1. Minutes of the regular meeting held on Wednesday, August 8, 2018 2. The schedule of checks written 7/31/18 to 9/5/18 3. Staffing: a. Hire of Kellie Bushmaker to the .45 FTE, Student Wellness Coordinator, limited term position. This is a position within the Teacher group. Kellie will be compensated at Step 6 Lane F as a Provisional Educator. (18-19 compensation $24,668.21) Kellie is also currently a part time member of the Support Staff serving as an Educational Associate – Social Work Assistant. This is a new, grant-funded position, offered on a limited term basis for the 2018-19 school year. b. Resignation of Julie Stiles from her full time Educational Associate – Special Education Aide position at Pioneer Elementary School effective at the end of the 2017-2018 school year. Posting is underway to fill this vacancy. 1 c. New hire of Christopher Gallegos to the full time Educational Associate – Special Ed Aide position at Pioneer Elementary School effective at the beginning of the 2018-2019 school year. Chris will be compensated $16.73/hour. This position is vacant due to the resignation of Julie Stiles. d. New hire of Steve Havlichek to the full time, exempt, Technical Director position in the Performing Arts Center effective September 4, 2018. Steve will be compensated $34,165.75, which is pro-rated based upon his date of hire. ($41,000 annual salary). This is a new position whose primary function is to be the primary technical liaison for all events at the Center. e. Hire of Brenda Pavek to the .29 FTE, Educational Associate – Clerk position at Cormier School & Early Learning Center effective at the beginning of the 2018-2019 school year. Brenda will be compensated $17.10/hour. This position is vacant due to the resignation of Nancy Upstone. Brenda is currently an Educational Associate at Cormier and with her new position, it will bring her to a .79 FTE. f. Resignation of Tori Destree from her half-time, Educational Associate – 4K Aide position at Cormier School & Early Learning Center, effective 9/7/18. Posting is underway to fill this vacancy. G. Resignation of Jacqueline Grant from her full time Cross Categorical Instructor position at Parkview Middle School, effective 9/10/18. This resignation is contingent upon receipt of resignation fee. 5. There were 79 co-curriculars approved

I. Superintendent’s Report:  Staff Welcome Back – The Welcome Back Meeting was highly successful and a great hit. The student performances by the high school encore choir, jazz band and drumline was fantastic. Set the vision about the district’s focus on culture along with its math and literacy goals.  Start of School Year – The start of school went well. All the credit for this smooth start goes to our administrators and staff who did an outstanding job. Weyers spend time at each building throughout the first week of school. He also has the opportunity to connect with student and families while riding the 4K and 5K buses  Fall Activities – Fall activities are up and running. Over 165 girls and 160 boys are participating in a fall sport. The start of school saw the start of musical cast and crew, DECA, SKILLS USA, Dance, Cheerleading, and clubs such as Art, Eco, Formula, Student Council, and Spanish. Nelsen spoke to the freshmen class about getting involved in co-curriculars.  District / Building Level goals – District and building goals will be in October after buildings have had the opportunity to develop their internal culture goals and share their goals with teams.

There will be a mini-data retreat to look at relevant data from this fall’s assessments. Data will be looked at through two different measures. One to compare the same cohort from year to year (4th grade to 5th grade), and the other to look at a three year average for all students to measure our effectiveness with curriculum fidelity as well as meeting the benchmarks for being college and career ready. The district goals include: 1. Math goal - Targeted sub group 2. Literacy goal - Targeted sub group 3. Culture goal - each building, building and grounds, food service, district office 4. Part of setting our ASD culture is to share OUR story and purpose. One way we are currently doing this is through engaging our community around school district’s Vision - getting stakeholders involved, engaging our parents, students and community. It has been powerful to see parents and community members reciting our school district’s vision.  Safety Grants 1. Round 1 - $99,870.00 a. Security Cameras at each building b. TV monitors in each office / cameras placed on screen for entrances c. Radios d. Shatter-resistant film on windows in entrances

2 2. Round 2 - $182,000.00 - submitted on August 30th - amount based on per pupil rate of $55. Should hear in the beginning of October a. Additional security cameras $7,000.00 b. New access card reader system $63,000.00 c. New PA system at Parkview Middle School $14,000.00 d. Upgrade High School PA system $6,000.00 e. Shatter-resistant film on windows for entrances $19,000.00 f. New security door for Cormier’s entrance - $19,000.00 g. New windows at Parkview lower level - $42,000.00 h. Trauma training for High School and Cormier staff members - $11,000.00

J. Discussion/Presentation Items: 1. Student Recognition Guidelines: Nick Senger and Brian Nelsen presented the changes to the student recognition guidelines. Nelsen stated the administrative guidelines have been changed as requested. A copy is contained in the board packets. He inquired if the board had any questions on the guideline changes.  Have the banners been ordered? No they are still being proofed.  What is the timeline for the banners going up? We are working with Fast Signs. Once they are approved, the turnaround time for receiving the banners is approximately one month.  Will they look the same as the other banners? Yes they will.  Who is paying for the banners? The district.  What is the general timeline for hanging the banners? We are anticipating they will go up in the late fall (i.e. between sports seasons).  Some board members has spoken to a number of the students recognized on the banners, and they are excited and interested in coming back for the installation. Is there any type of presentation/ceremony being planned? At this point nothing has been planned. The high school administration has not been contacted by anyone interested in this type of event. Interested people should contact the high school administration.  Are there any proofs of the banners the board could see tonight? Senger stated they are all on his computer, and he did not have it with him at the meeting. He stated he could email them to the board later. Nelsen stated that in order to equitable to all students, the banner will be the same as the current ones with the exception of the organization they are tied to. If they are not tied to an organization, that space will be left blank.

