects under execution will be continuously coordinated and supervised, new projects (See Annex 9) will be assisted especially in the inception phase.

According to the decisions of the working group of the National Secretaries (Tashkent, May 2003) and in agreements with the representatives of the EC, the Co-ordination Team will start a new identification exercise for projects in order to present a new Action Plan during the third Annual meeting of the IGC. This work will be realised in collaboration with the Permanent Secretariat.

The co-ordination team will render their expertise to the TRACECA Projects and the beneficiaries/project-partners as well as to the interested representatives of the European Commission or the delegation of the EC. TRACECA Co-ordination Team Progress Report III May 2003 17

As the SC is working now, special attention will be paid to the co-ordination of the horizontal projects with BS-PETrA Action Plan and multi-annual Working Programme. Under regional aspects, the border crossing project between Ukraine and Moldova gains special care and support.

3.3 Coordination of Other Donors/Financiers/Investors/Associations

Close contacts and good working relationships with EBRD, WB, ADB, UN ESCAP, and all other parties connected with the development of the TRACECA Corridor will be maintained and enlarged. Especially the relations with the Steering Committee of the Black Sea PETrA and the Steering Committee of the TEN Corridor IX southern part will be renewed and intensified. TRACECA action plans will be discussed with World Bank, EBRD, Islamic Development Bank and Asian Development Bank where appropriate.

In Black Sea region, the relationship with Forwarding Associations and private transport industry will be intensified. The intention of the BS-PETrA SC to install a new Working Group, dedicated to analyse and implement forwarders and users’ interests, will be strongly supported.

3.4 Global Feasibility Study

The Global feasibility study will be finalized in the remaining time. The report will be submitted together with the Final Project Report. The Black Sea region countries will be included in field work and conclusions. Additional capacity has been allocated to this task from the home office.

3.5 Dissemination

Dissemination work will be continued. The new magazine “TRACECA life” will be published every three months. The sixth issue will be available in July 2003 and the seventh issue – in October 2003.

The TRACECA website will be updated and maintained on a monthly basis

The Black Sea PETrA website will be managed and regularly updated by the Odessa Office. The formulation of the input is made together with MoT of Ukraine as the Chair of the SC. Links are available to TRACECA website and all other concerned parties.

The update of the new TRACECA Brochure will be done in summer 2003.

New printing of the TRACECA map A1 and A3 will be carried out in September 2003.

3.6 Project Management

The Team leader and coordinators will continue to assist the Task Manager in the management of the projects.

Financing support to National Secretaries, General Secretary and Executive Secretary will be made until the end of November 2003.

4 Project progress in reporting period

4.1 Main Activities of TRACECA Co-ordination Team during the reporting period until May 31, 2003.

4.1.1 General Aspects

Co-operation with the European Commission: The relation between the EU – Delegations in Tbilisi, Almaty and Kiev have been intensified. The Task manager has visited the Caucasus and Central Asia. During these missions the Co-ordination Team has organised the meetings with the transport officials and operators in each of the countries visited. The newly developed TACIS Regional Co-operation Strategy paper and Indicative Programme for 2004-2006 has been used for the Guidelines for TRACECA Project identification. The European Commission has appointed the British Outfit of the US-Consultancy Jacobs with an evaluation of the TRACECA – Projects. Within the period of March to May, 2003 the co-ordination team has organised the missions for the evaluators, the meetings with the authorities, beneficiaries and stakeholders of the transport industry.

Cooperation with National Co-ordination Units: The co-ordination with the National Co-ordination Units in most TRACECA countries have been maintained and met whenever possible. Their input on technical-administrative issues is still invaluable. As Baku and Tashkent are concerned the “European House Concept” and its responsibilities are still a little bit unclear. The strategy of the European Commission as well as the regional approach and the relation to TRACECA so far are not clearly identified.

4.2 Task A: Co-Ordination of TRACECA-Programme Activities

4.2.1 Permanent Secretariat:

Activities concentrated on:

• Request of the Islamic Republic of Iran to become a member of the TRACECA corridor (Meeting and Mission to Iran – June 2002) • Request of Afghanistan to become a member of the TRACECA corridor. • Request of the organisation of the third IGC TRACECA Annual meeting (Yerevan, October 2003). • Preparation of the Action Programme 2004-2006. • “Memorandum on Creation of the most Favourable Conditions for Special and Humanitarian Goods Transported to Afghanistan and Central Asia along the Transport Corridor TRACECA” that established special basic tariffs for the goods transportation • Preparation of new editions of TRACECA Magazines and TRACECA Brochure • Preparation and participation in several meetings/conferences. This includes logistical support as well as preparation of all the necessary documentation, the finalisation and distribution of those after the events.

4.2.2 National Secretaries/National Commissions:

Regular contacts with the National Secretaries and National Commissions have been maintained whenever possible.

Contacts/meetings concentrate on preparation of Working Groups, other Meetings, and the development of specific topics and specific projects. The TRACECA Co-ordination Team gives support with clarification, explains technical issues, assists with balancing different views and informs on the on-going and future work.

The co-ordination team assisted the National Secretaries in the set up of the Working Groups dealing with the projects Common Legal Basis for Transit Transportation, Harmonisation of Border Crossing Procedures and Unified Policy of Transit Fees and Tariffs.

4.2.3 Local Contact Points: activities in respective countries

The network of local contact points (local experts) was fully established in the reporting period and was approved by the Task Manager with the exception of Kazakhstan. The local expert has left the project and a solution for the replacement will be done during the next trip to Kazakhstan. It is under consideration to set up a contact point in Tajikistan, even if that was not foreseen at the beginning of the project. For Odessa Co-ordination team Office, the Task Manager approved one more expert dealing with BS-PETrA tasks.

The Local Experts are fulfilling their tasks as was already described in Progress Report I as follows:

• close co-operation with the on-going TRACECA-projects • information on projects financed either by other donors/investors or out of national budgets which complements the TRACECA programme • information on transport policy and plans in respective countries • logistical support to the TRACECA Coordination Team. • translation, interpretation • secretariat

4.2.4 Black Sea PETrA:

As was reported in Progress Report II, Odessa Office undertook intensive work to activate the Black Sea PETrA by organising the 6th Steering Committee meeting on March 18-19, 2003 in Odessa, together with the MoT and MfA of Ukraine. This work was aimed to fulfil with one of the principles for Europe Aid for the TRACECA States – to link the TRACECA route with the Trans – European Networks. The main outcome of that meeting can be described as follows:

- The Black Sea PETrA won back its role and the tools to act as defined in MoU, - The Black Sea PETrA is, and will be supported in the future as well, by TRACECA Co- ordination team project, - All participants are strongly committed to produce results. The work with Working Groups will continue. The pending tasks will be fulfilled, new ones defined, - Close connection with transport industry organisations has been re-established, - The Action Plan of Black Sea PETrA for the period 2003-2004 was approved in principle, - The multi-annual Working Programme to define the strategy is being shaped for approval by 7th SC meeting, scheduled to be held at the middle of September 2003 in Odessa, in principle, - The Black Sea PETrA website will be redesigned and kept running by the TRACECA Co-ordination team Office in Odessa. The owner of the website will be the Steering Committee

Odessa Office continues coordinating work corresponding to the adopted Action Plan 2003-2004. Main issue is to fit in BS PETrA into regional transport and trade development.

All documents are attached in Annex 11.

4.3 Task B: TRACECA Projects

4.3.1 Current projects

1. Customs Facilities at Central Asian Border Crossings (Computer Solution)

The part of the Road Feasibility Study was reallocated to the road Project Bishkek (Kyrgyzstan) and Almaty (Kazakhstan) for the Border Posts on each side. The equipments for the other border crossing are identified and tender documents are worked out. There are still ongoing discussions about the equipment for Turkmenistan and the definite date for a Workshop in Ashgabat. Both subjects will be clarified in short time.

2. Harmonisation of Border Crossing Procedures (SWK)

The Project has maintained good progress and has undertaken the Activities, Tasks and Sub-tasks in-line with the original Project Objectives. With the completion of the Border Audit, Border Audit Database and Evaluation Workshop, the subsequent recommendations will strengthen the capabilities of the Customs Working Groups. The work of strengthening the institutional capabilities of the National Commissions and National Secretaries is still a vital part of the Project. There was also progress made with the CWG’s Awareness Training with the production of Discussion Papers and Case Studies relating to many areas of Harmonisation and Trade Facilitation. The evaluation and the implementation of recommendations, from these documents, will be continued through the next reporting period together with ‘lessons learned’ from the Customs Working Groups.

Two regional Team leaders work closely with the offices in Tashkent and Odessa. The new appointed coordinator for the Black Sea region held several workshops with beneficiaries and involved entities of the concerned countries. The National Secretaries supported his mission by calling meetings, distributing material and collecting information. The project is widely accepted and progressing well. Presentation was made for participants of the 6th Black Sea PETrA SC meeting in Odessa. The First Progress Report was issued in October 2002. Second Progress Report was issued in May 2003. Completion report is expected in October 2003.

4. Unified Policy on Transit Fees and Tariffs (SWK)

Project progress during the period since the inception phase has generally been according to the plan. Four working group meetings have been held (rail, maritime and road) established under this project, with attendance by delegates from most of the TRACECA countries. Project experts have visited most of the TRACECA Countries to discuss project objectives, elicit national tariff and transit fee policies, and to gather information for analysis and formulation of conclusions and recommendations. Second Progress Report will be issued in June 2003. Completion report is expected in December 2003.

5. Pre-feasibility Study of a New Rail Link between the Ferghana Valley, Bishkek and Kashgar (Lahmeyer)

The final report has been delivered and the beneficiaries have accepted the report.

6. Central Asia Railways Telecommunication (ITALFER) The project has been almost finalised. The Draft Final Report was delivered and only Uzbekistan has requested to change the railway section for the feasibility study. This led to the effect that an extension of the project was agreed upon. The final versions of the feasibility studies will be delivered by the middle of July, 2003.

7. Supply of an Optical Cable System for Communication and Signalling to the Railways of Azerbaijan, Georgia and Armenia (Siemens/Finnroad)

The project was completed successfully in May 2003.

4.3.2 New projects:

• Common Legal Basis for Transit Transportation

The contract was signed with Lamnidis and Associates SA on the week 47, 2002, kick off meeting in Brussels took place in the same week. The project started week 48, 2002. TRACECA Co-ordination Team Progress Report III May 2003 22

The Inception Report was issued in February, 2003.

• Capacity Development for Senior Transport Officials

The second evaluation Committee took place in March 2003, the signing of the contract is expected in June 2003. The project will start in June, 2003.

• Feasibility study for the improvement of the road and rail border crossings between Moldova and Ukraine and for the upgrading of the multimodal terminals in Moldova and Ukraine

The contract was signed with Eurecna Srl on the week 52, 2002, the kick-off meeting in the Ministry of Transport of Ukraine took place on January 27, 2003. Inception Report was issued in February, 2003. The first Progress Report was issued in May, 2003. Upon remarks of MoT of Ukraine, some corrections as regards further work with the multi- modal component have been made, ensuring its further treatment in the scope of the project. As the involved Ministries of the two concerned countries are very interested in improvements in BC and multi-modal terminals – ToR has been drawn in close contacts with them – a realistic result can be expected as mentioned in the objectives. In May 2003 the experts visited the multi-modal terminals both in Moldova and Ukraine. Liski as a contact point in Ukraine has still to improve the volume of provided information. First Steering Committee Meeting took place in Chisinau on 22 May 2003. Representatives of the Moldovan and Ukrainian Transport Authorities discussed the Project progress, BC Database, the phase 2 Recommendations, traffic forecasting and investment appraisal issues

• Rehabilitation of Caucasus Highways

The contract was signed with Louis Berger on the week 48, 2002. The kick-off meeting in the Azeravtoyol took place on the week 4, 2003. The Inception Report was issued in February, 2003.

• Railway Transit Oil Logistical Center

The contract was signed with Uniconsult on the week 49, 2002. The Inception Report was issued in February, 2003.

• Supply of tank wagons to Azerbaijan Railways

The contract was signed with CONEC in December, 2002. The tank wagons were delivered in March, 2003.

