San Carlos Recycling Ordinance ORDINANCE NO. 1418 ORDINANCE OF THE CITY OF SAN CARLOS ADDING CHAPTER 8.25 TO THE MUNICIPAL CODE: MANDATORY COMMERCIAL AND MULTI-FAMILY RESIDENTIAL RECYCLING AND AMENDING CHAPTER 8.04.030 OF THE MUNICIPAL CODE: SOLID WASTE – DEFINITIONS IT IS ORDAINED by the City Council of the City of San Carlos as follows: Section 1: RECITALS WHEREAS, the City of San Carlos wishes to increase the rate of recycling of materials in Commercial and Multi-Family Residential properties in the City; and WHEREAS, increasing such recycling will have several benefits including extending the life of the landfill site in San Mateo County, reducing the City’s Carbon Footprint through the reduction in the creation of methane gases, reduced Solid Waste disposal costs through revenue generated by the sale of recycled materials through Rethink Waste and continuing to meet and surpass required recycling goals set by State Law; and WHEREAS, passage of a local Mandatory Commercial and Multi-Family Residential Recycling Ordinance will supersede the need to be covered by the upcoming State Regulations in this area and will avoid the potential of a $10,000 per day fine if the City fails to adopt such a local ordinance or follow the State Regulations in this area; Section 2: Chapter 8.25 - MANDATORY COMMERCIAL AND MULTI-FAMILY RESIDENTIAL RECYCLING is added to the municipal code as follows: Chapter 8.25 MANDATORY COMMERCIAL AND MULTI-FAMILY RESIDENTIAL RECYCLING 8.25.010 Purpose 8.25.020 Findings 8.25.030 Definitions 8.25.040 Solid Waste Customers 8.25.050 Commercial Generators 8.25.060 Multi-family Generators 8.25.070 Special Events 8.25.080 Provisions For Self-haulers 8.25.090 Solid Waste Collectors 8.25.100 Exclusions 8.25.110 Exemptions 8.25.120 City Authority 8.25.130 Administrative Appeal 8.25.140 Enforcement Goals 8.25.150 Enforcement for Contamination 8.25.160 Enforcement for Other Violations Page 1 of 18 8.25.170 Penalties 8.25.180 Implementation Schedule 8.25.190 Other Provisions 8.25.200 Disclaimer of Liability 8.25.210 Duties Discretionary 8.25.220 Severability 8.25.010. Purpose The purpose of this Ordinance is to: a. Establish requirements for the Collection and Recycling of Recyclable Materials and Collection and Organics Processing of Organic Materials generated from Commercial Facilities, Multi-family Dwellings, and Special Events. These requirements are intended to accomplish the following: i. Assist the City in complying with the Integrated Waste Management Act of 1989 (AB 939 passed and signed into law in 1989) and Alternative Compliance Act of 2008 (SB 1016 passed and signed into law in 2008), which requires each local jurisdiction in the State to divert the equivalent of 50% of waste from landfill Garbage Disposal on a per capita basis, and the California Global Warming Solutions Act of 2006 (AB 32 passed and signed in to law in 2006), requiring that Commercial Generators statewide participate in Recycling programs. ii. Augment voluntary Recycling efforts to further the City’s Recycling and diversion goals. iii. Reduce greenhouse gas emissions associated with the mining and manufacturing of goods from virgin materials and associated with the disposal of Solid Waste in landfills. iv. Further protect the natural environment and human health as well as enhance the economy through increased Recycling and Organics Processing activities. b. Provide for enforcement through the use of fines for violating the requirements of this Ordinance; c. Establish a schedule for implementing and enforcing the Ordinance; d. Provide exclusions and exemptions for select Solid Waste Customers, Commercial Generators, and Special Events who are not included or able to comply with this Ordinance or for whom the Ordinance poses an undue burden. 8.25.020 Findings The City Council finds and determines as follows: A. The City wishes to maintain a safe, controlled and cost-efficient Commercial and Multi-Family Residential Recycling program, which serves as a convenience to the community and preserves the public health and safety. The City wishes to encourage commercial, multi family and special event recycling in order to reduce impacts to landfill and to reduce greenhouse gas emissions attributable to solid waste. C. The City has determined that reducing the amount of solid waste is entering the waste stream in the overall interest of the community, and is required by State mandates under the Integrated Waste Management Act of 1989, the Alternative Compliance Act of 2008 and the California Global Warming Solutions Act of 2006. 8.25.030. Definitions The definitions set forth in Section 8.04.030 of the Municipal Code shall apply to this chapter. 8.25.040 Solid Waste Customers Each Solid Waste Customer shall be responsible for ensuring and demonstrating its compliance with the requirements of this Ordinance. Each Solid Waste Customer shall: a. Subscribe to an adequate level of service for Recyclable Materials and, when applicable, Organic Materials generated at the Commercial Facility, Multi-family Dwelling, or Special Event if the Solid Waste Customer does not Self Haul those Recyclable Materials or Organic Materials to a Recycling or Organics Processing facility. b. Provide, directly or through the Solid Waste Collector, appropriate and sufficient Containers, placed in appropriate and accessible locations with adequate signage, to ensure maximum Segregation of Recyclable Materials by all Commercial Generators, Multi-family Generators, and Special Events and to ensure maximum Segregation of Organic Materials by Food Service Establishments. c. Post and maintain signs containing information and instructions on the proper Segregation and storage of Recyclable Materials and Organic Materials in areas where Containers are located. d. Ensure that all Containers used for collecting and storing Recyclable Materials and Organic Materials (i) are affixed with or have adjacent to the Container signs that display the appropriate information to enable users to clearly differentiate which Containers are used for Recyclable Materials, Organic Materials, and Garbage; (ii) display the name of the Solid Waste Collector that provides collection service of the Container; and (iii) ensure that users of the Containers make efforts to minimize the Contamination of material placed in the Containers. e. Distribute Ordinance requirements and appropriate educational materials to all Commercial Generators, Multi-family Generators, and Special Events at the Commercial Facility or Multi-family Dwelling at least once each year. All new Commercial Generators, Multi-family Generators, and Special Events shall receive this information upon occupancy, employment, or contracting. Educational materials shall include (i) the requirement and procedures to ensure the accurate Segregation of Recyclable Materials and Organic Materials from Garbage; (ii) the Commercial Generator’s, Multi-family Generator’s, or Special Event’s responsibilities regarding compliance with this Page 3 of 18 Ordinance; and (iii) the types and location of Recyclable Materials, Organic Materials, and Garbage Containers. f. Ensure that instructions or training materials provided to Commercial Generators, Multi- family Generators, and Special Events are promptly made available to the City upon request. g. Ensure that the contents of the Recyclable Materials and Organic Materials Containers are not collected for Garbage Disposal unless the contents of these Containers include unacceptable levels of Contamination. Solid Waste Customers shall be assessed a premium fee based on the size of the Container for Recyclable Materials and Organic Materials Containers that are collected for Garbage Disposal by the Franchisee if the contents of their Recyclable Materials and Organic Materials Containers contain unacceptable levels of Contamination. 8.25.050 Commercial Generators Each Commercial Generator shall be responsible for ensuring and demonstrating its compliance with the requirements of this Ordinance. Each Commercial Generator shall: a. Ensure the Segregation of Recyclable Materials and, for Food Service Establishments, Organic Materials from Garbage by placing each type of material in a separate designated Receptacle or Container and ensure that employees, contractors, volunteers, customers, visitors, and other persons on site Segregate Recyclable Materials and, for Food Service Establishments, Organic Materials. b. Provide an adequate number and type of labeled Receptacles needed for Segregating and storing Recyclable Materials and, for Food Service Establishments, Organic Materials and provide adequate access to these Receptacles. c. Post and maintain signs containing information and instructions on the proper Segregation and storage of Recyclable Materials and, for Food Service Establishments, Organic Materials in areas where Receptacles are located. d. Ensure that all Receptacles used for collecting and storing Recyclable Materials, Organic Materials, and Garbage are affixed with signs or labels that display the appropriate information to enable users to clearly differentiate which Receptacles are used for Recyclable Materials, Organic Materials, and Garbage to minimize the Contamination of material placed in Receptacles. e. Provide adequate instructions to employees, contractors, and volunteers of the requirements of this Ordinance, including (i) the requirement and procedures to ensure the Segregation of Recyclable Materials and, for Food Service Establishments, Organic Materials from Garbage; (ii) the employee’s, contractor’s,