2. Policy/Bylaw Update - first read: Kurt Weyers and Jennifer Bower recently met with Neola to review the latest updates to board policies and bylaws. There are a total of 59 policies being updated. The board will receive these policies for review and approval over three meetings. Weyers presented the first set of policies for a first read. The policies will return in October for a second read and final approval. Weyers stated a majority of the changes are small wording changes. Policies are being cleaned up to reflect the policies definitions list. Weyers opened the topic for discussion.  On policy 1460 the wording “all candidates for positions in which the employee will come in contact with children or prepared food” was removed. There is a concern that this should remain in the policy. It was explained that this policy is for administrators and the wording being removed does not pertain to their role.

K. Action Items: 1. Update Middle School Health Curriculum and Supporting Materials: Jill Kieslich stated that in April of 2017, the Human Growth and Development Committee shared their findings with the board and recommended the curriculum include the addition of the topics and consequences of human trafficking and sexting.

3 During the 17-18 school year, the curriculum was once again worked on by Sherry Craig (Parkview Health teacher) and Eric Miller (AHS Health teacher). Together they worked diligently to make sure the high school and middle school Health curriculums are congruent. Through this work, they updated the curriculum to include the topics of bullying and e-cigarettes. Both instructors brought a wealth of knowledge to the table. Through this process, it was determined that the middle school was in need of a new text book. Craig uses the text book as a resource along with many other supporting materials. Miller felt the high school text book and materials along with online resources and the information provided by the police liaison officers are adequate at this time. Kieslich commended the work of Craig and Miller. She stated they put in many hours to create a well thought out curriculum. Kieslich recommended the board approve the revised curriculum and materials for middle school and high school health. Discussion:  VanDeKreeke spoke about his experience in middle school health class. He clearly remembers the simulation of a coffee filter stained with nicotine from a cigarette. This demonstration made a huge impact on him and his views on smoking. He stated he was not sure if this type of demonstration is still used or if it can be used today. He inquired if anything similar is done with students? Craig stated that this particular demonstration is not used but similar ones are shared through video clips and visual aids like Mr. Gross Mouth. She stated the depending on the unit, she used different visuals and simulations to education and inform students. She stated that she has learned through end of the year course evaluations that student get the greatest impact from participating in hands on activities.  Craig stated that the curriculum added a focus on e-cigarettes. She stated the use of cigarettes has dropped BUT the use of e-cigarettes has drastically increases. She stated juuling ads target children by offering things like fun flavors. They make it easy for students to have and hide e-cigarette devices through their small packaging. Kieslich stated the FDA just reported that the use of e- cigarettes is growing in epic proportions.  Trondson inquired if cyber bullying is addressed in the bullying unit. Yes, cyber bullying (including the use of text and photos) is discussed. Student are taught ways to avoid cyber bullying. Before technology, student could leave bullying type situations behind when they left school and social setting involving this activity. Now they are connected 24/7. In the bullying unit, Students learn different ways to disconnect from these situations (i.e. turning off their devices at night and disconnecting from social media).  Do we offer any support or education for parents? Parkview has offered sessions for parents about social media and vaping. These sessions have been for parents only to help keep them aware of what is happening with children and what to look for.  Garrigan asked how much time is spent on the topic of depression and suicide. This topic is covered very thoroughly. Many resources are pulled in from social workers to student counselors. Students are provided various resources they are able to reach out for if needed. Every student seems to have a phone. There have been times that we have actually plugged the hotline number into a student’s phone so they have immediate access to somebody to talk to.  What is the cost for the text books and curriculum? $4,688.63 for 7th grade books and online materials. L. Board & Superintendent Communications:  Vyskocil stated she attended the Staff Welcome Back Session. The presentation by Joe was both amazing and emotional. She stated is was a great way to kick off a new year. She thanked everyone who was involved in bringing Joe to the district.  VanDeKreeke stated he recommended a friend’s son tour the high school. He did and through this tour enrolled in AHS. VanDeKreeke stated that both the student and family are very happy with his experience so far. VanDeKreeke thanks the high school staff and administration.

4  Hucek stated that the entire Parkview school did a practice ALICE drill on the second day of school. She thanks Brian Carter for work with Parkview staff and the evacuation site staff to make this drill a success. She praised the student for their part in the demonstration. The entire building was empty and at the evacuation site in 11 minutes.

Ashwaubenon School Board Meeting Date: October 24, 2018 Issue: First Reading of Policies Requested By: Kurt Weyers Attachments: POLICIES Policy 2131 - Academic Standards - Legislature has amended the academic standards, which are incorporated into policy. The revisions provided here reflect the legislative changes and should be adopted in order to have accurate policy language.

Policy 2412 - Homebound Instruction - The policy has been revised to reflect current law and standards as it relates to homebound instruction. This revision is recommended for consistency with the law.

