NOTICE IS HEREBY GIVEN THAT PERMISSION FOR THE PROPOSED DEVELOPMENT in the manner described on the application and shown on the accompanying plans and drawings is

GRANTED subject to the following conditions:

1. The development hereby permitted shall be begun within 5 years from the date of this permission.

2. The development hereby permitted shall not be carried out otherwise than in complete accordance with the submitted plans, subject to the following conditions or modifications:

(i) Before any other operations are commenced a new vehicular access shall be formed to Main Street in accordance with the application drawings, designed, laid out and constructed all as may be agreed with the Peak District National Park Authority and provided with 90 m visibility splays from a 2.0 m minor road distance in either direction, the area in advance of the sightlines being maintained clear of any object greater than 1 m in height (600 mm in the case of vegetation) relative to adjoining nearside carriageway channel level.

(ii) The new parking space, the sUbject of the application, shall not be taken into use until space has been provided within the site curtilage for the parking, picking up and selling down of passengers and manoeuvring in accordance with the application drawings, laid out and constructed with a solid, bound material (ie not loose chippings), all to the satisfaction of the Peak District National Park Authority and maintained thereafter free from any impediment to its designated use.

(iii) There shall be no gates within 5 m of the highway boundary and any such gates shall open inwards only.

Reasons for Conditions:

1. To comply with Sections 91, 92, and 93 of the Town and Country Planning Act 1990 (which requires the National Park Authority to reconsider the proposal afresh after a period of years).

2. (i)-(iiil) In the interests of highway safety.

(iv)-(vi) In the interests of the character and appearance of the development.

Appeals to the Secretary of State If you are aggrieved by the decision of your local planning authority to refuse permission for the proposed development or to grant it subject to conditions, then you can appeal to the Secretary of State for the Environment under Section 78 of the Town and Country Planning Act 1990. a) Pursuant to Section 184 of the Highways Act 1980 and Section 86(4) of the New Roads and Streetworks Act 1991, at least 6 weeks prior notification should be given to the County Council's Director of Environmental Services at County Hall, Matlock (tel: 01629 580000 and ask for the District Highway Care Manager - North West area) before works commence upon the proposed access modifications.

b) Pursuant to Section 163 of the Highways Act 1980, where the site curtilage slopes down towards the existing highway, measures shall be taken to ensure that surface water run-oft is prevented from escaping across the footway margin of the road by means of a barrier (eg Dish channel, gUlly etc).

c) During a site inspection it was noted that vegetation within the highway, adjacent to the above site, is likely to impede visibility from the proposed access. In view of this, as part of the Section 184 application, it would be advisable to discuss the removal of the vegetation with the District Highway Care Manager.
