C 375/2 EN Official Journal of the European Union 12.11.2015 IV (Notices) NOTICES FROM EUROPEAN UNION INSTITUTIONS, BODIES, OFFICES AND AGENCIES COUNCIL COUNCIL DECISION of 10 November 2015 adopting the Council's position on draft amending budget No 8 of the European Union for the financial year 2015 (2015/C 375/03) THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Functioning of the European Union, and in particular Article 314 thereof, in conjunction with the Treaty establishing the European Atomic Energy Community, and in particular Article 106a thereof, Having regard to Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union and repealing Council Regulation (EC, Euratom) No 1605/2002 (1) and in particular Article 41 thereof, Whereas: — the Union's budget for the financial year 2015 was definitively adopted on 17 December 2014 (2), — on 20 October 2015, the Commission submitted a proposal containing draft amending budget No 8 to the general budget for the financial year 2015, — in order to facilitate Member States' cash flow management at year-end and alleviate the financial burden on national treasuries in a timely manner, draft amending budget No 8 to the general budget for 2015 needs to be adopted without delay. C 375/4 EN Official Journal of the European Union 12.11.2015 Interpretative Notice on indication of origin of goods from the territories occupied by Israel since June 1967 (2015/C 375/05) (1) The European Union, in line with international law, does not recognise Israel’s sovereignty over the territories occupied by Israel since June 1967, namely the Golan Heights, the Gaza Strip and the West Bank, including East Jerusa­ lem, and does not consider them to be part of Israel’s territory (1), irrespective of their legal status under domestic Israeli law (2). The Union has made it clear that it will not recognise any changes to pre-1967 borders, other than those agreed by the parties to the Middle East Peace Process (MEPP) (3). (2) The application of existing Union legislation on indication of origin of products to products originating in Israeli-occupied territories has been the subject of notices or guidance adopted by the relevant authorities of several Member States. There is indeed a demand for clarity from consumers, economic operators and national authorities about existing Union legislation on origin information of products from Israeli-occupied territories (4). The aim is also to ensure the respect of Union positions and commitments in conformity with international law on the non-recognition by the Union of Israel’s sovereignty over the territories occupied by Israel since June 1967. This notice also aims at main­ taining open and smooth trade, is not hindering trade flows and should not be construed to do so. (3) This Notice does not create any new legislative rules. While this Notice reflects the Commission’s understanding of the relevant Union legislation, enforcement of the relevant rules remains the primary responsibility of Member States. According to the case-law, while the choice of penalties remains within their discretion, Member States must ensure that penalties for infringements of provisions of Union law are effective, proportionate and dissuasive (5). The Commission ensures, as guardian of the Treaties, compliance with these obligations of Member States if need be by way of infringe­ ment proceedings. This Notice is without prejudice to other requirements established by Union legislation, and to the interpretation which the Court of Justice may provide.     IZVJEŠĆE O STANJU U PROSTORU OSJEČKO-BARANJSKE ŽUPANIJE I. POLAZIŠTA I.1. Ciljevi izrade Izvješće o stanju u prostoru (u daljnjem tekstu: izvješće), je osnovni i jedini dokument, te snažan alat stalnog i neprekinutog, praćenja stanja u prostoru. Ono omogućuje Županu, Skupštini Osječko-baranjske županije (u daljnjem tekstu: Skupština) te stručnoj i široj javnosti cjelovito praćenje stanja u prostoru na temelju analize i ocjene osnovne prostorne strukture, trendova prostornog razvoja, zaštite i korištenja posebno vrijednih prostora kao i analize i ocjene provedbe prostornih planova i drugih strateških dokumenata koji utječu na prostor. Svrha izrade Izvješća je dobivanje sveobuhvatnog pregleda prostornog razvoja i prostornog planiranja sa sustavom prostornog uređenja. Ovim dokumentom nastoji se prikazati cjelovita, argumentirana i objektivna spoznaja o prostoru Osječko-baranjske županije (u daljnjem tekstu: Županija) kao neobnovljivom temeljnom dobru. Povezivanjem svijesti o vlastitom prostornom potencijalu s praktičnim djelovanjem u području zaštite i uređenja prostora potrebno je snažnije afirmirati vrijednosti prostora Županije te zaustaviti negativne pojave u prostoru. Izvješće prioritetno prikazuje utvrđene probleme u prostoru, postojeća rješenja za poboljšanje stanja te ukazuje na mogućnosti daljnih usmjerenja prostornog razvoja, odnosno analizira stanja i promjene u prostoru koje nastaju pod utjecajem različitih društvenih procesa i imaju veći ili manji neposredan utjecaj na prostor.     