Policy 2461 - Recording of IEP Team Meetings - The use of tape recorders at IEP meetings is not addressed in State or Federal law. The decision about whether parents may tape such meetings is left to the discretion of the local Districts. Any policy limiting or prohibiting a parent's right to tape record an IEP meeting should provide for exceptions if they are necessary to ensure that the parent is able to understand the IEP or the IEP process or to implement other parental rights. A policy limiting or prohibiting a parent's right to tape record IEP meeting involves complex issues of federal constitutional law. Also, it is noted that when recording an IEP meeting, it must be maintained by the district, it must be treated as a pupil record pursuant to State and Federal law.

Policy 3120.04 – Employment of Substitutes - The policy is revised to allow for either the employment of, or the contracting with a service to provide substitute teachers, and to account for the ever-expanding types of licensure available. The District’s interest is in having substitutes that are properly certified and preferably grade level and subject matter certified, but must retain flexibility to use any of various mechanisms for certification.

Revision is also made to clarify and make it easier for the District Administrator who has the authority to end a current assignment or to remove an individual from the substitute list altogether for any reason not arbitrary, capricious, or discriminatory. These revisions are recommended for clarity and consistency.

Policy 3139 & 4139 - Staff Discipline - An option has been added to the policy to allow for employment termination by the District Administrator unless Board action is required by law. A legal reference to the statutory grievance procedure has also been added to the policy. This revision is optional.

Policy 1630.01, Policy 3430.01 and Policy 4430.01 - Family & Medical Leave of Absence ("FMLA") - These policies were revised to clarify that, in circumstances where leave is governed solely by the federal Family and Medical Leave Act, an employee may take leave intermittently or on a reduced leave schedule after the birth of a child or placement of a child for adoption or foster care only if the employer agrees (as contrasted with intermittent leave based on a serious health condition of a child where intermittent leave is medically necessary). This revision is recommended for consistency with the law.

Policy 4440 - Job-Related Expenses - This policy has been revised to reflect that the District will identify an individual who will be responsible for determining the validity of job-related expenses. This revision is recommended for consistency with law and other policies.

Policy 5111 – Eligibility of Resident/Nonresident Students - Revisions to this policy are made to better describe residency requirements. Also, the policy is revised to eliminate the suggestion that Districts make determinations regarding the immigration status of potential students. This is not the purview of, nor a permissible exercise of local School Districts. Standard residency considerations apply to all student-age individuals, regardless of alienage (with the lone exception of student exchange programs through District-sponsored F-1 status or, in some cases, outside organization-sponsored J-1 status). This revision is recommended for consistency with the law.

Policy 5512 – Use of Tobacco by Students - In the continuing efforts to keep up with modern realities, including the constant evolution of student conduct requiring disciplinary or other correction action, this policy is revised to include prohibition on the use of nicotine patches and nicotine gum at the school. Note that possession and use of nicotine products by minors is already prohibited by Wisconsin law.

Policy 5516 – Hazing - This policy is revised to remove the requirement that the Hazing policy be distributed as presently required. There is no separate legal requirement that a hazing policy be created or disseminated; only the bullying policy is required. Hazing is a separate but often inter-related concept and therefore it is reasonable and good practice to have a policy prohibiting it, but the policy references Policy 5517 - Bullying and that policy is subject to annual distribution. The revision is recommended to avoid taking more responsibility than is required by law in terms of distributing the various policies to students, parents, etc.

Policy 5530 – Drug Prevention - Language has been added to this policy to be consistent with the requirements of Wisconsin Act 262, now reflected in Section 118.01(2)(d), Wis. Stats., with respect to the components of education regarding drug abuse issues. This revision is required for consistency with law.

Policy 5540 - The Schools and Governmental Agencies - This policy has been revised to reflect that a school official will attempt to contact the student's parent before law enforcement questions a student, unless specifically requested not to because such contact would unduly impede the investigation. The addition of the word attempt was included, because school personnel do not have a requirement to reach the parents prior to law enforcement questioning a student. It is being recommended that the following information be added to 5113 - Open Enrollment and 5200 - Attendance policies. These changed are recommended to clarify what is used to determined habitual truancy (tardiness) and the board authority to return a student to their resident district for habitual truancy reasons (Wis. Stats 118.51 (11).

Even though it is permitted in state statute, the following statement must be contained in board’s Open Enrollment policy and Attendance policy. It is being recommended the board approve adding it to Policy 5113 and Policy 5200 as noted below:

Under 118.51(11) Wis. Stats., if the non-resident Board determines that a student attending the non-resident school district under open enrollment is habitually truant from the non-resident school district during either semester in the current school year, the nonresident Board may prohibit the pupil from attending the non- resident school district under open enrollment in the succeeding semester or school year. When determining habitual truancy, a student’s overall attendance is taken into consideration (i.e. any absence from school without an acceptable excuse for part or all of five (5) or more days, including tardiness, on which school is held during a school semester).