    Chapter 198 SOLID WASTE § 198-1. Declaration of policy. The accumulation, collection, removal, and disposal of solid wastes must be controlled by the Town for the protection of the public health, safety, and welfare. It is consequently found and declared that: A. The Town is authorized by law to regulate the disposition of solid wastes generated within its boundaries, to collect a charge therefor, and to license solid waste collectors; B. The Town is also authorized by Connecticut General Statutes § 22a-220a to designate the area where solid wastes generated within its boundaries shall be disposed; C. The Town has executed a municipal solid waste management services contract with the Southeastern Connecticut Regional Resources Recovery Authority (SCRRRA); including an Amendment No. 5 to such Municipal Solid Waste Management Services contract (collectively with such Amendment No. 5, the MSA). The MSA defines the System (the SCRRRA System) to include the solid waste disposal and resource recovery facility located in Lisbon, Connecticut and operated by Wheelabrator Lisbon Inc. or its successors or assigns (the SCRRRA Facility) pursuant to a Solid Waste Disposal Agreement between SCRRRA and Wheelabrator Lisbon Inc. (the Wheelabarator Agreement), and designates the SCRRRA Facility as the “Facility” within SCRRRA System. Pursuant to the MSA, the Town has agreed to deliver or cause to be delivered all Solid Waste (as defined in the MSA) generated within the corporate boundaries of the Town to the SCRRRA System as directed by SCRRRA for ultimate delivery to the SCRRRA Facility for disposal, subject to and in accordance with the Wheelabrator Agreement. "Sanitary Sewage": shall mean sewage discharging from the sanitary conveniences of dwellings (including apartment houses and hotels), office buildings, factories or institutions, and free from storm, surface water and industrial wastes. 9. "Sewage Treatment Plant": shall mean any arrangement of devices and structures used for treating sewage. 10. "Industrial Wastes": shall mean the liquid wastes from industrial processes, trades or businesses as distinguished from sanitary sewage. 11. "Garbage": shall mean solid wastes from the preparation, cooking and dispensing of food, and from the handling, storage and sale of produce. 12. "Properly Shredded Garbage": shall mean garbage that has been shredded to such 145 degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one half (1/2) inch to any dimension.

