MAKE PLANS NOW TO ATTEND TRANSPORTATION DAY FEB. 14

West Virginians for Better Transportation will join together on February 14, 2013 at 9:30 a.m. at the State Capitol to educate lawmakers about the challenges facing our state’s transportation system. The 2013 Transportation Day at the Capitol will be held on the second day of the 60-day legislative session, and participants will have an opportunity to attend a joint session of the House and Senate transportation committees being held that day.

“We have an opportunity on February 14 to educate and emphasize the importance of our transportation system and our industry to our state lawmakers,” WVBT Board Member Bob Orders, Orders Construction Company, said. “As employers, we seldom visibly band together in numbers.” CAWV members are urged to attend the event.

“Here’s a chance to show up and be counted. There is no reason why every member shouldn’t have someone at Transportation Day at the Legislature on February 14,” he said. “We need a strong show of support from our CAWV members. That will send a clear message: WVBT Transportation Day is about JOBS! Our JOBS! Better JOBS!”

The CAWV will provide safety vests and talking points to make our group – and our message - highly visible to lawmakers. Parking is available at the Laidley Street lot and shuttle service will be provided to the Capitol.

EXCITING LINE UP OF SPEAKERS PLANNED FOR CAWV MIDYEAR MEETING

CAWV Program Committee Chairman C.R. Neighborgall IV is pleased to announce the informative line-up of speakers which has been arranged for the 2013 Midyear Meeting being held January 25-30, at the Ritz Carlton Grand Cayman. “We have organized an educational program that hits all facets of the construction industry,” Chairman Neighborgall said. “The goal of the meeting is for everyone to leave with tools and knowledge they can use to strengthen their businesses.” The Program Committee has planned an excellent mix of educational programs, division meetings and social outings. The meeting will feature a number of social and island activities to complement the informative business sessions.

Nearly 300 CAWV members are registered to attend the meeting. Information on the tours and activities that have been arranged by the association was set to attendees last week. AGC RELEASING 2013 CONSTRUCTION HIRING & BUSINESS OUTLOOK JANUARY 14

AGC of America will release the results of the 2013 Construction Hiring and Business Outlook - put together by AGC and Computer Guidance, Inc. - this Monday, January 14. SENATE & HOUSE RE-ELECT LEADERS – SESSION BEGINS FEB. 13

Senate President Jeff Kessler (D-Marshall) and House Speaker Rick Thompson (D-Wayne) have been re-elected to lead the state's two legislative bodies for the next two years. Kessler has been a member of the Senate since 1997, and was elected President in November 2011 to fill the vacancy left by then Senate President , who became Acting Governor. Speaker Thompson is beginning his eighth term in the House, and his fourth term as Speaker.

As expected, Senator Joe Minard (D-Harrison) was elected as the new Senate Clerk. Governor Tomblin will soon appoint a replacement in the Senate for Minard. The governor has three recommendations for a replacement. House Judiciary Chairman Tim Miley, Delegate and Commissioner Mike Romano were submitted by the 12th Senatorial District Executive Committee. Newly elected state Agriculture Commissioner Senator Walt Helmick (D- Pocahontas) will resign next week and the governor will receive a list of three from that senatorial district. The newest member of the Senate, (D-Ohio) was sworn in earlier this week to replace Senator Orphy Klempa, who was elected to the Ohio County Commission.

The 81st Legislature was sworn in on Wednesday, January 9. The composition of the House of Delegates will be more bi-partisan with a Democratic majority of 54-46. The 60-day regular session will convene on Wednesday, February 13, and adjourn on Saturday, April 13.

SEN. ROCKEFELLER ANNOUNCES RETIREMENT

At a press conference held today, January 11, U.S. Senator Jay Rockefeller (D-WV) announced he will not seek re-election. Sen. Rockefeller has served West Virginia for five terms. “As I approach 50 years of public service in West Virginia, I’ve decided that 2014 will be the right moment for me to find new ways to fight for the causes I believe in and to spend more time with my incredible family,” Sen. Rockefeller said. Seven-term U.S. Representative Shelley Moore Capito (R-WV) announced her plans to run for Sen. Rockefeller’s seat in 2014.

