IN THE UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF WISCONSIN LARRY SPENCER, Petitioner, OPINION AND ORDER v. 05-C-0666-C CATHY FARREY, Warden, New Lisbon Correctional Institution, Respondent. This is an application for a writ of habeas corpus brought pursuant to 28 U.S.C. § 2254. Larry Spencer, an inmate at the New Lisbon Correctional Institution, collaterally attacks the judgments of conviction imposed upon him by the Circuit Court for Dane County following petitioner’s entry of Alford pleas in two cases, 01 CF 1125, a case involving multiple forgery counts, and 01 CF 1242, a drug case. This court previously dismissed petitioner’s attack on the latter case on grounds of procedural default. Now before the court for decision are the claims attacking the validity of the forgery conviction. Those claims, as construed by this court in previous orders, are the following: 1) petitioner’s plea was involuntary because a) it was coerced; b) his lawyer misled him about the nature of an Alford plea and c) the trial court said nothing at the plea hearing to correct petitioner’s misunderstanding; 2) the trial court violated petitioner’s Sixth Amendment right to self- representation by refusing to allow petitioner to represent himself at trial; 3) petitioner’s trial lawyer was ineffective for failing to seek a competency evaluation of petitioner before allowing petitioner to enter an Alford plea; and 4) petitioner’s appellate lawyer was ineffective for raising only this last issue on appeal. There is no dispute that petitioner has procedurally defaulted his first two claims by failing to fairly present them to the state courts on direct appeal.

  • SLIP OPINION (Not the Court’S Final Written Decision)
NOTICE: SLIP OPINION (not the court’s final written decision) The opinion that begins on the next page is a slip opinion. Slip opinions are the written opinions that are originally filed by the court. A slip opinion is not necessarily the court’s final written decision. Slip opinions can be changed by subsequent court orders. For example, a court may issue an order making substantive changes to a slip opinion or publishing for precedential purposes a previously “unpublished” opinion. Additionally, nonsubstantive edits (for style, grammar, citation, format, punctuation, etc.) are made before the opinions that have precedential value are published in the official reports of court decisions: the Washington Reports 2d and the Washington Appellate Reports. An opinion in the official reports replaces the slip opinion as the official opinion of the court. The slip opinion that begins on the next page is for a published opinion, and it has since been revised for publication in the printed official reports. The official text of the court’s opinion is found in the advance sheets and the bound volumes of the official reports. Also, an electronic version (intended to mirror the language found in the official reports) of the revised opinion can be found, free of charge, at this website: https://www.lexisnexis.com/clients/wareports. The Fifth Amendment and the Guilty Plea: An Incompatible Association By VIvIAN DEBORAH WILSON* Introduction In the year 1590, John Udall, a Puritan minister who preached against Her Majesty's church and wrote bitter, anticlerical lampoons, was on trial for libeling Queen Elizabeth I. The penalty was the gal- lows. He stood in the dock at Croyden Assize, badgered by the Prose- cutor and the Judge. Accused the Judge: What say you? Did you make the Book, Udall, yea or no! What say you to it, will you be sworn? Will you take your oath that you made it or not? We will offer you that favour which never any in- dicted of Felony had before; take your oath, and swear you did it not, and it shall suffice. Udall refused to confess. I will go further with you; [said the Judge.] Will you but say upon your honesty that you made it not, and you shall see what shall be said unto you? Ultimately defeated, the Judge addressed the Jury: You of the Jury consider this.