Policy 5113 – Open Enrollment Program It is being recommended the board approved the following statement is added to page 3 of policy 5113:

ATTENDANCE/HABITUAL TRUANCY Under 118.51(11) Wis. Stats., if the non-resident Board determines that a student attending the non-resident school district under open enrollment is habitually truant from the non-resident school district during either semester in the current school year, the nonresident Board may prohibit the pupil from attending the non-resident school district under open enrollment in the succeeding semester or school year. When determining habitual truancy, a student’s overall attendance is taken into consideration (i.e. any absence from school without an acceptable excuse for part or all of five (5) or more days, including tardiness, on which school is held during a school semester).

Policy 5200 – Attendance At the September 12, 2018 board meeting, board had a first read of this policy recommending the following changes: The policy has been updated to reference revisions to the law which now permit, but do not require, delivery of notices under the law by way of electronic mail. The policy update is recommended to assure accuracy as to the permitted notice mechanisms, and must be updated to reflect that mailing notice is only permitted after telephone, personal contact, or email communication (unless the parent has refused email).

Since the first reading of this policy, additional changes are also being recommended per DPI review of a student’s appeal to a habitual truancy denial. It is being recommended the board approved the following information in green be added to pages 3 and 4 of policy 5200:

A student will be considered truant if s/he is absent part or all of one (1) or more days from school, including tardiness, during which the School Attendance Officer, principal, or a teacher has not been notified of the legal cause of such absence by the parent or guardian of the absent student. A student who is absent intermittently for the purpose of defeating the intent of the Wisconsin Compulsory Attendance Statute Sec. 118.15, Wis. Stats., will also be considered truant.

A student will be considered a habitual truant if s/he is absent from school without an acceptable excuse for part or all of five (5) or more days, including tardiness, on which school is held during a school semester.

Habitual Truancy and students attending under open enrollment

Under 118.51(11) Wis. Stats., if the non-resident Board determines that a student attending the non-resident school district under open enrollment is habitually truant from the non-resident school district during either semester in the current school year, the nonresident Board may prohibit the pupil from attending the non-resident school district under open enrollment in the succeeding semester or school year. 5113 - OPEN ENROLLMENT PROGRAM (Inter-District)

The School District ("District") will participate in the Wisconsin Public School Open Enrollment Program in accordance with applicable law and the relevant policies and rules of the District, all as amended from time-to-time.

DEFINITIONS

The following definitions will apply to the District's Open Enrollment Program.

A. Non-Resident District

A school district located in Wisconsin which is not a student's district of residence.

B. Non-Resident Student

A student who does not reside within the geographic boundaries of the District and who seeks admission to this District under the Open Enrollment Program.

C. Tuition Student

A non-resident student who attends school in the District and pays tuition in accordance with State law.

D. Full-Time Enrollment

A student is enrolled for the entire school day and receives all of his/her required education in this District.

E. Class Size

The District's determination of the maximum number of students who can be accommodated properly in a particular classroom without jeopardizing the quality of the instructional program and mitigating circumstances for a particular school, class, or program, including enrollment projections established by the Superintendent.

F. Program Size

The enrollment or size restrictions in a specific program within a class or building. The District reserves the exclusive right to establish program size and to limit enrollment based upon the capability to properly allocate available resources, create and maintain a proper learning environment, and comply with contracts, grants, and applicable laws and regulations.

G. Resident Student

A student who is a legal resident of this District and is consequently entitled to attend school in this District in accordance with Policy 5111 - Eligibility of Resident/Non-resident Students.

Decisions on non-resident open enrollment applications will be based only on the following criteria:

1. The availability of space in the schools, programs, classes, or grades within the District. The School Board shall determine during a regular meeting each January the number of regular education and special education spaces available. In determining the amount of space available, the District will count resident students, students attending the District for whom tuition is paid under 121.78(1)(a), Wis. Stats., and may include in its counted occupied spaces students and siblings of students who have applied under Section 118.51(3)(a) or 118.51(3m)(a) and are already attending public school in the District.

Other factors the Superintendent may consider in determining the availability of space include:

a. District practices, policies, procedures or other factors regarding class size ranges for particular programs or classes.

b. District practices, policies, procedures or other factors regarding faculty-student ratio ranges for particular programs, classes or buildings.

c. Enrollment projections for the schools of the District which include, but are not limited to, the following factors: the likely short and long-term economic development in the community, projected student transfers in and out of the District, preference requirements for siblings of non-resident open enrollment students, the required length of K-12 attendance opportunities for open enrollment students and current and future space needs for special programs, laboratories (e.g. in technology or foreign languages) or similar District educational initiatives.

2. Whether an applicant for a pre-kindergarten, four (4) year old kindergarten, early childhood or school operated day care program resides in a district which offers the program for which application is made.

3. Whether the non-resident student has been expelled from any school district within the current school year or the two (2) preceding school years, or is pending any disciplinary proceeding, based on any of the following activities:

a. Conveying or causing to be conveyed any threat or false information concerning an attempt or alleged attempt being made or to be made to destroy school property by means of explosives.

b. Engaging in conduct while at school or under school supervision that endangered the health, safety or property of others.

c. Engaging in conduct while not at school or while not under the supervision of a school authority that endangered the health, safety, or property of others at school or under the supervision of a school authority or of any school employee or Board member.

d. Possessing a dangerous weapon (as defined in Section 939.22(10), Wis. Stats.) while on school property or under school supervision.