2013 CAWV MEMBERSHIP DIRECTORY/BUYERS GUIDE PROMOTES MEMBERS STATEWIDE

The 2013 CAWV Membership Directory / Buyers Guide was sent this week to state and federal agencies, coal companies, oil and natural gas producers and manufacturing businesses throughout the state. Procurement officers at the county, state and federal level now have members’ names and contact information at their fingertips. The Directory lists members alphabetically, by region, and by the products and services they provide. Through the years, the Directory has become a one-stop-shop for those looking for contractors, subcontractors and suppliers.

The Directory was mailed this week and should have arrived on members' desks. Members are encouraged to familiarize themselves with the publication which features information about the CAWV, contact details for federal and state agencies, tax rates, and phone numbers for local municipalities. Each member firm receives one free copy of the directory. Additional copies are available at $15 each. ORDER YOUR CAWV LICENSE PLATES NOW - APPLICATION ONLINE

Members can show their support for the construction industry and elevate the reputation of construction as a career choice by signing up for an official Division of Motor Vehicles - issued “Hard at Work” license plate. (Final may vary slightly). An application is available on the association’s homepage at www.cawv.org. Companies can submit multiple applications by completing a form for each vehicle and submitting one check to cover the total fee. The initial cost, payable to the CAWV Scholarship Foundation, is $70. This includes a one-time $40 fee for the license plate and the normal $30 yearly registration fee. Annual renewals are $45. The entire license plate fee goes directly to the State Road Fund. All Class A vehicles, which includes anything under 10,000 pounds, are eligible for the plate. Please pass the application along to your co-workers, employees, friends and family members and consider them for your vehicle fleet and personal vehicles. OSHA FORM 300A POSTING DATE APPROACHING - STARTS FEBRUARY 1

Many companies are required to post an OSHA Form 300A. This is a summary log of all work- related injuries and illnesses that occurred at a place of business in 2012. The posting period is from February 1 through April 30, 2013. You can download forms 300, 300A, 301 from OSHA's Injury & Illness Recordkeeping Forms Web page. This mandate is part of OSHA's Recording and Reporting Occupational Injuries and Illnesses Standard, 29 CFR 1904.

HIGHER EDUCATION OFFICIALS SUBMIT $18 MILLION FUNDING LIST

State higher education officials have submitted $18 million worth of capital improvements at the state's four-year colleges and community colleges, and they want the state Legislature to pay more than half of the cost. Richard Donovan, senior director of facilities for the state Higher Education Policy Commission, said the list was cut down from a total of about $1 billion in funding requests from colleges. The list includes 33 projects at four-year institutions, and 10 projects at community and technical colleges. The projects would require $10 million of appropriations from the Legislature, with the remainder to be funded by the institutions.

West Virginia University has the most projects on the list, totaling $3.83 million. However, three of those projects are at the WVU Institute of Technology campus in Montgomery. That includes $1.25 million to upgrade the campus' main electrical feed, $200,000 to replace an elevator in the engineering lab, and $105,000 for engineering classroom upgrades. Marshall had the second-largest amount of requests on the priority list, at $3.05 million, including $1.04 million for emergency generators. January 11, 2013 Seven Common Accident Causes

Consider this statistic: 80 out of every 100 accidents are the fault of the person involved in the incident. Unsafe acts cause four times as many accidents and injuries as unsafe conditions.

Accidents occur for many reasons. In most industries, people tend to look for "things" to blame when an accident happens, because it's easier than looking for "root causes," such as those listed below. Consider the underlying accident causes described. Have you been guilty of any of these attitudes or behaviors? If so, you may have not been injured…but next time you may not be so lucky.

1. Taking Shortcuts: Every day we make decisions we hope will make the job faster and more efficient. But do time savers ever risk your own safety, or that of other crew members? Short cuts that reduce your safety on the job are not shortcuts but an increased chance for injury.

2. Being Over-Confident: Confidence is a good thing. Overconfidence is too much of a good thing. "It'll never happen to me" is an attitude that can lead to improper procedures, tools, or methods in your work. Any of these can lead to an injury.

3. Starting a Task with Incomplete Instructions: To do the job safely and right the first time you need complete information. Have you ever seen a worker sent to do a job, having been given only a part of the job's instructions? Don't be shy about asking for explanations about work procedures and safety precautions. It isn't dumb to ask questions; it's dumb not to.

