Last year, Congress provided $5.1 billion for the program, the most in the program’s 26-year history. Advocates will request at least as much this year, if not more, due to the many Americans struggling due to the global recession. Participating industry groups this year include the New England Fuel NEFI EDUCATION Institute, Oilheat Council, Oilheat Council of , CALENDAR Oilheat Institute of Rhode Island and the Fuel Merchants Association of New Jersey. REGULATORY ALERT: SPCC RULE FREEZE AFFECTS SPCC REGULATORY RELIEF On January 20, 2009 the Obama administration announced a regulatory review of all “last minute” final rules issued during the waning days of the Bush

administration. Agency regulators were ordered to review all such rulemakings to decide whether they were consistent with the policies of the new administration-- and if not, to impose a 60-day freeze to allow for additional public comment and possible regulatory change. The EPA announced today that the final SPCC rulemaking published on 12/05/08 that provides significant regulatory relief for bulk plant owners and operators is subject to the freeze. The effect of the freeze is two-fold:

• The 02/03/09 effective date of the SPCC regulatory relief provisions is delayed until 04/04/09. This means that bulk plant owners and operators who are currently http://www.nefi.com/NEON/NEON_issues/NEON_February_6_2009.html Page 4 of 13 NEON: NEFI Energy Online News 12/5/11 12:20 PM

until 04/04/09. This means that bulk plant owners and operators who are currently revising and implementing SPCC plans must postpone taking advantage of these regulatory relief provisions until 04/04/09 (provided they are not eliminated or changed by the EPA in the interim).

• The EPA is reopening the entire final rule for a 30-day period to seek additional public comment and possible regulatory changes. While the entire rule is technically open for comment, the EPA is concerned only with the provision that allows self certification of SPCC plans for bulk plants under 10,000 gallons capacity (certain parts of the rule that do not apply to petroleum marketers may be subject to change as well, but this is unlikely to effect the regulatory relief provisions). The self-certification provision was not included in the proposed rulemaking stage and therefore never subject to public comment. The EPA is probably reopening the rule to correct this procedural error rather than out of any concern over the regulatory relief provisions.

It is likely that the key provisions in the SPCC rule that are important to small bulk plant owners and operators will be retained after the 30-day comment period closes. The net effect for now is that the regulatory relief provisions will not be available to bulk plant operators or owners until 04/04/09. These provisions include; clarification of the definitions of “facility” and “loading rack” that limits the cost of complying with SPCC regulations; more flexible and cost effective security requirements at bulk plants; streamlined SPCC plans and self-certification for small bulk plants; more flexible integrity testing requirements; and an exemption for parked cargo tank trucks from the sized secondary containment requirements.

A separate rulemaking on January 14, 2009 extended the SPCC compliance deadline from 07/01/09 to 11/20/09. The EPA will decide shortly whether this rulemaking will also be re-opened for public comment and subject to possible change.

• GAO CITES POOR DATA IN REPORTING NO SPECULATION: This week, Bloomberg News (article unavailable) reported that the Government Accountability Office (GAO) sent a letter to US House Agriculture Chairman Peterson, reporting that speculation had little apparent involvement in the behavior of commodity markets, but the report cited data from government regulators that is extremely limited due to loopholes in federal oversight.

• CFTC CHAIRMAN-DESIGNATE PROMISES TO GET TOUGH ON TRADERS: In a letter to House Agriculture Committee Chairman Peterson, Chairman- designate for the Commodity Futures Trading Commission (CFTC), the federal futures market watchdog, has promised to support increases in transparency and oversight of the futures market. The letter comes in response to Peterson’s 19- question letter to Gensler, who has received some skepticism from members of Congress and advocates for futures market reform (including NEFI) in light of his relationship to former partner at Goldman Sachs and his past support for index- and swap-trading. • PRESIDENT TAPS SENATOR GREGG FOR COMMERCE POST: Senator (R-NH) is in-line to become the next Secretary of Commerce, provided he receives Senate confirmation (which is likely, as early as next week). Gregg is well known for his fiscal conservatism and will be the second Republican in the Obama administration after Transportation Secretary Ray LaHood (Defense Secretary Gates is an Independent). NH Governor Lynch, a Democrat, has announced his selection of former Gregg Chief-of-Staff Bonnie Newman as his replacement. There are about a dozen families in the Granite State that have children on a variety of life-supporting systems that do not have electric generators. • PRESIDENT OBAMA OKs CIGARETTE TAX INCREASE: President Obama has signed into law a Children’s Health Bill this week that includes a tax hike for tobacco products, including an increase in cigarette tax to 62 cents per pack. PMAA and the National Association of Convenience Stores (NACS) have been vocal opponents to tobacco tax increases. Read More.

• NACS STUDY: MORE CONSUMERS BLAME SPECULATORS FOR PRICES: According to a recent study by the National Association of Convenience Stores (NACS), 50 percent of people surveyed believe that speculators were to blame for rising gas prices, up from 34 percent last year and second only to OPEC (61 percent) and government inaction (58 percent). • CALIFORNIA STUDY FINDS COSTS IN ATC MANDATE: According to PMAA, a California Energy Commission (CEC) report has found temperature compensation to be a net-cost for the consumer, and state and regional differences make a national mandate troublesome.
