ARTICLE I– NAME Section 1: The name of this organization shall be 91.3 FM WUNH, hereafter referred to as WUNH. Section 2: The officers of WUNH shall make up the Executive Board of WUNH.

ARTICLE II– PURPOSE Section 1: The purpose of this organization shall be to broadcast programming consisting of music, sports and talk shows meant to both entertain and inform listeners. Section 2: The purpose of the Executive Board is to ensure the efficient operation and control of WUNH and all of its related activities.

ARTICLE III– MEMBERSHIP Section 1: The general body of this organization may be comprised of both UNH students and non UNH students alike. WUNH membership of Non Student Activity Fee (Non­SAF) paying members may not exceed 25%. Membership will be divided into 3 categories, as listed below in Sections 2 and 7 Section 2: The process for becoming a full member of WUNH is as follows: (1) Complete required training hours and tasks as designated by the Chief Announcer. (2) Complete a clearance “tape” to be approved by Chief Announcer. (3) Pass the Engineering Clearance test, with content and passing grade determined by WUNH’s Chief Engineer. (4) Submit a signed copy of the Membership Agreement to the General Manager. Section 3: The requirements for maintaining membership in WUNH are as follows: (1) Annual passing of the Engineering Clearance Test (2) Maintain a signed copy of the Membership Agreement with the General Manager. Section 4: The privileges and responsibilities of membership are to: (1) Broadcast as a WUNH on­air operator at a time and with content approved by WUNH’s Program Director. (2) Hold officer positions of the Executive Board (with some exceptions to non­SAF members, as outlined in Article IV, section 12). (3) Vote in WUNH general elections as well as any other decision open to voting by the general membership (with some exceptions to non­SAF members, as outlined in Article VII, section 3). Section 5: Membership from WUNH may be revoked by the Executive Board by a 2/3 majority due to violation of the rules and guidelines set forth in this Constitution and its appendix, for failing to operate WUNH’s on­air board under the rules and regulations of the FCC or for other reasons stated by the Executive Board. The Executive Board’s decision may be appealed to the Office of Student Involvement and Leadership. Section 6: Membership rules of WUNH will not be contrary to the University of non­discrimination policy as listed in Students’ Rights, Rules and ​ Responsibilities. Section 7: Non­Member Definitions: 1. Trainee: A trainee at WUNH is any person currently enrolled in the WUNH On­Air Training Program as outlined by Chief Announcer 2. Staff: A staff member at WUNH is a person involved with the station who has not completed the WUNH On­Air Training Program Alternate Member: When student membership is under 75%, non­SAF paying member numbers must stay under 25%. To ensure this, some members may be transitioned to an Alternate Member category which is defined as follows: 1. A member who has completed the On­Air Training Program 2. Has no regularly scheduled show during the fall and spring semesters, but may have a show during winter and summer breaks, and may fill in as needed. 3. Has no voting rights 4. May be transitioned back to full member through a process overseen by the Executive Board ARTICLE IV– OFFICERS Section 1: The officer positions of WUNH are as follows: General Manager, Program Director, Chief Announcer, Business Manager, Music Director, Production Director, Promotions Director, Events Coordinator, Sports Director, News Director, Marathon Coordinator, Webmaster, and Secretary. All officers shall be listed on WUNH’s Wildcat Link page. Section 2: The WUNH Executive Board shall consist of all officers; provided, however, that the Executive Board shall at all times consist of a minimum of a General Manager, a Program Director, a Chief Announcer, a Business Manager and a Music Director. Section 3: Via modification of the appendix to the Constitution, additional officer positions may be added as deemed necessary by the Executive board by a 2/3 majority vote. The Executive Board may eliminate officer positions that it deems no longer necessary by a 2/3 majority vote, with the exception of the positions of General Manager, Program Director, Chief Announcer, Business Manager and Music Director, which may not be eliminated. Section 4: The positions of General Manager, Program Director, Chief Announcer, Business Manager and Music Director must be filled by WUNH members. All other positions may be filled by non­members provided that there is no suitable member candidate. Section 5: The term of office shall be from May 1st to April 30th. Section 6: Officers shall be elected at WUNH’s March General Meeting by a paper ballot. Section 7: One month’s notice shall be given to the membership as to the specific date of the election meeting. Section 8: Members may indicate their commitment to run for an officer position by submitting a letter of intent to the WUNH membership up to 48 hours before the election meeting. Members can also be nominated from the floor during the election meeting. Section 9: Any officer may be removed from his/her position by a 2/3 majority vote of the Executive Board. Any officer removed from office may appeal to the general membership. If his/her appeal is approved by 2/3 vote of the membership, said officer shall be considered reinstated. Section 10: Any vacancy which may occur in an office shall be filled by appointment by the General Manager pending ratification at the next General Meeting. In the event of a vacancy in a position of General Manager, the Executive Board will convene within 72 hours of the position becoming vacant to choose a replacement to serve until the next Board of Governors meeting. The Board of Governors will meet within 30 days of the Executive Board’s decision to ratify the new General Manager. Section 11: Non­SAF paying members are eligible to hold officer positions under the following stipulations: (1) He or she must be elected in accordance with Student Senate guidelines, which prohibit stipend payments and require the approval of the Student Activity Fee Committee. (2) In order to hold office a non­SAF paying member must receive a 2/3 vote of the general membership when a SAF paying member is running for the same position. (3) A non­student may not hold a position on the Executive Board for two consecutive terms.