4. Poor Housekeeping: When clients, managers or safety professionals walk through your work site, housekeeping is an accurate indicator of everyone's attitude about quality, production and safety. Poor housekeeping creates hazards of all types. A well maintained area sets a standard for others to follow. Good housekeeping involves both pride and safety.

5. Ignoring Safety Procedures: Purposely failing to observe safety procedures can endanger you and your co-workers. You are being paid to follow the company safety policies-not to make your own rules. Being "casual" about safety can lead to a casualty!

6. Mental Distractions from Work: Having a bad day at home and worrying about it at work is a hazardous combination. Dropping your 'mental' guard can pull your focus away from safe work procedures. You can also be distracted when you're busy working and a friend comes by to talk while you are trying to work. Don't become a statistic because you took your eyes off the machine "just for a minute."

7. Failure to Pre-Plan the Work: There is a lot of talk today about Job Safety Analysis. JSA's are an effective way to figure out the smartest ways to work safely and effectively. Being hasty in starting a task, or not thinking through the process can put you in harms way. Instead, Plan Your Work and then Work Your Plan.

WVDOH RELEASES SIX MONTHS REVENUE FIGURES

West Virginia Division of Highways revenues for the first six months of the fiscal year are running ahead of projections and above revenues from the previous year. Total revenue through December total $340.6 million compared to the Governor’s estimate of $335.6 million and $333.6 million collected during the same period last year. Gas tax revenue continues to remain on target with $210 million collected, up from $204 million last year. The wholesale gas tax increased 1.3 cents January 1, from 33.4 cents to 34.7 cents per gallon. The wholesale tax is based on the average wholesale price of gas and is calculated each year. The tax generates about $14 million per penny.

The state’s Privilege Tax, which is the five percent tax on vehicles, continues to increase following several years of declines. Collected revenues are $90.7 million, which is slightly above the Governor’s estimate of $89 million and holds steady actual FY2012 collections. As car and truck sales increase, revenues increase since the tax is indexed to the value of the vehicle.

Registration fees show some lagging from years past. Revenues at $38.8 million are 5.7 percent under estimates. Although revenue is consistent with the previous year’s collections, it is down from the $41.2 million Governor’s Estimate. Under the assumption that West Virginians are driving the same number of vehicles they have in the past, registration fees should be fairly consistent.

HIGHWAY STUDY COMMITTEE RECOMMENDS TRANSPORTATION NEEDS $1.13 BILLION MORE A YEAR

An infrastructure committee of the Governor’s Blue Ribbon Commission on Highways (BRHC) is recommending that the full commission consider finding ways to provide the State Road Fund with $1.13 billion more a year to stop deterioration of the current road, bridge and highway system and to enable the construction and expansion of new projects. The committee was provided information from the state Department of Transportation that showed current funds are inadequate to maintain/preserve the existing system and that no funds are available for new construction or expansion projects.

“The committee concluded that, based on the information provided, if no increase in funding is provided the quality level of the highway system will continue to deteriorate at an alarming rate leading quickly to a very unsatisfactory level of service,” said Joe Deneault, who chairs the infrastructure committee. The committee’s recommendation is to provide an additional $750 million a year to preserve and improve the state’s existing roads, bridges and highways and to provide an additional $380 million a year to fund key construction or expansion projects over the next 20-25 years. The report now moves to the BRHC’s revenue committee, which is tasked with exploring a variety of ways to fund the state’s transportation needs….now and into the future.

The special study group was been formed in July 2012 by Governor Earl Ray Tomblin to examine the condition and needs of the state’s transportation system and develop a long-term strategic plan of action, including recommendations on funding. WVDOH SPECIFICATION BOOK UPDATE

There has been some confusion lately regarding the availability of copies of the 2010 WVDOH Standard Specifications for Roads and Bridges. This publication IS still available for purchase from the Contract Administration Division. That is especially good news for individuals taking technician exams who are in need the spec book for reference during the exam. Students are not allowed to use computers, electronic tablets on similar devices during exams.

Students also need copies of the new 2013 Supplemental Specifications dated January 2, 2013, which is available as an electronic document now on the DOH website (click here to view). Printed copies should be available from the DOH by February 1. The 2013 Supplemental is applicable to the January 15 letting and all subsequent lettings.

