THE CHICKEN MARKETING PLAN REGULATIONS – BASE QUOTA LEASING Order No. 75/16. CHICKEN FARMERS OF SASKATCHEWAN board, pursuant to the provisions of The Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 All transactions in which a licensed producer leases their base quota (leaser) to another licensed producer (lessee) must adhere to the requirements outlined in this Order. 958 THE SASKATCHEWAN GAZETTE, MAY 6, 2016

2 A lease application must be made on the basis of kilograms of base quota to be produced in a given production period. 3 A complete, written lease quota application signed by both the leaser and lessee must be: (a) submitted to the Board office four weeks prior to the lessee’s chick placement date; (b) limited to one production period at a time; and (c) include any other information that the board requires. 4 Subject to section 5, the maximum allowable amount of quota that may be leased out by any licensed producer at any given time is 35% of that producer’s base quota. 5 More than 35% of a producer’s base quota may be leased at any given time upon the approval of the Board and request of the leaser if: (a) an “Act of God” requires a licensed producer’s production unit to be out of operation for a period of time; (b) a start-up period of no longer than seven (7) production periods is needed to allow for new licensed producers to build or acquire production units acceptable for production; or (c) a grace period of no longer than seven (7) production periods is needed to allow existing licensed producers who have acquired additional base quota to build or acquire additional production unit capacity. 6 Production Period is defined in Order No. 66/11: Base Quota Allocations. 7 Any lease authorization granted by the Board may be subject to terms and/or conditions that the Board considers appropriate in the circumstances. 8 The leaser and lessee are: (a) jointly responsible for the marketing of chicken in accordance with these regulations; and (b) jointly and individually liable for: (i) all service charges and levies assessed pursuant to these regulations; and (ii) any judgment obtained in respect of service charges or levies assessed pursuant to these regulations. 9 The Board shall not allow a lease of base quota from a leaser to a lessee if: (a) either party has outstanding service charges, overproduction penalties or levies payable to the Board; or (b) the proposed lessee would exceed the base quota limit established by these regulations. 10 No subleasing of base quota shall be permitted. 11 Order No. 59/11: Base Quota Leasing shall be revoked. 12 This order will remain in effect for a period no longer than five years from the date this order is approved by the Agri-Food Council. Order No. 75/16 is made pursuant to clause 7(y) and section 32 of The Chicken Marketing Plan Regulations and shall be effective upon the date of this Order.