• Supply of Aids to Navigation Equipment to the Ports of Aktau (Kazakhstan), Baku (Azerbaijan) and Turkmenbashi (Turkmenistan)

The contracts were signed with Transas Europe GmbH on the week 6, 2003 and with Pintsch Bamag Antriebs- und Verkehrstechnik GmbH on the week 8, 2003. The delivery is expected by the end of June, 2003

• Supervision and Training for the Supply of Navigational Aid Equipment

The contract was signed with HPTI in January, 2003. The Inception Report was issued in April, 2003.

In addition three projects, related to the establishment of the transhipment station of the ferry terminal at Batumi started during the reporting period. These projects are financed within the TACIS National budget of Georgia but will be coordinated by the TRACECA Coordination Team.

• Rail ferry terminal in Batumi Port – Caucasus - Georgia Supply contract – Railway Material Contractor / Hansel

• Supply of handling equipment to Batumi Port – Caucasus – Georgia Supply contract – Handling Equipment Contractor / Holtrade

• Supervision of the supply for the Ferry terminal at the Port of Batumi Service contract Contractor/ HPC

4.3.3 Project Pipeline:

The action plans of Tbilisi and Tashkent have been revised together with the Task Manager and a list of project proposals to be financed out of the TRACECA and Regional Budget has been developed. In Tashkent Working Group Meeting of National Secretaries the Task Manager has presented TRACECA 2004 - 2006 showing the priorities of the new strategic approach, the priorities, expected results and indicators.

4.4 Task C: Co-operation with IFI and other Potential Investors

Contacts with IFI have been established throughout the TRACECA region. These contacts have been maintained to secure an exchange of information about the TRACECA programme in general and specific activities, approaches of the IFI and other potential donors on their regional and country-specific strategies and activities. In the Caucasus region the relations and co-operation with IFI are since long very good and various projects have been based on the work of TACIS TRACECA projects. However, these dialogues have to be maintained and especially in Central Asia the contacts and co-operation with EBRD, ADB and World Bank have been intensified.

The need to exchange information and to co-ordinate specific projects where similar objectives are assumed in common understanding as well as the need for the detailed technical co-operation in areas with co-financing and close co-operation where duplication of efforts could be assumed.

In addition to that, the co-ordination team in each location is working on the collection of data from the investment plans of the involved Railways, Shipping Lines, Ports and other stakeholders of the Transport Industry.

The activities within the National Co-ordination Units to establish a data base of projects financed by donor organisation are not finalised.

4.5 Task D: Global Feasibility Study

Regular up-date of traffic data base in Permanent Secretariat has been done. The Local Point in Azerbaijan – based in the Permanent Secretariat in Baku – is in charge for the regular update of the traffic database. The work is done in close co-operation with:

a) TRACECA member states and the National Secretaries to collect the most recently available data and update the traffic data base within the TRACECA website.

b) Short term expert on the Global Feasibility Study to ensure mutual full information where necessary. As it is some time difficult to get the proper information from the Member States because of change of persons or other reasons (security) it was necessary to send the responsible local expert to Central Asia and it is most likely that other trips have to follow.

4.6 Task E: Dissemination

• The TRACECA Logo has been updated two times • The dissemination materials have been published:; • Restructuring and redesign of the TRACECA Website have been performed. • Activation of the new dynamic website has been performed • Permanent (5 times) update and maintaining of the Website has been done. • Redesign and pre-press finishing of the TRACECA Image Brochure has been done. This brochure will be distributed together with this report

Website: The permanent process of updating the TRACECA Website has made this dissemination tool as actual as possible.

Black Sea PETrA website is registered under the Steering Committee, redesigned and administrated by Odessa Office. Final layout of front and following pages has to be approved, links are to be established.

Brochure: The concept of the new brochure has been approved by the Task Manager and the distribution has been started since the beginning of December, 2002. The Brochures have been delivered together with the Progress Report II. The Brochure will be updated in summer 2003. In total 3000 brochures will be published.

Magazine: The fourth and the fifth editions of TRACECA Life Magazine were published in January and April, 2003. These magazines are informing about the news concerning the TRACECA Corridor and its institutions. Each Magazine contains a TRACECA MAP and a guide to the internet. The TRACECA Life Magazine is distributed in all TRACECA Countries, the EC Delegations, IFI, Embassies of the EC and TRACECA Member States, National Co-ordination Units and the Ministries and Institutions of the TRACECA Member States. The forwarding and transport Industry is also receiving the magazines and even when crossing borders in the regions magazines and maps are distributed to customs and border control officers. In total

• 1000 TRACECA Life Magazine, the fourth edition (Annex 12) • 1000 TRACECA Life Magazine, the fifth edition (Annex 13) have been published in the reporting period.

5 Project planning for next reporting period

5.1 General Aspects

Co-operation with European Commission:

There is an ongoing process within the European Commission with the participation of AIDCO, DG Relex, DG –Trex and DG-Taxud about the future engagement of the EC in Central Asia and in TRACECA. The allocation of funds is made by Relex and they are most probably based on September 2001, even roughly 150 Million Euro for the next three years for Central Asia available. It is said, that the development of transport Infrastructure has no priority and it is also said that a “Regional Approach” should have priority. Based on this, eventually 2 Million Euro may be allocated to the TRACECA Corridor and TRACECA Projects in which 13 countries are involved with 12 member States of the “Basic Multilateral Agreement on International Transport for the Development of the Corridor Europe - Caucasus - Asia“.

It was so far not possible to convince the involved DGs of the European Commission, that TRACECA has already an even more than regional approach and that the economical development of countries and regions is based on a functioning infrastructure and a common understanding of the use of this infrastructure especially in regard of border crossing and harmonisation of procedures. It may happen, that for the countries in Central Asia some infrastructure projects might be identified but most likely without the TRACECA Organisations.

Close contact with the EU-Delegations and the “Europe House” will be continued.

Co-operation with TACIS Monitoring Teams: Monitoring of the Inception Phase was carried out in May and June 2002. Monitoring reports for Ukraine and Azerbaijan were issued in September and October 2002 Further monitoring activities are expected for the delivery of the Progress Report III

Project Offices Odessa and Tashkent offices are fully operational. A contact point in Tajikistan will be set up and the last contact point in the Black Sea area, Turkey will be in force.

TRACECA Evaluation An evaluation team has been appointed by the European Commission to evaluate the viability of the corridor and the opinion of the involved Institutions, Ministries and other Stakeholders of the transport industry. The co-ordination team participated in most of the meetings and made the observation that the approach of the evaluation team was characterised by a certain bias towards the TRACECA Programme . In a suggestive form the TRACECA National Secretaries and the other before mentioned Institutions have been examined especially in regard of the question “Is TRACECA a corridor or just a group of interested countries” with the aim to receive arguments against the “Corridor Approach”. From various parties the co-ordination team received questions why the evaluators exhibited such a negative approach towards TRACECA.

5.2 Tasks

I. TASK A: Coordination of TRACECA-Programme Activities

Activities will concentrate on:

o TRACECA membership of the Islamic Republic of Iran.

o TRACECA membership of Afghanistan.

o Organisation of the third IGC TRACECA Annual meeting in Yerevan.

o Elaboration of the Action plan 2004-2006.

o Preparation of TRACECA Magazines.

o Update of TRACECA Website

o Update of TRACECA Brochure.

o Preparation and participation to several meetings/conferences. This includes logistical support as well as preparation of all necessary documentation and the finalisation and distribution of those after the events.

The Borders Harmonization Evaluation Workshop (BHEW) in the framework of the project “Harmonisation of Border Crossings Procedures” / Baku - July, 2003.

Workshop on Road Transport in the framework of the project “Unified Policy on Transit Fees and Tariffs”. / Baku – July 2003.

National Secretaries/National Commissions:

Regular contact with the National Secretaries and National Commissions will be continued.

The National Secretaries will be urged to deliver their monthly reports earlier.

Black Sea PETrA:

The TRACECA Co-ordination Team, Office in Odessa, will continue working as support office for the Ukraine chaired Steering Committee along the tasks laid down in the approved Action Plan 2003-2004. Next Steering Committee meeting is scheduled for the middle of September 2003. The main objectives of the meeting are to discuss and approve the multi-annual Working Programme, defining the policy on development in the scope of this Pan-European Transport Area.

II. TASK B: TRACECA PROJECTS

A .Current projects

The TRACECA Coordination Team will continue their activities concerning supervision and co-ordination of current TRACECA projects.

A. New projects:

TRACECA Co-ordination Team will give full support in the inception phase for the following TRACECA projects:

• Common Legal Basis for Transit Transportation

• Capacity Development for Senior Transport Officials

• Feasibility study for the improvement of the road and rail border crossings between Moldova and Ukraine and for the upgrading of the multimodal terminals in Moldova and Ukraine

• Rehabilitation of Caucasus Highways

• Establishment of Railway Oil Logistics Center

• Supervision and Training for the Supply of Navigational Aid Equipment

• Supply of Aids to Navigation Equipment to the Ports of Aktau (Kazakhstan), Baku (Azerbaijan) and Turkmenbashi (Turkmenistan)

B. Project Pipeline:

According to the decisions of the working group of the National Secretaries (Tashkent, May 2003) and in agreements with the representatives of the EC, the Co-ordination Team will start a new identification exercise for projects in order to present a new Action Plan during the third Annual meeting of the IGC. This work will be realised in collaboration with the Permanent Secretariat.

III. TASK C: CO-OPERATION WITH IFI AND OTHER POTENTIAL INVESTORS

Contacts with IFI will be continued and widened. There will be continued emphasis on co- operation with those institutions working on the improvement of conditions for transport of humanitarian goods to Afghanistan through the TRACECA Corridor.

The discussion with UN ESCAP, World Bank, EBRD and Asian Development Bank on the development of a Memorandum of Understanding will be continued.

IV. TASK D: GLOBAL FEASIBILITY STUDY

Regular up-date of traffic data base in Permanent Secretariat An updated version of the Global feasibility Study will be available in Summer 2003 and the summary of the existing O-D matrix base will be prepared, including visualisation of data.

V. TASK E: DISSEMINATION

Website: The TRACECA website will be hosted and regularly up-dated after major event. BS PETrA website is hosted and regularly updated by TRACECA Coordination Team - Office in Odessa.

Brochure: an update of the new brochure will be available at the end of June, 2003 for approval by the Task Manager. Printing is foreseen by the end of September, 2003.

Magazine: two more Magazines will be published in the next 6 month (July and October, 2003) and distributed.

Map: The map A1 will be further on distributed. New printing will be carried out in September 2003.

Technical library The technical library will be up-dated continuously in the PS.

RECOMMENDATIONS AND DECISIONS

The Working Group Meeting of National Secretaries and Legal Experts of IGC TRACECA was held in Baku, January 23-24, 2003 with participation of representatives of the Parties of the Basic Multilateral Agreement.

Participants of the WG discussed the issues, in accordance with the agenda. (Appendix 1)

List of participants of the WG is attached. (Appendix 2)

On the results of the meeting the following recommendations and decisions have been adopted:

1. Communications of the Parties on implementation of decisions of the Second Annual Meeting of IGC TRACECA

Having discussed the reports from the Secretary General of PS IGC TRACECA Mr. A.Tagirov and TRACECA National Secretaries on implementation of decisions of the Second Annual Meeting of IGC TRACECA (Tashkent, April 24-25, 2002), as well as the progress of TRACECA projects: «Harmonization of Border Crossing Procedures», «Unified Policy on Transit Fees and tariffs» and «Common legal Basis for Transit Transportation», the WG noted the importance of the work done by the Permanent Secretariat of IGC TRACECA and TRACECA National Commissions.

2. Proposals on the Future Business-Plan of the IGC TRACECA

For implementation of p. 3 Article 9 of «Basic Multilateral Agreement on international transport for development of corridor Europe-the Caucasus-Asia», the WG discussed participation of the Parties in co- financing of the Permanent Secretariat of IGC TRACECA and decided as follows:

• Adopt (except Bulgarian Party) the draft system of co-financing of the Permanent Secretariat of IGC TRACECA, proposed by PS and EC Experts. (Appendix 3)

• For implementation of p.3 Article 9 of Basic Multilateral Agreement, request the Chairman of IGC TRACECA Mr. R. Yunusov, to charge the Secretary-General of PS IGC TRACECA Mr. A. Tagirov with sending the draft system of co-financing of the Permanent Secretariat of IGC TRACECA to the Parties, according to existing procedure, for its consideration and further adoption by the Parties, viewing Bulgarian position.

