FORCING RESCUE: THE LANDSCAPE OF HEALTH CARE PROVIDER OBLIGATIONS TO TREAT PATIENTS Barry R. Furrowt INTRODUCTION. A POOR CITIZEN living in America suffers a range of indigni- ties-poor housing and diet, limited educational opportunities, a high risk of becoming a crime victim. Restricted access to health care is another such indignity, a fatal one in the wrong circum- stances. Between 1975 and 1986 the proportion of low income per- sons covered by Medicaid fell from 63% to 38%, primarily due to tightened eligibility requirements.1 During this same period the number of Americans living at or above 125% of the federal pov- erty level increased by 27%.2 Hospitals' abilities to subsidize indi- gent care by cost-shifting to private payers have diminished, as they are forced to negotiate discounts with insurers and employers.3 Employers now offer fewer and less extensive health care options to their employees, including reduced dependent coverage. Those who lack health insurance have trouble finding care.4 A 1986 study found that nearly 14 million people said they did not even seek health care because they would not be able to afford it.' HEALTH MATRIX [Vol. 3:31 to receive prenatal care, less likely to have their blood pressure checked, and less likely to see a physician even when they have seri- ous symptoms."6 When uninsured patients do seek care from hos- pitals, they are often turned away or superficially treated and transferred to stressed and overburdened public hospitals.' When they do receive health care in hospitals, indigent patients experience a higher mortality rate because they do not receive as many high- cost procedures.8 America has a health care access problem that makes us the embarrassment of modem industrialized societies. Yet, ironically, Americans seem to view access to health care as almost a "right", an egalitarian value that led to political passage of the Medicare and Medicaid programs.9 These programs consume a significant portion of state and federal budgets, in contrast to housing and food policies characterized mostly by their penuriousness. Access to health care, with government help, has become part of American political con- sciousness.10 A principle of egalitarianism has at times driven na- tional health policy, fueled by public discomfort at the thought of not providing the poor and the elderly with a financial net when they face catastrophic illness and its expense. At the same time, the strong libertarian streak imbedded in the American character has often braked the ship of state, diverting impulses toward consistent funding for the poor by supporting a conception of health care as a service best provided by physicians and providers within the param- 6. "Trust us," resonate doctors at the frequency of libertarianism. "We are professionals, driven by our fiduciary duties to help you." "Grant us respect," chant hospitals, "for we are charities with all that implies." "Leave politics out of health care," the full chorus repeats in a basso ostinato, "for we are nonpolitical." The realm of "rights" talk offers a useful frame of reference for discussing the current state of access to health care. Judge-made and statutory requirements imposed on health care providers-to rescue patients from a crisis, to fund free care, to mandate bene- fits-are "rights"-based approach to health care access. Under what circumstances, then, are physicians, health care providers, and insurers compelled to treat patients (or pay for their treatment) at the risk of some legal penalty for failure to comply? What moral vision of health care obligations, unifies these obligations imposed on providers by regulatory schemes, with insurance law obligations imposed by the courts, the handling of "bad debts" by taxing au- thorities, tax exemptions, and judicially imposed rules? Finally, what more can be done to promote access to necessary health care? The current debate over national health insurance may lead to broad-based reform of the American system. Or it may not. Com- prehensive reform of our expensive, and yet, inadequate, health care system awaits the commitment of a new President facing a powerful array of interest groups. Even if some system reform results from the efforts of a new administration, "rescue" obligations will still need to be explored and expanded. This article will pursue a "rights"-based approach, unfashionable in an era of efficiency, scarce resources, and sympathy for constraints on health care pro- viders. The exquisite sensitivity to the world of scarce resources, often displayed by analysts, too readily concedes to providers their desires to retain as much autonomy as possible and to prevent fur- ther slippage away from the era of the blank check and the in- dependent provider. Affirmative obligations by courts, tax collectors, and other agents of the state, while certainly inefficient 11. The social legislation of the sixties and seventies pushed America toward an egalita- rian model of health care delivery. A uniquely American phenomenon, however, has been the endeavor to extract an egalitariandistribution of health care from a delivery system still firmly grounded in libertarianprinciples... in no other modem society espousing egalitarian princi- ples for the distribution of health care have physicians and hospitals been quite so free as they have in the United States to organize their facilities as they see fit, to practice medicine as they see fit, and to price their services as they see fit. HEALTH MATRIX [V'ol. 3:31 and problematic at times, have advantages. Such obligations tighten the screws on the health care industry, force physicians to better define their professional responsibilities, and stretch the re- sources of providers and insurers in socially valuable directions. These pressures may speed reform of financial and structural barri- ers to access. More indigent individuals will ultimately receive more and better care than at present, through expanded obligations of providers to care for patients-to "rescue" them from their dis- tress. 2 Such obligations are not imposed by agents of the state out of thin air; they are grounded in the definition of health profession- alism, the images and promises projected by providers, and the con- crete expectations created. They are therefore morally justifiable, and as such, not simply conscription without justification. A. The Definition of "Rescue" A duty to rescue is an enforceable legal obligation to help some- one out of a situation of peril without a specific prior agreement to do so and without the promise of compensation.

