Determina Del Direttore Della Area Vasta N. 5 N. 539/Av5 Del 16/05/2016 Numero: 539/AV5 Pag. 1 Data: 16/05/2016 DETERMINA DEL DIRETTORE DELLA AREA VASTA N. 5 N. 539/AV5 DEL 16/05/2016 Oggetto: Autorizzazione all’apertura del Dispensario Farmaceutico sito in Via Roma n. 13 - Comune di Montemonaco (AP) IL DIRETTORE DELLA AREA VASTA N. 5 - . - . - VISTO il documento istruttorio, riportato in calce alla presente determina, dal quale si rileva la necessità di provvedere a quanto in oggetto specificato; RITENUTO , per i motivi riportati nel predetto documento istruttorio e che vengono condivisi, di adottare il presente atto; VISTA l’attestazione del Dirigente/Responsabile della Ragioneria/Bilancio in riferimento al bilancio annuale di previsione; - D E T E R M I N A - 1. di autorizzare l’apertura del Dispensario Farmaceutico sito nel comune di Montemonaco (AP) in Via Roma n. 13 e di affidare la gestione dello stesso al Dott. Strada Mauro titolare della farmacia di Comunanza (AP) sita in via Dante n. 60, ai sensi della L. n. 221/68 e s.m.i.; 2. di dare atto che dal presente provvedimento non deriva, né possono derivare oneri per l’Azienda; di trasmettere il presente provvedimento al Dott. Capocasa Giulietta) IL DIRIGENTE U.O.C ATTIVITA’ ECONOMICHE E FINAZIARIE VISTO Il Dirigente f.f. dell’U.O Economico Finanziaria (Dr. Milani Cesare ) La presente determina consta di n. 05 (cinque) pagine che formano parte integrante della stessa. - DOCUMENTO ISTRUTTORIO - (DAT) Normativa di riferimento • Legge 8 marzo 1968 n. 221 • Legge 8 novembre 1991 n. 362 • L.R. 16 febbraio 2015 n. 4 Motivazione Preso atto della determinazione dirigenziale n. 59/AS del 25.03.2005 a oggetto: Assegnazione in gestione provvisoria della sede farmaceutica di Montemonaco (AP) alla dr.ssa Elena di Tommaso; Considerata la determinazione dirigenziale n.120/AS del 05.07/2011 inerente l’assegnazione alla Dott.ssa Elena Di Tommaso della sede farmaceutica unica del Comune di Montemonaco (AP) - della copia della comunicazione di accettazione della medesima Dott.ssa Di Tommaso del 12.07.2016 prot. n. 0034953, NS prot. n. 0027244 del 14.07.2011; Vista la determina n. 662/ZT13DZONA dell’08.08.2011 a oggetto Assegnazione titolarità sede farmaceutica unica nel comune di Montemonaco (AP) alla dott.ssa Elena di Tommaso – Autorizzazione all’esercizio e la cessione della gestione provvisoria; Impronta documento: 23A4AC32194B9C2FA5AB738CB4748A349128850A (Rif. documento cartaceo 3F29C1E87CC316C0DAE8663E34D14EB63F7854AC, 4/02/13A5FARM_D_L) Nessun impegno di spesa Numero: 539/AV5 Pag. 3 Data: 16/05/2016 Vista la comunicazione della Dott.ssa Elena Di Tommaso, titolare della farmacia San Benedetto nel Comune di Montemonaco, trasmessa a mezzo Pec, a questa Area Vasta - NS prot. n. 98817 del 21.12.2015 - relativa alla comunicazione della chiusura definitiva della farmacia rurale sopra menzionata; Considerato che la legge 221/1968 e s.m.i. stabilisce che nei comuni, frazioni, o centri abitati con popolazione non superiore a 5.000 abitanti, ove non sia aperta la farmacia privata o pubblica prevista nella pianta organica, sono istituiti dispensari farmaceutici e che la gestione dei dispensari è affidata alla responsabilità del titolare di una farmacia privata o pubblica della zona, con preferenza