U.S. HOUSE TRANSPORTATION AND INFRASTRUCTURE CHAIR LAYS OUT AGENDA

New U.S. House Transportation and Infrastructure Committee Chairman Bill Shuster (R- PA) said this week that the panel will make sure transportation is a high priority in the 113th Congress. "Our national transportation system binds us together," Chairman Shuster wrote in an op-ed published in Roll Call. "Working together in the 113th Congress, the committee will focus on strengthening America’s national transportation network to make us more efficient, more competitive and more prosperous. This is an important responsibility of government — especially the federal government." Rep. Shuster said the panel would focus on passing new funding bills for waterways and rail programs early in his tenure as Transportation Committee Chairman. He also promised that he would "pursue an aggressive oversight agenda," specifically as it relates to implementation of the $105 billion transportation bill that was approved by Congress last year. The Federal Aviation Administration and other transportation-related agencies will also be under the watchful eye of the Transportation Committee, Shuster continued.

Even as he talked of monitoring the implementation of the current funding bill for road and transit projects, however, Rep. Shuster said the Transportation Committee would begin right away preparing for the next highway authorization bill. "Preparing for the reauthorization of surface transportation programs, which expire on Sept. 30, 2014, will be a priority of the committee," he said of the Moving Ahead for Progress in the 21st Act (MAP-21). Shuster said the Highway Trust Fund, was "facing its own version of a fiscal cliff in the coming year," making it necessary for lawmakers to consider other funding mechanisms for road and transit development.

The President of the U.S. Chamber of Commerce Thursday said it was time for the federal government to “quit fooling around” with the transportation trust that fuels many state and local infrastructure projects and called for an increase in the gas tax. “You don’t need a lot,” President Thomas Donohue said during a press conference. “You do a little bit a year for a couple of years and it’ll make a big difference.” Donohue noted that the gas tax meant to fully fund the U.S. highway transportation trust fund is no longer sustaining the highway program. “A lot of people in the Chamber get a little squishy because a lot of people on [Capitol] Hill don’t like anything that sounds like a tax,” Donohue said. “It’s not a tax, it’s a user fee. And if you don’t want to ride on the roads you don’t have to pay for it.”

WVDOH ANNOUNCES NEW WARM MIX ASPHALT (WMA) POLICY

The WVDOH has adopted a contractor permissive-based, Warm Mix policy which was outlined in a January 3, 2013 memo from Todd Rumbaugh, acting deputy State Highway Engineer-Construction and Development. The Division will now allow the contractor to substitute a WMA mix in lieu of any Hot Mix Asphalt (HMA) item on all existing contracts. The memo, attached for your review, also notes that for the 2013 paving season, all projects advertised will have an addendum noting this policy change via Special Provision and will require use of all applicable WMA bid items.

The DOH wants to track the use of WMA, necessitating the need to continue use of WMA bid items. While the contractor can bid HMA or WMA, they may choose a different production method, the DOH wants only one production method used on any single project. The new Purchase Order (PO) documents will reportedly also reflect adoption of the new WMA policy. This policy change will be discussed in more detail at the February 20 Statewide Asphalt Preconstruction Conference and 2013 Asphalt Paving Conference. FHWA CLARIFIES BUY AMERICA PROVISIONS

The Federal Highway Administration (FHWA) sent a Memorandum to its Division offices clarifying the application of Buy America requirements to manufactured products used on Federal-aid highway contracts. Since 1982, Buy America requirements have applied to all steel and iron products used on projects with FHWA funding. At that time, FHWA waived the application of these requirements to manufactured products that are not predominantly steel products. When Congress enacted the American Recovery and Reinvestment Act (ARRA) stimulus legislation it included Buy America requirements for projects funded under this legislation. The ARRA law created a great deal of uncertainty as to what is and is not covered under Buy America and many states were applying these requirements more broadly than intended.

FHWA’s Memorandum, issued on December 21, 2012, clarifies that, “in order for a manufactured product to be considered subject to Buy America, the product must be manufactured predominantly of steel or iron. The FHWA deems a product to be manufactured predominately of steel or iron if the product consists of at least 90% steel or iron content when it is delivered to the job site for installation. For the purposes of applying Buy America and determining whether a product is a steel or iron manufactured product, the job site includes the sites where any precast concrete products are manufactured.” The entire memo can be read here.