JanKoVIć castle, Suhopolje ProJect descrIPtIon Janković Castle, located in the Suhopolje municipality in the central part of Virovitica-Podravina County, has historical, architectural and townscape value and, as such, is protected as a cultural monument. Together with the historical park and the remaining supporting structures, Virovitica the castle makes a valuable example of feudal countryside Suhopolje architecture of the late 18th and the early 19th century. The main idea behind the project is the renovation of the old castle and the corresponding facilities into a four-star hotel with accompanying wellness, restaurants and sports Zagreb facilities (swimming pools) covering the total area of 74,430 m2. The location has very good transport links (distance from the highway is 75 km, railway 1 km, airport 85 km) and all necessary infrastructure (gas, electricity, water, sewage) is provided. Given the lack of accommodation facilities, especially those of high quality in the region of Virovitica-Podravina County, the project offers significant potential for tourist development of the region, particularly for sports tourism such as hunting. This region is rich with big game and is known for a large number of wild boars and deer as well as attractive quail hunting in the summer and hare, pheasant, partridge and wild duck hunting in the winter season. PotentIal transactIon structure Janković Castle, 100% owned by Virovitica-Podravina County, will be offered to a strategic partner based on right to built model which will be granted for 99 years and will cost 1 HRK per year (1 HRK = 0.13 EUR) under the condition that the real estate will be brought to purpose within five years from the selection of the best bidder.

    VIROVITIČKO-PODRAVSKA ŽUPANIJA _________________________________P R O S T O R N I P L A N________________________________ UVOD Obveza izrade Prostornog plana Županije utvrđena je člankom 18. Zakona o prostornom uređenju (Narodne novine, broj 30/94. i 68/98.), a izrada Plana predviđena je i Programom mjera za unapređenje stanja u prostoru Virovitičko-podravske županije iz 1996. i 1998. godine. Kao vrsta prostorno-planske dokumentacije, prostorni plan Županije predstavlja potpuno novu kategoriju uvedenu Zakonom o prostornom uređenju iz 1994. godine, kojom se po prvi put planski obrađuje nova teritorijalno planska cjelina-županija. Županijskim planom definiraju se strateške odredbe za elemente na državnoj i regionalnoj razini, određuju smjernice i kriteriji za planiranje na nižoj razini te stvaraju uvjeti za izradu prostornih planova uređenja općina, gradova i drugih cjelina. Prostorni plan Županije izradio je Zavod za prostorno uređenje Virovitičko-podravske županije u suradnji sa Zavodom za prostorno planiranje d.d. Osijek, a tijekom izrade Plana uspostavljena je suradnja s odgovarajućim državnim ustanovama, županijskim uredima i javnim poduzećima. Sadržaj i način izrade Plana temeljeni su na materijalima Ministarstva zaštite okoliša i prostornog uređenja (bivše Ministarstvo prostornog uređenja, graditeljstva i stanovanja), kojima se daju upute vezane uz sadržajnu strukturu Plana i obradu ključnih tematskih cjelina. The central element of this procedure is the Committee of Experts, established in accordance with Article 17 of the Charter. Its principal purpose is to report to the Committee of Ministers on its evaluation of compliance by a Party with i ts undertakings, to examine the real situation of the regional or minority languages in the State and, where appropriate, to encourage the Party to gradually reach a higher level of commitment. To facilitate this task, the Committee of Ministers adopted, in accordance with Article 15.1, an outline for the initial periodical report that a Party is required to submit to the Secretary General. The report should be made public by the State. This outline requires the State to give an account of the concrete app lication of the Charter, the general policy for the languages protected under its Part II and in more precise terms all measures that have been taken in application of the provisions chosen for e ach language protected under Part III of the Charter.
