2005 -- S 1111 ======= LC03333 ======= STATE OF RHODE ISLAND IN GENERAL ASSEMBLY JANUARY SESSION, A.D. 2005 ____________ A N A C T RELATING TO THE GENERAL ASSEMBLY - COMPOSITION OF THE SENATE Introduced By: Senators Ruggerio, Alves, Lanzi, Tassoni, and Badeau Date Introduced: May 19, 2005 Referred To: Senate Judiciary It is enacted by the General Assembly as follows: 1 SECTION 1. Section 22-1-2 of the General Laws in Chapter 22-1 entitled "Composition 2 of Senate" is hereby amended to read as follows: 3 22-1-2. Districts. -- [Note: This section is set out as it appears in P.L. 2002, ch. 4. 4 However, the director of law revision of the joint committee on legislative services anticipates 5 several substantive errors that will require further legislative action. Section 22-11-3.4 precludes 6 the presentation of these expected changes, as such action would exceed the authority granted.] 7 The state is hereby divided into thirty-eight (38) senatorial districts bounded and described as 8 follows: 9 (1) It is understood and intended that for the purpose of this section a line described as 10 running on, along, to or through any street (including road, avenue, lane, way, parkway, 11 expressway, divided highway, state route or interstate route, or trail), stream or river, is intended 12 to mean the center line of that street, stream or river, in all instances, unless it shall be otherwise 13 specified. 14 (2) It is further understood and intended that for the purpose of this section, the districts 15 described in this section shall be composed of United States census geography (tracts and blocks), 16 as defined by the 2000 version of the "TIGER" files from the United States Census Bureau, 17 whose boundaries correspond to the below metes and bounds set forth in this section and which 18 are hereby made a part of this chapter. A listing of which census blocks are contained within each 19 district shall be deemed to be incorporated by reference. 1 (3) (i) It is further understood and intended that for the purpose of this section, the 2 districts will be depicted on thirty-nine (39) maps, compiled by Election Data Services, Inc. for 3 each city and town, and hereinafter may be referred to as town maps. 4 (ii) The secretary of state shall keep a copy of each set of the foregoing maps and a copy 5 of the census tract and block listing available for inspection during ordinary business hours at his 6 or her office. The secretary of state shall furnish each city and town a copy of the town map 7 covering that particular city or town within ten (10) days from the passage of this act. 8 (iii) For purposes of this title, references to "tract" or "CT" shall mean "census tract", as 9 that demographic unit is established by the United States Bureau of the Census for the 2000 10 census as described by maps and publications of the bureau. References to "block", "blocks", 11 "block groups", "enumeration district", or "enumeration districts", refer to those demographic 12 units as established by the United States Census Bureau for the 2000 census as described by maps 13 and publications of the bureau. 14 (iv) Any reference to a "city or town", "city or town boundaries", or "city or town limits" 15 shall refer to the boundaries or limits of the particular city or town as they existed on January 1, 16 2000. 17 (v) In the census tract and block listing, the first two (2) digits of a census description 18 shall refer to the state of Rhode Island (44), the next three (3) digits of a census description shall 19 refer to the county in which the district lies. Bristol county carries the code 001; Kent county 20 carries the code 003; Newport county carries the code 005; Providence county carries the code 21 007 and Washington county carries the code 009. The next six (6) digits refer to the census tract 22 within the county set forth in the description. The last four (4) digits refer to the census block 23 within the census tract. "TIGER" is an acronym for the computer readable geographic data base 24 that automates the mapping and related geographic activities required to support the United 25 States' Census Bureau's census and survey programs and stands for "Topologically Integrated 26 Geographic Encoding and Referencing." 27 (vi) If any census tract, block, block group, or enumeration district is omitted, listed 28 more than once, or is only partially provided for, it is intended that the districts be defined in such 29 a manner as to not omit any area of Rhode Island from a district and to comply with the standard 30 of Articles VII and VIII of the Rhode Island Constitution requiring that districts be reasonably 31 equal. In order to carry out the intent of the general assembly as expressed in this section the 32 secretary of state, shall if necessary, undertake measures to insure compliance with this section. 