In its background stands the history of The Socialist Federal Republic of Yugoslavia, where the violence and exclusion allow us to grasp clearly the loss of particular reason. With the work of Hegel the word modern is put in the focus, while oeuvre of Jürgen Habermas brings another goal and possibility for the modern world – the intersubjectivity. This work follows Habermas’s arguments and it is on the ground of their shortcoming where the critique of modernity arises. The world is social, but can the modern world grasp the intersubjective nature of our societies? I chose to frame the critique of Habermas’s project around the concept of modern law using the theory of Carl Schmitt, who challenges the concepts of liberal democracy, legitimacy, and legality, leaving the possibility to think an alternative to the mass democracies, like the agonistic model of Chantal Mouffe. Key words: modernity, modern law, critique, Habermas, Schmitt, Yugoslavia. Resumo No centro deste trabalho é a possibilidade de pensar e criticar a modernidade e o direito moderno. Em seu fundo está a História da República Federativa Socialista da Jugoslávia, onde a violência e a exclusão nos permitem compreender claramente a perda de uma racionalidade particular. Com o trabalho de Hegel, o moderno é colocado em foco, enquanto a obra de Jürgen Habermas traz outro objetivo e outra possibilidade para o mundo moderno - a intersubjetividade. Seguindo os argumentos de Habermas chegamos até o mundo, que é social. Porém, a pergunta que surge é se esse mundo moderno pode compreender a natureza intersubjetiva de nossas sociedades. Eu escolhi enquadrar a crítica do projeto de Habermas em torno do conceito de lei moderna usando a teoria de Carl Schmitt, que desafia os conceitos de democracia liberal, legitimidade e legalidade, deixando a possibilidade de pensar uma alternativa às democracias de massa, como o modelo agonista de Chantal Mouffe.     TELLING THE TRUTH ABOUT CLASS G. M. TAMÁS ne of the central questions of social theory has been the relationship Obetween class and knowledge, and this has also been a crucial question in the history of socialism. Differences between people – acting and knowing subjects – may influence our view of the chances of valid cognition. If there are irreconcilable discrepancies between people’s positions, going perhaps as far as incommensurability, then unified and rational knowledge resulting from a reasoned dialogue among persons is patently impossible. The Humean notion of ‘passions’, the Nietzschean notions of ‘resentment’ and ‘genealogy’, allude to the possible influence of such an incommensurability upon our ability to discover truth. Class may be regarded as a problem either in epistemology or in the philosophy of history, but I think that this separation is unwarranted, since if we separate epistemology and the philosophy of history (which is parallel to other such separations characteristic of bourgeois society itself) we cannot possibly avoid the rigidly-posed conundrum known as relativism. In speak- ing about class (and truth, and class and truth) we are the heirs of two socialist intellectual traditions, profoundly at variance with one another, although often intertwined politically and emotionally. I hope to show that, up to a point, such fusion and confusion is inevitable. All versions of socialist endeavour can and should be classified into two principal kinds, one inaugurated by Rousseau, the other by Marx. The two have opposite visions of the social subject in need of liberation, and these visions have determined everything from rarefied epistemological posi- tions concerning language and consciousness to social and political attitudes concerning wealth, culture, equality, sexuality and much else.

This paper turns the mirror on lawfare critics themselves, and argues that the critique of lawfare is no less abusive and political than the alleged lawfare it attacks.     brazilianpoliticalsciencereview ARTICLE The Place of Normativity in the Political Ontology of Ernesto Laclau* Daniel de Mendonça Universidade Federal de Pelotas, Brazil This article is a reflection on normativity in the field of political theory, with the ontological dimension found in Ernesto Laclau’s discourse theory as a presupposition. We base ourselves on the premise that, as a political theorist (rather than a political philosopher), Laclau has developed a political theory with great analytical applicability, which is also significantly useful for thinking about the role and limits of political normativity. We sustain that the normative, widely understood as a set of precepts or politically desirable situations, has a limited place in the area of discourse theory. In order to carry out our proposal, this paper is divided into five parts. Firstly, we deal with the post-foundationalist position found in Laclau’s thought. Following that, we present him as a political theorist. We then analyse the notions of ideology and discourse, central to the political ontology present in discourse theory. Following that, we discuss antagonism and dislocation, categories used to explain the incompleteness of social meanings, ac- cording to Laclau. Lastly, in the light of the ontological presuppositions presented, we seek to establish the possibilities and limits of political normativity, bearing in mind the discourse theory developed by him. The paper argues that technology is not neutral and we must engage with the moral issues that arise from our relationship with it. Design/methodology/approach – Society's relationship with technology is examined through the lens of Socrates' consideration of the technology of writing. It identifies “technophilia” as a major theme in society and “neo-Luddism” as the Socrates-like examination of the benefits of technology. Findings – While rejecting both technology determinism and technology presentism the paper argues technology is not neutral and does afford social change within a particular social ecology. The authors suggest that ultimately the use of all technology, including the technology underpinning eDependency, leads to important moral questions which deserve considered debate. The paper concludes by arguing that the Information Systems (IS) discipline should take the mantle of King Thamus and that the study of these issues should become a key concern for the discipline.

