This15thAnnual Reports of Arunachal Pradesh Information Commission 2020-21has been prepared in one volume. The data for preparation of this report are collected from the state Government Departments. According to Information provided by the departments, the total number of Public Authorities in the State is 78 and the number of Public Information Officers is more than 310.

The Right to Information Act, 2005 is a landmark legislation that has transformed the relationship between the citizen and the State. This legislation has been created for every citizen to hold the instrumentalities of Governance accountable on a day-to-day basis. The legislation perceives the common man as an active participant in the process of nation building by conferring on him a right to participate in the process through the implementation of the Right to Information Act.

It has been 15 years since the RTI Act has been in operation in the State. The State Public Information Officers and Appellate Authorities are quasi-judicial functionaries under the RTI Act with distinctive powers and duties and they constitute the cutting edge of this “Practical regime of information”, as envisaged in the preamble of the Right to Information Act. Together, they create an effective, mechanism for disposal of increasing numbers of requests for information being received from the citizen of .

The Arunachal Pradesh Information Commission has prepared the Annual Report for the year 2020-21and while preparing the same, many government functionaries have extended help in many ways for bringing out this Annual Report.

We also acknowledge the contribution of the Chief Secretary, Government of Arunachal Pradesh, and Development Commissioner Finance and the Staff for their assistance in preparing the report.

Our thanks to the Director, Department of Printing, Government of Arunachal Pradesh, and his Staff for their role in bringing out this report in the most presentable form.

CHAPTER-I

INTRODUCTION

Freedom of information is a fundamental human right and this was recognized by the United Nations at its very inception in 1946 when the General Assembly resolved: “Freedom of Information is a fundamental human right and the touchstone for all freedoms to which the United Nations is consecrated” Enshrined in the Universal Declaration of Human Rights, the right’s status as a legally binding treaty organization was affirmed in Article-19 of the International Covenant on Civil and Political Rights which states – “Everyone has the right to freedom of opinion and expression: this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers”. This has placed the right to access information firmly within the body of universal human rights law.

This right to information was explicitly held to be our fundamental right under Article-19(1)(a) of the Constitution of India for the first time by Justice K.K Mathew in the State of U.P –Vs- Raj Narain. This view was followed by the Supreme Court of India on numbers of decisions and, after public demand; the Right to Information Act, 2005 was enacted and brought into force.

The RTI Act is not new for India. Many of its States have already enacted similar Acts in the past. The RTI Laws were first successfully enacted by some State Governments of our Country, like – Tamil Nadu and Goa in 1997, Rajasthan and Karnataka in 2000, Delhi in 2001, Maharashtra and Assam in 2002, Madhya Pradesh in 2003 and & Kashmir in 2004. And there had already been a Law enacted called as ‘the Freedom of Information Act, 2002’. In order to ensure greater and more effective access to information the Government of India decided to repeal the Freedom of Information Act, 2002 and to enact another law for providing an effective framework for effectuating the right of information recognized under Article-19 of the Constitution of India. To achieve this object, the Right to Information Bill was introduced in the Parliament. The Right to Information Bill, having been passed by both the Houses of Parliament, received the assent of the President on 15th of June, 2005 and finally the same came into being as ‘the Right to Information Act, 2005 (Act 22 of 2005)’. Some provisions of the Act came into force with immediate effect from 15th June, 2005 when the President gave his assent so that the public authorities could make preliminary arrangements for implementation of the Act in the field of: designation of Central/State Public Information Officers; designation of Central/State Assistant Public Information Officers; designation of First Appellate Authorities senior to Public Information Officers; framing of rules for smooth implementation of the Act; setting up of Central/State Information Commission(s); preparation of 17 manuals for dissemination of pro-active

1 information, etc. And the Act later fully came into force in our Country, including in the State of Arunachal Pradesh, on 12th of October, 2005 after 120 days of enactment of the Act.

The Right to Information Act, 2005, is the first ever ‘sunshine law’ enacted by the Parliament which extends to the whole of India, in as much as, like most ‘sunshine laws’ it provides a right to all citizens to demand information from any public authority in India while also creating a positive obligation upon these authorities to pro-actively publish information about their functioning. It has been made applicable to all public authorities, viz, all Central and State Government Ministries; Departments; Organizations; Undertakings, Autonomous Bodies, Municipalities, Panchayat, etc, enacted by law and also covers the Union Territories. The Judiciary and the Legislature including Parliament and State Legislature are also covered under its purview.

The Right to Information Act, 2005, has been enacted to provide for setting out the practical regime of right to information for citizens. The basic objectives of this Act are to: empower the citizen to get information from any public authority; to promote transparency and accountability in the workings of the Government and its instrumentalities; to contain corruption and; to make our democracy work for the people in real sense.

The Right to Information Act, 2005, is divided into six chapters and contains thirty-one sections in the whole. All these sections of the Act had remained intact for a period of more than 15(fifteen) years from the date of its enactment on 15th of June, 2005. After such a long period of more than 15 (fifteen) years as aforesaid an amendment bill called as ‘the Right to Information (Amendment) Bill, 2019’ was introduced in the Lok Sabha by Minister of State for Personal, Public Grievances and Pension, Mr. Jitendra Singh on 19th of July, 2019 and the same which was passed by the both Houses of the Parliament was given assent to by the President of India on the 1st day of August, 2019 called as ‘the Right to Information (Amendment) Act, 2019 (24th Act of 2019)’ and by which provisions of Section(s)-13, 16 and 27 of the Principle/Original Act of 2005 have now been amended. And accordingly, the Ministry of Personnel , Public Grievances and Pensions( Department of Personnel and Training ) Govt. of India (Central Govt.) while in the exercise of Power conferred by clauses (ca) and (cb) of sub-section (2) of Section-27 of Right to Information Act,2005 (22 of 2005) framed the Rules, Vide Notification, , the 24th October ,2019 called as the Right to Information (Terms of Office, Salaries,Allowances and Other Terms and Condition of Services of Chief Information Comimissioner, Information Commissioners in the Central Information Commission, State Chief Information Commissioners and State Information Commissioners in the State Information Commission.) Rule, 2019 which came into force with immediate effect on the date of the Notification.