per il titolare della farmacia più vicina; Rilvato che con determinazione n. 9 R.S del 04.02.2016 la provincia di Ascoli Piceno ha assegnato la gestione del dispensario farmaceutico di Montemonaco (AP) alla Farmacia del Dr. Strada Mauro situata in Via Dante n. 60 a Comunanza (AP), ai sensi dell’art.1 della legge 221/68 e s.m.i.”; Preso atto che il Dispensario Farmaceutico di Montemonaco gestito dal Dr. Strada Mauro, osserverà i seguenti orari: lunedì, martedì, giovedì e venerdì dalle ore 10.00 alle ore 12.00, il mercoledì dalle ore 17.00 alle ore 19.00, così come comunicati dal medesimo farmacista in data 09.02.2016 NS protocollo n. 0011324; Vista l’istanza del 15.02.2016 NS prot. n. 0012990 del 16.02.2016 a oggetto: richiesta ispezione preventiva presso il Dispensario Farmaceutico, sito in Via Roma n. 13 a Montemonaco (AP), inoltrata dal Dr. Mauro Strada; Visto che la Commissione Farmaceutica Ispettiva di cui all’art. 28 della L.R. n. 7 del 03/03/82, competente per territorio - integrata anche dal sopralluogo effettuato dal Servizio Igiene e Sanità Pubblica dell’Area Vasta 5 in data 22.02.2016, che ha espresso parere favorevole con nota ID. 668412 del 23.02.2016/APSISP - ha provveduto a eseguire in data 16.02.2016 l’ispezione preventiva ai sensi dell’art. 111 T.U.LL.SS, nei locali scelti per l’apertura del Dispensario Farmaceutico sito a Montemonaco (AP); Dato atto che la Commissione di cui sopra, con verbale d’ispezione, redatto in data 16.02.2016, in occasione della visita ispettiva nei locali del Dispensario Farmaceutico di Via Roma n.13 a Montemonaco (AP) ha espresso parere favorevole all’esercizio dell’attività farmaceutica; Alla luce degli atti, degli adempimenti, e degli accertamenti sopra riportati, e ai sensi delle norme vigenti in materia, si ritiene di autorizzare l’apertura del Dispensario Farmaceutico del Comune di Impronta documento: 23A4AC32194B9C2FA5AB738CB4748A349128850A (Rif. documento cartaceo 3F29C1E87CC316C0DAE8663E34D14EB63F7854AC, 4/02/13A5FARM_D_L) Nessun impegno di spesa Numero: 539/AV5 Pag. 4 Data: 16/05/2016 Montemonaco (AP) ubicato in Via Roma n. 13 allo scopo di garantire la continuità dell’assistenza farmaceutica ai cittadini del territorio del Comune di Montemonaco (AP); Atteso che la documentazione presente agli atti dell’Area Vasta 5 è depositata presso gli archivi del Dipartimento Farmaceutico. Atteso che dal presente provvedimento non deriva, ne possono derivare oneri per l’Azienda. Vista la nota del Direttore di Area Vasta prot. n. 2096/P dell’11.01.2016 ad oggetto incarico: Dott. Canaletti Marco: integrazione competenze. Vista la delibera n. 431/AV5 ad oggetto: parziale rettifica ed integrazione della determina n.112/AV5 del 31/01/2013 e successiva n.114/AV5 del 05/02/2013. Variazione funzioni ed obiettivi delle UU.OO.CC. D.A.O. e D.A.T. Provvedimenti. Per le considerazioni sopra esposte si ritiene: 1. di autorizzare l’apertura del Dispensario Farmaceutico sito nel comune di Montemonaco (AP) sito in Via Roma n. 13 e di affidare la gestione dello stesso al Dr. Strada Mauro titolare della farmacia di Comunanza (AP) sita in via Dante n. 60; 2. di dare atto che dal presente provvedimento non deriva, né possono derivare oneri per l’Azienda; di trasmettere il presente provvedimento al Dott.