• Request Romanian Party to clarify its position concerning the draft system of co-financing of PS IGC TRACECA in a 3-days period.

3. On the Draft of the Rules of Procedure of the IGC TRACECA

The Working Group, in accordance with the Agenda of the Meeting, has discussed the draft of the Rules of Procedure of the IGC TRACECA, submitted by the Permanent Secretariat IGC TRACECA, and decided, upon the conclusion of discussions, to recommend to the IGC TRACECA to discuss during its forthcoming Meeting the elaborated draft of the Rules of Procedure of the IGC TRACECA for its subsequent adoption.

In this regard the WG recommends to the IGC to consider and adopt the Decision as follows:

“The Parties to the Basic Multilateral Agreement on International Transport for Development of the Europe-the Caucasus-Asia Corridor, signed in Baky, Republic of Azerbaijan, on September 8, 1998 (hereinafter referred to as “the MLA”), with the assistance of the European Union.

WHEARES

• the MLA has entered into force in respect of all Parties.

• the MLA provided for the establishment of an Inter-Governmental Commission (hereinafter referred to as “the IGC") to regulate the issues regarding the implementation and application of the provisions mentioned therein.

• within the framework of the MLA, during its first annual Conference in Tbilisi, Georgia, the IGC adopted its Rules of Procedure, on March 11, 2000.

• the MLA also provided for the establishment of a Permanent Secretariat registered in Baky, Republic of Azerbaijan, as a body with international legal personality.

• in compliance with the Technical Annex on Customs and Documentation Procedures of the MLA, the Parties are examining the implementation of or are implementing the international Conventions such as: a.) Customs Convention on the International Transport of Goods under cover of TIR Carnets, 1975; b.) International Convention on the Harmonization of Frontier Controls on Goods, 1982; c.) Customs Convention on Containers, 1972, and are further examining [accession] to and implementation of additional International Conventions related to the international transport of goods and passengers, such as: a) The Kyoto Convention, 1973 (Annexes A2, E1, E2, E3), as revised and b) Convention on International Multimodal Transport of Goods, 1980 as a further step to abolish the legal barriers to international transport within the transport corridor Europe – The Caucasus - Asia.

RECOGNISING

• the value of conciliation, mediation and arbitration as methods of settling disputes arising in the context of international economic relations, as already provided for in the MLA.

• the value of National Trade Facilitation Working Groups in assisting the IGC to develop initiatives and fulfill the objectives of the MLA on the territories of each of the Parties.

BEING AWARE OF THE NEED

• to explore the possibility of establishing a regional scheme for the protection and guarantee of investments against non-commercial risks, and the creation of a specialized investment guarantee trust fund.

During its Annual Meeting, on September ______, 2003, the IGC have revised its Rules of Procedure and agreed to adopt them.”

4. On the Draft Statute of the Permanent Secretariat of the IGC TRACECA

The Working Group, in accordance with the Agenda of the Meeting, has discussed the Draft Statute of the Permanent Secretariat of the IGC TRACECA, submitted by the Permanent Secretariat of the IGC TRACECA. The Working Group acknowledges the good work done by the Permanent Secretariat and the experts of the Project “Common Legal Basis for Transit Transportation”.

The Working Group has agreed and reached consensus in respect of texts of the Preamble and Articles 1, 2 and 3 of the Draft Statute of the Permanent Secretariat of the IGC TRACECA. (The texts of the Preamble and Articles 1, 2 and 3 of the draft Statute of the Permanent Secretariat of the IGC TRACECA, agreed by the Working Group is attached hereto – Appendix 5).

Furthermore, the Working Group requests the Permanent Secretariat to elaborate further the remaining provisions of the Draft Statute, in order to be presented to the Working Group during its next meeting, taking into consideration any possible comments and proposals to be made prior to its next meeting. In this respect it requests the experts of the Project “Common Legal Basis for Transit Transportation” to assist the Permanent Secretariat to complete the elaboration of the Draft Statute and conduct bilateral consultations with the relevant authorities in each Party.

The representatives of the Parties on consensus adopt the above Recommendations and Decisions.

Tashkent, May 22-23, 2003

RECOMMENDATIONS AND DECISIONS

The Working Group Meetings of National Secretaries and Legal Experts of IGC TRACECA were held in Tashkent, May 22-23, 2003 with participation of representatives of the Parties to Basic Multilateral Agreement.

Participants of the WGs discussed the issues, in accordance with the agenda (Appendix 1).

List of participants of the WGs is attached (Appendix 2).

The Working Groups adopted the following recommendations and decisions:

Working Group of National Secretaries and Legal Experts was held in the spirit of cordial and friendly relation among its member countries and the Meeting expressed its appreciation to the European Commission the continued financial support to the implementation of the Basic Multilateral Agreement. The Meeting also expressed its appreciation to the Permanent Secretariat for preparing the documents and making excellent arrangements in the organization of the Meeting.

1. Reports of the National Secretaries on the implementation of Decisions of the second Annual Conference of the IGC TRACECA, Tashkent, 2002

Having discussed the reports from the Secretary General of PS IGC TRACECA Mr. Tagirov and TRACECA National Secretaries on implementation of decisions of the Second Annual Meeting of IGC TRACECA (Tashkent, April 24-25, 2002) the WG noted the importance of the work done by the Permanent Secretariat of IGC TRACECA and TRACECA National Commissions.

2. Adoption of Drafts Rules of Procedures of the IGC TRACECA and Statute of the PS IGC TRACECA

The Working Group of legal experts in accordance with the Agenda of the Meeting, has discussed the drafts of the Rules of Procedure of the IGC TRACECA and Statute of the PS IGC TRACECA submitted by the Permanent Secretariat IGC TRACECA and decided, upon the conclusion of discussions, to recommend to the IGC TRACECA to discuss during its forthcoming Meeting the elaborated drafts of the Rules of Procedure of the IGC TRACECA (Appendix 3) and Statute of the PS IGC TRACECA (Appendix 4) for its adoption.

3. Joint Financing of IGC

The subject was discussed and all Participants agreed to contribute to the financing of the PSs Budget by 15 % for the period December 2003 – December 2004. In this respect the Parties will contribute on equal basis i.e. EURO 7.000 each. The total amount of contribution will be raised to EURO 84.000.

4. Development of Trade Facilitation Concepts

Participants of the Working Group of the National Secretaries have been very active and supportive in embracing the concept of Trade Facilitation Working Groups under the Chairmanship, where possible, of the National Secretaries. They have fully understood the importance of “Trade Facilitation” and integrating the work of the HBCP, UPTFT and CLBTT projects.

5. Present Status of On-going TRACECA Projects

Project Managers of the on-going TRACECA projects gave both verbal and computer projected presentations of their respective projects. The presentations from all three projects can be found in the Meeting Documents Folder.

6. TRACECA Council of the Heads of Railways

The PS informed the Participants of the WG on the organisations of the joint meeting of the of the UIC, PS and the TRACECA Heads of Railways in July 2003 in Baky, Republic of Azerbaijan. This meeting will be the first step for the establishment of the Council of the TRACECA Heads of Railways.

7. Action Plan 2004-2006 (Update and Identification of the TRACECA Projects)

After the presentation of the Representative of the European Commission on future of TRACECA Program 2004-2006 the Participants of the WG were agreed to start a new identification exercise for projects in order to present a new action plan during the 3rd Annual meeting of the IGC. Project proposals will be provided to the PS by the end of July 2003 according the criteria of the TACIS Regional Strategy Paper 2004-2006 and the format that was agreed during the meeting.

8. Adoption of Concept of Creation of TRACECA Fund and TRACECA Route

The Team Leader of CLBTT Project introduced the idea to adapt a Protocol of Additions or Technical Annex to the MLA creating: A TRACECA Route; TRACECA Investment; Settlement of Disputes Annex.

This idea was discussed during bilateral consultations with the relevant authorities and organizations of the Parties.

The Participants expressed their satisfaction for the proposed procedure. CLBTT will prepare a draft Protocol /Technical Annex by the end of June for further elaboration by the relevant authorities of the Parties.

9. Adoption of the Main Items of Third Annual Meeting in Yerevan

The Participants have agreed on the following main items of the Third Annual meeting of the IGC:

1. Report on the actions of the IGC TRACECA. Statement of the Chairman-in-Office of the IGC TRACECA.

2. Hand over to the new Chairman-in-Office Statement of the Republic of Armenia (Chairman-in-Office).

3. Reports of Parties of the Basic Agreement on the activity done on implementation of the decisions adopted earlier and recommendations within the framework of the IGC TRACECA. Statements of the Heads of Delegations of the Parties

4. Approval of the Rules of Procedure of IGC and Statute of PS IGC TRACECA

5. Parties Agreement about joint financing of PS.

6. Signature of the Protocol (according to article 11 of the MLA) on amendments and new technical annexes to the Basic Multilateral Agreement, adopted at the Second Annual Conference of IGC, held on April 25, 2002 in Tashkent.

7. Approval of the new proposals on amendments to Technical Annexes on international road transport (establishment of TRACECA permit system) and customs procedures and documentation process.

8. Adoption for a new TRACECA Strategy for the period of 2004 – 2008.

9. Adoption of the new project proposals, according to the Tacis Regional Strategy Paper 2004- 2006.

7. Creation of a TRACECA Council of the Heads of the Railways.

During his speech, Mr. P.Chkheidze mentioned the importance of the regional development in the framework of the Basic Multilateral Agreement reflected in the Letter from H.E. President of Georgia, Mr. E. Shevardnadze to the President of the Islamic State of Afghanistan H.E. Mr. H. Karzay.

Mr. Z. Kvachantiradze gave brief information on the TRACECA Program and stressed the importance of accession to the Basic Multilateral Agreement for the Islamic State of Afghanistan.

Mr. Vadim Turdzeladze introduced a Special Action Plan adopted during the IGC TRACECA Conference in Tashkent (April 2002) and Final Recommendation of the Extraordinary IGC TRACECA meeting in Tbilisi related to the improvement of the transport infrastructure on the border crossing between Afghanistan – Uzbekistan and Afghanistan – Turkmenistan. In

TRACECA Co-ordination Team - Progress Report III – Annex 4 additional to that the importance of the legislation in the field of transport in the region was also mentioned.

During the meeting it was agreed to hold several meetings with the Ministry of Commerce and the Ministry of Transport.

Foreseen meetings with Mr. Abdullo Abdullo, the Minister of Foreign Affairs and Mr. H. Karzay, the President of Afghanistan did not take place due to the late notice from the Ministry of Foreign Affairs about their absence at that time.

At the end of the meeting monthly magazines, brochures, maps of the TRACECA and full set of documents on the decisions of IGC TRACECA related to Afghanistan were handed over.

Mr. Marc Graille gave detailed information on the TRACECA Program and stressed the importance of accession to the Basic Multilateral Agreement for the Islamic State of Afghanistan in the field of regional cooperation related to the development of transport in the framework of the TRACECA Program.

It was also mentioned that in case of Afghanistan joining the Basic Multilateral Agreement, which means reorientation of the TRACECA Program, the necessity to call a TRACECA Summit by the end of 2003 (see Tashkent Declaration, Proposal of Georgia) may arise.

In case of Afghanistan joining the Basic Multilateral Agreement, Mr. Gilles Bertrand suggested to consider the possibility of the Summit to take place at the President’s Palace in Kabul.

The Delegation of the European Commission in Kabul will inform directly their Director in RELEX Mr F. Fotiadis.

At the end of the meeting monthly magazines, brochures, maps of the TRACECA and full set of documents on the decisions of IGC TRACECA related to Afghanistan were handed over.

Mr. Z. Kvachantiradze provided brief information on the activity of the Permanent Secretariat IGC TRACECA, Action plan and plans for the future related to the development of regional transport infrastructure especially in Central Asia.

Mr. Vadim Turdzeladze gave a presentation of the project on “Common Legal Basis for Transit Transportation” and its importance in the field of regional development and harmonization of the transit transportation in the framework of the Basic Multilateral Agreement.