United States', which limited the situations in which mail and wire fraud cases may be premised on violations of the "intangible right to honest services," has the potential to alter the future of health care fraud enforcement. To be clear, Skilling was not a healthcare case. Rather, the litigation stemmed from the investigation of Enron's former CEO, Jeffrey Skilling, who was accused of engaging in a conspiracy to commit honest services wire fraud as well as multiple forms of securities-related fraud. In rejecting a vagueness challenge to the honest services theory, however, the Court read the statute in a very narrow way that puts kickbacks and bribery cases squarely in the crosshairs, an approach that may have serious implications for healthcare fraud.

The now well-documented and contemporaneous failures of the war on drugs and the movement to deinstitutionalize people with serious mental illness and intellectual disabilities illuminate the need for a cohesive response among system actors to society’s ills. As you read this report, it will be clear to you that the money and resources spent rooting out and arresting people suffering from illness and addiction are far better reserved for finding alterna- tives that connect them to treatment and care. Otherwise, the burden is placed on law enforcement officers to provide a means of relief or otherwise send sick and impoverished people to overcrowded cells and through the wringer of the criminal justice system. Recent national health care reform and bipartisan calls for criminal justice reform present an opportunity to course correct. Our public services must bet- ter align themselves to address the health disparities that arise from poverty and the lack of proper treatment and care. In the case of Gloucester, Massachu- setts—which had seen an uptick in heroin-related deaths—the police chief has offered the city’s precincts as sanctuary to people with drug addictions where they can be directly connected to treatment without fear of arrest or incarcera- tion.

THORNTON$ FORTY years ago Bohlen expressed the view that "There is no dis- tinction more deeply rooted in the common law and more fundamental than that between misfeasance and non-feasance, between active mis- conduct working positive injury to others and passive inaction, a fail- ure to take positive steps to benefit cthers, or to protect them from harm not created by any wrongful act of the defendant." 1 The line between "active misconduct" and "passive inaction" is not easily drawn. The range of human conduct theoretically susceptible of tort consequence runs from the zenith of clearly affirmative mis- conduct (misfeasance) to the nadir of clear inaction (nonfeasance), but there exists an area of shadow-land where misfeasance and non- feasance coalesce. The existence of this shadow-land is well illustrated by Bohlen's famous example. 2 For one to use a chattel known to be defective in such a way as to create a serious risk of harm to others is palpably a misfeasance. On the other hand a failure to take steps to provide protection for people who come on one's premises without in- vitation and without permission is patently passive inaction, a non- feasance. But between those extreme cases consider a median situation where one uses a chattel for a particular purpose without having ascer- tained by inspection or othenvise whether it is fit for that purpose, with knowledge that the article, if defective, will create a serious risk of harm to others. Here there exists an admixture of nonfeasance and misfeasance.