33 (vii) In the event of a discrepancy between the metes and bounds description, the 34 description of census tracts and blocks, and the maps which shall be on file with the secretary of 2 1 state, then the listing of census tracts and blocks shall take precedence and be controlling. 2 The first senatorial district shall consist of all of that part of the city of Providence 3 bounded by a line beginning at the intersection of Academy street and Smith street; thence 4 southeasterly along Smith street to Oakland avenue; thence northerly on Oakland avenue to Eaton 5 street; thence westerly on Eaton street to Huxley avenue; thence northerly on Huxley avenue to 6 Admiral street; thence easterly on Admiral street to Douglas avenue; thence northwesterly on 7 Douglas avenue to Corina street; thence northeasterly on Corina street to Appian street; thence 8 northwesterly on Appian street to Corina street; thence northeasterly on Corina street to Glasgow 9 street; thence southeasterly on Glasgow street to Anchor street; thence northeasterly on Anchor 10 street to Yorkshire street; thence easterly on Yorkshire street to Hawkins street; thence 11 northeasterly on Hawkins street to Branch avenue; thence southeasterly on Branch avenue to 12 Charles street; thence northerly on Charles street to Marietta street; thence northeasterly on 13 Marietta street to Hall street; thence northerly on Hall street to Ledge street; thence easterly on 14 Ledge street to Job street; thence northerly on Job street to De Pinedo street; thence easterly on 15 De Pinedo street to Silver Spring street; thence northeasterly on Silver Spring street and 16 continuing on Selkirk street to the Providence-Pawtucket boundary line; thence easterly along the 17 Providence-Pawtucket boundary line to Hillside avenue; thence southeasterly on Hillside avenue 18 to Chace drive; thence southerly on Chace drive to Chace avenue; thence westerly on Chace 19 avenue to Highland street; thence southwesterly on Highland street to 3rd street; thence 20 southeasterly on 3rd street to Creston way; thence northeasterly on Creston way to Summit 21 avenue; thence southeasterly on Summit avenue to Memoria l road; thence westerly on Memorial 22 road to Camp street; thence southerly on Camp street to Woodbine street; thence westerly on 23 Woodbine street to Main street; thence southwesterly on Main street to Branch avenue; thence 24 northwesterly on Branch avenue to interstate route 95; thence southerly on interstate route 95 to 25 the New York, New Haven and Hartford Railroad; thence southerly on the New York, New 26 Haven and Hartford Railroad to Smith street; thence easterly on Smith street to Canal street; 27 thence southeasterly on Canal street to the Providence River; thence southeasterly on the 28 Providence River to Exchange terrace; thence southwesterly on Exchange terrace to Memorial 29 boulevard; thence westerly on Memorial boulevard and continuing on Rhode Island route 10 and 30 U.S. Highway 6 to Atwells avenue; thence westerly on Atwells avenue to Mount Pleasant avenue; 31 thence northerly on Mount Pleasant avenue to Chalkstone avenue; thence easterly on Chalkstone 32 avenue to Rowan street; thence northerly on Rowan street to Glover street; thence northeasterly 33 on Glover street to Home avenue; thence northeasterly on Home avenue to Farm street; thence 34 easterly on Farm street to Academy avenue; thence northerly on Academy avenue to the point of 3 1 origin. 2 The second senatorial distric t shall consist of all of that part of the city of Providence 3 bounded by a line beginning at the intersection of Rhode Island route 10 and Westminster street; 4 thence easterly on Westminster street to Messer street; thence southerly on Messer street to Wood 5 street; thence easterly on Wood street to Sycamore street; thence southerly on Sycamore street to 6 Chapin avenue; thence easterly on Chapin avenue to Cranston street; thence northeasterly on 7 Cranston street to Dexter street; thence southeasterly on Dexter street to Cromwell street; thence 8 easterly on Cromwell street to Elmwood avenue; thence northerly on Elmwood avenue to Parkis 9 avenue; thence easterly on Parkis avenue to Broad street; thence southeasterly on Broad street to 10 Hawthorne avenue; thence southwesterly on Hawthorne avenue to F.C. Greene Memorial 11 boulevard; thence southeasterly on F.C. Greene Memorial boulevard to Park path; thence 12 southeasterly on Park path to F.C. Greene Memorial boulevard; thence easterly on F.C. Greene 13 Memorial boulevard and continuing on Montgomery avenue to the Cranston-Providence 14 boundary line; thence southerly and westerly along the Cranston-Providence boundary line and 15 continuing northerly and westerly along the Cranston-Providence boundary line to Rhode Island 16 route 10; thence northerly on Rhode Island route 10 to the point of origin.