During the meeting monthly magazines, brochures, maps of the TRACECA and full set of documents on the decisions of IGC TRACECA related to Afghanistan were handed over to Mr. Karl Harbo.

At the end of the meeting all participants agreed that the fact that Afghanistan joins the MLA will positively reflect on the development of international transport and transport infrastructure in the Central Asia region.

Mr. Ziauddin Zia stressed the importance of the implementation of the TRACECA program in the field of facilitation of trade and development of transport. It was also mentioned that a Special Commission consisting of the representatives of the MFA, Ministry of Transport and Ministry of Commerce had been established to consider the possibility of Afghanistan joining the MLA. In his opinion, the Commission established will reach a positive outcome concerning the accession of Afghanistan to the MLA in the nearest future.

Mr. Marc Graille gave detailed information on the TRACECA Program and stressed the importance of accession to the Basic Multilateral Agreement for the Islamic State of Afghanistan in the field of closer regional cooperation related to the development of international transport in the framework of the TRACECA Program.

Mr. Z. Kvachantiradze provided brief information on the activity of the Permanent Secretariat IGC TRACECA, Action plan and plans for the future related to the development of regional transport infrastructure especially in Central Asia.

During the meeting, Mr. P.Chkheidze mentioned the importance of the regional development in the framework of the Basic Multilateral Agreement reflected in the Letter from H.E. President of Georgia, Mr. E. Shevardnadze to the President of the Islamic State of Afghanistan H.E. Mr. H. Karzay.

In addition to that, Mr. P.Chkheidze informed the participants that there meetings held with the Mr. Abdullo Abdullo, the Minister of Foreign Affairs and Mr. H. Karzay, the President of Afghanistan in Ashgabat during which, there were several matters concerning the importance of the closer regional cooperation in the framework of the TRACECA Program in case of Afghanistan joining the MLA discussed. Mr. Abdullo Abdullo, the Minister of Foreign Affairs and Mr. H. Karzay, the President of Afghanistan favored the idea of Afghanistan joining the MLA.

Mr. Karl Harbo mentioned the importance of the TRACECA Program in the development of the regional cooperation and kindly asked the Minister to speed up the internal procedures on joining the Afghanistan to the MLA.

Mr. Marc Graille gave detailed information on the TRACECA Program and stressed the importance of accession to the Basic Multilateral Agreement for the Islamic State of Afghanistan in the field of closer regional cooperation related to the development of international transport in the framework of the TRACECA Program.

Mr. Z. Kvachantiradze provided brief information on the activity of the Permanent Secretariat IGC TRACECA, Action plan and plans for the future related to the development of regional transport infrastructure especially in Central Asia. Mr. Z. Kvachantiradze kindly asked the Minister to appoint a contact person from the Ministry of Transport for the coordination of the current matters on the internal procedures related to the accession of Afghanistan to the MLA.

During the meeting monthly magazines, brochures, maps of the TRACECA and full set of documents on the decisions of IGC TRACECA related to Afghanistan were handed over.

At the end of the meeting the Minister expressed his gratitude for the detailed presentation of the TRACECA Program and stressed the significance of TRACECA in the development of trade and international transport. The Minister committed to accelerate the procedures related to the accession of Afghanistan to the MLA. The Minister also mentioned that in case if Afghanistan joins the MLA the Government of Afghanistan will present its concept on matters of regional cooperation on the filed of trade and international transport.

1. Background Information

The transport and communication infrastructure in the Central Asian Republics was developed as a part of large, inward looking Soviet transport system. In fact, this transport and communication system was designed to facilitate relations and domestic trade with the Northern and European parts of the former Soviet Union. Trade and transport links to the South and East were underdeveloped. Any interest in developing infrastructure for East - West transit traffic was focussed on corridors further north via Moscow or to the Far - East via the Trans – Siberian- Route by-passing Central Asia. The most densely populated area in Central Asia is the Ferghana Valley. It straddles the borders of three countries, Uzbekistan, Kyrgyzstan, and Tajikistan. For all three of them this is an area of principal economic importance.

The valley floor is wide, fertile and well irrigated by the Syrdarya river and its tributes. It has therefore been intensely cultivated. The most important crop is cotton, which is practically all sold on world markets. Furthermore, considerable industrial development has taken place. The city of Andijan produces and imports components for assembly of automobile and consumer goods. Several other cities such as Xojand, Kokand, Osh, Jalal-Abad and Ferghana are relatively well developed centres of commerce. They are known to be mineral and hydrocarbon deposits in the area. The most important exploitation at present is of petroleum oil in the Uzbek sector of the Valley. Not only better railway connections to the world markets but also the transportation within Central Asia will make this region benefiting.

The European Union Tacis TRACECA Project 01/0165.00 “feasibility study of new rail links between the Ferghana Valley, Bishkek and Kashgar in China” will be finished by the end of March 2003. This feasibility study is also made to connect not only the Ferghana Valley to China but also on a direct rail line to Lugovaya (Kazakhstan) via Bishkek and Balikchi. Kyrgyzstan possesses enormous coal deposits in the region of Kara-Keche, about 190 km from the existing rail terminal at Balykchi. A specific rail link project is being developed with Japanese assistance, which will allow to transport coal to Bishkek and in the future to other destination linked by the railways.

In the other side, the economic development of the Zerashvan Valley (Pendjikent Region, Anji Region and mountainous part of Matchi Region) situated in the North of the Tajikistan Republic, is depending dramatically on the development of transport infrastructure. Zeravshan zone of Tajikistan, with estimated population of 500000 people, has different climatic conditions and is rich with deposits of mineral raw resources. This area has a great deposit of antinomy, mercury, tin, gold, silver and coal.

The development of Fan-Yagnob coal mine is now considered advisable, including issues related to mining, transportation and production sales, including export service. The further development of these specialised fields is limited because of lack of safe transport links. The Zeravshan valley has no railway connection and the nearest station is Samarkand (Uzbekistan), which is roughly 80 km far from Penjikent. In order to improve the economic situation of this region, the construction of a new railway line between Samarkand - Bulungur and Penjikent is still envisaged. This new railway line supposes the improvement of transport servicing regions mentioned before. This new railway connection will link this area with the TRACECA Corridor and the world markets. In the Western part of Central Asia, the port of Aktau in Kazakstan has been developed with the help of Tacis TRACECA and the EBRD. The Uzbek Railways have built up a railway line from Uchkuduk via Misken, Nukus and Kungrad to Beyneu (Kazakhstan). This line connects the railway network of Uzbekistan with the railway network on Kazakhstan in the West and provides access to the port of Aktau.

The project has a regional character and the beneficiary countries are Kazakhstan, Kyrgyzstan Tajikistan, Turkmenistan and Uzbekistan.

1.2 Contracting authority

The European Commission represented by Europeaid Co-operation office.

1.3 Relevant countries’ background

The beneficiary countries are still in a process of conversion from the former Soviet system into market oriented economies. This process so far has different results in the three countries. Below some basic information about the countries:

1.4 Current state of affairs in the relevant sector

Currently, the International Financial Institutions (IFIs) demonstrate serious attitude to the investments of transport sectors in the Central Asian region. Uzbekistan’s railways are rehabilitating railway track of the line of Tashkent – Samarqand using credits of the Asian Development Bank. Second part of the rehabilitation project is the railway line Samarqand – Bukhara. This project of rehabilitation of the tracks is now at its implementation phase, which also funded by means of the credit of the Asian Development Bank. Other project for purchase of electric locomotives for the Uzbek Railways is performed out of credits sources from the EBRD.

The Existing railway lines Jalal-Abad – Kara-Su – Andijan (79km) and Osh – Kara-Su– Andijan (72km) have been built on the territory of two countries – Kirghiz Republic and the Republic of Uzbekistan. These are potentially the integral part of the Chinese- Kirghiz-Uzbek trunk-railway. These railway lines have been built in the populated and agricultural regions with a great number of artificial constructions (overpasses, bridges, water-disposal lines, etc.) which also need to be rehabilitated. The implementation of this for the rehabilitation project including the communication and signalling systems will allow increasing the transportation capacity of the areas mentioned above.

However, current situation of the railway tracks on the Central Asian railways is considered as unsatisfactory. It is necessary to prevent accident and to increase the traffic speed.

1.5 Related programmes and other donor activities

In 1999-2000 the Asian Development Bank experts examined the existing situation on the railway line of Lugovaya – Bishkek – Balikchi and came to a conclusion on the necessity of its improvement due to the unsatisfactory conditions of tracks. The refurbishment should include major repairs of the track and purchase of tools and equipment for the tracks maintenance. In the future prospective this line will become an integral part of the international trunk-railway Lugovaya – Bishkek – Kara-Keche – Torugart – Kashgar (CPR). On the 6th September, 2001 the railway ferry berth in the port of Aktau was commissioned and regular voyages started between the ports of Aktau and Baku. Due to this fact flows of railway traffic will be strongly increasing. Major repairs of the track’s area should be performed for the purpose of increasing of its transportation capacity.

2. Contract Objectives

2.1 Problems to be addressed

The adaptation of the old Soviet railway transport system, designed to facilitate relations and domestic trade with the Northern and European parts of the former Soviet Union, into a new railway network serving the present needs of the five NIS of Central Asia. 2.2 Project wider objective

The development of viable, secure, safe and competitive transport routes linking the countries of Central Asia with Europe and other neighbouring countries. Strengthened border management capacity facilitating economic development, the movement of people and goods and the prevention of organised crime.

The objective of this project is to carry out:

Module A /

Analysis of the relevant national railway transport plans and any regional railway transport planning provisions

Module B /

Preparation of Technical and Economic Justifications to support and to attract the investments for the rehabilitation of railway lines in Kyrgyz Republic, Kazakhstan and Uzbekistan for the purpose of increasing transportation capacities of these areas.

2.3 Project purpose / specific objectives

The project will carry out:

Module A /

Overview of relevant traffic flows and forecasts, with special attention on freight transport from Central Asia towards Europe especially through TRACECA corridor. Identification of weaknesses and bottlenecks. Investigation on the cross-border elements, including co-operation in exchange of data and in customs (also with Afghanistan) Evaluation of multi-modal dimensions and possibilities for inter-operability Harmonisation of standards and of operating procedures, with particular attention to compatibility with EU standards, in particular with regard to safety and security standards for the transportation of dangerous goods and oil products.

Module B /

Technical and Economic Feasibility Studies for the rehabilitation and construction of new railways lines. Pursuant to the Technical and Economic Justification data there will be prepared the loan applications to the lending banks for the allocation of investments to implement the projects.

2.4 Results

Module A /

• On the basis of the above-mentioned review, identification of strategic priorities and proposals for the appropriate responses at project level.

Module B /

Technical and Economic Justification for the rehabilitation of the following important railway sections already identified by the beneficiary countries:

• Jalal-Abad – Kara-Su – Andijan (79 km), • Osh – Kara-Su – Andijan (72 km) and • Lugovaya – Bishkek – Balikchi (322 km) and for • Aktau – Beyneu – Kungrad (700 km)

The importance of these sections will be verified by the Module A study.

2.5 Target groups and Project Partner

Target groups Humanitarian Aid organisations dealing with Afghanistan, railway forwarders and the general public of the five Central Asia states.

Project Partners The Ministries of Transport or Transport Authorities of Central Asian Countries and the Railway Departments of the five Central Asia Countries.

3. Assumptions and Risks

3.1 Assumptions underlying the project intervention

It is assumed that the beneficiaries will give the full technical and logistic support available to the Contractor.

3.2 Risks

However, political situation and security problems can make the access to the area for the Contractor difficult.

Other Risks:

• Unreliable information concerning volumes of transportation ( domestic and transit) • Difficult Geographic and climatic conditions for implementation of field explorations ( geo- technical, topographic, and others) • Publication of railway related information could be in conflict with the existing laws of some of the countries. • To obtain adequate geographic maps especially of the border regions of the involved countries may cause some difficulties

4. Scope of the work

4.1. General

The Contractor shall ensure that experts are adequately supported and equipped when in the field. In particular it shall ensure that there is sufficient administrative, secretarial and interpreting provision to enable professional staff to concentrate on their core tasks. The Contractor undertakes to ensure that necessary funds are transferred to the field in a timely fashion to support the activities of the project, and that the project staff are paid regularly and in a timely fashion.