Notwithstanding the Board’s acceptance of a non-resident student’s application, the Board may withdraw acceptance if, prior to the beginning of the first school year in which the non-resident student will attend a school in the District, s/he is determined to fall under paragraph B. 3.

The Board may request a copy of a non-resident student’s disciplinary records from the resident School Board.

The resident Board shall provide to the nonresident Board a copy of any expulsion order or findings, a copy of any pending disciplinary proceedings, a written explanation of said proceeding, the length of the expulsion or possible outcomes of a pending proceeding, and/or such records as permitted by law.

4. Whether the special education program or related services described in the non-resident student’s individualized education program ("IEP") are available in the District. Funding for the education of students with disabilities will be made to the non-resident school district by the Department of Public Instruction in accordance with State law.

5. Whether there is space available in the District to provide the special education or related services identified in the non-resident student’s IEP, after consideration of class size limits, student- teacher ratios, and enrollment projections.

Stats. or identified by his or her resident school board under 115.77(1m)(a) Wis. Stats. , but not yet evaluated by an individualized education program team.

(Note: If a non-resident student’s IEP is developed or changed after starting in the District, and it is then discovered that the District does not have necessary programs available or does not have space in the special education program, the District may notify the student’s parent and the student’s resident Board. If such notice is provided, the non-resident may be transferred to his/her resident school district.)

7. If the Board has made a determination that a non-resident student attending the District under the open enrollment program is habitually truant from the District during either semester of the current or previous school year, the Board may prohibit the student from attending in the succeeding semester or school year.

B. Reapplication Procedures

The Board will not require accepted non-resident students to reapply under the open enrollment policy when the non-resident student enters middle school, junior high school or high school. A non-resident student may be required to reapply only once.

C. Transportation

The parents of a student attending a non-resident school district will be solely responsible for providing transportation to and from the school site unless the non-resident student is a special education student and transportation is required by his/her IEP.

ALTERNATIVE APPLICATION PROCEDURES

The parent of a non-resident student who wishes to attend a school in the District may apply at any time throughout the year by submitting an application under the alternative application procedure if the student satisfies at least one (1) of the statutory criteria and has not applied to more than three (3) non-resident school districts. Applications for open enrollment under the alternative application procedure for enrollment in the current school year will be evaluated based on the District’s policy in place prior to th start of that school year (July 1st), which may be accessed here.

General Provisions

A. A student, who has been accepted under this program, who has not met the academic prerequisites for participation in a particular program in which the student wishes to enroll shall not be placed in that program.

B. The District's Policy 2260 – Nondiscrimination and Access to Equal Educational Opportunity shall apply to all applicants under this program. In addition, the District will not discriminate on the basis of an applicant's intellectual, academic, artistic, athletic, or other ability, talent, or accomplishment, or based on a mental or physical disability, except as provided for in the statute authorizing this program.

5200 - ATTENDANCE

State law requires the Board of Education to enforce the regular attendance of students. Further, the Board recognizes that the District's educational program is predicated upon the presence of the student and requires continuity of instruction and classroom participation. The regular contact of students with one another in the classroom and their participation in a well-planned instructional activity under the tutelage of a competent teacher are vital to this purpose.

All children between six (6) and eighteen (18) years of age shall attend school regularly during the full period and hours, religious holidays excepted, that the school in which the child is enrolled is in session until the end of the term, quarter, or semester of the school year in which the child becomes eighteen (18) years of age, unless they fall under an exception under State law, this policy, or administrative guideline issued under this policy. A child who is enrolled in five (5) year-old kindergarten shall attend school regularly, religious holidays excepted, during the full period and hours that kindergarten is in session until the end of the school term.

Parent or Guardian Written Excuse Required

The Superintendent shall require, from the parent or guardian of each student or from an adult student, who has been absent for any reason a written, signed, dated statement stating the reason for the absence and the time period covered by the absence. The Board reserves the right to verify such statements and to investigate the cause of each single absence.

School Attendance Officer

The Superintendent shall designate an administrator at each school to be the School Attendance Officer. The School Attendance Officer shall perform any duties and responsibilities s/he is required to perform by State law, this policy, and any administrative guidelines issued by the school. The duties of the School Attendance Officer shall include, but not be limited to, the following.

A. Determining daily from attendance reports submitted by teachers which students enrolled in the school are absent from school and whether the absence is excused.

B. Submitting to the Superintendent, on or before August 1st of each year, a report of the number of students enrolled in the school who were absent in the previous year and whether the absences were excused. The Superintendent shall then submit this information to the State Superintendent.

C. Providing student attendance information to individuals and agencies for purposes authorized by State law and the Board's Policy 8330 - Student Records.

Excused Absences

As required under State law, a student shall be excused from school for the following reasons:

A. Physical or Mental Condition

The student is temporarily not in proper physical or mental condition to attend a school program.

B. Obtaining Religious Instruction

C. Permission of Parent or Guardian

The student has been excused by his/her parent or guardian before the absence for any or no reason. A student may not be excused for more than ten (10) days per school year under this paragraph and must complete any course work missed during the absence. Examples of reasons for being absent that should be counted under this paragraph include, but are not limited to, the following:

1. professional and other necessary appointments (e.g., medical, dental, and legal) that cannot be scheduled outside of the school day

2. to attend the funeral of a relative

3. legal proceedings that require the student's presence

4. college visits

5. vacations

D. Religious Holiday

For observance of a religious holiday consistent with the student's creed or belief.