ARTICLE V– DUTIES OF OFFICERS Section 1: The duties of all WUNH officer positions are described in the appendix to the Constitution. These responsibilities may be amended at any time by a 2/3 majority vote of the Executive Board.

ARTICLE VI– THE BOARD OF GOVERNORS Section 1: The Board of Governors (BOG) will consist of the following members: (1) A representative from the Theater or Communication Department. (2) A representative from the Electrical Engineering Department. (3) A representative from the faculty community. (4) A representative from the University System. (5) Two Members­at­large selected from the community. (6) The General Manager who will act as a non­voting chairperson. Section 2: At least four of the seven BOG positions must be filled at all times. Section 3: Members are appointed to BOG through a majority vote of the existing BOG members. Section 4: BOG members terms run until voluntary retirement or removal by the other members of BOG by a 2/3 majority vote. Section 5: The Executive Board, by a 2/3 majority vote can require BOG to vote on the removal of a BOG member. Section 6: BOG is the direct representative of the Board of Trustees of the University System of New Hampshire and is responsible for advising WUNH on matters of policy and general operation to the satisfaction of the requirements of the FCC and the Board of Trustees, who holds the license of WUNH. ​ ​ Section 7: BOG supervises the finances of WUNH by approving the annual budget proposed by the Executive Board and reviewing the administration of the budget throughout the year. Section 8: BOG has authority over individual officers on the Executive Board, and may remove any officer from his/her position by a 2/3 majority vote for failure to adequately perform their duties. Section 9: The General Manager shall convene a BOG meeting: (1) At least once each semester; (2) At the request of an BOG member; (3) To act as an appeal board for Executive Board decisions; (4) To approve the fiscal budget before brought forth for SAFC approval.

ARTICLE VII– MEETINGS Section 1: Parliamentary procedure: Robert’s Rules of Order Revised shall be followed by ​ ​ ​ ​ WUNH in all cases involving parliamentary procedure when it does not conflict with the Constitution. The rules may be suspended by the General Manager at his or her own discretion. Section 2: Meeting types: ​ ​ (1) There shall be three regularly scheduled meeting types in a given semester by WUNH, as follows: A General Meeting, an Executive Board meeting and a Board of Governors meeting. (2) The times of regularly scheduled meetings shall be: a. General Meeting­ Once per month. b. Executive Board meeting­ Once per week c. BOG meeting­ Outlined in Article VI section 5 of the Constitution. (3) At least 14 days of notice shall be posted for each regularly scheduled meeting. For General and BOG meetings an agenda will be published at least 48 hours prior to. (4) Special or emergency meetings may be called with less than 72 hours of notice by the Executive Board. (5) The meetings shall include a quorum, order of business and disposition of the minutes. Section 3: Voting ​ ​ (1) A quorum shall be 1/3 of the general membership for a General Meeting and 2/3 of the Executive Board or BOG, provided efforts have been made to inform all members of the given body of the meeting time and location. (2) All full members have the right to vote in all general membership decisions. (3) Proxy voting is allowed at for Executive and BOG meetings. General members are allowed to use proxy voting if they have attended at least one General Meeting in the given semester. (4) All decisions made by the Executive Board, Board of Governors or General Membership are made by those present and any allowed proxy votes.

ARTICLE VIII– BYLAWS Section 1: Bylaws of WUNH shall be established and altered by the same procedure used for amendments to the Constitution, with the exception of officer duties which can be amended by the procedures outlined in Article V Section 1. Section 2: Bylaws of the organization will be attached to this document in the appendix to the Constitution.