    Chapter 2 Critique of Technology (DRAFT) Stephen Petrina University of British Columbia If critique barely changes a thing, including youth consciousness, what is its utility? Most critiques of media and technology are instrumental by definition and intended to have an effect or make a difference. If it has been enough for criticism and critique to offer a counter to progress narratives, then how effective has this been? Has the critique of media and technology run out of steam, as Latour (2004) suggests? If out of energy drawn from the steam age, should critique be retrofit to run on light and signals? Meantime, the trend in vaping may conceivably pressurize critique enough to sputter into the future. Is the critique of media and technology over time sufficiently prejudicial or probative? Instrumental or terminal? Accounting for prehistories of cultural evolution, where two hominids debate the merits of a stone implement or pictograph, the first and best critique of technology is Genesis. For over 2,500 years and to this moment, the Garden, Tree of Knowledge, Tower of Babel and Babylon are commonly raised to illustrate the fourfold of spirituality, nature, humanity and technology and accentuate critique. Critique of technology is given dimension in Revelation 18 and takes a form of uncompromising judgment (Greek krino, krisis, Latin iudicium, discrimen) of merchants and luxuries as YHWH proceeds to level Babylon. This chapter begins with the spiritual critique of media and technology and proceeds historically through cultural criticism and social, psychic, ontic, and identic critiques. Differentiated from the spiritual critique that precedes, cultural criticism of media and technology emerges in the fifteenth and sixteenth centuries as a mode of describing and depicting the mechanical arts.

In this discussion, the nature of this binding is explored in detail, in large part in relation to Oakeshott’s own usages, such as his discussion of the relation of faith and skepticism, between collective goal-oriented associations and those based on contract, and between a legal regime based on neutral rules and one oriented to policy goals . Other examples might include Weber’s distinction between the politics of intention and the politics of responsibility. Moreover, such ambiguous concepts as “rights,” have antinomic interpretations.     On the Methodological Role of Marxism in Merleau-Ponty’s Phenomenology Abstract While contemporary scholarship on Merleau-Ponty virtually overlooks his postwar existential Marxism, this paper argues that the conception of history contained in the latter plays a signifi- cant methodological role in supporting the notion of truth that operates within Merleau-Ponty’s phenomenological analyses of embodiment and the perceived world. This is because this con- ception regards the world as an unfinished task, such that the sense and rationality attributed to its historical emergence conditions the phenomenological evidence used by Merleau-Ponty. The result is that the content of Phenomenology of Perception should be seen as implicated in the normative framework of Humanism and Terror. Keywords: Merleau-Ponty, Phenomenology, Methodology, Marxism, History On the Methodological Role of Marxism in Merleau-Ponty’s Phenomenology In her 2007 book Merleau-Ponty and Modern Politics after Anti-Humanism, Diana Coole made the claim (among others) that Merleau-Ponty’s phenomenology is “profoundly and intrinsically political,”1 and in particular that it would behoove readers of his work to return to the so-called ‘communist question’ as he posed it in the immediate postwar period.2 For reasons that basical- ly form the substance of this paper, I think that these claims are generally correct and well- taken. But this is in spite of the fact that they go very distinctly against the grain of virtually all contemporary scholarship on Merleau-Ponty. For it is the case that very few scholars today – and this is particularly true of philosophers – have any serious interest in the political dimen- sions of Merleau-Ponty’s work.

But contrary to the usual narratives, the focus will not be on great authors. Closely following the cours magistral lectures of Samuel Hayat, our discussions focus on the history of ideologies, i.e. comprehensive sets of ideas about what society is and should be. Starting with the emergence of the modern State up to the most contemporary debates, this course will give students an overview of the main ideological trends that framed our political conceptual world(s). Required Readings: The mandatory readings (mostly excerpts from larger texts, varying from 20 to 60 pages per week) for this conférence de méthode will be shared with students via google drive. For the most part, the mandatory readings overlap with the readings included in the syllabus of Samuel Hayat’s cours magistral lectures. Please note that there is a no digital devices policy (laptops, phones, tablets, etc.) for this class. Students are required to print the mandatory readings and bring them, when assigned, hard-copy to class.
