BIS URN 09/1074 – Reply to questions 1 – 38 Respondents: listed at the end of this document submitted by administrators at http://www.pedlars.info 12 February 2010 Pedlars have responded to the title and first 7 pages of this consultation to remove misleading and confusing concepts, language and information. Question 1: Do you agree that the definition is in need of updating and clarifying? If not, please provide your reasons. Answer: Reason: NO On page 13 point 42 the allegation of confusion because of the age of the Pedlars Act is unacceptable. Pedlars I understand that a constituent has recently contacted you about the regulation of pedlars. You asked for an update on the situation following on from the Library standard note on the subject dated June 2012. Summary 1. Current regulation of pedlars and street traders As mentioned in my previous note, a pedlar is different to a street trader. Section 3 of the Pedlars Act 1871 defines a pedlar as: …any hawker, pedlar, petty chapman, tinker, caster of metals, mender of chairs, or other person who, without any horse or other beast bearing or drawing burden, travels and trades on foot and goes from town to town or to other men's houses, carrying to sell or exposing for sale any goods, wares, or merchandise, or procuring orders for goods, wares, or merchandise immediately to be delivered, or selling or offering for sale his skill in handicraft. In other words, a pedlar is defined in the Act as an itinerant trader. He travels and trades on foot. However, case law has established that a trader may act as a pedlar even if he is not 1 travelling from town to town on foot. -

Mountbatten Journal of Legal Studies Licensed Street Trading and Pedlars Barry Hough Introduction There are many who will lament the passing of the ancient office of Lord Chancellor. It will shortly fall victim to the scythe of modernisation, which bears its victims, be they high or low, into the ever deepening shades of history. Keats' "hungry generation" usurps its predecessors, and a new order supplants the old. The highest state office has succumbed, which bodes ominously for some ofthe more vulnerable and constitutionally inferior. Amongst these are the pedlars. Some might express surprise that their occupation has not already become outmoded and reformed. Yet, somewhat at the margins of the popular awareness, these traders continue to ply their trade in the face of almost implacable hostility from town centre managers and local authorities. They have survived because, according to statute,l the status ofpedlar normally places the trader outside the scope ofthe onerous and costly licensing schemes operated by local authorities. Firstly, in contrast to street traders, properly so-called, pedlars can trade in almost any location,' because it is the essence oftheir business that they move from place to place. Street traders, who trade from a particular pitch, are strictly regulated as to when and where they can trade; for example, they are usually only individually licensed in respect of a particular pitch; and, by designating certain streets as "prohibited" streets, local authorities' can control where street trading takes place. -