ARTICLE IX– AMENDMENTS TO THE CONSTITUTION Section 1: Amendments to this Constitution may be proposed by any member of WUNH. The language of any proposed amendment must be submitted to the general membership for consideration at least one week prior to voting. Section 2: Amendments are passed by a 2/3 majority vote of the membership present at the General Meeting at which the vote takes place. Section 3: Amendments must receive a majority approval of BOG after their approval by the General Membership before finalization. Section 4: It is the responsibility of the General Manager to update changes to the Constitution on Wildcat Link.

APPENDIX TO THE CONSTITUTION OF WUNH­FM

Article I­ OFFICER and Other Position RESPONSIBILITIES Section 1: General Manager: (1) Acts as chief executive officer of WUNH and is responsible for its overall administration and operation. (2) Is responsible for any business concerning the University administration, FCC and the Board of Trustees. (3) Supervises, together with the Business Manager, all financial dealings of the radio station. Has authority over all expenditures. (4) Is the official representative of the radio station at the University and non­University functions. (5) Has authority over all departments of the station. Acts as voting chairperson of the Executive Board and Board of Governors. Is responsible for scheduling weekly Officer Meetings and Executive Board meetings. (6) Responsible for the annual budget and financial audits of the station together with the business manager. (7) Responsible for, with the News Director, the editorial stand of the station. (8) Calls General Meetings in accordance with Constitutional procedures. (9) Is responsible for the administration of Federal Communications Commission rules and regulations including Public files and license renewals unless otherwise specified. (10) Responsible for maintaining the speaker level of the hall speakers, in the MUB hallway, outside the lobby door of WUNH. This level must adhere to the MUB Policy G.1. Section 2: Program Director: (1) Is considered the Chief Operator of WUNH. (2) Assures compliance with all FCC rules and regulations including weekly remote meter calibrations. (3) Has authority over the complete on­air sound relative to production quality, news and public affairs programing. Also supervise the duties of the Music Director, Chief Announcer, Production Director and Sports Directors. (4) Is responsible for the scheduling of programs and announcers for programs each semester as well as program content including musical formats. (5) Sees that the FCC required logs (program, transmitter, discrepancy reports and cross references) are maintained and stored properly. (6) Responsible for obtaining all programming materials necessary from outside sources. (7) Has final approval of audition tapes for all program announcers. (8) Administers the programming budget with the approval of the General Manager and the Business Manager. (9) Will assist the General Manager in the administration of the FCC rules and regulations including ascertainment surveys, EBS tests and any on­air notification requirements. Will assure that all programming is in compliance with FCC standards and regulations. (10) Is responsible for the overall organization and administration of the annual fund­raising marathon. Section 3: Chief Announcer: (1) Supervises the Training Program under written guidelines posted at the beginning of each semester and is responsible for trainee activity in the station. (2) Has authority over the approval of audition tapes of prospective announcers. (3) Is responsible for the scheduling of replacement announcers for air­shifts. (4) Makes air­checks and recommendations to Program Director Relative to announcer’s performance. (5) Is responsible for keeping accurate files of current on­air membership and trainees regarding programming clearances, etc… Section 4: Business Manager: (1) Responsible for the processing of all invoices and debts acquired by the radio station through the S.A.F.O. business office. (2) Responsible for the processing and depositing of all revenue to WUNH's accounts. (3) Together with the General Manager is responsible for the approval of all purchase contracts for services and related expense items, including travel expenses and other expenditure cases. (4) Keeps accurate and up­to­date records of WUNH income and expenses as well as assures their agreement with S.A.F.O. books. (5) Along with General Manager, is responsible for the fiscal responsibility of the radio station during audits and budget transfers. (6) Must attend all meetings of SAFC as WUNH's voting representative unless an alternate is appointed by the General Manager at the request of the Business Manager. (7) Assures WUNH's compliance with SAFC and Student Senate guidelines. (8) Maintains station business supplies. Section 5: Music Director: (1) Is responsible for the procurement of records and maintaining relations/record service with record companies and their distributors. (2) Composes and distributes the station playlist. (3) Is responsible for the maintenance of album files; handles and administers new records as they arrive. (4) Administers the Music Department budget with the approval of the GM and BM. Section 6: Production Director: (1) Responsible for the quality production of all promotional announcements and taped programs