THE BOROUGH OF BOURNEMOUTH (PARKING REGULATION ORDERS) (CONSOLIDATION) ORDER 2009 The Council of the Borough of Bournemouth ("the Council"), • in exercise of its powers under Sections 1(1), 2(1) to (3), 3(2), 9, 10, 51, 52, 99, 101 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 ("the Act") and of all other enabling powers, • in accordance with Regulation 21 [special provisions for Consolidation Orders] of The Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996, and • after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:- PART – 1 A. REVOCATION OF ORDERS 1. The provisions of the Orders specified in the Schedule to PART - 4 of this Order are reproduced in this Order without addition or amendment. 2. The Orders specified in the Schedule to PART - 3 of this Order are hereby revoked. B. REPRODUCTION OF PROVISIONS OF ORDERS 1. PROHIBITED WAITING- Save as provided in Article C of this Order no person shall cause or permit any vehicle to wait in that part of the length and side of road specified during the times stated in the Series 1, 3 & 21 of the Schedule to PART 4 of this Order. 2. PROHIBITED LOADING- Save as provided in Article C of this Order no person shall cause or permit any vehicle to load in that part of the length and side of road specified during the times stated in the Series 2 & 22 of the Schedule to PART 4 of this Order. 3. LIMITED WAITING- Save as provided in Article C of this Order no person may cause or permit any vehicle to wait longer than the maximum period in that part of the length and side of road specified during the times stated in the Series 8 of the Schedule to PART 4 of this Order, or to contravene any of the Regulations as provided in Schedule 1 to PART-2 of this Order 4. PAY AND DISPLAY LIMITED WAITING- Save as provided in Article C of this Order no person may cause or permit any vehicle to wait longer than the maximum period in that part of the length and side of road specified during the times 1 of 8 stated, either for waiting or charging, in the Series 15 of the Schedule to PART 4 of this Order, or to contravene any of the Regulations as provided in Schedule 1 to PART-2 of this Order 5. STREET PARKING PLACES- Save as provided in Article C of this Order no person shall cause or permit any authorised vehicle to wait in a street parking place longer than the maximum period specified during the times stated in the Series 9, 10 & 12 of the Schedule to PART 4 of this Order, or to contravene any of the Regulations as provided in Schedules 1 and 2 to PART-2 of this Order. 6. PAY AND DISPLAY STREET PARKING PLACES- Save as provided in Article C of this Order no person shall cause or permit any authorised vehicle to wait in a pay and display street parking place longer than the maximum period specified during the times stated, either for waiting or charging, in the Series 11 of the Schedule to PART 4 of this Order, or to contravene any of the Regulations as provided in Schedules 1 and 2 to PART-2 of this Order. 7. RESIDENTS PERMIT PARKING PLACES- Save as provided in Article C of this Order no person shall cause or permit any authorised vehicle to wait in a residents permit parking place longer than the maximum period specified during the times stated in the Series 16 of the Schedule to PART 4 of this Order, or to contravene any of the Regulations as provided in Schedules 1 and 2 to PART-2 of this Order. 8. ZONES- Save as provided in Article C of this Order no person shall cause or permit any vehicle to stop in that part of the length and side of road specified during the times stated in the Series 14 of the Schedule to PART 4 of this Order. or to contravene any of the Regulations as provided in Schedules 1 and 2 to PART-2 of this Order. 9. LOADING BAYS- Save as provided in Article C of this Order no person shall cause or permit any vehicle other than for authorised loading to stop in that part of the length and side of road specified during the times stated in the Series 20 of the Schedule to PART 4 of this Order. 10. TAXI RANKS-Save as provided in Article C of this Order no person shall cause or permit any vehicle to wait, other than a Hackney carriage waiting during a permitted waiting period, in that part of the length and side of road specified during the times stated in the Series 4 of the Schedule to this Order, or to contravene any of the Regulations as provided in the schedule 3 to PART-2 of this Order. 11. BUS STANDS & COACH BAYS - Save as provided in Article C of this Order : a) no person shall cause or permit between 8am and Midnight any authorised vehicle to stop on a Bus Stand or any vehicle other than a Local Service Bus Standing Over during permitted waiting periods or Taking Up and Setting Down in that part of the length and side of road specified in the Series 23 of the Schedule to PART 4 of this Order, 2 of 8 b) coaches may wait in that part of the length and side of road specified in the Series 13 of the Schedule to PART 4 of this Order, or either to contravene any of the Regulations as provided in the schedule 4 to PART-2 of this Order. C. EXEMPTIONS 1. Nothing in this Order shall restrict the powers of the Council to suspend the whole or part of this order, and any variations made upon this order, either temporarily or permanently. 2. Nothing in Section B above of this Order shall apply to anything done upon the direction or with the permission of a police constable in uniform. 3. Nothing in Article 1 of Section B shall prohibit a disabled person’s vehicle from waiting up to a maximum period of three hours, but not to return for one hour from the last period of waiting. 4. Nothing in Articles 3 and 4 of Section B shall prohibit a disabled person’s vehicle from waiting for an unlimited period except where times and waiting periods are expressly stated for disabled person’s vehicles. 5. Nothing in Section B of this Order shall render it unlawful for a person to cause or permit any vehicle to wait or load so long as may be necessary to enable the vehicle to:- (i) avoid an accident. (ii) be used for the removal of any obstruction to traffic, (iii) be used for police, fire and rescue or ambulance purposes, (iv) be used in the service of any local authority or with the permission of any such authority in pursuance of statutory powers or duties. (v) be used for the purpose of delivering or collecting postal packets as defined by the Post Office Act 1953. (vi) be used for building, industrial or demolition purposes, if the purpose cannot be carried out on any other road. (vii)be used for the maintenance, improvement or reconstruction of the said lengths of road (viii)be used for the laying, erection, alteration or repair of in or adjacent to the length(s) of road of any sewer or of any main pipe, or apparatus for the supply of gas, water or electricity or of any telecommunication systems defined in the Telecommunications Act 1984 D. OTHER ORDERS 1. This Consolidation Order is made without prejudice to other orders or similar provisions, which remain in full force and effect. 3 of 8 2. Any Variation Order to The Borough of Bournemouth (Parking Regulation Orders) (Consolidation) Order 2006 not consolidated into this Order will remain in full force and effect as though it were a variation to this Order. 3. All Borough of Bournemouth (Bus Stop Clearway) Orders will no longer remain in force, as they do not now require a TRO, but will remain as an inventory item to this Order. 4. Any Variation Order to The Borough of Bournemouth (Bus Stop Stands) Order 1977 will remain in full force and effect as though it were a variation to this Order. E. INTERPRETATION 1. The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament. 2. In this Order the following terms will have the meanings given: (i) “Bus” has the same meaning as in the Roads (Construction and use of) Regulations 1986. Being a passenger vehicle with more than eight seats excluding the driver. (ii) “Coach” and “Passenger Vehicle” means a vehicle adapted to carry more than eight passengers, excluding the driver. (iii) “The Driver” in relation to this Order means the person driving the vehicle at the time it was left. (iv) “Invalid Carriage” means a vehicle as defined in Section 136(5) of the Highways Act 1984. (v) “Local Service Bus” has the same meaning as in Section 2 of the Transport Act 1985 (vi) “Hackney Carriage” has the same meaning as in section 13(3) of the Transport Act 1985 (vii) “Authorised Loading” means any authorised vehicle(s) or person(s) stated in the Schedule to PART 4 of this Order.