Where consortia are formed, arrangements should allow for the maximum of flexibility in project implementation, and arrangements offering a fixed percentage of work to each consortium member should be avoided.

4.2. Role of the Project Partners in the implementation of the project

The project partners will provide office facilities furnishings, and telephone equipment and lines with national and international access.

The Project Partners shall appoint a senior member of its staff to liaise with the Contractor, and shall ensure that staff of the appropriate level is made available to work alongside the staff of the Contractor. Staff of the Project Partner shall not be paid from project funds.

The Project Partners will provide such assistance to the Contractor as necessary to arrange visas for expatriate personnel of the Contractor, and customs clearance and inland transport (from border point to final destination) for the Contractor's imported equipment.

The Project Partner should also provide all possible assistance to solve unforeseen problems which the Contractor may face. The possible failure to solve some of the Contractor's problems encountered locally will not free the Contractor from meeting its contractual obligations vis-à-vis the Contracting Authority

4.3 Specific activities

The project would include the following actions, not necessarily in the sequence given:

Module A /

• Review the previous studies carried out by local design institutes and the previous TRACECA studies.

• Overview of relevant traffic flows (last 10 years) and forecasts, with special attention on freight transport from Central Asia towards Europe especially through TRACECA corridor.

• Identification of weaknesses and bottlenecks.

• Investigation on the cross-border elements, including co-operation in exchange of data and in customs (also with Afghanistan)

• Evaluation of multi-modal dimensions and possibilities for inter-operability

• Harmonisation of standards and of operating procedures, with particular attention to compatibility with EU standards, in particular with regard to safety and security standards for the transportation of dangerous goods and oil products.

Module B / The Consultant’s services shall consist of a study comprising two phases:

Phase 1: Technical and Economic Feasibility Study of the project and the Environmental Impact Assessment.

Phase 2: Detailed Engineering design, preparation of tender documents and cost estimates

Phase 1: Technical and Economic Feasibility Study

Traffic Analysis

The Consultant shall identify, describe, and quantify existing and potential traffic generating factors in the immediate areas served by the project and in areas likely to be influenced by future economic development. Such factors shall include:

a) population growth and changes in rural and urban population distribution;

b) regional and national economic growth;

c) growth of cargo and passenger traffic

d) development of agriculture, industry, commerce, and tourism within the project area;

e) other factors identified by the Consultant.

In order to carry out a traffic study using varied methodologies and macro-scenarios

. Design

• Develop more detailed topographic maps of the region traversed, by aerial/satellite photograph techniques, and field survey of key points.

• Carry out geo-technical and hydrological investigations of the routes

• Review existing geo-technical plans. In case of construction of a new railway line, carry out a detailed field surface survey and prepare a geological plan of the terrain traversed.

• Investigate the seismological characteristics of the zones traversed and the implications for the project in terms of cost to maintain acceptable security of the lines.

• Surface site investigate all tunnel sites, site investigate all potential snow avalanche and flood hazards

• Surface site investigate all locations of substantial bridges (e.g. greater than 25m spans)

• Design and specify a plan for sub-surface investigations (e.g. trenching, drilling, testing etc.) for all civil and structural works. Design and specify a detailed hydrological survey. Estimate the costs of such surveys.

• Optimise the proposed alignments for minimum cost of construction.

• Provide typical details of design elements, including typical cross sections for divers terrains and conditions, protection works, river passing, snow drifting protection, a standard bridge and culvert type, etc

• Propose the operational characteristics of the rail links to be created. Optimise the project characteristics for such aspects as single or double track, and whether the line should be electrified.

Environmental Impact

Carry out a social impact analysis, and environmental impact analysis, using standard development bank guidelines.

Economic Viability and Cost Estimates

Develop detailed cost estimates of the optimal works, and three options. It is to be expected that optimal implies minimum construction costs of a single, non-electrified line, with fairly low- speed/low-capacity operating characteristics, but other options should be investigated, to be sure that the most financially viable project is proposed.

The Consultant shall prepare preliminary estimates of quantities with an accuracy of +/- 15% of the cost of the works under Stage I of the services. .

Preliminary cost estimates with an accuracy of +/- 15% shall be based on the locally derived unit price appropriate for the previously estimated quantities (see 3.2.11 above). The estimates will also indicate cost escalation in terms of price fluctuations, and the direct and indirect foreign currency, local currency, tax and duty components of the costs of main works of each item, supported by details of his assessments of the respective proportions. Also provision shall be made for unforeseen contingencies.

Economic Costs/ Economic Benefits/ Economic Evaluation

The Consultant shall undertake evaluation of the economic viability of the project for the twenty(20) years following the completion of the rehabilitation/construction.

The economic viability shall be expressed in terms of:

a) the economic internal rate of return;

b) the benefit-cost ratio.

Based on the above indicators, the contractor will carry out economic and financial analysis using standard development bank and business criteria. Present detailed cash-flow spread sheets of project options over a thirty year operating horizon (ie. during the presumably phased construction period, and thirty years beyond).

Rehabilitation/construction Implementation Schedule

The Consultant shall determine a realistic rehabilitation/construction implementation schedule.

Phase 2: Detailed engineering design, preparation of tender documents and cost estimates

The consultant shall carry out detailed engineering designs and tender documents for the proposed project.

The Contractor is expected to ensure the achievement of the results listed at 2.4 above. In order to achieve these results the tenderer may propose alternative or complementary project activities to those identified in this section, where it can clearly justify them.

5. Logistics and Timing

5.1 Project location

Central Asian Countries / Kazakhstan, Kyrgyzstan, Uzbekistan, Tajikistan, Turkmenistan.

5.2 Project period

The project duration is 18 Month.

The Contracting Authority may, at its own discretion, extend the project in duration and/or scope, subject to the availability of funding. Any subsequent extension of the contract would be subject to satisfactory performance by the Contractor. This shall be judged, in particular, in terms of the progress towards the achievement of the project purpose, and the delivery of the anticipated results. The intervention of events outside the Contractor’s control shall also be taken into consideration.

6. Requirements

The specified minimum percentage of EU expertise time to be spent in the partner states is 75%.

attention to the need to ensure the active participation of local professional skills where available, and a suitable mix of European and local staff in the project teams. All local experts are to be independent and free from conflicts of interest.

The selection procedures shall be transparent, and shall be based on pre-defined criteria, including professional qualification, language skills and work experience. The findings of the selection panel shall be recorded. The selection of local experts shall be subject to approval by the Contracting Authority in the same way as expatriate staff.

Civil servants and other staff of the public administration of the beneficiary country shall not be recruited as experts (see Article 9.3 of the General Conditions for Service Contracts Financed by the EC, December 2000).

6.3 Equipment

Equipment shall only be supplied when it contributes directly to the achievement of the objectives of this project. Where such needs are identified, the Contractor applies to Contracting Authority on behalf of the counterpart for the provision of equipment. The application shall be accompanied by a detailed specification, cost estimate and recommendation from the project team. The project equipment budget may not be used to equip the Contractor’s team.

Any equipment must be purchased in accordance with EC procurement procedures set out in the Practical Guide published on the Web site http://europa.eu.int/comm/europeaid/index_en.htm.

The Contractor shall be responsible for procuring all equipment financed out of the Incidental Expenditure. The amount of funding available for equipment is defined in the next paragraph.

6.4 Project budget

The total budget available to implement the project is € 2 000 000.

The Provision for incidental expenditure is € 700 000. This amount must be included without modification in the Budget Breakdown. Its use is governed by the provisions in the General Conditions and the notes in Annex V of the contract.

Incidental expenditures are broken down as follows:

• Equipment € 25 000 • € 675 000 for other incidental costs, including cost in relation to project offices to be set up by the project; office support; interpretation; drivers; translation costs; telecommunication and copying costs; travel costs in the NIS for project purposes (so-called missions, including per diems if the mission requires an overnight stay outside the duty station as defined in paragraph 5.1); car hire; studies, training, workshops; and the cost of the end-of -project audit (by an auditor approved by the Contracting Authority).

The Contractor will need prior written approval from the Contracting Authority before spending the funds related to following components within the Incidental Expenditure:

No funds of the Incidental Expenditure budget may be used for fees for experts.

During contract implementation the Contractor may request the Contracting Authority for a transfer of funds from Fees to Incidental Expenditures. approval from the Contracting Authority. Transfer of funds from Incidental Expenditure to Fees will not be possible.

7. Reports

7.1 Reporting requirements

Reports must be prepared every 6 months during the period of execution of the contract. There must be a final report at the end of the period of execution. Reports accompanying invoices for interim payments should be submitted as defined in Art. 28.1 of the General Conditions.

TACIS Reporting

An inception report shall be submitted two months after the signature of the contract. Subsequently, progress reports will be submitted every six months unless otherwise agreed by the Project Manager. In addition, notes have to be submitted to the Project Manager, as frequently as considered necessary by the European Commission, in order to monitor the substance and the quality of the technical assistance. Meetings between the Contractor and the Project Manager and other appropriate EU Commission services, will be organised as frequently as necessary.

Meetings between representatives of the Project Partner and the Project Manager, or Commission Delegation shall be organised as frequently as necessary. A draft final report will be submitted one month before the end of the project.

Reports produced in this project will be submitted by the Contractor to the European Commission with copies to the Project Partner, the EC Delegation in Almaty the National Co- ordinating Units in Central Asian Countries, the TACIS TRACECA Co-ordination Office in Tashkent and the TACIS Monitoring team. The Project Partner shall be encouraged to submit comments on the report to the Project Manager. The Europe Aid Project Manager is solely responsible for the approval of reports. The inception, progress and final reports will be prepared in Russian and in English, and will follow general TACIS guidelines.

The reports shall be submitted in hard copy and electronic format (as a single Word file). In addition to the above formal reports, the Contractor shall provide such information on project progress as is reasonably required by the European Commission, and shall regularly inform the Commission of political, economic or institutional developments of relevance to the project. The Contractor shall in particular provide the European Commission electronic and hard copies of:

- training material prepared under this project; - reports of short-term specialists;

No report or document shall be distributed to third parties prior to the approval by the European Commission. The Contractor shall pay particular attention to the confidentiality of data. Reports, as well as press statements, etc, made by the Contractor will make clear that any opinions expressed therein remain those of the Contractor and do not represent the opinion of the European Commission.

Copyright on all reports and other material prepared under this contract shall reside with the European Commission.

Project Inception Report An Inception Report shall be issued within two months of the start of the project. It shall summarise the salient details of the Contractor's investigations and a work plan the planned activities.

Project Progress Reports These reports will be submitted at six-monthly intervals and cover progress and status of the Contract to date. They will include reports on investigations and training interventions during the reporting period.

Final Report The Draft Final Report will be submitted one month before the termination of the project. The Final Report will be submitted at the termination of the project and will include any comments required by the Project Manager.

8. Monitoring

The project will be monitored according to standard procedures. Project monitoring and evaluation will be based on periodic assessment of progress on delivery of specified project Results and towards achievement of project objectives.

8.1 Definition of indicators

Suitable objectively quantifiable indicators will be agreed between the Contracting Authority and the Contractor, supported as necessary by the Monitoring contractor.

TRACECA PROJECT IDENFICATION / PROPOSAL

A/ Criteria of Selection.

1-Objectives:

• Improvement and development of the TRACECA Corridor including in the framework of implementation and development of the MLA • To link the TRACECA Corridor with Trans-European Networks (TENs). • Increase intra-NIS trade flows via TRACECA Corridor. • Leveraged IFI investment and the involvement of private sector. • Improved safety, security, economic and environmental performance in different transport modes.