aired on WUNH. (2) Responsible for scheduling studios and production facilities to ensure the most effective use of available studio time in accordance with studio priorities: a. Repairs on equipment b. On­air broadcasting (including remote set­ups) c. Station production d. Trainee tapes e. Personal production (non­broadcast) f. Sudden impulses (3) Supervises and administers all recording done by WUNH. Also supervises and delegates individual production responsibilities including script assignment, production supplies and submissions to the Program Director. (4) Administers the Production budget with the approval of the GM and BM. Section 7: Promotions Director: (1) Responsible for the placement of ads promoting the stations activities in area newspapers and places of business. (2) Responsible for the sale of non­broadcast advertising, program funding and promotions (advertising space for Program Guide, etc..) and for the Program Guide itself. (3) Obtains promotional material with the Executive Board's approval. (4) . In addition: a. Is responsible to the General Manager b. Must be familiar with FCC rules pertaining to underwriting. c. Responsible for acquiring underwriting financing. d. Responsible for promotions in our listening area, increasing station visibility. e. Must understand the operations and philosophy of the station. f. Responsible with the Business Manager for billing and procuring funds. g. Maintains records and reports to the Executive Board. h. Is compensated 10% of all income generated by his/her sales, upon collection. Section 8: Events: (1) Responsible for coordinating all events, concerts, etc. (2) Administers Events budget along with Business Manager and General Manager. Section 9: Sports Director: (1) Responsible, along with the Program Director and the GM for determining which University sports events should be covered live and actual coverage of the agreed upon games. (2) Schedules personnel to announce live games, and to write and read sports for local newscasts, subject to the approval of the News and Program Directors. (3) Responsible for any stories or scores for University sports, including follow up stories covered by UNH. (4) Regarding sports broadcasts, acts as liaisons between WUNH and University officials, telephone companies and lodging facilities to assure professional, quality broadcasting. (5) Administers the Sports budget with the approval of the GM and BM. Section 10: News Director: (1) Responsible for the overall quality of news broadcasts on WUNH, for the scheduling and training of news announcers and, in conjunction with the Sports Director, the scheduling of Sports announcers. (2) Maintains an inventory of news department equipment and supplies. (3) Responsible for maintaining Teletype service, supplies and maintenance. (4) Administer the news budget, with the approval of the GM and BM. Section 11: Marathon Coordinator: (1) Responsible for setting date of marathon. (2) Responsible with Public Relations Director for effectively promoting marathon. (3) Coordinating with DJ’s to ensure all premiums are ready and paid for. (4) Responsible for coordinating all marathon efforts during the chosen week, including: Making sure additional phone lines are installed, arranging tables and chairs for lobby, finding people to answer phones, etc. (5) Responsible for coordinating: group sessions to mail out premiums, mailing of reminders, (6) Responsible, along with Business Manager and General Manager, for administration of Marathon budget. Section 12: Webmaster: (1) Responsible for the maintenance, upkeep and supervision of the website (2) Administers usernames and DJ accounts for the website (3) Generally responsive to the information technology needs of the General Manager and Program Director Section 13: Secretary: (1) Receives and types schedules and announcements with the Program Director's approval. (2) Maintains station files and business supplies in conjunction with the Business Manager. (3) Types, compiles, files, and mails all WUNH correspondence. (4) In general, assures the smooth flow of information within the station and from the station to outside sources. (5) Is responsible for keeping minutes of all General Meetings and Board of Governor's meetings. Section 14: Description of Assistants’ Responsibilities (1) Assistant Program Director a. Assists the Program Director as requested. (2) Assistant Music Director a. Assists the MD in compiling playlists b. Assists the MD with record responsibilities. c. Assists the MD with record procurement, replacements and company relations. Section 15: Paid Staff Responsibilities: (1) Engineer a. Is responsible for the overall maintenance, repair and planning of the radio station’s facilitates b. Regularly clean and maintain studio equipment including styli and audio levels for proper operation of the audio chain. c. Instruct station members and student engineer in the proper care and use of equipment. d. Help coordinate outside productions including remotes. Section 16: Additional Officer Responsibilities: (1) In addition to the outlined position requirements, all current officers of WUNH are required to: a. Attend Executive Board meeting as scheduled b. When representing WUNH, officially or otherwise, conduct themselves in a manner deemed appropriate by the Executive Board. c. Post office hours within two weeks of the start of a given semester.

