Mr H Lewis addressed the Committee and outlined reasons why he considered the following application should be refused.

P/05/1141/FUL Side garden of 11 St. Maddocks Cl., Brackla, Bridgend CF31 2BL - Two bedroom property including 2 No. car parking spaces

1. If the application was granted, this would contravene criteria 7 of Policy EV45 of the Unitary Development Plan.

P/05/1458/FUL Embassy Cinema Car Park - Permanent siting of burger trailer 3 Mt x 2 Mt x 2.5mt (8.00am - 5.00pm Mon to Sat) in applicant's name.

1. The proposed development would generate a greater intensity of short term parking on Brewery Lane to the detriment of highway safety. Contrary to Policy T2 of the Unitary Development Plan.

2. The proposals would reduce the availability of long term parking spaces at this location to serve the town centre to the detriment of highway amenity, which is contrary to Policy T2 of the Unitary Development Plan.

A Mr Davies addressed the Committee and outlined reasons why he felt the application below should be refused, or alternately, be subject of a site visit. Mr Maddock, the applicant responded by giving reasons why he felt the application should be granted.

Reason: Where the proposed development will have a major impact over a wide area and the traffic implications can only be fully appreciated on site.

(2) That the following application and enforcement case be deferred for one month, in order that the Site Visit Panel of

Reason: So as to enable a full assessment of the implications regarding retaining this unauthorised structure, set against the context of existing development on this part of the Industrial Estate.

RESOLVED: (1) That the Executive Director - Environment be given delegated power to issue a decision notice granting consent in respect of the following applications provided that there are no adverse representations received from the Council's Public Protection Department:-

1. No works shall commence until such time as a scheme has been submitted to and approved in writing by the Local Planning Authority showing an expansion of the school "Keep Clear" markings, to provide a continuous length of markings on the western side of the carriageway between the School access and the junction with The Woodlands, and, on the eastern side of the carriageway, from a point opposite the school access to the junction with The Spinney, supported by speed actuated signing. such scheme shall be implemented as approved prior to beneficial use of the nursery accommodation commencing.

The Chairperson (as Ward Member) vacated the Chair for consideration of the following application and the Vice-Chairperson took her place. Following the completion of deliberations upon the application, the Chairperson re-took the Chair accordingly.

Reason: 1. The site is brownfield.

2. The site adjoins the settlement of Heol y Cyw.

3. The replacement of a transport depot would improve the residential amenities of the amenities of the occupiers of dwellings adjoining the access to the site.

P/05/1215/OUT Land R/o 45 & 47 Kings Terrace, Nantyffyllon, Maesteg CF34 0HD - One detached dwelling with small attached physiotherapy clinic.

Reason : 1. Only a small part of the site is outside the settlement limits of Nantyffyllon and as such the proposal is marginally out of accord.

2. No part of the residential development would be in the countryside only a relatively modest length of access track that would be finished in grasscrete.

P/05/1317/OUT Land at Werndew Farm, Heol Persondy, Aberkenfig, Bridgend CF32 9RH - One dewllinghouse.

Reason : 1. The site comprises an existing barn and is within the curtilage of an existing dwelling and would not lead to new built development in the countryside and green wedge, nor lead to the coalescence of existing settlements.

2. The proposal would not have a detrimental affect on the visual amenity of the area.

(2) That should Council consider approving the above applications, then such approval be subject to any conditions the Executive Director - Environment considers appropriate for each application.

386 TOWN AND COUNTRY PLANNING ACT 1990 SECTION 106 AGREEMENTS

RESOLVED: (1) That having regard to the following application, the applicant enters into a Section 106 Agreement to provide a contribution of £8,500 towards the provision of measures to reduce the incidences of on street parking on Whitethorn Drive, prior to development commencing on the site:-

391 CLIMATE NEUTRAL DEVELOPMENT SCHEME

The Executive Director - Environment submitted a report together with attached Appendix 'A', advising that as part of its commitment to sustainable development, the Authority has signed the "Welsh Declaration on Climate Change and Energy Efficiency".

Following consideration of the report by the Committee, it was

RESOLVED: That the use of the Climate Neutral Development Scheme Applicants Checklist with Bridgend County Borough Council's planning application process, be approved.

392 PUBLIC ELECTRONIC ACCESS TO PLANNING DOCUMENTS

The Executive Director - Environment submitted a report (deferred from the Special Planning and Development Committee 30 November 2005) which, with the assistance of a small powerpoint Presentation, provided a brief overview of the existing a future opportunities for the public to access information from Bridgend's Planning Website and using the site to communicate directly to the Council's Planning Department.

RESOLVED: That the report (including the contents of the accompanying Presentation), be noted.

393 BRIDGEND COUNTY BOROUGH CITIZENS’ PANEL AND PLANNING OFFICERS' SOCIETY FOR WALES STATISTICS

The Executive Director - Environment submitted the above report, deferred from the Special Planning and Development Committee on 30 November 2005.

394 MARAGAM MINE, OPENCAST COAL MINE - EXTENSION

The Assistant Director (Planning) advised Members verbally that Neath Port Talbot County Borough Council will be presenting a report to their Planning Committee on 12 January 2005, with a view to obtaining a response to this Authority's request for a joint site inspection at the site of the Margam mine.

Should this request be approved, then arrangements would be put in place to arrange this for the end January/early February, next year.

395 ANNOUNCEMENT

The Chairperson concluded by wishing those present a Merry Christmas and a Happy New Year. The Mayor echoed this statement, then called upon Councillor Sage, who confirmed it was his pleasure to announce that Councillor Brett and Councillor Jenkins had earlier made a collection for the children of Chernobyl totalling £346.42. Finally, the Mayor invited Members for refreshments immediately following the meeting, in the Council Suite.
