The development hereby permitted shall be begun within 5 years from the date of this permission. 2. The development hereby permitted shall not be carried out otherwise than in complete accordance with the submitted plans, subject to the following conditions or modifications: (i) Before any other operations are commenced a new vehicular access shall be formed to Main Street in accordance with the application drawings, designed, laid out and constructed all as may be agreed with the Peak District National Park Authority and provided with 90 m visibility splays from a 2.0 m minor road distance in either direction, the area in advance of the sightlines being maintained clear of any object greater than 1 m in height (600 mm in the case of vegetation) relative to adjoining nearside carriageway channel level. (ii) The new parking space, the sUbject of the application, shall not be taken into use until space has been provided within the site curtilage for the parking, picking up and selling down of passengers and manoeuvring in accordance with the application drawings, laid out and constructed with a solid, bound material (ie not loose chippings), all to the satisfaction of the Peak District National Park Authority and maintained thereafter free from any impediment to its designated use. (iii) There shall be no gates within 5 m of the highway boundary and any such gates shall open inwards only. (v) All door frames shall be recessed a minimum of 100 mm (approximately 4 inches) from the external face of the wall. (vi) All door openings shall be provided with natural gritstone lintels. Reasons for Conditions: 1. To comply with Sections 91, 92, and 93 of the Town and Country Planning Act 1990 (which requires the National Park Authority to reconsider the proposal afresh after a period of years). 2. (i)-(iiil) In the interests of highway safety. (iv)-(vi) In the interests of the character and appearance of the development. Note: The following policies have been taken into account in determining this application. Relevant Structure Plan policies include: GS1, C3, C4. Relevant Local Plan policies include: LC2, LC4, LC5, LT11. STATEMENT OF APPLICANTS RIGHTS ARISING FROM THE REFUSAL OF PLAINNING PERMISSION OR FROM THE GRAINT OF PERMISSION SUBJECT TO CONDITIONS Appeals to the Secretary of State If you are aggrieved by the decision of your local planning authority to refuse permission for the proposed development or to grant it subject to conditions, then you can appeal to the Secretary of State for the Environment under Section 78 of the Town and Country Planning Act 1990. If you want to appeal, then you must do so within 6 months of the date of this notice, using a form which you can get from the Planning Inspectorate at 3/02 Kite Wing, Temple Quay House, 2 The Square, Temple Quay, Bristol BS1 6PN, telephone No. 0117 372 8428. The Secretary of State can allow a longer period for giving notice of an appeal, but he will not normally be prepared to use this power unless there are special circumstances which excuse the delay in giving notice of appeal. The Secretary of State need not consider an appeal if it seems to him that the local planning authority could not have granted planning permission for the proposed development or could not have granted it without the conditions they imposed, having regard to the statutory requirements, to the provisions of any development order and to any directions given under a development order. In practice, the Secretary of State does not refuse to consider appeals solely because the local planning authority based its decision on a direction given by him. Purchase Notices If either the local planning authority or the Secretary of State for the Environment refuses permission to develop land or grants it subject to conditions, the owner may claim that he can neither put the land to a reasonably beneficial use in its existing state nor render the land capable of a reasonably beneficial use by the carrying out of any development which has been or would be permitted. In these circumstances, the owner may serve a purchase notice on the Council (District Council, London Borough Councilor Common Council of the City of London) or, where the land is situated in a National Park, the National Park Authority for that Park in whose area the land is situated.