A BRIEF ABOUT ARUNACHAL PRADESH INFORMATION COMMISSION

The Right to Information Act, 2005 is a landmark legislation that has transformed the relationship between the citizen and the state. This legislation has created for every citizen to hold the instrumentalities of Governance accountable on day to day basis. The legislation perceives the common man as an active participant in process of nation building by conferring on him the right to participate in the process through the implementation of Right to Information Act.

It has been more than 15 years since the RTI Act has been in operation in the state of Arunachal Pradesh.A key strength of the Act pertains to administrative and adjudicative autonomy of Information Commission.

The Right to Information Act 2005 came into force in Arunachal Pradesh along with the rest of the country on 12th October 2005 after 120 days of its enactment. As per the provisions of this Act, State Public Information Officers (SPIO) and Assistant Public Information Officers (APIO) were appointed by the Government of Arunachal Pradesh under separate notifications. In pursuance to the provisions of Clause 3 of Section 15 of the Right to Information Act, a selection committee was constituted for the appointment of State Chief Information Commissioner and State Information Commissioners. On 13th October 2006, Arunachal Pradesh Information Commission (APIC) was constituted and the State Chief Information Commissioner Shri NyodakYanggam and State Information Commissioners Shri Bani Danggen, Shri Habung Payeng and Shri Nipo Nabam were administered the oath of office by His Excellency Governor of Arunachal Pradesh, on 19th October 2006.As per Notification No. OM/51/2005/390 dated 14.11.2007 Shri Toko Anil was appointed as 4th SIC and was sworn in on 3rd December, 2007.

As provided under section 15 (1) of The Right to Information Act, 2005, the Governor of Arunachal Pradesh constituted the Arunachal Pradesh Information Commission vide Notification No. OM-51/2005 dated 13.10.2006 with 1 (one) Chief Information Commissioner and 3 (three) Information Commissioners with immediate effect.In exercise of the powers conferred by the Section 15 of the Right to Information Act 2005 (No.22 of 2005) and in partial modification of the Notification No. OM-51/2005 dated 13.10.2006, the Governor of Arunachal Pradesh constituted the Arunachal Pradesh Information Commission with a Chief Information Commission and 4(four) Information Commissioners with immediate effect vide Notification No. OM-51/2005/396 dated 14.11.2007.

The Commission started functioning after getting office accommodation at Secretariat Annexed building in the first week of December 2006 with office functionaries provided by the State Government. The Commission thereafter, entertained complaints, appeals and initiated proceedings to dispose of all the cases in accordance with the provisions

3 of the RTI Act. It also started monitoring the implementation of RTI Act and issued necessary instructions to various departments to comply with the provisions of RTI Act. The Commission has strived to educate the public and officials for proper implementation of RTI Act with the help of the State Government. Due to dismantling of the State Civil Secretariat for construction of new buildings, the Arunachal Pradesh Information Commission was shifted to Hotel Bomdila on 5th November 2008. The Commission continuedfunctioning from the same place without proper facilities like court room, office chamber, furniture, library facility, housing accommodation and supporting staffs and was delivering its duties under pathetic conditions.

However, the Commission has been shifted to the present location – earlier Planning Department premises, opposite to the Legislative Assembly, Arunachal Pradesh, since 28thFebuary 2017.

The Arunachal Pradesh Information Commission (APIC) has been rendering wonderful services for transparent and good governance since its inception in the state of Arunachal Pradesh since 2006. It is worth mentioning here that in the year 2009, the Arunachal Pradesh Information Commission was awarded the best InformationCommission of India for its effective implementation of Right to Information Act, 2005 in the state. This award was initiated by The Public Cause Research Foundation (PCRF), a Ghaziabad based NGO.

Shri Y.D. Thongchi, IAS (Rtd.) was appointed as the State Chief Information Commissioner and was administered oath of office on 1st March, 2011, as Shri NyodekYonggam demitted the post on 28thFebruary 2011. On 6th Oct’2015, the Arunachal Pradesh Information Commission bade farewell to Chief Information Commissioner Shri Y. D. Thongchi on his attaining the age of 65 as per section 16 (1) of the Right to Information Act, 2005.

Four Information Commissioners, Shri Matheim Linggi, Smti Nanom Jamoh, Shri Eken Riba and Shri Abraham K. Techi were appointed as State Information Commissioners of Arunachal Pradesh Information Commission (APIC) on 2nd January 2014 vide Notification F.NO. Ar-113/2011 and took Oath of office on 8th January 2014. Shri Eken Riba, SIC demitted office on 27/7/2016 on attaining the age of 65 years under section 16(2) of the RTI Act 2005.Shri Matheim Linggi, Smti Nanom Jamoh and Shri Abraham K. Techi demitted their office on 7th January, 2019 after completion of their tenure of 5 years.

Dr. Joram Begi was appointed as the State Chief Information Commissioner (SCIC) on 28th June, 2016 and was administered oath of office on 10th July, 2016 by the Hon’ble Governor, Shri Thatagata Roy. Shri Goto Ete was appointed as State Information Commissioner vide order No. AR-19/2017/142 dated 7th May, 2018 and was sworn in on 16th June, 2018 by the Hon’ble Governor, Brig (Dr.) B D Mishra (Rtd). Shri Leki Phuntso was appointed as State Information Commissioner vide order No. AR-133/2018 dated 4thJune, 2019 and was administered oath of office on 26th July, 2019 by the Brig. (Dr.) B.D Mishra and he demitted his office on 08-04-2020 on attaining age of 65 years.