Hill County Executiv SUBJECT: Compost Pilot Program Update The Solid Waste Management Program (SWMP) has prepared this report to supplement the Compost Pilot Program Update presentation (draft attached) that will be provided on February 2, 2021, to the Environmental Committee. The report, written in response to directives from the Board of Supervisors through the Green Initiatives #2, examines the resources, planning and options available to create a system to divert food waste from the waste stream. For our community to be successful in reducing our collective waste being generated, we are working towards a cultural change on how we generate and dispose of waste items. Reducing and composting food waste and other organic items like paper towels and napkins is another rung on the ladder to waste reduction. Research The process to expand food waste composting programs began with a review of the approaches taken by communities in the region and across the nation. The research shows that there are essentially three ways to provide the service: as a drop-off program at weekly events such as farmers markets; as a drop-off program at public and private facilities that are open daily; and as a curbside program with weekly collection. Locations must be carefully selected to ensure that they do not attract illegal dumping and that the food scraps are not contaminated. Factors such as cost, convenience, safety, demand for the service and economies of scale must all be considered as we develop this service for our residents.

The Tha Khon Yang Subdistrict Municipality is a representative example of many local governments in Thailand that have been facing MSWM issues. In-depth interviews with individuals and focus groups were conducted with key informants including the municipality staff, residents, and external organizations. The major influences affecting waste management were categorized into six areas: social-cultural, technical, financial, organizational, and legal-political barriers and population growth. SWOT analysis shows both internal and external factors are playing a role in MSWM: There is good policy and a reasonably sufficient budget. However, there is insufficient infrastructure, weak strategic planning, registration, staff capacity, information systems, engagement with programs; and unorganized waste management and fee collection systems. The location of flood prone areas has impacted on location and operation of landfill sites. There is also poor communication between the municipality and residents and a lack of participation in waste separation programs.

General Requirement for Solid Waste Disposal: To protect public health, safety and well- being and to control the spread of vectors, the person responsible for the day-to-day operation of each premises in the City shall make arrangements for the collection, removal and disposal of garbage, solid waste, green waste and recyclable materials generated or accumulated on those premises in accordance with the requirements of this chapter. B. City, Contractor or Licensee: The collection, removal, and disposal of all garbage, solid waste, green waste, and recyclable material shall be performed exclusively by the City under the supervision of the Public Works Director; and for such purpose the City may use City personnel or enter into contracts therefor with any person with or without advertising for bids, or both; provided, however, that the Public Works Director may authorize any person to collect, remove and dispose of garbage, solid waste, green waste, and recyclable material under such terms, conditions and limitations deemed necessary in the interest of public health, safety and welfare. C. Permit and License: Every person under contract with the City or authorized by the City to engage in the business of the collection, removal and disposal of waste matter shall, before commencing such business, obtain a permit from the Public Works Director and a license from the License Division and shall pay permit and license fees as set forth in the Burbank Fee Resolution and file a surety bond in the sum of one thousand dollars ($1,000.00) conditioned upon compliance with the terms, conditions and limitations of the contract and permit and the provisions of Title 3, Chapter 6, Article 3 of this code relating to surety bonds.

Forbes September 2017 Solid Waste Management Program Solid Waste Advisory No. 17-008 [email protected] 703-324-5230 Recycling Services and Collection Fees at Commercial Properties Fairfax County’s solid waste management ordinance, Chapter 109.1, requires that everybody, at work and at home, have access to recycling. This Solid Waste Advisory is intended to clarify selected mandatory recycling requirements that apply to commercial property owners and their waste collectors. 1. The purpose of Chapter 109.1 is the furtherance of effective solid waste management, which includes the proper storage, collection, and processing or disposal of the solid waste stream generated within Fairfax County. Refuse and recyclables (as defined by Chapter 109.1) are each fractions of the solid waste stream, and as such each must be managed and collected properly, in accordance with the law. 2. Commercial property owners (e.g., office buildings, apartment complexes) are required to provide a recycling system to their tenants, occupants, employees, and/or customers. This system must include adequate storage of recyclables until they can be collected. 3. Recyclables that are stored outside must be stored in an appropriate container. Appropriate container designs include 50-100 gallon carts, 1-2 yard trash containers, and 6-8 yard dumpsters. Other designs and capacities can be used as space and needs dictate. Section 109.1-5-6 provides further detail on required container design features. 4. Recyclables containers must be serviced weekly, unless the property has registered w/ the County’s Reduced Collection Frequency pilot program (RCF).
