This can also be downloaded from website www.omfed.com. OMFED reserves the right to accept or reject any or all the tenders without assigning any reason thereof. // 2 // SCOPE OF WORK AND GENERAL TERMS & CONDITIONS: The Odisha State Cooperative Milk Producers’ Federation Ltd., Bhubaneswar requires the services of well established and financially sound Vendor to set up & operate Milk Stall as Sub- licensee for selling Omfed products Jaleswar Railway Station on payment of license fee as decided by the Railway Authority from time to time in the State of Odisha as mentioned below: Sl Railway Station Categor P.F No. Nos.of 1st year Dairy Name No, y Stalls license fees i Jaleswar D 2/3 01 Rs.60,000/- Balasore Dairy (1) Interested parties may apply in the prescribed form along with EMD of Rs.10,000/- in shape of demand draft in favour of OMFED, Balasore Dairy payable on any Nationalized Bank at Balasore. Offer without EMD shall be rejected. Application to be addressed to the Plant Manager, Balasore Dairy, Januganj, Remuna, Balasore- 756019 in a sealed envelope duly superscribed- “Application for OMFED Milk Stall at Jaleswar Railway Station, PF No 2/3 and should be submitted in the OMFED Balasore Dairy from 10.00 hrs up to 14.00 hrs of Date:16.4.2015After which no application will be entertained. All documents of both the essential and desirable should be submitted with the application duly attested by a Gazetted Officer. The OMFED authority reserves the right to reject any or all applications without assigning any reason whatsoever. (2) The tenure of contract will be for 05 years for Railway Station at Jaleswar and the same may be renewed at the discretion of Railway Authority after every term of specified years subject to satisfactory performance, payment of required license fee, dues and arrears if any by the Sub-licensee. (3) Modular Stall shall be constructed by the Vendor/Sub-licensee at his own cost as per specification & at the earmarked location of the Railway Authority. (4) Temporary construction is to be made by the Vendor and under no circumstance permanent brickwork shall be allowed for the purpose. (5) The Vendor/Sub-licensee shall have to deposit minimum lump sum License fee subject to revision as per catering policy of Railway Authority decided from time to time. (6) Lump sum license fee will be required to be deposited in advance with OMFED, Balasore Dairy for the entire terms of the contract and the balance amount of revised License fee as decided if any by the Railway authority shall be deposited by the Sub-licensee within one month on receipt of intimation from the Federation. (7) The Sub-licensee shall arrange electricity and water supply connection to the stall and make payment here for regularly on actual consumption basis. (8) After allotment of Stall, tripartite Agreement will be executed among the Railway, Omfed & the Sub- Licensee. (9) The Sub-licensee shall have to obtain Food license, trade license & Medical certificate from the competent authority & renew the same from time to time. (10) The products will be supplied to the Sub-licensee at whole sale price as per indent alongwith advance payment. The Sub-licensee will arrange for lifting of the items from the distribution Van to the Stall inside the Rly. Plat Form.. Omfed Ice-cream supply arrangement may be made at Retail Price subject to availability in that area. (11) The Photo copy of all the supporting documents with self attestation should be submitted along with the application form. (12) The Sub-licensee shall not claim for any compensation in the event of failure on the part of the Federation to deliver the products in time due to breakdown of plant / distribution vehicle or for any other reasons. (13) The Sub-licensee shall put to sale exclusively Omfed products in the stall allotted to him and arrange for lifting of products as per target given from time to time. (14) Performance of the Sub-licensee shall be reviewed from time to time and the contract is subject to termination on the basis of performance review made by the Federation. (15) Successful bidder will deposit License fee and interest free Security Deposit as agreed by him within Ten working days on receipt of intimation. If the bidder fails to deposit the Security Deposit within 10 working days, OMFED reserves the right to reject his bid treating him as unsuccessful bidder unless the date line for deposit of Security Deposit is extended by OMFED. (16) The Security Deposit will be retained by OMFED during the contract period which is refundable without any interest after the contract period unless forfeited in case of breach of agreement. After deposit of the Security money within the prescribed date line, an agreement will be signed between the bidder and Railway and OMFED for the said purpose. Cost of execution of agreement shall be borne by the bidder. In the event of failure on the part of the selected bidder to execute the agreement within the stipulated time , EMD deposited by him along with tender shall stand forfeited. (17) The Technical Bid and Financial Bid shall be submitted in two separate sealed cover indicating thereon specification of Bid. (18) Tenders filled in all respect must be sent by Regd. Post/ Courier/ Person to reach Plant Manager, Omfed, Balasore Dairy, Remuna, Balasore-756019 on or before 1400 Hours dtd.16.4.15. Incomplete tenders and tenders received after specified time shall not be accepted. Omfed shall not be responsible for any type of delay in arrival of tender. Once tender is accepted cannot be allowed for withdrawal. (19) The Technical bid will be opened by a Committee at 1500 Hours dtd.16.4.15 at Balasore Dairy in presence of interested tenderers/ their authorized Representatives. (20) If the Technical Bid of any particular bidder is not found in order then his Financial Bid shall not be taken into consideration without any notice. The Financial Bids of Technical Bid qualifiers shall be opened at ______ Hours dtd. _____ at Balasore Dairy, in the presence of interested tenderers/ their authorized representatives, who wish to be present on the spot at that time. The date and time shall be communicated on the spot accordingly. (21). EMD of successful bidder will be adjusted towards security deposit. The EMD of unsuccessful bidder shall be refunded within one month of finalization of order in the shape of Account Payee Cheque. (22) Security Deposit/EMD as the case may be, of the successful bidder shall be forfeited in the event of failure on his part to carry out the instructions contained in the work order/authorization letter within the given time (23) If the tenderer does not meet statutory requirement to the satisfaction of the management as stipulated above, Competent Authority shall reserves the right to reject the tender outright at the time of opening of tender.
