JOURNALS OF THE SENATE AND HOUSE OF REPRESENTATIVES OHIO SENATE JOURNAL WEDNESDAY, OCTOBER 9, 2019 SENATE JOURNAL, WEDNESDAY, OCTOBER 9, 2019 1261 ONE HUNDRED TWELFTH DAY Senate Chamber, Columbus, Ohio Wednesday, October 9, 2019, 1:30 p.m. The Senate met pursuant to adjournment. Prayer was offered by Pastor Brian Hanson, Grace Baptist Church in Cedarville, Ohio, followed by the Pledge of Allegiance to the Flag. The journal of the last legislative day was read and approved. The following guests were recognized by the Senate prior to the commencement of business: Senator Craig honored Franklin County Public Health on its 100th Anniversary. Senator Antonio recognized Mike and Jaret Gold on their visit to the Statehouse. Senator Craig recognized Hailey Kaye as a new staff member in his office. Senator Hottinger recognized Annie Bowen on her visit to the Statehouse. Senator Peterson requested a moment of silence in memory of Bret Wiseman. On the motion of Senator Peterson, the Senate advanced to the ninth order of business. OFFERING OF RESOLUTIONS Senators Obhof and Peterson offered the following resolution: S. R. No. 382-Senators Obhof, Peterson. Relative to the election of Louis W. Blessing III, to fill the vacancy in the membership of the Senate created by the resignation of Lou Terhar of the 8th Senatorial District. WHEREAS, Section 11 of Article II of the Ohio Constitution, provides for the filling of a vacancy in the Senate by election by the members of the Senate who are affiliated with the same political party as the person last elected to the seat which has become vacant; and WHEREAS, Lou Terhar of the 8th Senatorial District has resigned as a member of the Senate effective September 30, 2019, thus creating a vacancy in the Senate; now therefore be it 1262 SENATE JOURNAL, WEDNESDAY, OCTOBER 9, 2019 RESOLVED, By the members of the Senate who are affiliated with the Republican party, that Louis W. Blessing III (Republican), having the qualifications set forth in the Ohio Constitution and the laws of Ohio to be a member of the Senate from the 8th Senatorial District, is hereby elected, pursuant to Section 11 of Article II of the Ohio Constitution, as a member of the Senate from the 8th Senatorial District, to fill the vacancy created by Lou Terhar; and be it further RESOLVED, That a copy of this Resolution be spread upon the journal of the Senate together with the yeas and nays of the members of the Senate affiliated with the Republican party voting on the Resolution, and that the Clerk of the Senate shall certify the Resolution and the vote on its adoption to the Secretary of State. The question being, "Shall the resolution, S. R. No. 382, be adopted?" The yeas and nays were taken and resulted – yeas 22, nays 0, as follows: Those who voted in the affirmative were: Senators Brenner Burke Coley Dolan Eklund Gavarone Hackett Hoagland Hottinger Huffman, M. The title was agreed to. Senator Blessing appeared at the bar of the Senate and was administered the oath of office by the Honorable Larry Obhof, President of the Ohio Senate. On the motion of Senator Peterson, the Senate reverted to the first order of business, reports of reference and bills for second consideration. REPORTS OF REFERENCE AND BILLS FOR SECOND CONSIDERATION Senator Obhof reports for the standing committee on Rules and Reference, recommending that the following bills and resolution, standing in order for second consideration, be referred to committee as recommended: S. To amend sections 149.43, 2919.13, 3701.79, and 3701.99 and to enact section 3701.792 of the Revised Code to require reports to be made after a child is born alive following an abortion or attempted abortion and to establish certain civil or criminal penalties for failing to preserve the health or life of such a child. To the Committee on Health, Human Services and Medicaid. S. B. No. 209 -Senator Williams To amend Section 285.10 of H.B. 529 of the 132nd General Assembly to modify the purpose of a capital appropriation. To the Committee on Finance. S. B. No. 213 -Senator Brenner To amend sections 5901.02, 5901.03, and 5901.05 and to enact section 5901.10 of the Revised Code to modify Veterans Service Commission Law and to mandate each county veterans service commission to establish a veterans service committee. To the Committee on Local Government, Public Safety and Veterans Affairs. YES - 12: DAVE BURKE, WILLIAM P. COLEY, II, MATT DOLAN, JOHN EKLUND, JAY HOTTINGER, SEAN J. To the Committee on General Government and Agency Review. Sub. H. B. No. 123 -Representatives Holmes, G., Manning, G., et al. To amend sections 149.433, 3313.536, 3313.60, 3313.951, 3314.03, 3319.073, 3319.31, 3326.11, 3328.24, and 3737.73; to amend, for the purpose of adopting a new section number as indicated in parentheses, section 3313.536 (5502.262); and to enact sections 3301.221, 3313.669, 3313.6610, 3313.6611, and 5502.263 of the Revised Code to enact the "Safety and Violence Education Students (SAVE Students) Act" regarding school security and youth suicide awareness education and training. To amend section 4509.101 of the Revised Code to waive the fee for filing a petition for limited driving privileges for an individual who qualifies as indigent and whose license is suspended as a result of failure to maintain proof of financial responsibility, and to authorize a court to grant such limited driving privileges on a first offense. To amend sections 3314.03, 3323.11, 3326.11, and 3328.24 and to enact sections 3319.077 and 3319.078 of the Revised Code with regard to professional development for screening and intervention for children with dyslexia. No. 204 -Senators Schuring, Sykes To enact sections 308.20, 308.21, 308.22, 308.23, 308.24, 308.25, 308.26, 308.27, 308.28, and 308.29 of the Revised Code to authorize the creation of an airport development district for the purpose of funding public infrastructure improvements and attracting airlines and additional flights to a qualifying airport. To amend sections 959.131, 959.99, and 2953.36 of the Revised Code to increase the penalties for serious acts of cruelty towards or the killing of a companion animal. To the Committee on Judiciary. No. 206 -Senator Schaffer To enact section 718.17 of the Revised Code to require municipal corporations with more than $100 million in annual income tax collections to provide a tax credit to nonresident taxpayers.