2-Description of programmes

• Establishment of a coherent TRACECA corridor management system, including the Black Sea PETRA and the relevant Pan European Corridors and taking into account the links with other transport corridors in the NIS and links with the Trans-European Transport Network (TEN-T). Development in that context of multi-annual business plans that prioritize activities and distinguish between EU support, beneficiary countries contributions and IFI or other donor financing. Tacis assistance should focus on the harmonization of core technical, safety, security and environmental standards and urgent measures to tackle border bottlenecks, including financing of selective small-scale investments. • Promotion of harmonisation of legislation, standards, rules and procedures, including interoperability, in different modes of transport and border crossings, where appropriate with EU standards and rules. Special attention should be dedicated to improved safety and security of air transport (South Ring programme), in particular as regards harmonisation between European safety (e.g. JAR) and environment (noise, engine emissions) standards and NIS standards, as well as to the establishment of the appropriate regulatory environment ensuring implementation and enforcement. As regards railways, consideration can be given to promotion of railway interoperability, including harmonisation with EU technical, safety and environmental standards. Finally, in the case of maritime transport, priority should be given to improve the maritime safety record the Black Sea and the Caspian Sea, to tackle maritime oil spills and to enhance safety of maritime energy transportation. • Promote investment by IFIs in the transport field by assisting in the identification and preparation of investment projects through existing facilities.

TERMS OF REFERENCE

EVALUATION OF TACIS INTERSTATE TRACECA PROGRAMME IN TRANSCAUCASUS AND CENTRAL ASIA

BACKGROUND

The TRACECA Programme was launched at a conference in Brussels in May 1993 which brought together Trade and Transport Ministers from the eight TRACECA countries (five Central Asian republics and three Caucasian republics). It was agreed to implement a programme of European Union funded technical assistance to develop a transport corridor on a West-East axis from Europe, across the Black Sea, through the Caucasus and the Caspian Sea to Central Asia.

The European Union offers this programme not as an exclusive but as an additional route which will complement the traditional routes. The programme is essential for the diversification of the traditional Moscow-centred trade and transport flows and to open up trade routes to the West.

This programme corresponds to the global European Union strategy towards these countries and consists of the following objectives:

• support the political and economic independence of the Republics and to enhance their capacity to access the European and world markets via a multitude of alternative transport routes.

• enhance regional co-operation among the republics concerned.

• increasingly use TACIS as a catalyst for attracting support by International Financial Institutions (IFI's) and private investors.

• link the TRACECA route with the Trans-European Networks.

Representatives of the Partner States and the EC developed the programme plan through “sectorial” working groups (trade, rail, road and maritime transport). The corridor was narrowed to one specific route on which TRACECA should focus its actions. On a dialogue driven basis, the working groups identified deficiencies in the region’s transport systems and translated them into projects to be financed by the EC. These projects were essential for the diversification of the traditional Moscow-centred trade and transport flows and to open up trade routes to Europe. In 1997, the Partner States reiterated the necessity of linking the TRACECA route to the Crete corridors that link the Black Sea region with the Trans European Networks. Therefore, the EC organised a conference in Tbilisi that brought around the table the 16 Transport Ministers of the Black Sea littoral states and the NIS involved in the TRACECA programme. The participants expressed a clear wish for closer co-operation between TRACECA and the Black Sea countries and they commonly agreed that Ukraine and Moldova would become full beneficiaries of the TRACECA programme. Furthermore, an ad hoc Ministerial Committee was established to introduce this initiative at the Pan European Conference in Helsinki in June 1997. The Helsinki Conference identified the Black Sea Region as a Pan European Transport Area (PETrA) which links the networks and corridors in Europe with international routes such as the TRACECA route.

The TRACECA Baku Summit (September 1998) agreed on a “Basic Multilateral Agreement on International Transport for the Development of the Transport Corridor Europe-Caucasus-Asia”, including technical annexes on rail and road transport, commercial maritime navigation, customs procedures and documentation.

The Multilateral Agreement has been signed by 12 countries: 3 South-Caucasus, 4 Central Asia, excluding Turkmenistan, Ukraine, Moldova, Romania, Bulgaria and Turkey. A Permanent Secretariat was established in Baku with the support of Tacis/TRACECA.

In March 2000 the first TRACECA Intergovernmental Commission took place in Tbilisi. The TRACECA Multi-lateral Agreement on Transport, initiated at a Presidential Summit in Baku in 1998, is now ratified by the national parliaments of the 12 signatory states (Moldova, Ukraine, Georgia, Armenia, Azerbaijan, Uzbekistan, Kazakhstan, Kyrgyzstan, Tajikistan, Turkey, Romania, and Bulgaria). According to the Multilateral Agreement two supporting structures were set up in order to facilitate its implementation. The Intergovernmental Commission: a ministerial committee that decides by consensus on new actions and discusses the possibilities of TRACECA-funding by the EC and the Permanent Secretariat (established in Baku) that prepares the yearly meetings of the IGC and co-ordinates the activities with the designated officials in the signatory states.

In the period 1993-2002 53 projects (39 TA and 14 investment projects) to the total sum of € 110 million have been enabled in the TRACECA programme.

DESCRIPTION OF THE ASSIGNMENT

2.1 Beneficiaries

Beneficiaries of this evaluation are all TRACECA countries (Moldova, Ukraine, Armenia, Georgia, Azerbaijan, Turkmenistan, Kyrgyzstan, Kazakhstan, Tajikistan, Uzbekistan) and the Commission.

2.2. Global and specific objectives

A Steering Committee consisted of representatives from DG RELEX, TREN and AIDCO will follow the consultant activities. TecnEcon has carried out an evaluation of TRACECA from December 1997 to April 1998. This evaluation will focus on the analysis of the impact of the policies and strategies adopted in the framework of the TACIS Interstate TRACECA programme between 1998- and 2002; related to TRACECA projects financed through other budget lines will also be considered.

Therefore the main aims of this evaluation exercise are as follows:

• provide recommendation on possible policy and strategy reorientation in the framework of the 1998-onward TRACECA programme;

• suggest possible improvement in the Interstate and in TRACECA programme cycle to allow the adoption of more effective decision making, planning and implementation management system.

2.2.1 Programme level

The evaluation of the management process will concern programming, decision making, implementation and M&E mechanisms.

Relevance of the Programme

The evaluation will concern: the relevance of the programme policy objectives and sectorial policy in relation to EU and TACIS policy objective, TRACECA concerned NIS/EU trade and level of transport on TRACECA route.

Institutional set up and Programme management

A major element to be analysed by the consultants is the appropriateness of the TRACECA management mechanism with regard to planning, implementation and M&E procedures:

• the appropriateness of Interstate Programme cycle and its decision making process in relation to the specific TRACECA institutional set up and management mechanism; • the level of policy analysis on which is based the identification of policy objectives, implementing strategies and projects; • the role of the working groups in the planning phase, the level of policy dialogue and regional co-operation they ensure; • the effectiveness of working group approach to ensure the participation of beneficiary countries to the planning and identification phase and to allow for an appropriate level of ownership; • the mechanism put in place and achievement in policy co-ordination and programme complementarity with concerned EC General Directorates, TACIS National programmes, Interstate programmes and International Financing Agencies; • appropriateness of co-ordination team approach and its effectiveness; • the mechanism put in place to ensure the overall co-ordination of projects implementation and its effectiveness; • programme flexibility and the pace of the implementation process also in relation to the needs of matching the rapid change of socio-economic environment associated with the reform process; • the use of local expertise; • procurement procedures; • monitoring and evaluation practices and feed back; • mechanism for the dissemination of project results in the concerned NIS.

Global Impact

• At the level of the global programme, the evaluation will be based on a preliminary analysis of Programme impact on: - regional co-operation in general and on trade and transport in specific - multiplier effects - regional trade and trade with EU member states via TRACECA route - private and IFI investment

2.2.2 Policies

At this level the evaluation will concern: • the analysis of the relevance of the policy objectives in relation to needs, taking into consideration the evolution of their level of priority from the inception of the assistance; • the analysis and the comparison of the impact for each of the implicit policy objectives: policy and regulatory framework, transport management, transport service, investment in infrastructure maintenance and development.

2.2.3 Project level

The individual projects will be evaluated on the basis of the key criteria of relevance, efficiency, effectiveness and impact.

Relevance: The relevance of the projects will be analysed, accordingly to their objectives, in relation to:

• the selection and the attitude of the partners (ownership)

• the specific constraints affecting the performance of the partner institutions • the specific constraints in the transport system that the project aimed at removing • the macro-economic and institutional environment

Management efficiency: The analysis will concern, inter alia, the following:

• design of terms of reference; • implementation pace; • project outputs against expected results; • performance of the contractor; • participation of partner and beneficiary institutions in designing, managing and monitoring of the activities to ensure ownership; • co-ordination between Brussels headquarters, Delegations, co-ordination team, PCU and project management; • co-ordination among the partner institutions in the different NIS; • degree of project management flexibility in adapting to changing situations; • co-ordination complementarity and synergy between the specific project and other projects financed in the framework of TACIS programmes and IFI; • dissemination of project results.

Effectiveness and Impact

The analysis will concern the effectiveness of the implementing strategy adopted by the project to achieve the stated objectives and the degree of their achievement.

Whenever possible specific indicators have to be developed to analyse the impact of the single projects. Some of the possible areas for which impact indicators should be developed are presented below.

• Policy and regulatory framework development Opening-up the market to private companies harmonisation of transport legislation among concerned NIS and with EU harmonisation of custom procedures and trade documentation transport safety

• Transport management improvement improvement in the transport information system interstate co-ordination in transport planning co-ordination of tariffs and timetable development of inter-modal transport development of management methods: marketing analysis, strategic planning, cost and accounting system

• Infrastructure maintenance and investment facilitation improvement in maintenance management and in resources allocation private and public investment realised or in the pipeline

• Transport services restructuring services privatisation and private investment / easy access to services / service re-organisation and interstate co-operation

• Direct investment reduction of transport time and costs / multiplier effect

The consultant will make a number of interviews to freight and transport agencies, forwarding agents and others final users in order to better appreciate the impact of TRACECA projects in relation to the above mentioned issues.

1.3 Requested services

The evaluation will be implemented at three different levels:

Programme level

At this level the evaluation will focus on the global programme and its management framework. This implies analysis of the efficiency and appropriateness of the programme cycle management in relation to the stated policy objective and of the changing socio-economic background. Particular emphasis will be placed on complementarily and co-ordination of the programme with concerned TACIS National programme and Interstate (Oil and Gas Pipeline project in particular), co-ordination of policy and programmes with Member States and other Multilateral and Bilateral Donors. The global impact of the programme with regard to the stated wider objectives will also be analysed.

Policy objectives level

At this level the evaluation will concern the impact of the sectorial policies, as well as the analysis of their evolution from the inception of the assistance. It will also concern the comparison of the effectiveness of the different implementing strategies adopted to implement sectorial policies.

Project level

For each of the policy objective, a significant sample of projects will be selected for in-depth evaluation.

2.4. Expected results

The evaluation is planned to be conducted in three phases.

The first phase will be mainly a desk study which will include the analysis of all the available documentation and interviews with the concerned task managers and other EC officials from the concerned DGs. The first phase report will include:

• a presentation of EU policy relevant to the sectors in question. • a presentation of the evolution of Interstate and concerned NIS/EU trade • a presentation of the evolution of transport on the TRACECA route and its links to the TEN programme • a preliminary review and classification of projects on the basis of policies and implementing strategies • preliminary conclusion • projects selection criteria and project list • detailed plan of work and methodology (including impact indicators) for the second phase

The second phase will focus on the implementation of field visits for the evaluation of the selected projects. The output will be a report which will include:

• a synthetic evaluation report for each project analysed. • the description and the preliminary analysis of the programme management. • the preliminary synthesis of main conclusions.

The third phase will be devoted to preparation of the synthesis report. The report will be organised on the basis of the evaluation criteria presented below.

The consultant will present its conclusion in relation to the categories of analysis, which have been presented above, taken as a whole. The conclusions will, in particular: i) discuss the impact of TRACECA in relation in to its implicit policy objectives and analyse reasons for success or failure in relation to appropriateness of: • “sectorial” policies • priorities as defined by resources allocation • implementing strategies ii) analyse the appropriateness of programme management system with particular reference to the regional co-operation and programme complementarity

The recommendation should be an input to next programming exercise with regard to the possible re-orientation of programme focus, resources allocation patterns, sectorial policy and strategies. Furthermore, taking into consideration the existing regulatory framework and institutional set up, recommendation should be put foreword on possible improvement in management, co-ordination and monitoring procedures.