  • Commonwealth Director of Public Prosecutions
DPP Commonwealth Director of Public Prosecutions 24 July 2012 Statement in the Matter of David Hicks On 19 July 2011, following an investigation and referral by the Australian Federal Police the Commonwealth Director of Public Prosecutions commenced proceedings against Mr David Hicks, pursuant to the Proceeds of Crime Act 2002 (Cth). The proceedings were commenced by way of Summons in the Supreme Court of NSW. The Summons sought orders relating to publication of the book Guantanamo: My Journey, including a restraining order, pursuant to section 20 of the Proceeds of Crime Act, and a literary proceeds order, pursuant to section 152. On 23 July 2012, the Director made a decision to discontinue the proceedings. The matter was discontinued in Court on 24 July 2012. In explaining his decision, the Director said: “As is often the case under the Proceeds of Crime Act, these proceedings were commenced with initial steps to preserve assets from dissipation, in order that the assets placed under restraint could remain available to satisfy any orders that the Court might ultimately make. The evidence available to my Office was sufficient to commence those proceedings on the basis that Mr Hicks stood to benefit financially from the commercial exploitation of his notoriety resulting from the commission of a foreign indictable offence. The evidence included Mr Hicks’ plea of guilty before the United States Military Commission and admissions made by him before that Commission. These admissions are recorded in the following documents, which were obtained through international cooperation: A certificate of conviction issued by the Military Commission in relation to Mr Hicks, for an offence against 10 United States Code section 950v Part 25 – providing material support for terrorism, to wit al Qaeda.

  • Plea of Guilty to a Felony Pursuant to North Carolina V. Alford, 400 Us 25
PLEA OF GUILTY TO A FELONY PURSUANT TO NORTH CAROLINA V. ALFORD, 400 U.S. 25 (1970) (1) My name is _____________________________________________. My date of birth is ________________________. I am _______ years old. (2) I am represented by Counsel whose name is ___________________________ and I am entirely satisfied with the services of my attorney. (3) I have received a copy of the warrant or indictment before being called upon to plead and have read and discussed it with my attorney. I fully understand the charge against me. I am the person named in the indictment. I have discussed the charge and its elements with my lawyer and I understand what the Commonwealth must prove before I may be found guilty. I have had enough time to discuss with my lawyer any possible defenses that I may have had to this charge. (4) I have discussed with my lawyer whether I should plead guilty or not guilty. After that discussion, I decided for myself that I should plead guilty. I am entering the plea of guilty freely and voluntarily. I am entering this plea of guilty pursuant to North Carolina v. Alford, 400 U.S. 25 (1970) because while I do not admit that I committed the crime charged, I understand that evidence against me is sufficient for a conviction and it is in my interest not to go to trial. (5) My attorney has advised me that the punishment which the law provides is as follows: A maximum of ______ year(s) imprisonment and a minimum of ______ years(s) imprisonment, or in the discretion of the Jury or the Judge sitting without a jury, up to ______ months in jail and a fine of not more that __________ or both, and also that probation may or may not be granted; and that if I plead guilty to more than one offense, the Court may order the sentences to be served consecutively, that is, one after another.

  • Alford Was Indicted for First Degree Murder Under a North Carolina Statute That Restricted the Death Penalty of Jury Con- Vicions
CONSTITUTIONAL LAW-CONTEMPoRANEous DECLARATIONS OF INNO- CENCE DO NOT NECESSARILY INVALIDATE GUILTY PLEAS-State of North Carolina v. Henry C. Alford, 400 U.S. 25 (1970)-Alford was indicted for first degree murder under a North Carolina statute that restricted the death penalty of jury con- vicions. 1 Upon advice of his attorney and others, Alford pleaded guilty to second degree murder but maintained his innocence. He was sentenced to 30 years im- prisonment, the North Carolina statutory maximum.2 Following a series of appeal actions, Alford's conviction was reversed by the United States Court of Appeals for the Fourth Circuit,3 which found Alford's plea to be coerced by a statutory penalty scheme that was unconstitutional under United States v. Jackson.4 North Carolina appealed, and the United States Supreme Court reversed the Fourth Circuit in a six to three decision.5 The Supreme Court held that guilty pleas representing "a vol- untary and intelligent choice among the alternative courses of action" are valid." Neither the existence of an unconstitutional penalty scheme nor defendant's inability to admit his guilt invalidates his plea when the judge is satisfied that it has a factual 7 basis. The Alford case raises two important questions concerning current guilty plea standards. First, what is a coerced guilty plea? Second, what safeguards remain in the guilt determining process to prevent disadvantaged but possibly innocent de- fendants from convicting themselves when subjected to strong prosecutorial and judicial pressures to plead guilty? The North Carolina statute under which Alford was initially indicted contained the Jackson defect.