4 ACTIVITIES UNDERTAKEN BY THE ARUNACHAL PRADESH INFORMATION COMMISSION DURING 2020-21

Awareness programme on RTI Act, 2005 at Yingkiong, Aalo and Menchuka District. Arunachal Pradesh Information Commission (APIC) conducted awareness programme on RTI Act, 2005 at Yingkiong, Aalo and Menchuka District on 28/01/2020 to 31/01/2020.Dr. Joram Begi Chief Information Commissioner (CIC) along with State Information Commissioners (SICs) Shri Goto Ete and Leki Phuntso visited Yingkiong, Aalo and Mechuka and elaborated how to seek information under section 6,7,18,19 and 20 of Act 2005 and also mentioned the role of SPIO/SAPIO under Section 7,8,9 and 11of RTI Act.

Conducted online hearing during the Covid-19 pandemic by Arunachal Pradesh information Commission, Itanagar.

During the Covid-19 pandemic the Commission had decided to conduct online hearing through Video/ Audio call. The decision was taken during a meeting between the state Chief Information Commissioner (SCIC) and the State Information Commissioner (SIC) on 20 April 2020. The Commission also decided that the receipt of appeals/complaints in physical form will be suspended until further orders. Those who intend to file an appeal or a complaint were advised to do so in the electronic form and e-mail it to [email protected]. Also, the SCIC and the SIC had volunteered to take a pay cut of 30 per cent from their gross salaries for a month and deposited the amount in the account of the Chief Minister’s Relief Fund for use in combating Covid-19.

In exercise of the powers conferred by sub-section (1) of section 27 of the Right to Information Act, 2005 (Act No. 22 of 2005), the Governor of Arunachal Pradesh is hereby pleased to make the following rules to amend the Arunachal Pradesh Right to Information Rules, 2005, namely: -

1. Short title commencement :

(1) This rule may be called the Arunachal Pradesh Right to Information (1st Amendment) Rules, 2006.

(2) They shall come into force from the date of their publication in theArunachal Pradesh Gazette.

2. Amendments: In the Arunachal Pradesh Right to Information Rules, 2005 (hereinafter called the Principle Rules);

(1) For clause (b) of sub-rule (1) of Rule 2, the following clause shall be Substituted, namely:

"(b)" Competent authority" means the Public Information Office (PIO) or such Officer who is senior in rank to the Public Information Officer as the case may be".

(2) In rule 3 of Principal Rules; the following proviso shall be inserted namely:

"Provided further that the PIO/APIO shall assist the person requesting for Information in filling up the form-A to ensure complete details of information required. Provided further that person's residing outside the Capital Complex as well as District headquarters are allowed to apply on plain paper."

(3) In Rule 4 of the Principal Rules, (i) for Sub-clause (1) following sub-rule shall be substituted by the following namely:(i)"(1) If the requested information does not fall within the jurisdiction of the competent authority, it shall transfer the remaining part to the concerned PIO/APIO

6 of the Department/office with intimation to the applicant in form 'B' as soon as practicable, normally within fifteen days and in any case within thirty days of the receipt of the application, advising the applicant. Wherever possible, about the competent authority to whom the applicant should approach for the remaining part of the information. The application fee deposited in such cases shall not be refunded, nor is the applicant liable to pay application fee again on transfer of application for the remaining part of the information".

(ii) For sub-rule (3), the words, "reject the remaining part giving reasons thereof" shall be substituted by the words, namely:

"Transfer the remaining part to the competent authority of the concerned Department/Office thereof. Provided that the application for information shall not be rejected unless it is exempted from discloser".

(4) In Rule 5 of the Principal Rules, Sub-clause 3 (a) & (b) shall be omitted. (5) In Rule 6 of the Principal Rules, Sub-Rule (1) shall be omitted.

(5) In Rule 8 of the Principal Rules,

(1) for-clause (ii) of Sub-Rule (1) (A), the following clause shall be Substituted, namely:"

(i) Information in the form of Two rupees per page, Communication/ letter etc.

(ii) for-serial number-2 of Sub-Rule (1)(B), the following shall be substituted namely:

(iii) in clause (B) of Sub-rule (1) of rule 8, after serial No. 2, the following serial number and entries shall be added namely:"

(3) For inspection of records, no fee for - Rupees five”. the first hour; and for each subsequent hour (or fraction thereof).

The Governor of Arunachal Pradesh is further pleased to order that Dr. Joram Begi shall hold the office for a term of 5 (five) years from the date on which he enters upon his office or till he attains the age of 65 (Sixty-five) Years which ever is earlier.

The pay and allowance and other conditions of services shall be governed by the provisions of the Right to Information Act, 2005 (No. 22 to 2005).

In exercise of the powers conferred by Section 15 (3) of the Right to Information Act, 2005 (No.22 of 2005) and on the recommendation of the Committee chaired by the Chief Minister, Arunachal Pradesh, the Governor of Arunachal Pradesh is hereby pleased to appoint Shri Leki Phuntso as State Information Commissioner, Arunachal Pradesh information Commission (APIC) in the pay Scale Rs 2,25,000 (Rupees two lakhs twenty five thousand ) only fixed per month and other allowances as admissible from time to time with effect from the date he assumes the charge of the office.

The Governor of Arunachal Pradesh if further, please to order that Shri Leki Phuntso shall hold the office for a term of 5 (five) years from the date on which he enters upon his office or till he attains the age of 65 (Sixty-five) years, whichever is earlier.

The Governor of Arunachal Pradesh is also, please to order that the pay and allowances and conditions of services of Shri Leki Phuntso shall be governed by the Arunachal Pradesh Information Commision (salaries, Allowances and other conditions of Service) Regulations, 2015, Notified vide Notification No.AR-203/2015 dated 12th January, 2016.

RECOMMENDATION OF THE COMMISSION TO THE STATE GOVERNMENT

As per Section 25 (3)(g) the Commission would like to reiterate the following recommendation to the Government of the Arunachal Pradesh for effective implementation of the RTI Act in the state.

REGULAR REPORT RETURN FROM PUBLIC AUTHORITIES

Although Sub Sections (2) and (3) of Section 25 of the RTI Act mandate that each Ministry and Department in relation to the Public Authorities within their jurisdication, shall collect and provide such information to the State Information Commission, as is required to prepare the Annual Report. It has been found that only 78 State Public Information Officers (PIOs)/APIOs out 310, have submitted the report return for the purpose. The State government, through the nodal department should direct all the PIOs to submit the quareterlyreportof the Public Authority as specified under the provisions of section to the State Information Commission regularly.