LOCATION AND DURATION

The assignment will start in December 2002 with a briefing with EuropeAid Co-operation office project manager in Brussels. A meeting with representatives of RELEX and TREN participating in the Steering Committee will follow.

The consultant is then expected to continue his assignment with the phase no1. After submission and approval of the final report of phase 1 by the EuropeAid project manager the consultant will start the phase 2.

In this phase he will carry out three missions; one covering Ukraine and Moldova, one the three Caucasus countries and one the CA countries. Before submission of the final report of the second phase a meeting with the Steering Committee will be held in Brussels.

After submission of the final report of the second phase and its approval by the EuropeAid project manager the consultant will start the third phase.

The provisional synthesis report will be presented to the Steering Committee in a meeting that will be held in Brussels.

The final synthesis report will be submitted for approval; after incorporation of the comments of the Steering Committee and of the EuropeAid project manager.

The duration of the assignment is 12 months. Location of assignment: Brussels and TRACECA countries (see par. 2.1).

REPORTING

The consultant will have to submit the following reports:

• an interim report after one week from the beginning of the work, it will focus on the methodology that will be utilised and on a detailed plan of work for the first phase, (English/10 copies); • a final report of the first phase within 1 months from the beginning of work, (English/10 copies); • a final report of the second phase within 4 months from the beginning of work, (English/10 copies); • a provisional synthesis report within 30 days from the beginning of the third phase, (English/15 copies); • a final synthesis report 15 days after having received comments of the Commission concerned services, (English, Russian, 20 copies).

The final report has to include an executive summary (max. 6 pages) and a brief presentation of the evaluation (max. 2 pages). All the reports have to be delivered on hard copy and on electronic version (CD-ROM).

Report of the team of technical experts for the period from 01.11.2002 to 01.06.2003

The group of experts of the Permanent Secretariat of the IGC TRACECA participated in organizing and holding of the First Meeting of the Working Group on road transport within the framework of the project “Unified Policy on Transit Fees and Tariffs” (November 27-28, 2002, Baku).

In close cooperation with the experts of the project “Common Legal Basis for Transit Transportation” the PS expert group took part in working out the documents for the Meeting of the Working Group of National Secretaries and Legal Experts, which was held on January 23- 24, 2003 in Baku, Azerbaijan.

The expert group took part in preparation of the documents and the presentation of the PS IGC TRACECA for the First International Transport Conference and Exhibition on intermodal and sea transport in the Caspian and Black sea countries held on February 26-28, 2003, in Istanbul, Turkey.

The group of experts participated in sub-regional seminar on the International Agreement for the Asian Highways Network and in Project Working Group – Transport and Border Crossing within the framework of SPECA held on March 27-29, 2003 in Baku, Azerbaijan.

The group of experts took part in preparation and organization of the Third Working Group for Railways, Ports and Shipping Companies within the project “Unified Policy on Transit Fees and Tariffs” (Baku, 15-16.04.2003).

The expert group actively participated in working out the documents and holding of the Second Meeting of the Working Group of National Secretaries and Legal Experts within the framework of the project “Common Legal Basis for Transit Transportation” held on May 22-23, 2003 in Tashkent, Uzbekistan.

In close cooperation with the project “Common Legal Basis for Transit Transportation” there was prepared the draft Protocol on amendments to the Technical Annexes on international road transport, on customs and documentation procedures to the “Basic Multilateral Agreement on International Transport for the Development of the Corridor Europe – Caucasus – Asia”.

The expert group provided the required support to the projects “Harmonization of Border Crossing Procedures”, “Unified Policy on Transit Fees and Tariffs” and “Common Legal Basis for Transit Transportation”.

There have been developed the materials for the TRACECA stand within the framework of the 2-nd International Transport and Logistics Exhibition Trans Caspian 2003 (Baku, May 21-23, 2003).

Besides, the Technical Group of Experts took an active part in preparation of two issues of the “TRACECA Life” magazine.

ACTION PLAN 2003-2004 FOR THE BLACK SEA PAN-EUROPEAN TRANSPORT AREA

The overall economic development of the Black Sea region relies on efficient transport infrastructure and transport services, and on transparent administrative procedures along the trade links, both between the BS PETrA, the BSEC and the TRACECA countries and other countries.

The Action Plan 2003 – 2004 for the BS PETrA is continuation of the work carried out until 2003 and is to ensure its further development in the following directions:

1. Commencement of concrete actions in co-ordination of cooperation between the BS- PETrA, TRACECA, BSEC, Pan-European transport corridors and land connection encircling the Black Sea: - Adjustment of adopted working programmes and project information; - Adjustment of databases. Elaborating of one unified methodology for submitting statistic data by member countries; - Co-ordination of meetings, joint meetings, events, conferences; - Providing by the countries-participants the information required for constant updating of the BS PETrA website by the Odessa Support Office.

2. Assessment of the work done by the working groups: - Working group on infrastructure related to ports and their hinterland connections to corridors for the Black Sea PETrA; - Working group on “Harmonisation of institutional aspects of transport and customs procedures”, ad-hoc working group on the customs procedures.

3. Actualisation of results and continuation of the work with working groups: final adjustment of the protocol on “Harmonisation of institutional aspects of transport and customs procedures” and its adoption;. finalising regional map basing on the national and regional maps of member countries; formation of an agreed list of priority investment projects within BS PETrA; development and approval of the required working programmes including formation of WG staff; studying the expedience of establishing a new special WG, formed by the representatives of the private companies, engaged in the transport area in order to clarify the bottlenecks arising in the course of their activities connected with service providing in transport sector.

4. Preparing the application of TINA tools and experiences on the BS PETrA countries, where appropriate, - Confirmation of TINA tools expedience and experiences for BS-PETrA; - Initiating an EU-financed project/workshop to enable country experts to use TINA tools and experiences.

5. Drawing-up and obtaining approval for the long-term Working Programme, th - Upon decision of 6 SC meeting drawing-up the long-term WP of the BS PETrA; th - Submitting of the long-term WP for the adoption at the 7 SC meeting.

Remarks to actions regarding fields of activities:

1. PORTS

Ports play an important role, not only in terms of trade facilitation, but also as centres of regional and national development. Besides their function with respect to the loading and unloading of vessels, they are vital nodes and connecting points within the overall transport chain, providing the essential interface between sea and land transport and connection to the land networks.

Member country shall aim to develop BS PETrA ports. The selection of ports for development by the responsible national authorities might follow the elements for eligibility defined by the WG and comply with UN/ECE and EC regulations.

2. INFRASTRUCTURE DEVELOPMENT

2.1 DEVELOPMENT OF THE PORTS INFRASTRUCTURE

Investments on port infrastructure shall imply new construction, reconstruction and maintenance of main and ancillary infrastructures, as well as adequate storage facilities.

In order to create a compatible, flexible transport system the ports must provide the most extensive facilities for efficient intermodal transport.

2.2 PORT ACCESS FROM AND TO THE HINTERLAND

To ensure efficient port services focus must be directed on the improvement of the access from and to the hinterland taking into account current traffic volumes and traffic forecasts. Access should be multi- modal, wherever warranted, using road, rail or inland waterways. The improvement of the hinterland connections should be in line with the standards of international transport agreements. If TINA tools and experience are applicable and available, their use will be managed by the WG.

Special attention will be given to improve rail, road and inland waterway connections, where appropriate by use of the interconnections with the Pan-European Transport network, hereunder Corridors IV, VII, VIII, IX, X and TRACECA and the Ring corridor. The action programme concentrates on access routes in a radius of approximately 150 km to the ports. Due to scarcity of infrastructure in some regions, such conditions may allow for a radius up to 300 km.

2.3 THE LAND CONNECTION ENCIRCLING THE BLACK SEA

Positive effect can be reached by developing of hinterland transport infrastructure. In this aspect special attention should be paid to enhanced coordination of co-operation between BS PETrA, TRACECA and Corridor IX , southern section (as it was stipulated before).

3. ADMINISTRATIVE PROCEDURES

Facilitation of administrative procedures will imply harmonisation of customs legislation and procedures, respecting established Community acquis/international rules. These procedures, notably information and documentary requirements, linked to the cargo are often not user friendly. The application of following key concepts could significantly increase the productivity of the transport sector and therefore help the countries' economic and commercial position:

• gradual liberalisation of the transport market in compliance with Community rules; • technical and social harmonisation in road transport and • liberalisation of the railways to ensure better competitiveness.

As under the current TRACECA programme three important horizontal projects are being carried out, a close coordination with the WG is endeavoured. Introducing common legal procedures, including customs procedures as well as a common freight insurance system based on international legislation, could lead to a set of draft guidelines for common procedures. These guidelines could be drafted in English and Russian.

It is necessary to activate the work on harmonisation of institutional aspects of transport and customs procedures within the frameworks of the appropriate WG. Other areas for improvement include immigration controls, agricultural and veterinary checks, transport checks etc.

4. CUSTOMS PROCEDURES

An ad hoc group on customs procedures under the working group on harmonisation shall activate its work. As border and customs control procedures are time-consuming, efforts will be undertaken for interchanging results of projects being realized in the Black Sea region and implementing best practices.

5. MARITIME LINKS AND INLAND WATERWAYS

When developing existing and new shipping routes co-operation should be promoted between public and private companies, port authorities and trade interest groups. High shipment volumes mean waiting times are short, efficiency high and costs moderate. The use of inland waterways is an alternative and a supplement to transport by land for every type of cargo and should be taken into consideration wherever possible.

6. TRANSPORT SERVICES

Transport services are to be seen as an integrated part of the transport system and include "software" measures (e.g. at border crossings or intermodal points). Many transport bottlenecks have their principal causes in the "software" rather than in the "hardware". Investing in other measures, such as the improvement and rationalisation of administrative procedures, may bring much greater benefits than infrastructure investments.

6.1 LOGISTICS

By intelligently combining different modes of transport, logistics quality can be improved and costs reduced. Furthermore, with the same aim, the set-up of Logistics and/or Distribution Centres will be proved in a case-by-case form for each country by the Working Group on infrastructure.

6.2 SAFETY

Safety measures shall guarantee secure handling and shipping of cargo and vessels. This includes, safety of navigation by well equipped and up-to-date harbour services and professional pilot services, as well as instant tracking and tracing of any cargo. An issue of particular interest is the maritime safely related to old ships still in use in the Black Sea maritime basin. When making relevant priority projects for BS PETrA use safety projects to be considered.

6.3 TELEMATICS

The application of telematics and information technology shall be encouraged. Port and port-related projects of common interest which could be e.g. projects in relation to the development of Electronic Data Interchange (EDI) systems in ports and Vessel Traffic Management Systems (VTMS) to be focused on.

6.4 TRAINING

To increase efficiency in administrative procedures training schemes shall be introduced. A corresponding TRACECA project is being prepared for starting in 2003. Terms and results will be co- ordinated with BS PETrA.

7. ENVIRONMENTAL PROTECTION

The Black Sea is a particularly sensitive maritime area in respect of environmental conservation. Protection against the contamination of water, soil and air shall be treated as a top priority.

Measures must respect international standards and legislation on transport of dangerous goods, including oil and other harmful substances, aimed at the reduction of hazardous influence caused by transport.

8. TIME SCHEDULE

This Action Plan is to be revised annually [Article 3 of the MoU].

The long-term Working Programme for the BS PETrA will be drafted during the next months and submitted to the 7th SC meeting for approval.

WGs shall take decisions in respect to the Rules of Procedures of the SC on their own activities in consultation with the SC.

This Action Plan has been submitted for approval to the 6th SC Meeting on 19 March, 2003. It was agreed on it in principle. The Action Plan was improved upon a balance of the expressed remarks and directed to the member countries for implementation.

6th STEERING COMMITTEE MEETING ON THE DEVELOPMENT OF THE BLACK SEA PAN-EUROPEAN TRANSPORT AREA 18-19 March 2003, Odessa

Minutes

The steering committee on the development of the Black Sea European Transport Area under the Ukrainian presidency took place in Odessa, on March 18-19, 2003.

The meeting was attended by the delegations from all signature parties, all observers and other parties concerned.

The list of participants is attached in the Annex 1.

The meeting was chaired by Mr. Sergey Symonenko, Deputy State Secretary of the Ministry of Transport of Ukraine.