Public health law issues range from narrow questions of legal interpretation to complex matters involving public health policy, social justice and ethics. Law as a public health tool Legal tools such as statutes, regulations and litigation have played a vital role in historic and modern public health achievements including advances in infectious disease control, food safety, occupational health, injury prevention and emergency preparedness and response. For example, local governments have passed clean indoor air legisla- tion to address tobacco as a health hazard, state courts have upheld vaccination mandates and federal regulations have established vehicle performance crash standards to promote motor vehicle safety.3 Sources of public health law Legal authority relevant to population health comes from five basic legal sources and from every level of govern- ment. In addition to the U.S. Constitution, which applies nationally, all 50 states and many tribal and territorial governments have adopted constitutions.

LINDEN* In the past, tort law has displayed a reluctance to impose a duty to rescue or to compensate rescuers injured during a rescue attempt Furthermore, tort liability has been imposed upon would-be rescuers whose incompetence has led to an abortive attempt. Professor Linden argues that this reluctance to promote rescue is out-dated in a modern society which espouses humani tarian ideals. The author examines Canadian and English jurisprudence to demonstrate the recent recognition of the need to encourage and compensate Good Samaritans. New tort duties to render aid, which have been fashioned by analogy to criminal legislation, are analysed as well as the rescuer's duty which arises once the rescue has been undertaken. Professor Linden also dis cusses the applicability of the principle of voluntary assumption of risk to a res cuer's claim for compensation for injuries sustained during the course of the res cue. The author concludes by suggesting that the concept of contributory negligence be used to dissuade rash rescue attempts in place of the current judicial practice of complete denial of compensation. Everyone admires a rescuer and a Good Samaritan. The common law, however, in years gone by did not go out of its way to reward such conduct. A rescuer injured while attempting to save someone in peril used to be denied tort recovery. Someone who acted as a Good Sama ritan might also be mulcted in damages if his effort was bungled. At the same time, no one was obligated to render assistance, even though he could do so without danger to himself.

Not surprisingly, clever fraudsters view the healthcare industry as a lucrative and attractive hotspot for illegal activity. Although federal and state governments have increased their funding and prosecu- tion efforts relating to healthcare fraud, this fraud continues to be a major threat to the U.S. economy and every patient and consumer. The impact of healthcare fraud is substantial and far-reaching. Healthcare fraud in the U.S. affects not only the government, but also insurance companies, patients, healthcare providers, and con- sumers. This Article examines the types of healthcare fraud and the major federal laws used to combat this type of fraud.

    Malpractice and Emergency Medicine Walter Kuhn, M.D., FACEP Every Emergency Physician fears being sued. Unfortunately, the practice of Emergency Medicine is high risk and malpractice claims stemming from emergency care number about 20% of all claims occurring in hospitals. The Emergency Department is the third riskiest area of the hospital following the operating room and the delivery suite. Malpractice premiums paid by Emergency Physicians have risen dramatically over the last years with a 200 % rise in some States. Lawsuits against Emergency Physicians are not nuisance claims: more than half of legitimate claims involve serious disability or death. Surprisingly, the big payoffs do not go for the missed hard-to-diagnose Zebra conditions. They come from missed bread-and-butter cases such as missed M.I., ectopic pregnancy, appendicitis, meningitis, missed fractures and soft tissue foreign bodies. Half of all patients who file successful lawsuits met standard criteria for hospital admission, yet serious illness was not even considered by the Emergency Physician. As is often said, it is not the one you anticipate that gets you into trouble, but the one you never expect. In other words, if you knew or thought that a patient would have a bad outcome, you would have instituted means to protect both your patient and yourself. Understanding the Law There are two major bodies of legal action; criminal and civil. A criminal action is one in which the state or government sues an individual for a wrongdoing considered against public interest.
