    At Cross-purposes? Governments and the Crossbench in the NSW Legislative Council, 1988-2011 – David Clune The Legislative Council in session in 1999 with a record 13 crossbenchers part four Part Four of the Legislative Council’s History Project President’s foreword This publication is very timely, coming so soon after an election that has seen the crossbench in the NSW Legislative Council expand to 11, its largest size in several parliamentary terms. No government has had a majority in the Council since 1988 and all have had to work with a crossbench of varying size and composition. Whenever governments are faced with ‘hung’ parliaments or upper houses with non-government majorities there is much concern with the role of the crossbench. How are governments to implement their electoral mandate while accommodating the interests of minor parties and independents? Do minor parties and independents have disproportionate influence on political outcomes? Can crossbench members use their positions to improve legislation and hold governments to account, or are their interests too diverse for effective collaboration? The fourth in the series of Legislative Council History Monographs attempts to provide some insights into these questions during two distinct terms of government: the Coalition Government from 1988 to 1995 and the Labor Government from 1995 to 2011. In this time, the crossbench grew from five in 1988 to eight after the 2007 election, peaking at 13 in 1999. It is based on interviews conducted as part of the Council’s oral history project. We read about the development of the Legislative Council as a house of review, the art of negotiation, and the impact on legislation.

NUMBER: Working Paper ITLS-WP-11-24 TITLE: The impact of discontinuity in governance: How transport planning went off the rails in Sydney. ABSTRACT: The impacts on transport planning of discontinuity in governance within the same political administration are illustrated through a case study of NSW, Australia. The Labor government in power in NSW for 16 years from 1995 to 2011 was committed to public transport in its strategic plans. But from 2003, unprecedented changes in the premier, ministers, and departments responsible for transport planning, disrupted public transport planning and delivery. The impacts of discontinuity included delays to public transport projects, waste of scarce funds, and loss of trust and confidence amongst stakeholders including the community, planning professionals, and the federal government. The impact is best seen with the North West Rail Link project for a major growth area: originally identified in 1998 for delivery in 2010, it was in 2010 proposed for completion in 2024. Conflict over funding of transport contributed to the changes in premiers and ministers and the subsequent impacts on transport planning with compounding effects over time. The NSW experience shows that a strategic commitment to public transport must be accompanied by long- term funding sources to ensure the public transport goals articulated in strategic plans are delivered.

That this House notes that: (a) a Part 3A proposal to establish a Somersby Fields Sand Extraction project on the Central Coast, a 42 hectare sand mine to operate for 15-18 years is currently before the Minister for Planning for approval, (b) on two other occasions the same development has been abandoned due to resistance from the community, (c) the project is opposed by residents, the local school community, the regional education director for the Central Coast, Gosford City Council, the Labor member for Gosford, Marie Andrews MP, and the Shadow Minister for the Central Coast, Chris Hartcher MP, (d) the sand mine will be 260 metres from Somersby Public School, resulting in students being exposed to noise and dust from the mine site, with particular concern about the risk of respiratory diseases such as silicosis, (e) a school survey showed the majority of parents will pull their children out of that school if the mine goes ahead, (f) the mine will impact on scarce local water sources drying up permanent spring flows on surrounding property and interrupting flows from three streams on the site which feed into the Central Coast water supply catchment, and (g) community opposition to the mine is also based on: (i) the impact on more than 200 local residents and many more who work in the area, (ii) increased truck movements (e.g.

Incompetence, misbehaviour, maladministration, infighting and leadership instability saw the Labor government’s stocks plummet to record low levels as measured in the opinion polls running up to the 2011 election. The period was characterised in the words of one observer as ‘the biggest mess in the history of public administration in Australia’.1 Since the victory in 2007 by Morris Iemma, who succeeded long-time Premier Bob Carr in 2005, the government writhed in anguish as scandal after scandal engulfed it; resignations, rebellions and dismissals have occurred with alarming regularity, so much so that by the time of the Parliament’s dissolution, the political landscape bore little resemblance to that at the start of the term. Iemma, whom some thought had won against the odds in 2007,2 was no longer in Parliament; a newly-elected member in 2007, Nathan Rees, had succeeded him in 2008, but by 2011, Rees was a backbencher, having been deposed at the end of 2009 after just 15 months at the helm; and a junior minister in 2007, Kristina Keneally, was in place as the first female Premier in the state’s history. The abrupt rise and fall of Rees established two records: he was the shortest-serving member of the NSW Parliament to become Premier since Federation, and he enjoys the dubious distinction of being the only Labor Premier not to have led the party into an election.
