APPENDIX D-17: Wangkuai-Xidayang Reservoir Connection Project Resettlement Plan Wangkuai-Xidayang Reservoir Connection Project Resettlement Plan Integrated Ecosystem and Water Resources Management in Baiyangdian Basin Project Wangkuai~Xidayang Reservoir Connection Project RESETTLEMENT PLAN July, 2007 Wangkuai-Xidayang Reservoir Connection Project Resettlement Plan Letter of Commitment Through Ministry of Finance, Baoding Municipal Government (BMG) is applying for the loan from the Asian Development Bank (ADB) to finance the present project. Therefore, the implementation of the present project should be in compliance with ADB’s policies of Social Safeguards. This Resettlement Plan represents a key requirement of the ADB and is the key basis for land acquisition, house demolition and resettlement in the present project. This Resettlement Plan also complies with the laws of the People’s Republic of China and local regulations. Besides, for better resettlement outcome it adopts additional measures and arrangements for implementation and monitoring. BMG hereby approves the contents of this Resettlement Plan and guarantees that resettlement budget has been included in the whole project budget and it will be made available as stipulated. BMG has discussed the draft Resettlement Plan with relevant departments and the latter have confirmed their acceptance. BMG authorizes Baoding ADB Project Management Office to be responsible for all project implementation and relevant resettlement activities. Related local governments take charge of actual subproject implementation and executing related resettlement. The Mayor of Baoding Municipal Government ___________________ (signature) __________________ (date) - D-17-I - Wangkuai-Xidayang Reservoir Connection Project Resettlement Plan Executive Summary Baoding Wangkuai ~ Xidayang Reservoir Connection Project is one of the core subprojects of ADB financed Baiyangdian Catchment Ecosystem Management and Environment Protection Project of Baoding, Hebei Province. The major task of this project is to form water supply green channel for Baiyangdian to prevent its swamp from shrinking; to improve ecosystem environment and water supply of Xidayang reservoir; to satisfy water demands of Baoding city and to improve its overground and underground water environment. The major components of this project are water diversion canal connecting two reservoirs, water refill canal for Baiyangdian and water diversion canal for Yimuquan. Water Resources Bureau of Baoding City is the Executing Agency for this project. The Resettlement Plan is based on the feasibility study report, field survey and relevant information survey. During the detailed design, if there is any change of land acquisition scope and/or significant change of ground attachments, the resettlement plan will be revised and submitted to ADB for approval. This project will be started in February 2008 and completed by February 2010. Land acquisition, compensation and resettlement action plan will be implemented in September, 2007 and completed by December, 2007. Project Resettlement expense is 27.136 million by estimation (at the first half year price of 2006), including land acquisition expense, taxes and contingency fee, which accounts for 13.55% of total project budget. The major impacts caused by this project include permanent land acquisition and temporary land occupation. According to the survey, land acquisition will affect three counties, five towns/townships, and seventeen villages. They are four villages of Dangcheng Township, Quyang County and one village of Lingshan Town, Quyang County; six villages of Pushang, Shunping County, five villages of Yaoshan Town, Shunping County; and one village of Fangshunqiao, Mancheng County. Project occupies 533 mu of collective land including 303.7 mu irrigable land, 90.8 mu dry land, 9.2 mu garden plots, 4.9 mu forest land and 124.5mu wasteland. The total population directly affected is 650 households with 2770 persons. The temporary land occupation is 243 mu, including 120 mu irrigable land, 72 mu dry land and 5.2 mu garden plots, 1.7 mu forest land and 44.2 mu wasteland. Temporarily affected population is 176 households with 694 persons. In addition, this project will affect ground attachments such as tombs, trees and telegraph poles. In order to avoid or minimize negative impacts caused by land acquisition, during the period of feasibility study, close consultation on the site selection has been made with local villages, groups and affected people. After comparison, the optimal scheme was selected. This Resettlement Plan is based on the Land Administration Law of the People’s Republic of China (2004), Decision of the State Council on Deepening Reform