DODD Chairman DODD. The Committee will come to order. My apolo- gies to all of you this morning for—they are doing an experiment, I guess, or test on constitutionality this morning. Not a good excuse but, nonetheless, that is reason I am a few minutes late, and I apologize to my colleagues and to the witnesses and to your fami- lies. Let me make an opening statement, if I can, and then I will be turning to my colleague from Alabama, the Ranking Member, and any other Members who wish to make some opening statements here. We will then swear in the witnesses and hear your testimony, and then we will raise some questions with you. First of all, I am pleased to welcome all of you here this morning. Today the Committee will meet in open session to hear from Dr. Randall Kroszner, Ms. Elizabeth Duke, and Mr. Larry Klane, who have been nominated to the Federal Reserve Board of Governors. One of the most important and influential nominations that we consider in this Committee is that of a Governor of the Federal Re- serve Board. The seven Federal Governors are the only individuals appointed by the President of the United States and confirmed by the U.S. Senate who have a voice in our Nation’s monetary policy. Fulfilling this mandate creates the conditions necessary for our economy to grow and for every American to have an opportunity to participate in the shared prosperity of our Nation. The role of the Fed is critical not just in setting monetary policy; it also serves as a regulator of the safety and soundness of our largest lending institutions and, very significantly, as a regulator and enforcer of the laws passed by the U.S. Congress and signed by the President to protect consumers and ensure that they have an opportunity to participate and succeed in the American econ- omy. The duties of the Fed are no less important than the Fed’s mone- tary policy responsibilities. In fact, given the depth of experience that the Fed’s current Governors have in monetary policy, issues of consumer protection and bank supervision are of particular im- portance with respect to the nominees that we have before us today. It is for all of these reasons that the Fed Governors should be of the highest caliber and quality to serve our Nation. The position of Governor also requires substantial political independence. In es- tablishing the Federal Reserve, the Congress created a system in which each Fed Governor’s seat has a fixed 14-year term. I know some of my colleagues wish that the Founders had thought of us in that way. Governors at the Fed enjoy the third longest

TAX CUTS AND THE REPUBLICAN MAJORITY Extending the 2003 tax cuts on dividends and capital gains and extending the GOP's control of the House of Representatives are interlinked processes, and both moved one step ahead yesterday when the House voted to approve last year's spending reconciliation bill (it had already been voted in December, but had to be voted again because of technical changes made subsequently by the Senate). The bill passed by the narrowest possible margin, and only with the last-minute switch of a single swing vote by a GOP representative from a blue state. But this vote shows that a politically vulnerable Republican majority under embattled leadership can still make things happen. It clears the deck politically for belated processing by the House and the Senate of last year's tax reconciliation bill, including extension of the 2003 tax cuts. And under Senate rules, the passage of the spending bill means that $70 billion in tax cuts can be accommodated within the filibuster- proof reconciliation framework, not just $60 billion. This is encouraging news because (1) the economy and the stock market will perform better if the 2003 tax cuts are extended, (2) improving prospects for extending the tax cuts improve the chances that the GOP will retain control of the House in the November elections; and (3) the economy and the stock market will perform better if the GOP keeps control.

    A summary of the roundtable discussion on retail payments fraud The Federal Reserve System’s Payments System Policy Advisory Committee (PSPAC) has an ongoing program to discuss payments system developments and barriers to innovation with the payments industry and relevant payments system participants. As part of this program, the committee hosted a roundtable discussion with industry leaders on issues involving fraud in retail payments.1 The roundtable discussion was held at the Federal Reserve Bank of Minneapolis on March 27, 2007. During the discussion, fourteen industry experts representing depository institutions, corporations, service providers, and law enforcement provided the committee with insights into key areas of concern regarding fraud in retail payments.2 Introduction The roundtable participants agreed that although the current level of payments fraud is being effectively managed and does not represent a crisis, organizations must constantly adapt to keep pace with criminal activity and with changes in technology and the payments landscape. It will never be practical to eradicate fraud completely. Rather, the range of organizations affected by payments fraud need to balance the costs and benefits of fraud prevention. The participants reported that while the dollar amount of fraud relative to business revenues in the U.S. likely is declining, the costs associated with investing in fraud mitigation are substantial and increasing.3 1 The Federal Reserve’s Payments System Policy Advisory Committee advises the Board on developments in both wholesale and retail payments at a time of significant overall change in the U.S. payments system and helps coordinate Federal Reserve work involving domestic and international payments and settlement systems.

Bobins Professor of Economics The University of Chicago Booth School of Business Prepared for Financial Crisis Forum Financial Crisis Inquiry Commission Washington, DC February 26-27, 2010 1 INTRODUCTION1 There is near universal agreement that a well functioning financial system is necessary for a thriving, modern economy and that the financial system is an important conduit through which central bank policy influences prices and economic activity. Naturally, a well functioning financial system will evolve with the economy, and this has certainly been true in the United States. One of the most pronounced changes in the structure of the financial system has been the growth of the non-bank sector. In 1950, depository institutions (banks for short) accounted for 60 percent of the assets held by the financial sector, by 2006 that share fell to 30 percent. Money market mutual funds (MMMFs) alone, for example, hold roughly $4 trillion, while total bank deposits are roughly $8 trillion. Accompanying the diminished role of banks has been an increase in the length and complexity of financial intermediation chains.2 Rather than a single bank accepting deposits from households and making commercial loans to firms or mortgage loans to other households, the financial system has evolved so that a lending household might purchase shares in a money- market mutual fund that holds commercial paper issued by a bank that engages in a repurchase agreement with a securities firm that has a special purpose vehicle that issues asset-backed securities that funds a pool of residential mortgages and that purchases credit derivatives from other financial institutions to hedge its exposure to these securities and others in its portfolio, etc.

Christian Chamorro-Courtland* INTRODUCTION I have previously argued in my Article, Central Counterparties and the New Transnational Lex Mercatoria,1 that the new transnational lex mercatoria is the main source of law governing the operations of central counterparties (CCPs or singularly CCP). It is a legal framework which recognizes that the customs, practices, and usages of CCPs are a legally binding source of law. That is to say, CCPs have operated as self-regulatory organizations (SROs) and have developed their own operations for risk management and default procedures by altering and adapting their customs and practices over the past several decades. Adhering to this framework, courts in various common law jurisdictions have enforced these customs and practices as legally binding between participants of the clearing system.

    WORKING PAPER Depositors Disciplining Banks: The Impact of Scandals 1 Mikael Homanen 2 September 14, 2018 Abstract Do depositors react to negative non-financial information about their banks? By using branch level data for the U.S., I show that banks, that financed the highly controversial Dakota Access Pipeline, ex- perienced significant decreases in deposit growth, especially in branches located closest to the pipeline. These effects were greater for branches located in environmentally or socially conscious counties and data suggests that savings banks were among the main beneficiaries of this depositor movement. Us- ing a global hand-collected dataset on tax evasion, corruption and environmental scandals related to banks, I show that negative deposit growth as a reaction to scandals is a more widespread phenomenon.