Article II­ DEFINITION OF CLEARANCE LEVELS Section 1: WUNH maintains four clearance levels that designate what time an operator is cleared to operate the on­air board. They are as follows (All times given in a 24­hour clock format): (1) Level 1: Cleared to operate between 2:00 and 6:00. (2) Level 2: Cleared to operate between 22:00 and 2:00 (3) Level 3: Cleared to operate at all times excluding 6:00 to 9:00 and 15:00 to 18:00 Monday through Friday. (4) Level 4 (Drive Time): Cleared to operate at all times. Section 2: WUNH’s Chief Announcer is in charge of approving all operator’s clearance levels. Section 3. On­air operators are permitted to broadcast one level above their current clearance level when covering fill­requests by other operators.

Article III­ BY­LAWS Section 1: ALCOHOL/DRUG POLICY (1) Alcoholic beverages/illegal substances are not to be present in any of the WUNH facilities. (2) An illegal substance is understood as defined in the University of New Hampshire Rights, Rules and Responsibilities. (3) If a member is found violating this regulation, his/her membership and operating privileges will be automatically terminated as outlined in Article III Section 4 . (4) Announcers and Engineers under the influences of such substances are considered to be incapable of fulfilling their on­air responsibilities and will face disciplinary action as outlined in Article III Section 4. Section 2: GUEST POLICY (1) The on­air operator signed in on the Program Log is allowed to have two guests present with them with the exception of operators signed in during non­operating hours of the Memorial Union Building. (2) Guests privileges may be taken away by the Executive Board. (3) On­air operators are required to have advanced permission from the Executive Board for more than two guests.

Section 3: FCC PROCEDURE (1) All on­air operators are responsible for knowing all applicable FCC laws and policies pertaining to non­commercial educational FM broadcasts.

Section 4: ON­AIR POLICIES AND STATION ETIQUETTE (1) Any of the following actions will result in an instant membership suspension and possible expulsion from WUNH (the length of suspension, and possibility of expulsion will be determined by the Executive Board): a. Speaking an obscenity (as defined by the FCC manual) over the air, regardless of time and intent; b. Violating the alcohol and drug policy as described in Article III section 1. c. Violating the UNH sexual harassment policy; d. Defacing the station or station property, whether physically or morally while on the air in accordance with CFR 73.1920, UNH policies and rules, and WUNH membership agreement; e. Removing any WUNH property without approval from the General Manager; f. Removing members or guests personal property without approval of the owning party. (2) WUNH will maintain a ‘3­strike policy’ to deal with all other infractions, including but not limited to the following: a. Failing to operate on­air without approved (by the Program Director) notice; b. Failing to uphold music playlist standards as defined by the Music Director; c. Failing to correctly record required information in the program log; d. Failing to attend required meetings without approved (by the General Manger) notice; e. Improper behavior on either of the WUNH email subscriptions. f. Any behavioral misconduct deemed inappropriate by the Executive Board (⅔ majority vote needed) (3) The WUNH General Manager, Program Director and Music Director are authorized to administer strikes to WUNH members. (4) The consequences for each strike are as follows: a. One Strike­ the General Manager and Program Director can require a meeting to discuss infraction. b. Two Strikes­ A suspension of one week may be authorized by the Executive Board (2/3 majority vote needed). c. Three Strikes­ Automatic four week suspension with the possibility of permanent expulsion if passed by a 2/3 majority of the Executive Board. (5) Strikes will be removed from members for the following reasons: a. A strike will be automatically removed after one calendar year. b. A strike will be removed if the member fills the on­air duties of another member if requested. c. The General Manager, Program Director and Music Director may remove a strike if they feel the offending member has adequately made amends for their discretion. Section 5: WUNH CONCEPT AND BUDGET (1) WUNH will maintain a concept and budget to be approved annual by the Student Activity Fee Committee. (2) It is the responsibility of the General Manager to update the WUNH concept on Wildcat Link.

Section 6: SPEAKERS (1) The speakers in the hallway of the Memorial Union Building, outside the lobby door of WUNH must adhere to the rules of the MUB Policy section G.1

Section 7: EMAIL SUBSCRIPTIONS (1) WUNH will maintain two email subscription lists, known as “bulletin” and “members’” (2) The bulletin subscription will be used for announcements approved by the Executive Board and show fill requests. (3) The General Manger is in charge of maintaining both email subscriptions.

91.3 FM WUNH Membership Agreement

I have read and understand the rules set for in the Constitution and its appendix and agree to follow them as a member of WUNH.
