• California Building Code “Green Code” • Savings by Design • CHPS • LEED • Living Building Challenge

A criteria can include formal commissioning and certification or used solely as a basis of design in accordance with the District’s policy/guidelines and the project budget.

38 DIXON UNIFIED SCHOOL DISTRICT REQUEST FOR ARCHITECTURAL SERVICES LITIGATION HISTORY 09

LITIGATION HISTORY

There have been no claims filed against Arch I Nexus related to any contract we have had with any client or contractor. Nexus has, however, been named as a third party in legal disputes between other contracting parties. Unfortunately in publicly bid projects this does occur, however our responsibility in these suits has been relatively minor. They were all settled in mediation. The only claim within the past five years is summarized below:

Alta View Emergency Department Expansion and Remodel Date: Contract date is 1/24/2008 and Claim date is 3/8/2012 Claimant: Jonie Draper (formerly Jonie Alhamjami) Court: Third Judicial Court, Salt Lake County, State of Utah

Summary: Plaintiff slipped and fell on the parking/drive surface approaching the Emergency Room during a heavy snow/ice storm. Damages for physical injuries are claimed. Claims are filed against the hospital, general contractor, architect, civil engineer and concrete subcontractor. The fall occurred on a surface not designed by Arch I Nexus.

Status: The claim has been settled. Architect was dismissed from the claim because the surface where the fall occurred was not designed by the architect or civil engineer.

RFP SECTION

3.1 TIMELINESS AND COMPLETENESS OF SOQ

3.2 TECHNICAL QUALIFICATIONS AND COMPETENCE Over the past 25 years, Arch I Nexus has provide design services for more than 25 California Public School Districts. New construction, modernizations, expansion, site improvements, installation of modular and portable classroom buildings, technology, accessibility and systems upgrade projects approved by the Division of the State Architect represents a construction value of more than $1,000,000,000.

In addition to its record of successful California K-12 projects, Architectural Nexus has also provided design services for the State of California, cities and counties including libraries, administrative office buildings, vehicle maintenance and fueling facilities, theaters, community colleges buildings and college/university buildings.

Nexus has a documented record of successful education projects as well as public works projects.

3.3 RECORD OF PAST PERFORMANCE Within this Statement of Qualifications, Arch I Nexus has provided project and client references. Please contact the references to affirm the ability of Nexus to work collaboratively on a variety of K-12 project types with large and small school districts.

3.4 APPROACH TO WORK The design process is inherently a collaborative process where alternatives and options are identified and evaluated relative to each project’s goals, aspirations and requirements. Outreach, transparency and engagement, to the degree deemed appropriate by the District, is an important factor to the success of every project. Nexus is committed to working with and supporting the District and facilitating enduring decisions consistent with each project’s requirements, budget and schedule.

3.5 COST CONTROL Construction cost control as well as adherence with the project schedule is fundamental to the success of every project. Despite the merits of a design, if it cannot be built within the constraints of budget and schedule, then the design does not the District’s goals, aspirations and requirements.

Nexus monitors the cost of each decision so that the priorities and components are selected for design merit, functionality and cost. Nexus will work to reconcile the construction cost estimate with the construction budget at each project phase. This process and the sensitivity to the importance of cost control, enables each project to be developed in an orderly manner without the need for last minute scope reductions in order to comply with the budget.