DAY 1 March 18, 2003

Chairman opened the session and welcomed the participants on behalf of the MoT of Ukraine Mr. Kirpa. He stated that this meeting is considered as an important stage in development of the countries- participants. Globalisation requires further integration of the transport systems of the European countries. The most important item is to coordinate investment projects and transport sector development plans of the countries participants

Romanian representative was glad to pass the chairmanship to Ukraine and provided information about activities done by the SC under its presidency.

Turkish representative said that during the chairmanship of Turkey in the WG of Infrastructure related to ports and their hinterland connection the priority tasks were distinguished. There is lack of information about relationship between existing bottlenecks and projects. She has passed a draft of the map to the SC in order to distribute among the participants.

Hellenic Republic representative as head of the WG on Harmonization of institutional aspects of transport and customs procedures presented the draft protocol on harmonization of institutional aspects of transport and customs procedures for SC discussion. This protocol was distributed and discussed by the members during previous SC meetings. She asked to initialise the approval procedure in order to sign it on the next meeting.

Chairman stated that the draft of the map is OK. Though he would like to have some information about the traffic and cargo flows as well as main characteristics of the ports on it. It was proposed to continue the work over the creation of a new up-to-date map of every country participant, which will contain the complete information about every participant.

Turkish representative stated that the efforts and assistance of all the countries are required in order to complete the map. All the countries are to provide data in GIF format for the WG.

Chairman stressed the importance of achievement of some practical results i.e. for example to have some joint database about customs, transport, immigration formalities etc. of the members at least. He asked the participants to highlight the main problems in respect to the previous activities done.

Mr. Efstathios Dalamangas presented briefly the TRACECA programme and stated that presently TRACECA has 3 horizontal projects running of specific interest for BS PETrA with the total budget of 6 mln. Euro. The conclusions and results of all TRACECA activities are in disposal of all the countries. They are accessible in the Internet.

Turkish representative said that it could be some problems with the software in respect to map preparation, unified software is to be used. Hence the assistance of all the countries is still required.

BASPA chairman stated that the said information about the main routes, ports etc. was provided for a few times but they failed to reach the agreement of all the participants in respect of the data to be included into the map. Hence he considered that WG partially failed to reach the results required.

BSEC executive director thanks Turkey for their efforts done in a WG. He considers that the main problem is collecting information for the map from the participants. He offered to create a ad hoc WG in order to develop the new joint map based on the relevant UN-ECE map.

Chairperson noted that one of the main points stated in the previously signed memorandum is information interchange. Hence he would like that all the national bodies and participants have an access to all the data about traffic, cargo flow, legislation, customs procedures etc.

Mr. Efstathios Dalamangas stated that it is a pleasure to participate in this conference. He also thanked Mr.Symonenko and Mr.Schlaack for organization of this meeting. He briefly introduced TRACECA project, its history and objectives for the participants. The aim of TRACECA – to provide link between the Europe and Asia could be the base for the cooperation. He stated that TRACECA is ready to provide assistance to the PETrA in respect to secretarial support.

TRACECA coordination team leader mentioned that it was a great pleasure for all the team to see each participant around the table. He presented the possibilities of the WG in respect of coordinating activities as it was stated in memorandum. By means of TRACECA the support office for PETrA was established in Odessa. Odessa office is financed by TRACECA coordination team project in order to carry out those coordinating activities. Odessa office will keep running the PETrA web site. But members’ support in our activities is also required.

Bulgarian delegate briefly represented the transport corridors crossing the Bulgaria territory. He stated that transport policy is the priority concern of Bulgaria government. Port Administration now is working over the project for creation the National information port system. Presently the administration is looking for the financing of the abovementioned project.

Chairperson said that different countries have different port management systems. It is advisable to share the knowledge about the existing administration systems in different countries. He informed that presently the block train is offering weekly service from Iliychevsk to Klaipeda.

Greece delegate thanked MoT of Ukraine for hospitality. He described the main changes that are underway in Greece in the port sector. The main item is liberalization of the national policy in accordance to the European rules. The final aim is to create fair competition between ports. The main development projects of ports of Thessaloniki, Kavala, and Alexandroupolis were described.

Moldova representative expresses thanks for The MoT of Ukraine for perfect conference arrangements. Presently there is an official concept for the transport corridor development in Moldova. The main problem for the further development of rail transport is related to the lack of the electrification unlike in Romania and Ukraine. Moldova is very interested in the TINA methodology and possibility of its application in Moldova. For this purpose the full complex of deeds aimed at the financial burden reduction is required.

Chairperson said that the Danube area is the zone of interest of many Black Sea countries. The main problem of its development is related with the ecological questions.

Romanian delegate presented the priorities on the short and medium terms projects regarding the railroad and port infrastructure. The main development projects of the port of Constanza were described.

Turkey representative stated that Turkey would like to facilitate Europe-Asia transit transport connection by creating an uninterrupted transport opportunity in Black Sea Region. First Istanbul strait tube crossing project will establish a connection between corridor 4 ending in Istanbul and TRACECA.

Second during the construction phase of Kars-Tbilisi railway project, the railway connection towards Caucasian region will be sustained through the railway ferry to be operated between the ports of Samsun, Poti and Batumi Third Turkey wishing to include into TRACECA plans the new railway between Samsun and Mersin as well as Mersin and Iskenderun ports.

Russian Federation delegate presented the main cargo-flows of the Russian railroad and ports. She said the concept of the development of international transport corridor on territory of Russia and Ukraine was adopted by the MoT of Russia and Ukraine. The extensive development plans of the railways in connection with the Black Sea Russian ports and development of the railroad infrastructure of the latter as well as and border-crossing points are existing.

Ukrainian delegate mentioned that the special booklet containing data about Ukrainian transport system was presented to the members. Ukraine has a complete program for the transport corridors development up to the year 2005. He highlighted the problem of the lack of connection between Danube and Black Sea in Ukraine. Presently the project of the new Danube-Black Sea canal is ready and is to pass the state expertise. Another important issue is to arrange the non-stopped transit cargo border crossing. He mentioned the necessity to increase the cooperation between PETrA, BSEC and TRACECA.

Head of port of Iliychevsk welcomed the participants. He said that BASPA is interested in development of the transport system of the region. The port of Iliychevsk was described. Few problems were mentioned: lack of PETrA results, TRACECA is mainly aimed towards the Caucuses region and the lack of attention to the Black sea is visible. So the balanced transport policy to be developed. PETrA should coordinate with BSEC. He asked the EU to prolong the activity of Odessa office as a coordinator of PETrA project.

Head of the UkrFerry briefly introduced the company. He presented a new project - to build the ferry complex in Hoppa Turkey for Iranian cargoes. He mentioned that some problems such as customs, border crossing etc. requires mentality change and are long-term then. Other are easier and could be solved immediately. First lack of system approach to the development of transports project. He considers the main reason is lack of planning. Second absence of particular beneficiary for the projects. So the results of the projects are not controlled. The solution is the beneficiary to be private or the further privatisation of the achieved results to be envisaged. Third problem is the lack of cargo base analyses in any project. The solution is to ask the participants of the project what is required. He asked for assistance from TRACECA, PETrA etc. in obtaining of the credits to local companies.

EC delegation representative made some comments on Mr. Kurland's speech. He mentioned that in case of direct assistance to a private beneficiary it needs to be avoided to strengthen up the possible existing monopoly.

AIFFU chairman of the board presented the AIFFU to the participants. He stressed a few problems: The main one is non-stable and unexpected legislation. The average speed is another concern. He asked the MoT of Ukraine to head the joint activities of all the parties concerned. Also the question of the personnel training was described in accordance to the FIATA requirements. He asked for some assistance in further development of this question.

EU representative informed the participants that a new project for the training of forwarders is proposed for TRACECA countries to EU member states for adoption. The budget is foreseen 2 mln. Euro.

The UN ECE Regional Advisor on Transport conveyed greetings from the Director of UN ECE Transport Division. He made a presentation on the activities of interest to the BS PETrA region. The major UN ECE agreements most recent mars of “E” networks and anther documents on UN ECE activities were provided to the participants. He stressed the UN ECE activities in Europe Asian transport links and its contribution in the development of Pan-European Corridors process. He proposed the closed cooperation of BS PETRA SC with UN TEM and TER Projects and expressed his satisfaction, on behalf

TRACECA Co-ordination Team - Progress Report III – Annex 11 of the UN ECE, that existing legal instruments, Agreements and Conventions development under the auspices of the UN ECE were well taken into account in the work of the BS PETrA work.

Ukrainian delegate presented the BS PETrA program for year 2003-2004.

Chairman, co-chairman and participants have discussed the issues of the Action programme The following decisions were taken: - To prolong the activities of the existing WG. - For the abovementioned reason it is required to make necessary step to sign up the draft protocol on harmonization of institutional aspects of transport and customs procedures in 2 months term. - To call the 7th SC meeting in October 2003.

DAY 2 March 19, 2003

TRACECA coordination team leader stresses an importance of the projects that are running presently. The PETrA plans for year 2003-2004 were described. He stated that all the information would be available at PETrA web site soon.

Team leader of the Harmonization of border crossing procedures team briefly described the Harmonisation of Border crossing procedure project. The main problems were highlighted. The proposed approaches, actions were noted: one stop control, all services to be within single EU information network. A list of required actions was mentioned.

BSEC PERMIS executive manager noted the importance of the development of collective vision of the regional future. He briefly described the general BSEC activities. A few propositions concerning further transport sector development were noted.

Representative of Ministry of foreign affair of Ukraine informed the participants about GUUAM activities and priority projects made within its frameworks. He would like to have a status of an observer in BSEC and PETrA and associated member in TRACECA. He invited TRACECA and EU authorities to visit the GUUAM meeting in Kiev.

BASPA executive director mentioned that it is important to made the scheme of the maritime transport routes in the region. He expressed his gratitude for the MoT of Turkey for the work actually done. He also mentioned some remarks in respect to the map: all the sea port to be shown on the map, the hub points between corridors should also be included; areas outside the map should be excluded from the map. The problem of transport approaches to the sea ports was highlighted. He underlined the importance of the joint efforts.

Chairperson asked the participants to return to the BS PETrA program for year 2003-2004 discussion. All the notes were summarized. He proposed to approve the results of the WG activities and ask them to provide the said results in the soft form to all the participants. Some propositions were made by the participants. The following was concluded: - The Draft Action Plan 2003-2004 for the BS PETrA was approved in general. The Ukrainian chairmanship is to update the Plan in accordance to the remarks made by the participants and distribute it within 2 weeks term. - The participants of the meeting have to express their remarks and opinion on the said draft plan in written and sent them to the SC ( MoT of Ukraine) within 1 month. - The updated Action plan is to be adopted during the next SC meeting.

As to the Long-term Action Plan of the BS PETrA the participants of the meeting concluded the necessity of its development and agreed to develop their propositions and provide them to the SC within the 2 months term. The draft Long-term Action Plan of the BS PETrA to be discussed on the next SC meeting.

Secretary of Transport corridor 7 briefly presented TINA and the possibility of its methodology implementation in respect to the Black Sea Region. The main TINA achievements were described.

EC delegation representative thanks the MoT of Ukraine and the TRACECA coordination office in Odessa for the excellent preparation. He mentioned the points of primary interest of the EC in the framework of the new neighbourhood policy with Eastern countries. Hence PETrA increasingly reflects EU aspirations.

TRACECA expert presented the PETrA web site and its content. The site wasn’t updated from year 2001. Presently the coordinating office of TRACECA in Odessa has the plans to completely renew it. The new site address www.bs-petra.org was approved. The SC would be the owner of the site. The importance of connection with the official sites of the countries participants was mentioned. The Turkey is to provide the SC with all the data available in order to place them on the site.

AsMAP UA representative briefly described the said organization, its tasks and prospects. The problem of tariff optimisation was mentioned.

The MoT of Azerbaijan presented Azerbaijan participation in TRACECA.

In order for further improvement of the coordination between TRACECA, BS PETrA and BSEC as well as providing assistance in fulfilment of the previously mentioned tasks for the BS PETrA development, the participants of the 6th SC expresses the wish to the EC to prolong the activity of the TRACECA coordination group in Odessa.

It was decided to held the next SC meeting at the middle of September 2003 in principle.