INADEQUATE PERFORMANCE OF THE FIRST APPELATE AUTORITY

As per Section 19(1)Any person who does not receive decision within the time specified or aggrievedby the decision of the State Public Information Officer (SPIO), may within 30 days from the expiry of such period or from the receipt of such a decision, prefer an appeal to such officer who is senior in rank to the State Information officer in each public authority.

It has been observed that this provision of First Appelate Autority is being done by a very few public authorities and most of the First Appellate Authorities do not function in the state so much so that, the department of Administrative Reform (AR) the nodal department, has not yet brought out the Rules on the First Appellate Authority.

For effective implementation of the Act, the provision of the First Appellate Authority (FAA) is to be complied with strictly. For this, the appropriate initiative is required from the nodal department of the government.

43 PROACTIVE DISCLOSURE

As per Section 4 of the RTI Act, it is the obligation of every Public Authority to disclose certain information onSuo Motu basis as laid down under sub-section (1) of the Section.

As per Sub Section (2) of the Section, it shall be a constant endeavor of every Public Authority to take steps in accordance with the requirments of the clause (b) of the Section 1 to provide as much information Suo-Motu to the public at regular intervals through various means of communication including internet, so that public have minimum resourt to the use of the Act to obtain information.

It has been observed that most of the Public Authorities are not strictly complying with the provisions of the Section by proactive disclosure of the activities undertaken by the Public Authority. It is also, abserved that many of the Public Authortiyare not even having website containing upto date information. If more and more Suo-Motu disclosure is made by the Public Authorities, undoubtedly there would be less and less people to resort to this Act for seeking information. Therefore, the Commission recommends that the Chief Secretary of the State should direct all the Public Authorities of the state to comply with the provisions of the Act strictly.

Shri NimaTondrang, Secretary i/c of Arunachal Pradesh Public Service Commission, Itanagar had made an appeal vide his letter No. PSC/RTI/177/2019 dated 3rd December’2019 for review of Order and judgment on case No. APIC-155/2019/254 dated 17.12.2019 passed by Shri GotoEte, State Information Commissioner on the case of Shri Bengia Jayanta –vs- Shri Bate Koyu, PIO-cum-Deputy Secretary, Arunachal Pradesh Public Service Commission, Itanagar to the State Chief Information Commissioner, stated to be under provision of Sub Section (2 ) and (3) of Section (23) of the RTI Act 2005.

The appeal was examined by the Commission, and the Commission found no provision under the Act to re-hear the parties and set aside and quashed the oder No. APIC-155/2019/254 dated 17.12.2019 passed by Shri Goto Ete, State Information Commissioner.

Howeverr, keeping the natural justice in view the Commission has decided to give a hearing to the parties by a double bench consisting of Dr. Joram Begi, State Chief Information Commissioner and Shri Leki Phuntso , State Information Commissioner and summoned order was issued to both the parties for hearing on 23rd January 2020 at 1030 hrs.

52 The hearing was held on 23rd January’2020 at 1100 hrs, Shri Bate Koyu, PIO- cum-Deputy Secretary, APPSC, Itanagar, Shri Tumi Gangak, APIO-cum-Under Secretary, APPSC, Itanagar, Adv. Nani Anju ,the legal counselor of APPSC, Itanagar and the Appellant of the Case APIC-155/2019 (Appeal) Shri Bengia Jayanta were present during the hearing. The hearing took place at 1100 hrs due to the Appellant Shri Bengia Jayanta reached the Court late due to heavy traffic.

The State Chief Information Commissioner at the very outset made it clear that there is no provision of re-hearing the parties and set aside and quashed the oder issued by another Information Commissioner under the RTI Act-2005. However, for the sake of natural justice this hearing is being done. He has also stipulated out that the hearing would be done in 2(two) parts, first the procedural aspects and the second on the subject matter. In the procedural part, the Chief Information Commissioner asked the PIO that under what provision/ section of the RTI Act 2005 the present appeal is being made to the State Chief Information Commissioner by the PIO/ the public authority. The PIO, requested the Commission to allow Legal Counselor of the APPSC to represent him. The Legal Counselor said that the APPSC had made this appeal for re-hearing of the case No. APIC-155/2019/254 dated 17.12.2019 passed by Shri GotoEte, State Information Commissioner under Sub Section (2) and (3) of Section (23) of the RTI Act 2005. The Chief Information Commissioner said that the matter has no Sub Sections nor the said content exist under Section (23) of the RTI Act 2005 and he read out the actual content of the relevant section. It was found that the legal counselor was pleading on the basis of Sub Section (2) and (3) of Section(23) of the Central Information Commission (Management) Regulation 2007. The Chief Information Commission has told her that the said Sub Sections (2) and (3) of Section (23) have already been amended and deleted by the Central information Commission on 28th October’2008 and accordingly the Arunachal Pradesh Information Commission has also amended and deleted the Sub Sections vide U.O. No. SCIC/02/2008 dated 28th December’2008. Therefore, the appeal has no locus standi. The legal counselor also accepted the fact.

In the second part, first asked the appellant Shri Bengia Jayanta 2(two) questions. -(1) Wheather, he was a candidate of the Assistant Engineer Selection Examination (2012-13) conducted by APPSC or not and if so whether, he was candidate of Assistant Engineer (Mechanical) or Assistant Engineer (Civil) ? (2) Why he is seeking information after the lapsE of 7(seven) years and why not immediately after the declaration of the result? Shri Bengia Jayanta the appellant of the case no. APIC-155/209 (Appeal) said that he was the candidate of the Assistant Engineer Examination (2012-13) for the post of Assistant Engineer (Mechanical) not of the Civil Engineering. His answer to the second question was that he is working as Junior Engineer and posted in interior place and so could not find time earlier to seek the information. The Commission said that since he was not a candidate of Assistant Engineer (Civil) he cannot insist information of Sl.no. 3 i.e. the Detail Mark list of top 50(fifty) Civil Engineering Candidates along with Details of Marks scored in each papers during 2012 Assistant Engineer (Civil) recruitment, as sought in his Form-A.

