Yours faithfully Chief Executive This page is intentionally left blank Agenda Annex Allerdale Borough Council Council – 4 March 2020 Community Governance Review - SillothTown Council The Reason for the Decision: To consider the recommendation of the Community Governance Review Working Group following a Review of the Silloth Town Council boundary Summary of options considered: To approve a draft Reorganisation Order amending the boundary between Silloth Town Council and Holme Low Parish Council Recommendations: 1. That Council approves a Reorganisation Order for Silloth Town Council, to take effect on 1 April 2020 for council tax purposes and at the normal parish council elections in May 2023 for electoral purposes, and which will have the effect of amending the boundary of the Silloth Town Council and Holme Low Parish Council areas as detailed on the map contained within the Option 3 Order 2. Subject to approval of Recommendation 1.above, that the council tax bases for Holme Low and Silloth are amended to 133.61 and 838.62 respectively Financial / Resource Implications The recommended Option 3 will have Council Tax precept implications for the two affected parish councils. Legal / Governance Implications None Community Safety Implications None Health and Safety and Risk None Management Implications Equality Duty considered / Impact N/A Assessment completed Page 3 Wards Affected: Silloth and Solway Coast Is this a Key Decision: No Portfolio Holder: Councillor Marion Fitzgerald Lead Officer Lindsay Tomlinson Electoral Services Manager [email protected] Report Implications Community Safety N Financial N Legal Y Partnership N Social Inclusion N Asset Management N Equality Duty N Health and Safety N Employment (internal) N Employment N (external to the Council) Background Papers Local Government and Public Involvement in Health Act 2007 LGBCE Guidance on Community Governance Reviews Community Governance Review Working Group reports and minutes 1.0 Introduction 1.1 Section 100 of the Local Government and Public Involvement in Health Act 2007 (The Act) sets out the process by which Principal Authorities such as Allerdale Borough Council can carry out a Community Governance Review (CGR) of parish arrangements within its area. 1.2 Allerdale Borough Council at its meeting on 25 September 2019 agreed to carry out two Community Governance Reviews, the first to consider amending the boundary between Silloth Town Council and Holme Low Parish Council to rectify an anomaly identified in May 2019 whereby Lido Village was effectively cut in half by the true boundary. The second was to consider a review of the Maryport Town Council area as a result of a petition received from local residents in Flimby. 1.3 Council established a Working Group comprising the nine Allerdale Borough Councillors who represented the Maryport North, Maryport South, Flimby and Silloth & Solway Coast wards, and agreed the Terms of Reference for the reviews. Page 4 2.0 Community Governance Review Working Group Statutory Consultation Process 2.1 The Working Group met on 15 January 2020 to consider the Silloth Town Council review. Members of Silloth Town Council and Holme Low Parish Council were invited to attend the meeting. The Working Group agreed at that meeting to commence a consultation on two options for the amended boundary. The first option was to bring those Lido Village properties currently in the Holme Low Parish area into the Silloth Town Council area. The second option was to take all of the Lido Village properties plus a number of properties in Barracks Bridge – currently in Holme Low Parish area – into the Silloth Town Council area. 2.2 The online consultation commenced on 18 January 2020 and ran until 10 February. Letters and paper copies of the maps and consultation were sent to all properties in Lido Village and to the Barracks Bridge properties affected by Option 2. 2.3 During the latter stage of the consultation a number of letters were received stating that some residents of Lido Village had proposed a third option and had sent letters to their neighbours asking them to request that this third option be given consideration. This third option would move all of the Lido Village properties into the Holme Low Parish area. The Barracks Bridge properties would not be affected as they were currently already within Holme Low. 3.0 Outcome of the Consultation Process and Statutory Process 3.1 The Community Governance Review Working Group met on 10 February 2020 to consider the outcome of the consultation process. Members of Holme Low Parish Council and Silloth Town Council were again invited and a number attended the meeting. 3.2 The Working Group acknowledged that the third option put forward by residents had gained some support, and that in order to fully allow all residents the opportunity to give their views then a further consultation should be undertaken which would also include the third option. 3.3 The second consultation commenced online on 13 February 2020 and letters were again sent to the affected properties on 14 February 2020, explaining the reason for the additional consultation and requesting responses by noon on 2 March 2020. 3.4 The Working Group met on 2 March 2020 and considered the responses received to the second consultation exercise. 3.5 A total of 87 responses were received, 75 as a response to letters sent to directly affected properties and 12 online responses. Of these, 66 indicated that they preferred Option 3, i.e. redrawing the boundary so that all Lido Village properties are within the Holme Low Parish Council area. Page 5 3.6 Both Silloth Town Council and Holme Low Parish Council were consulted at each stage of the consultation process. In response to the second consultation, Holme Low advised that it supported Option 3 as it would bring more properties into the parish area thereby reducing the council tax precept for existing residents. Silloth Town Council responded to say that although it would be more beneficial for the town council for the Lido Village properties to remain within Silloth, on balance it was considered more important that the views of the residents were taken into consideration. 