E. Suspension or Expulsion

The student has been suspended or expelled.

F. Program or Curriculum Modification

The Board has excused the student from regular school attendance to participate in a program or curriculum modification leading to high school graduation or a high school equivalency diploma as provided by State law.

G. High School Equivalency – Secured Facilities

The Board has excused a student from regular school attendance to participate in a program leading to a high school equivalency diploma in a secured correctional facility, a secured child caring institution, a secure detention facility, or a juvenile portion of a county jail, and the student and his/her parent or guardian agree that the student will continue to participate in such a program.

H. Child at Risk

The student is a "child at risk" as defined under State law and is participating in a program at a technical college on either a part-time or full-time basis leading to high school graduation, as provided under State law.

A student may be excused from school, as determined by the School Attendance Officer, or his/her designee, for the following reasons:

A. Quarantine

Quarantine of the student's home by a public health officer.

B. Illness of an Immediate Family Member

The illness of an immediate family member.

C. Emergency

An emergency that requires the student to be absent because of familial responsibilities or other appropriate reasons.

Unexcused Absences

The Superintendent shall develop administrative guidelines to address unexcused absences.

The Board authorizes, but does not encourage the Superintendent, to suspend a student from a particular class or from school if sincere efforts by the staff and parents or guardians cannot rectify the pattern of absence. In keeping with its philosophy, the Board supports efforts to provide for out-of-school alternative educational opportunities for truant students rather than to heighten the effects of absence through suspension.

Late Arrival and Early Dismissal

It is necessary that a student be in attendance throughout the school day in order to benefit fully from the educational program of the District.

The Board recognizes, however, that from time-to-time compelling circumstances require that a student be late to school or dismissed before the end of the school day.

As agent responsible for the education of the children of this District, the Board shall require that the school be notified in advance of such absences by written or personal request of the student's parent or guardian, who shall state the reason for the tardiness or early dismissal. Justifiable reasons shall be determined by the principal.

If one parent or guardian has been awarded custody of the student by the courts, the parent or guardian of custody shall provide the school with a copy of the custody order and inform the school in writing of any limitations in the rights of the noncustodial parent or guardian. Absent such notice, the school will presume that the student may be released into the care of either parent or guardian.

No student who has a medical disability which may be incapacitating may be released without a person to accompany him/her.

No student shall be released to anyone who is not authorized such custody by the parents or guardians.

Truancy Plan

The Board will issue a Truancy Plan based upon the recommendations of the County Truancy Committee convened under State law, the Board's policies and procedures, and applicable provisions of State law. The Board will review and, if appropriate, revise the Truancy Plan at least once every two (2) years.

The Truancy Plan will include, at a minimum, the following:

A. procedures to be followed for notifying the parents or guardians of the unexcused absences of a student who is truant or a habitual truant and for meeting and conferring with such parents or guardians

B. plans and procedures for identifying truant children of all ages and returning them to school, including the identity of school personnel to whom a truant child shall be returned

C. methods to increase and maintain public awareness of and involvement in responding to truancy within the school district

D. a provision addressing the immediate response to be made by school personnel when a truant child is returned to school

E. the types of truancy cases to be referred to the District Attorney and the time periods within which the District Attorney will respond to and take action on the referrals

F. plans and procedures to coordinate the responses to the problems of habitual truants, as defined under Sec. 118.16(1)(a), Wis. Stats., with public and private social services agencies

G. methods to involve the truant child's parent or guardian in dealing with and solving the child's truancy problem

A student will be considered truant if s/he is absent part or all of one (1) or more days from school, including tardiness, during which the School Attendance Officer, principal, or a teacher has not been notified of the legal cause of such absence by the parent or guardian of the absent student. A student who is absent intermittently for the purpose of defeating the intent of the Wisconsin Compulsory Attendance Statute Sec. 118.15, Wis. Stats., will also be considered truant.

A student will be considered a habitual truant if s/he is absent from school without an acceptable excuse for part or all of five (5) or more days, including tardiness, on which school is held during a school semester.

Habitual Truancy and students attending under open enrollment

Stats., if the non-resident Board determines that a student attending the non-resident school district under open enrollment is habitually truant from the non-resident school district during either semester in the current school year, the nonresident Board may prohibit the pupil from attending the non-resident school district under open enrollment in the succeeding semester or school year. When determining habitual truancy, a student’s overall attendance is taken into consideration (i.e. any absence from school without an acceptable excuse for part or all of five (5) or more days, including tardiness, on which school is held during a school semester).

Notice of Truancy

The School Attendance Officer shall notify a truant student's parent or guardian of the student's truancy and direct the parent or guardian to return the student to school no later than the next day on which school is in session or to provide an excuse for the absence. The notice under this paragraph shall be given before the end of the second school day after receiving a report of an unexcused absence. The notice mayshall be made by electronic communication, personal contact, or telephone call, or 1st class mailif possible, and a written record of this notice shall be kept. The School Attendance Officer shall attempt to give notice by personal contact, telephone call, or, unless the parent has refused to receive electronic communication, notice by 1st class mail may be given.In the event that an attempt is made to contact the parent or guardian by personal contact or telephone call and the parent or guardian is not reached, notice may be provided by 1st class mail. If such notice is not effective, notice shall be made by mail. This notice must be given every time a student is truant until the student becomes a habitual truant.