Then the Commission asked the PIO why the information sought under S.L. No. 1, 2, and 4 were not provided to the information seeker as directed by the earlier order of the Commission. The PIO replied that they have a rule which restricts providing of such information beyond 180 days i.e. 6(six) months. The Commission asked the PIO under what section of the RTI Act 2005 the rules have been framed. The PIO has admitted that these rules have not been framed under any section of the RTI Act.

53 The Commission also said that the rules can be framed either under section 27 of the RTI Act by the appropriate government or under section 28 by the competent authority. The PIO of the Arunachal Pradesh Public Service Commission admitted that said rules have not been framed under any section of the RTI Act. The Commission referred to Section (22) of the RTI Act that any other act or rules framed is being superseded by the section of the Act in regards to disclosure of information. The Commission further said that the working rules, manuals, guidelines can be framed but within the framework of the Act and Suo Motu disclosure should be done as per Sub clause (v) of clause (b) of Sub Section (I) of Section (4) of the RTI Act 2005 and hence information sought under Sl.no.5 of Form-A by the information seeker should be provided even after lapse of 7(seven) year as per Sub-Section (3) of the Section (8) of the Act .

The Legal counselor of the Arunachal Pradesh Public Service Commission was trying to convince the State Information Commission to reconsider the case on the basis of Supreme Court judgment, Union Public Service Commission and other –vs- Angesh Kumar and other that the for the greater public interest their plea should be accepted. The Commission said that the case referred is of exemption under Section (8) and (9) of the RTI Act 2005 and the present case does not attract any of these two section of the Act and hence it does not apply.

In view of the above hearing the Commission came to the conclusion that there is no reason as to why the case No. APIC-155/2019/254 dated 17.12.2019 passed by Shri GotoEte, State Information Commissioner be set aside and quashed.

Therefore, the case is hereby disposed of.

Whereas, an appeal under Section 19(3) of RTI Act, 2005 has been received from Shri Mohammed Sajid Hussain, S/o Mohammed MujeedHussain, 9-8-168/16/A Golconda Fort Bada Bazar, Hyderabad-500008, for non-furnishing of information, by Public Information Officer, Himalayan University, Jullang Village, Near Central Jail, Itanagar, as sought, by the Appellant under section 6(1) of RTI Act, 2005 on 20/05/2019.

Whereas, the 1st hearing was held on 4th February’ 2020.Shri Kido Bagra, PIO-cum- PRO Himalayan University, Jullang, Itanagar was present during the hearing. The Appellant ShriSajidHussain was found absent. The Registrar, Himalayan University, Itanagar, vide HU/JUL./PIO/Rply/19-20/185 Dated 03.02.2020 informed the Commission that Reg. NO. 525162880082157 & Admission No. 293459 as given by the Appellant does not exist in their records and hence are not correct. The PIO informed the Commission that the Appellant was

55 asked to submit his original documents for verification but the Appellant did not submit his original documents. The PIO also informed the Commission that the Himilayan University, Jullang (Itanagar) does not offer the course of Bachelor of Science (Medical Laboratory Technology) and the Himilayan University, Itanagar began in the year 2014 and its first convocation was held on December, 2017. Whereas, the Certificate submitted by the Appellant is issued in the year 2016. Therefore, the certificate submitted by the Appellant seems to be fake, the same has been conveyed to the Appellant vide letter No. HU/JUL./PIO/Rply/19-20/185 Dated 03.02.2020.

Whereas, the Commission directed the PIO to file FIR at Itanagar Police Station and the nearest Police Station of Golconda Fort Bada Bazar, Hyderabad if they disown the Certificate and bring a copy of the same in the next date of hearing.

Whereas, the 2nd hearing was held on 18thFebruary’ 2020.Shri Kido Bagra, PIO- cum-PRO Himalayan University, Jullang, Itanagar was present during the hearing. The Appellant Shri Sajid Hussain was found absent. The PIO informed the Commission that the Registrar of the Himalayan University, Itanagar has lodged a complaint against the Appellant of cheating & forgery at Police Station, Itanagar, Arunachal Pradesh. The PIO submitted a copy of complaint received, signed and sealed by the Police Incharge, Police Station Itanagar, Arunachal Pradesh.

Whereas, the Commission viewed that the Appellant remain absent for two consecutive hearing without intimation and the PIO has disowned the certificate submitted by the Appellant and a Complaint of cheating & forgery has been lodged in the Police Station Itanagar, Arunachal Pradesh.

Therefore, the case is hereby disposed of.

JUDGMENT/ORDER

Brief fact of the case is that that the above named appellant filed an RTI application under Form-A on 07.03.2020 before the PIO of the Office of the Deputy Commissioner, Papumpare District, Yupia, whereby, seeking various information regarding Pare & Ranga NadiHydrpoElectrict Project, NEFCO Ltd Doimukh, Arunachal Pradesh. And the same, received in the Office of the PIO-cum-CO of the Office of the Deputy Commissioner, Yupia, was transferred to the District Land Revenue & Settlement Officer (DLRSO), Papumpare District, Yupia, vide letter No.PP/RTI/YPA-480 Dated- 16th of March’2020. The applicant, having not received any response from the PIO, filed a First Appeal before the Chief Secretary Govt. of Arunachal Pradesh, Itanagar, on 08.05.2020. The Chief Secretary on receipt of the First Appeal from the appellant as aforesaid issued an order for directing the PIO to prove the required information to the applicant. After such issue of the order by the State Chief Secretary PIO-cum-DLRSO of Papumpare, Yupia, vide his letter No.LR-LM/RTI -07/001(Pt-II) Dated- 26th May’2020 furnished the information sought to the applicant. The applicant, being not satisfied with the information received as incomplete, filed a Second Appeal before the Arunachal Pradesh Information Commission on 13.06.20 and Registry of the Commission, on receipt of the same registered the appeal as APIC-98/2020 and processed it to the Commission for hearing and disposal.