and Strictly Enforcing Land Administration (Ref. No. GF [2004] 28), related policies of Baoding - D-17-II - Wangkuai-Xidayang Reservoir Connection Project Resettlement Plan municipality and Hebei province, ADB’s Policy on Involuntary Resettlement, and other relevant policies for social security. Also upon negotiation with local government and APs, the principles for preparation of this Resettlement Plan are: (i) Avoid or minimize resettlement, wherever feasible; (ii) The compensation and entitlements gained by the APs shall at least enable them to maintain the same living standards as “without project” or even better; (iii) All affected people regardless of the legal titles shall be entitled to get compensation and demolition assistance; (iv) If the remainder land after land acquisition fails to safeguard the livelihood of the APs, compensation in forms of cash or land replacement, plus other necessary profit-earning activities shall be provided for the APs; (v) The APs shall have good understanding of the qualification, means and standards of compensation, livelihood and restoration plan as well as project construction arrangement etc., and participate in the implementation of the resettlement plan;(vi) No land acquisition shall commence before the APs are satisfied with schemes for compensation and resettlement; (vii) The compensation and resettlement operations shall be monitored by the EA and an independent/ third party; (viii)Vulnerable groups shall receive special assistance and treatment so that they can live better; Affected persons could have chances to benefit from the Project; (ix) resettlement plan should be line with the general plan of affected city (district, county or Towns. (x) The resettlement budget should be enough to cover all aspects caused by resettlement. The compensation for permanent land acquisition shall include land compensation fees, resettlement subsidies and crops compensation. The Average Annual Output Value (AAOV) for past three years: Quyang County CNY 1,700/mu, Shunping County CNY 1,760/mu, Mancheng County CNY 1,650/mu. The compensation multiples is 16 times, including 10 times for land compensation and 6 times for resettlement subsidy. The compensation standard for temporary land acquisition includes land compensation fee and land restoration charge. The land compensation rate is: Quyang County CNY 1,700/mu per year for farmland, CNY 850/mu per year for waste land; Shunping County CNY 1,760/mu per year for farmland, CNY 880/mu per year for waste land; Mancheng County CNY 1,650/mu per year for farmland, CNY 825/mu per year for waste land, the occupation duration will last 2 years. After the occupation, the land will be restored by IAs, the restoration charge for farmland is CNY 3,333.3/mu and no restoration charge for wasteland. Income restoration measures for the affected people include cash compensation, training, priority in getting jobs from the project construction, etc. Project impact is line type because permanent land acquisition is caused by channel digging. Although project occupies lots of land they are scattered and thus land acquisition affects little of farmers’ daily agricultural production. After consultation with the affected APs, all the land compensation fees, resettlement subsidies and crop compensation shall be directly paid to the affected households who will invest them in soil improvement, orchards or non-agricultural business. The PMO of Baoding City will arrange a special fund of CNY 90,000 to provide technical training for the affected laborers (incl. 50% of women at minimum). Further, this PMO jointly with Water Resources Bureau also will keep CNY - D-17-III - Wangkuai-Xidayang Reservoir Connection Project Resettlement Plan 147,000 (1% of resettlement expenses) as support funds for the affected vulnerable groups. Civil Administration Department of affected counties will participate in the actual assistance process. All APs (incl. 30% women) have been informed of the key information of the Resettlement Plan by various means, such as meetings, interviews, village group discussions, public consultation, and community consultation, etc. Through these activities, all APs could participate in the project preparation and their demands have been full considered in the resettlement plan. Resettlement Information Booklets were handed out to APs or village groups at the end of November, 2006. RP was publicized on the ADB website in March, 2007. The channels have been set up for accepting complaints and grievances of APs. The related expenses will be paid by the preserved contingency fee. Baoding Municipal Water Resources Bureau is the implementing agency. Its resettlement section takes responsibility of RP implementation.