Notice of Habitual Truancy

When a student initially becomes a habitual truant, the School Attendance Officer shall provide a notice to the student's parent or guardian, by registered or certified mail, or by 1st class mail. The School Attendance Officer may simultaneously notify the parent of the habitually truant student by an electronic communication. The notice must contain, which contains the following:

A. a statement of the parent's or guardian's responsibility under State law to cause the student to attend school regularly

B. a statement that the parent, guardian, or student may request program or curriculum modifications for the student under State law and that the student may be eligible for enrollment in a program for children at risk

C. a request that the parent or guardian meet with the appropriate school personnel to discuss the student's truancy The notice shall include the name of the school personnel with whom the parent or guardian should meet, a date, time, and place for the meeting and the name, address, and telephone number of a person to contact to arrange a different date, time, or place. The date for the meeting shall be within five (5) school days after the date that the notice is sent, except that with the consent of the student's parent or guardian the date for the meeting may be extended for an additional five (5) school days.

D. a statement of the penalties, under State law or local ordinances that may be imposed on the parent or guardian if s/he fails to cause the child to attend school regularly as required by State law

The School Attendance Officer will also continue to notify the parent or guardian of a habitual truant's subsequent unexcused absences.

Referral to the District Attorney

Truancy cases will be referred to the District Attorney as provided in the County Truancy Committee Plan. The School Attendance Officer will ensure that appropriate school personnel have done the following before any case is referred to the District Attorney:

A. met with the student's parent or guardian to discuss the student's truancy or attempted to meet with the student's parent or guardian and received no response or were refused

B. provided an opportunity for educational counseling to the student to determine whether a change in the student's curriculum would resolve the student's truancy and have curriculum modifications under State law

C. evaluated the student to determine whether learning problems may be a cause of the student's truancy and, if so, have taken steps to overcome the learning problems, except that the student need not be evaluated if tests administered to the student within the previous year indicate that the student is performing at his/her grade level

D. conducted an evaluation to determine whether social problems may be a cause of the student's truancy and, if so, have taken appropriate action or made appropriate referrals

Note that paragraph A. is not required if the meeting between school personnel, the student, and the student's parent or guardian, which was requested in the Notice of Habitual Truancy to the parent or guardian, did not occur within ten (10) school days after the Notice was sent. Make-up Course Work and Examinations

Excused Absences

A student whose absence from school was excused, except for an expelled student, shall be permitted to make-up course work and any quarterly, semester, or grading period examinations missed during the absences when they return to school. It is the student's responsibility to contact his/her teachers to determine what course work and examinations must be made-up. Teachers shall have the discretion to assign substitute course work and examinations. Teachers shall also have the discretion to specify where and when examinations and course work shall be completed, including outside regular school hours. The time for completing the work shall be commensurate with the length of the absence, unless extended by the principal based upon extenuating circumstances.

Unexcused Absences

Credit in a course or subject shall not be denied solely because of a student's unexcused absences from school.

Students with unexcused absences shall be permitted to make-up course work and any quarterly, semester, or grading period examinations missed during the absence if the student is at risk of receiving no credit in a course or subject if the work is not made up.

Subject to the immediately preceding two (2) paragraphs, credit may, but is not required to be given for the completion of make-up work. Further, credit for make-up work may be given only after the student has satisfied consequences imposed for unexcused absences. The extent to which make-up credit is given shall be determined on a case-by-case basis by the principal and the respective teachers.

If make-up work has been assigned, it is the student's responsibility to contact his/her teachers to determine what course work and examinations must be made-up. Teachers shall have the discretion to assign substitute course work and examinations. Teachers shall also have the discretion to specify where and when examinations and course work shall be completed, including outside regular school hours. Superintendent Guidelines

The Superintendent shall develop administrative guidelines concerning the attendance of students which:

A. ensure a school session which is in conformity with the requirement of the law;

B. ensure that students absent for an excusable reason have an opportunity to make-up work they missed;

C. govern the keeping of attendance records in accordance with State law;

D. facilitate implementation of the Truancy Plan;

E. identify the habitual truant, investigate the cause(s) of his/her behavior, and consider modification of his/her educational program to meet particular needs and interests;

F. ensure that any student who, due to a specifically identifiable physical or mental impairment, exceeds or may exceed the District's limit on excused absence is referred for evaluation for eligibility either under the Individuals with Disabilities Education Act (IDEA) or Section 504 of the Rehabilitation Act of 1973 and Chapter 115, Wis. Stats.;

G. provide that a student's grade in any course is based on his/her performance in the instructional setting and is not reduced for reasons of conduct. If a student violates the attendance or other rules of the school, s/he should be disciplined appropriately for the misconduct, but his/her grades should be based upon what the student can demonstrate s/he has learned;

H. ensure that all parents and students are informed of the District's Attendance Policy and related guidelines;

I. enable the School Attendance Officer to perform his/her duties under State law and this policy; and

J. address unexcused absences.

This modification is recommended for consistency with Wisconsin Statute 120.07, Wis. Stats..