57 Accordingly, this appeal has come up for the first time today for hearing. Appellant Shri BengiaSagung is, though not present, represented by his learned counsel Mr. Tai Shiva (Advocate) before the Commission in person. Mr. NakapHina Nabam, PIO-cum-DLRSO of the DC’s Office, Yupia, is present through video conferencing. Both parties being heard. The PIO submitted that the all information sought have already been furnished to the appellant vide his letter dated-26.05.2020. The learned counsel for the appellant admitted to have received the information but the information furnished against Sl.No.(f) of the Form-A application is incomplete as the names of the affected persons receiving the compensations have not been disclosed. It has been revealed during the hearing that the Deputy Commissioner happened to be the First Appellate Authority of PIO-cum-DLRSO, Yupia, but the appellant, instead of filing his First Appeal before the Deputy Commissioner, Yupia, directly filed his First Appeal before the Chief Secretary of the State of Arunachal Pradesh. After hearing the parties I have also carefully read all available materials on record.

Having considered the respective submissions of the either party it appears to me that the PIO-cum-DLRSO, Yupia, is the PIO of the Land Record Department of the DC’s Office, Yupia. The appellant, who had not been responded by the PIO had a right of First Appeal for a period of 30 days from the first day of expiry of 30 days of his filing the application under Form-A before the PIO. That is to say, he had a right of First Appeal before the First Appellate Authority within a period of 30 from 08.03.2020 to 07.04.2020. And in the present case the PIO-cum-DLRSO, having been working under the administrative unit of the District Administration of Papumpare District, cannot reasonably be disbelieved to have been headed by the Deputy Commissioner, Papumpare District, Yupia, as the First Appellate Authority of the PIO. But the learned counsel of the appellant has no denial of the fact that the appellant had mistakenly filed his First Appeal before the Chief Secretary instead of filing the same before the Deputy Commissioner, Papumpare District, Yupia. Apart from filing the First Appeal before the wrong forum the appellant is found to have filed the First Appeal on 08.05.2020 after a lapse of a month of the expiry of the appeal period for filing of the First Appeal under the RTI Act. Now the fact remains that no First Appeal under sub-section (1) of Section-19 of the RTI Act has yet been filed by the appellant and without which the appellant has no legality to file this Second Appeal under sub-section (3) of Section-19 of the Act.

In view of facts and circumstances aforesaid I find this appeal fit to be dismissed. And, accordingly, this appeal is dismissed and stands disposed for once for all. Judgment/ order pronounced in the presence and hearing of the either parties on this 20th day of August’2020. Each copy of this judgment/order be furnished to the parties.

ORDER

This appeal vide No.APIC-81/2020 is a second appeal lying pending disposal before the Commission (APIC). Brief fact of the case is that the appellant filed an RTI application under Form-A before the PIO-cum-DySP, PHQ Itanagar, on 28.01.2020, whereby, seeking informations’ as under:

(1) Certified true copy of forwarding letter for forensic report of CCTV Footage in connection with WPS Case No.80/17 U/S 354/353/34 IPC R/W Sec-3 of PDPP Act.

(2) Certified true copy of detail report of CCTV Footage, sent for forensic test/confirmation in connection with above mentioned case.

PIO-cum-DySP, PHQ Itanagar, whereupon, vide her letter vide No.SPC/ITA/CR- 97/20 dated-29th January, 2020 transferred the appellant’s application to the PIO-cum- Officer-In-charge of the Itanagar Women Police Station on the very next day in terms of Section-6(3) of RTI Act, 2005. The appellant, having not received the informations’ so sought from the both PIO’s, filed the First Appeal on 27.02.2020 before the First Appellate Authority-cum-Superintendent of Police, Capital Complex, Itanagar. Appellant, again having not received any response from the FAA, filed the Second Appeal before the Arunachal

59 Pradesh Information Commission on 26.05.2020. And the Commission (APIC) on receipt of this Second Appeal registered the same, being Appeal No APIC-81/2020, and issued processes for its hearing and disposal. And, hence, the case.

Appeal came up for hearing before the Commission on 6(six) consecutive dates, i.e, on 03.09.2020, 01.10.2020, 15.10.2020, 05.11.2020, 10.12.2020 and 04.02.2021. During the first hearing on 03.09.2020 the PIO-cum-DySP, PHQ Itanagar, Smty Gari Tai submitted a written as well as a verbal submission before the Commission that since the information(s) sought were concerned with the Itanagar Women Police Station the application of the appellant seeking the said information was immediately transferred U/S 6(3) of the RTI Act, 2005 on the very next day of the receipt whereof to the PIO-cum-Officer In-Charge of the Itanagar Women Police Station with a request to her (PIO of Women PS) to directly furnish the informations’ so sought to the appellant from her end. PIO-cum-DySP, PHQItanagar, further submitted that a copy of the said letter transferring the application vide letter No.SPC/ITA/CR-97/20 dated- 29.01.2020 was also duly served to the appellant in terms of the said provisions of the RTI Act but she does not have any idea about howcome the transferee officer had not acted upon the transferred application. The Commission, after such hearing of the appellant and PIO-cum-DySP PHQ, Itanagar, including – after having careful considerations of the available materials on record, found the PIO-cum-OC WPS, Itanagar, required to be impleaded as a necessary party and, accordingly, directed for issue of a notice for her appearance in person on the next date fixed on 01.10.2020. Accordingly, on the next date fixed on 01.10.2020 the appellant and PIO-cum-DySP PHQ, Itanagar, were both present but Smty P. Taku PIO-cum OC WPS, Itanagar, was not present. However, one Smty N. Rupa the then I/C OC WPS, Itanagar, sent a letter informing the Commission that the Smty P. Taku, who had been detected positive of Covid-19, was under home quarantine. During the third hearing fixed on 15.10.2020 appellant was represented by her husband Shri Kamta Tawe and both PIOs Smty Gari Tai (DSP) and Smty P. Taku (Inspector) were present during which the representative of the appellant disclosed the fact that the PIO-cum-OC of the WPS, Itanagar, who had received his transferred application under Form-A, in lieu of furnishing the information directly to him from her end, had admittedly furnished only the information sought against item no.1 of his application through the PIO-cum-DySP PHQ, Itanagar, at belated stage sometime in the first Week of September, 2020. After hearing the parties and also after having careful considerations of the available materials on record the Commission found the PIO-cum-DySP PHQ, Itanagar, Smty Gari Tai as no more required in the proceeding and, as such, discharged from the case. However, the Commission found a prima- facie case well established against Smty/ Inspectior P. Taku, PIO-cum-OC WPS, Itanagar, liable for imposing reasonable penalty under sub-section (1) of Section-20 of the RTI Act, 2005 and, accordingly, ordered for issue of a show cause notice against her for giving her an opportunity of being heard as provided in the proviso to sub-section (1) of Section-20 of the Act as to why she should not be imposed a reasonable penalty for her refusal or neglect in furnishing the information sought under RTI Act within prescribed period of time. And, accordingly, a show cause notice dated-16.10.2020 was issued against the said Smty P. Taku with a direction to her to appear in person before the Commission on 5th of November’ 2020 for furnishing replies to the show cause notice in question.

