This is an application by Corus Entertainment Inc. (Corus), filed on behalf of the licensees of the specialty television programming undertakings listed in the Attachment to this letter. All licensees are wholly owned subsidiaries of Corus. 2. The purpose of this application is to seek an amendment, pursuant to Part 1 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure, to the broadcasting licences for each of the television services listed in the Attachment. 3. The proposed amendment would replacee the existiing condition of licence (COL) relating to the level of over-expenditures that may be deducted from the required expenditures on Canadian programming (CPE) or programs of national interest (PNI) in the next broadcast year, as set out in Broadcasting Decision CRTC 2013-737, Appendices 3 and 4 and Broadcasting Decision CRTC 2013-738, Apppendices 2 and 3. The affected COL for each service is listed in the Attachment. 4. Specifically, Corus requests that the affected COL for each service be replaced with the following COL: (b) In each broadcast year of the licence term, excluding the final year, where the licensee expends an amount for that year on Canadian programming or programs of national interest that is greater than the minimum required expenditure, the licensee may deduct that amount from the minimum required expenditure in one or more of the remaining years of the licence term. 5. Approval of the proposed amendment is consistent with the revised over- expenditure policy set out in Broadcasting Regulatory Policy CRTC 2012-596, Revised policy for large broadcast groups regarding Canadian programming expenditure over-expenditures for conventional television and specialty services (BRP 2012-596). 6. In BRP 2012-596, the Commission determined that it was appropriate to modify the over-expenditure policy that it had imposed following the group licence renewal proceeding in 2011 by removing the 5% limit on the carry- over of CPE/PNI over-expenditures. On the same day, the Commission approved applications by Bell Media Inc. and Rogers Media Inc. to amend the over-expenditure COLs of their respective television services to this effect. 7. Furthermore, in BRP 2012-596, the Commission stated that other licensees currently subject to this COL could apply to have it removed. 8. Corus has already availed itself of the flexibility afforded by the revised over- expenditure policy for each of its television services that formed part of the Corus group in 2012. In a letter dated December 17th, 2012, the Commission approved the application relating to the licences of various digital television services and specialty Category A and B services owned and operated by Corus. 9. Following the approval of the acquisition of the specialty services TELETOON/TÉLÉTOON, TELETOON Retro and Historia and Séries+ (see Broadcasting Decision CRTC 2013-737 and 2013-738), Corus seeks the same flexibility in relation to CPE over-expenditures that is afforded to its other specialty services in accordance with Commission policy in this regard. 10. We are submitting Form 301, Amendment requests (excluding technical amendments) Part 1 Proceedings with this letter. As this is an application to amend a COL to implement a regulatory policy of the Commission, we request that it be dealt with using the administrative approach as described in Broadcasting Information Bulletin CRTC 2011-960 Broadcasting applications that do not require a public process.