Policy 0161 – Parliamentary Authority - This revision has been made to provide an option for additional flexibility that is acknowledged in Roberts Rules of Orders for smaller Boards, as opposed to large assemblies. In addition, expanded disclaimer language has been added to avoid challenges to Board action on the basis of procedural objections. These modifications are recommended but not required.

Policy 0164.2 – Special Meetings Policy 0165.3 - Special Meetings (Deleted) Policy language regarding special meetings have been combined into one policy for clarity and to better represent the distinctions between special meetings in common school districts and unified districts. Appropriate legal references have been added to the policy. This revision is recommended for clarity and consistency with statute.

Policy 1213 – Student Supervision and Welfare - Policy language was clarified to indicate that it pertains exclusively to administrators rather than including administrative assistants who are support staff members. This revision is recommended for clarity.

Policy 1460 - Physical Examination - This policy has been revised to reflect the requirement that an administrator who has been offered employment will undergo a tuberculosis screening questionnaire or other tests in accordance with applicable law. Further, the policy has been revised to require that any non-employment recommendations should be directly related to the defined job responsibilities and a reasonable accommodation will not allow the employee or prospective employee to adequately fulfill those responsibilities.

Policy 3160 and 4160 - Physical Examination - This policy has been revised to add a drafting note regarding the legality of blanket pre-employment drug testing. Further, the policy has been revised to require that any non-employment recommendations should be directly related to the defined job responsibilities and a reasonable accommodation will not allow the employee or prospective employee to adequately fulfill those responsibilities.

Policy 1461 - Unrequested Leaves of Absence/Fitness for Duty - This policy has been revised to reflect that it is about administrators who may be unable to perform their duties.

Policy 1623 - Section 504 / ADA Prohibition Against Disability Discrimination - Reference to "work days" has been changed to "business days" to be consistent with other policies concerning complaints processing. Note that the use of "working days" is used in some statutory timelines, as is the term "business days". Both terms are defined as any day of the week excluding weekends or recognized holidays. This revision is recommended for consistency.

Policy 2270 – Religion In The Curriculum - Language has been removed from the policy which could be construed as inconsistent with the Board’s authority. This revision is recommended for consistency with law and other policies.

Policy 2271 - Early College Credit Program - The policy, as noted above, is revised to note that notice of ECCP options must first be provided to 8th grade students, although participation is limited to high school students. The policy is also revised to remove an incorrect statutory reference.

Policy 2271.01 - Start College Now Program - Districts are provided here with a policy, as a sub-policy to the Early College Credit Program that governs the Start College Now Program. This program, like the Early College Credit Program, took effect July 1, 2018, and first applies to participation in the Fall of 2018. Note that a student must notify the Board by March 1, 2018 of the student’s intent to enroll in a technical college under the program in the upcoming Fall. This was the same procedure that took place for enrollment at a technical college under the Youth Options program.

Policy 3120 - Employment of Professional Staff - This policy has been revised to reflect that the Board, by a majority vote, is required to approve the employment of all employees. This revision is recommended for consistency with law and other policies.

Policy 1422, Policy 3122 & Policy 4122 - Nondiscrimination and Equal Employment Opportunity - This policy has been revised to remove the language regarding collective bargaining agreements and encourage the use of the Districts Employee Handbook regarding sanctions and monitoring.

The school counselors and I reviewed the requests and after reviewing Board Policy and the eligibility requirements under the program statute and the administrative rules of the Department of Public Instruction, it was determined that all of these students are eligible for participation in the program. Recommendation: It is recommended these students be approved for enrollment in the Early College Credit program at the post-secondary institutions noted in their applications.

Explanation: We have final student counts and aid numbers from the State, so we have updated our budget to reflect the changes. We have made additional budget adjustments (see attachment for details) to present a balanced budget.

The attached report shows an increase in total students of 29 attending the District. This includes an increase in open enrollment students attending Ashwaubenon School District of 42 and an increase of 21 Ashwaubenon resident students attending other districts.

We are making reductions to our Fund 10 estimated budget of $459,286. This will adjust the total budget to $32,702,222 for the 2018-19 school year. The budget is up 1.84% from the 2017-18 budget.

In Fund 27 (Special Education Fund) the budget is down $58,581.99 from previous budget estimates. The total Fund 27 budget of $4,720,790.35 is up 0.24% from the 2017-18 budget.

We are also proposing an increase of $140,000 in the Fund 39 property tax levy. This will provide funding to make all future payments to the referendum approved debt. In other words, there will be no future debt levy for the existing bonds approved through high school and elementary referenda. When those referenda were passed the public was told that we would levy through 2022, so we are able to eliminate the debt levy 3 years earlier than originally planned.

As a result of these budget changes, the total property tax levy will be $16,466,315. This is $98,797 less than approved at the Annual Meeting. The total levy is $1,355,647 below the 2017-18 levy with the largest factor being a reduction in the Debt Service levy which is down $1,210,001 from last year.

Recommendation: We recommend that you approve the budget as presented.

Explanation: As a result of the proposed budget changes, the total property tax levy will be $16,466,315. This is $98,797 less than approved at the Annual Meeting.