60 The OC WPS, Itanagar, Inspector P. Taku vide letter dated 04.11.2020 furnished her written replies to the show cause notice in question and the same was placed before the Commission (APIC) for consideration during the hearing fixed on 05.11.2020. Relevant contents of the written replies to show cause notice of Inspector P. Taku reads as quoted – “ …. that sir, RTI application dated 29/01/2020 filed by Smty Rani Jamoh Tawe W/O Shri Kamta Tawe was forwarded from, PIO Smty Tai Gari, DySP (HQ) and the same was received on 31.01.2020 at Women Police Station, Itanagar which was endorsed. Due to personal reasons, I availed leave from 25 February 2020 and joined back on 4 June 2020.” During hearing of the show cause Inspector P. Taku took the same plea in her verbal submissions as made in her written submission as aforesaid. Apart from the facts as disclosed aforesaid the said OC WPS, Itanagar, further submitted, among others, that during her leave period she endorsed this RTI matter to those officer(s) taking charges of the OC WPS, Itanagar, namely, Inspector N. Rupa and Inspector M. Mibang, who could have also furnished the information sought within the stipulated period of 30 days. On such plea being raised by her (Inspector Taku) notices were issued against 2(two) other officers and were being heard on 10.12.2020. During the hearing both Officers Inspector N. Rupa and Inspector M. Mibang stated before the Commission in the presence and hearing of Inspector P. Taku that the PIO-cum-OC WPS, Itanagar, Smty P. Taku had not ever intimated or informed them anything about the RTI application of the appellant during their respective tenure as Incharge of the OC WPS, Itanagar. After hearing the said two other officers of the WPS, Itanagar, the Commission had a reason for believing of the fact that the said Inspector P. Taku had been negligent in dealing with the RTI application of the appellant and was accordingly about to pass an appropriate order against her. In the meantime, Inspector P. Taku, who was also then participating the hearing through audio video conferencing, requested the Commission for giving her one more chance of hearing in respect of the show cause notice issued against her and, accordingly, she was given a last chance of hearing in respect of the show cause aforesaid on the next date fixed on 04.02.2021.

Today is the date given as a last chance to Inspector P. Taku on her own request for a further hearing, if any, in respect of the show cause notice issued against her as to why she should not be imposed a reasonable penalty for her refusal or neglect in furnishing of the information sought under RTI Act within prescribed period of time as provided in sub-section (1) of Section-7 of the RTI Act, 2005. Appellant is present as usual but surprisingly Inspector P. Taku is not present today, i.e, on this 4th day of February’ 2021. In fact, a letter has been received from the Officer In-Charge of the Women PS, Itanagar, wherein, informing the Commission that Inspector P. Taku is on earn leave for 47 days. Since this is a date fixed on her own request for giving her a last opportunity for a further hearing in respect of the show cause notice issued against her as aforesaid and since she has neither submitted any other reason as on date other than the reason mentioned his written replies to the show cause notice for necessary consideration nor has she requested for hearing the matter on any other suitable date, I do not find any reason for giving any more chance to Inspector P. Taku for any further hearing on this aspect of the show cause notice issued against her.

61 And, accordingly, appellant being heard in absence of the PIO-cum-OC WPS, Itanagar, Inspector P. Taku in respect of the appeal along with the matter relating the show cause notice issued against the said PIO. All available materials on record,including – written & verbal replies of Inspector P. Taku to the show cause notice issued against her and the verbal statements of Ispector N. Rupa and Inspector M. Mibang, have been carefully considered. Having done so, it transpires that Inspector P. Taku, who received the RTI application of the appellant on 31.01.2020 as PIO-cum-OC WPS, Itanagar, on transfer U/S 6(3) of RTI Act, 2005 from the PIO-cum-DySP (HQ) had 25 days at her hand before she had availed a long leave from 25.02.2020 to 03.06.2020 within which she could have furnished the information to the appellant for maintaining the prescribed period of 30 days as provided under subsection (1) of Section 7 of the RTI Act. And, since furnishing of information within 30 days of receipt of the request/application is time bound under sub-section (1) of Section 7 of the RTI Act, Inspector P. Taku, by virtue of being PIO-cum-OC WPS, Itanagar, was under a bounden or lawful duty to instruct or inform the officer taking her charge of the OC WPS, Itanagar, to furnish the information so sought under RTI Act in remaining 5(days) of the prescribed period of 30 days. But those officers taking her charge as OC WPS, Itanagar, during her long leave period, namely; Inspector N. Rupa and Inspector M. Mibang have stated before the Commission on 10.12.2020 in her presence & hearing through audio/video conferencing that she (Inspector P. Taku) had not ever intimated or informed them (Inspector Rupa & Inspector Mibang) anything about RTI application of the appellant which goes without saying that Inspector P. Taku had been negligent either in furnishing of the information by herself within 25 days of her receipt of the RTI application or in getting the same furnished by the Officer(s) taking her charge as OC WPS, Itanagar, in remaining 5 days of the prescribed period of 30 days from the date of her receipt of the application on 31.01.2020.