4.0 Implications of the Options 4.1 There are 54 domestic properties in Lido Village of which 35 are in Silloth and 19 are in Holme Low; all have historically been paying Council Tax precept to Silloth because of the boundary issue. 4.2 The current council tax precept for a Band D property in Silloth is £196.15 and in Holme Low is £55.56. 4.3 Option 1 would not have an effect on the precept for either parish as until May 2019 the boundary anomaly had not been raised and all properties in Lido Village had historically paid council tax precept for Silloth. 4.4 Option 2 would remove 15 properties in Barracks Bridge from the Holme Low Parish area thereby reducing the tax base for Holme Low by 7.96 Band D equivalent properties. The tax base for Silloth would be increased by the same amount. 4.5 Option 3 would take 54 properties out of Silloth Town Council and into Holme Low Parish, reducing the Silloth tax base by 25.36 Band D equivalent properties and increasing the Holme Low tax base by the same amount. 4.6 Whilst the electoral arrangements do not take effect until May 2023, any by election in either Silloth Town Council or Holme Low Parish Council would be held on the revised boundary arrangements, Neither parish area is warded. 4.0 Polling District Amendment 4.1 Any change to the town council/parish council boundary will require a consequent amendment to the relevant polling districts. 5.0 Finance/Resource Implications 5.1 There will be no financial implications to Allerdale Borough Council if the recommended Option 3 is approved. 5.2 The current Tax base for Holme Low parish is 107.99 and the tax base for Silloth is 864.24. Page 6 5.3 Moving 38 properties from Silloth to Holme Low would result in a new tax base for Holme Low of 133.61 and for Silloth of 838.62. 5.4 Option 3 would result in: - a reduced parish charge for Holme Low residents (£44.91 for a band D property for 2020/21); an increased parish charge for Silloth residents (£202.14 for a band D property for 2020/21) 5.5 The changes to the council tax bases for Holme Low and Silloth have no impact on the overall council tax base for Allerdale Borough Council as approved by council on 29 January 2020. 6.0 Legal Implications and Risks 6.1 The procedure for conducting a Community Governance Review is set out in legislation and all statutory requirements have been complied with. 7.0 Recommendations 7.1 1. That Council approves a Reorganisation Order for Silloth Town Council, to take effect on 1 April 2020 for council tax purposes and at the normal parish council elections in May 2023 for electoral purposes, and which will have the effect of amending the boundary of the Silloth Town Council and Holme Low parish council areas as detailed on the map contained within the Option 3 Order 2. J. Markley Mrs Downham addressed the Council, explained her concerns and provided copies of the letter submitted to Allerdale in response to the application. Other residents have objected to Allerdale about the plans. The Parish Council discussed the planning application at length. The main concern is drainage. All of the houses along here are piped into the main sewer which is pumped to the Blitterlees pumping station and then to the Airfield which is already overloaded as it is, without additional demand on the system. After heavy rainfall, the road often floods due to the beck overflowing. Parts of the beck have not been cleaned out in over 40 years which contributes to the problem. The land is unsuitable for building on, as it is often under water during the wetter months of the year. Access and visibility are not good along this stretch of road, particularly as there is a blind bend towards the Beckfoot end of the road which is a concern.

    Silloth Community Governance Review You will have recently received a letter from Allerdale Borough Council regarding a Community Governance Review which is being carried out, to look at redrawing the boundary between Silloth Town Council and Holme Low Parish Council. This is to address the issue that the Lido Village is split by the boundary. There are a number of points which need to be taken into consideration. With Option 2, the 15 properties on Barracks Bridge would be taken out of Holme Low and those properties would then in all probability, have to pay increased council tax bills, as they would then have to contribute towards the Precept of Silloth Town Council. The only benefit from moving the boundary would be that residents of Barracks Bridge would then be allowed to vote in a Silloth Town Council election For example, on a Band D property, the Silloth portion of the Council tax bill will be in the region of £196.15 per year for 2020/21, whereas for Option 1 is to redraw the boundary so that all Holme Low, on a Band D property the Holme Low properties in the Lido Village are within Silloth portion of the council tax bill will be in the region Town Council area. of £56 per year. The following booklet not only contains information on famous residents such as William Wordsworth and Fletcher Christian, but also people of local interest, perhaps not known to people outside their own town or village. Also included are a few rather more weird and disturbing stories involving murder, witchcraft, poisoning, disease and ghosts. If possible the place of burial of the people researched has been found, with the intention for the reader to walk around the local cemeteries, and find the graves while reading the story behind the headstone. If the burial place isn’t stated below the persons name it means it couldn’t be found in the registers, and the person must be buried elsewhere. At the end of each person’s brief biography, a “story” from the “Cumberland Chronicle” has been included, with all the stories being between 1777 and 1779.