In view of the facts and circumstances as discussed aforesaid Inspector P. Taku, PIO-cum OC WPS, Itanagar, is found liable for imposing a reasonable penalty under subsection (1) of Section 20 of the RTI Act, 2005. And, accordingly, she is held liable for imposing penalty under the Act and ordered as follows:

1. That, PIO-cum-OC WPS, Itanagar, Inspector P. Taku shall pay a fine amounting to Rs.25000/-(rupees twenty five thousand) only until before next date of hearing fixed on 18.03.2021. The fine amount shall be deposited through challan payment in the name of the Registrar of the Arunachal Pradesh Information Commission (APIC), Itanagar, against the Head of Account No.0070.

2. That, she shall also pay a compensation amount of Rs.5000/-(rupees five thousand) only to the appellant until before the next date of hearing as mentioned above for the losses and suffering meted to her (appellant) for filing of this Appeal. This compensation amount shall be paid in the mode convenient to the PIO.

62 3. That, she shall submit all records or payment receipts made against both fine and compensation to the Commission on or before the next date of hearing for enabling the Commission for final disposal and closure of this appeal.

4. In the event of her neglect or failure in complying with all or any of the above order(s) the provisions of sub-section (2) of Section 20 of the RTI Act, 2005 for a disciplinary proceeding against her under the related service rules applicable to her may be invoked.

JUDGEMENT ORDER

The appeal under section 19(3) of RTI, Act,2005 has been received from Shri Mamu Sono, appellant Middle Sood Village, Naharlagun, Papumpare District, Arunachal Pradesh, for non-furnishing of information by the Public Information Officer O/o the Tax & Exercise Department, Itanagar, Papumpare, Dist. Arunachal Pradesh as sought, by the appellant under section 6 (1) of RTI Act,2005 on dtd 01.11.2019.

Whereas, the 1st hearing was held on 17th February the appellant Shri Mamu Sono, appellant Middle Sood Village, Naharlagun, Papumpare District, Arunachal Pradesh was present in the hearing while , Shri Tago Koyu, APIO Tax, Exercise & Narcotic Department was present.

64 Heard both the parties. The APIO stated that whatever information sought by the appellant had already furnished to the appellant and sent by register post but the appellant did not received the copies of information furnish by APIO due to postal delay and so on.

However the APIO admitted that he will furnish the information as sought by appellant on 2nd March 2020. In view of the Commission has fixed next date of hearing on 2nd March 2020 at 10.30 am in this Commission.

The 2nd hearing was on 2nd March 2020, both appellant and PIO were present in the hearing. The appellant informed that the information regarding mode of appointment of candidates should be submitted in column wise and APIO assured to furnish information as desired by appellant latest by 9th March 2020.The Commission directed the appellant to inform the Commission whether he is satisfied or not satisfied within stipulated date. The appellant further stated that the information sought at Sl. No (d) & (e) has been dropped since he wants to file afresh application on same matter. Till such time the instant case has been kept reserved. Hoverer, later on an application had received from Shri Mamu Sono, appellant Middle Sood Village, Naharlagun, Papumpare District, Arunachal Pradesh and informed that he wants to disposed of the case NO.APIC 21/2020. The appellant stated that whatever information furnished by PIO has been satisfied and requested for closure of the appeal.

Therefore, the Commission in view of that further hearing of same case No.APIC- 21/2020 is not necessary.

Hence, the instant case is disposed off herewith today 09.03.2020. The judgment order is forwarded to both the parties for information.

JUDGEMENT ORDER

The 4th hearing was held on 13.03.20.The PIO E.E Shri Taluk Jiram, RWD Division, Daporijo and PIO O/o the Chief Engineer RWD, Itanagar was also present. During the hearing Shri Tatum Nima appellant informed the Commission that he is not satisfied with the information furnished to him. Since the utilization Certificate was not furnished to him by PIO of Chief Engineer, Office RWD, Itanagar till 13.03.20. The Commission received application from the appellant wherein he had informed that Utilization Certificate (UC) is not furnished by PIO of Chief Engineer Office, Itanagar. The Commission asked the PIO that as to why he could not furnished the Utilization Certificate as of now. The PIO replied that he did not receive any order from the Commission to furnish particular information to the appellant by him.

66 However, the PIO said that he had received the hearing notice of dtd 11.03.2020. So he appeared on the day of hearing on 13.03.20.

Therefore, heard both appellant and PIO of Chief Engineer, RWD, Office Itanagar. During the course of hearing the PIO, Daporijo was present informed that he had furnished all the required information to appellant pertaining to the jurisdiction of his division and said that remaining documents related to Kamle District has been transferred to EE, RWD Raga under Kamle District for the necessary action.

While enquiring about Utilization Certificate of PMGSY Scheme of CE Office RWD, Itanagar informed and assured that he would furnish within a day or two i.e before 16.03.20 to appellant .The appellant has been directed collect and inform the Commission accordingly and at the same time PIO has been directed to provide the documents without further delay.

In view of above observation the appeal is reserved till 16.03.20 for final disposal of appeal.

After passing the Order by this Commission the PIO of Chief Engineer Office, Itanagar has furnished the Utilization Certificate for the period of 2018-19 and also up to 22.01.20 respectively. The appellant informed the Commission that he had received the information sought by him on 13.03.20 copy of letter submitted by appellant is available in the file.

Now therefore no further hearing of appeal is necessary. Hence, the instant case is disposed off wherewith today dtd 13,03.20.

Copy of the Order is forwarded to the concerned appellant and PIO’s for information.
