South Africa | Freedom House Page 1 of 8 South Africa freedomhouse.org In May 2014, South Africa held national elections that were considered free and fair by domestic and international observers. However, there were growing concerns about a decline in prosecutorial independence, labor unrest, and political pressure on an otherwise robust media landscape. South Africa continued to be marked by high-profile corruption scandals, particularly surrounding allegations that had surfaced in 2013 that President Jacob Zuma had personally benefitted from state-funded renovations to his private homestead in Nkandla, KwaZulu-Natal. The ruling African National Congress (ANC) won in the 2014 elections with a slightly smaller vote share than in 2009. The newly formed Economic Freedom Fighters (EFF), a populist splinter from the ANC Youth League, emerged as the third-largest party. The subsequent session of the National Assembly was more adversarial than previous iterations, including at least two instances when ANC leaders halted proceedings following EFF-led disruptions. Beginning in January, the Association of Mineworkers and Construction Union (AMCU) led a five-month strike in the platinum sector, South Africa’s longest and most costly strike. The strike saw some violence and destruction of property, though less than AMCU strikes in 2012 and 2013. The year also saw continued infighting between rival trade unions. The labor unrest exacerbated the flagging of the nation’s economy and the high unemployment rate, which stood at approximately 25 percent nationally and around 36 percent for youth. His actions recover trust in state institutions and are bringing the country back on economic growth. Questions remain why he remained quiet for a decade and did not act earlier against ex-president Zuma and corruption. Arnold Wehmhoerner FEPS Advisor on Southern Africa FEPS APRIL 2018 South Africa’s new President Cyril Ramaphosa: Master of the long game On April 6th this year ex-president Jacob Zuma briefly appeared in the Durban High Court facing 16 corruption charges linked to the multi-million dollar arms deal of the 1990s. Since 2005 when Zuma’s financial advisor Schabir Shaik was jailed for fraud and corruption in a related case had he successfully avoided this day in court. The case was adjourned to June and there will be many appeals and postponements but the fact that he had to appear before a judge is symbolic for the changes that are taking place in South Africa after Cyril Ramaphosa has become President of the country. Another indication of the new situation in the country is the fact that the Gupta brothers, whose business imperium was at the center of corrupt networks, have left the country. Cyril Ramaphosa faces two major tasks: firstly to clear the government of incompetent and corrupt ministers and civil servants in order to recover trust in state institutions and to bring the country back on economic growth and secondly to maintain the unity of the deeply divided African National Congress (ANC). -

PINS, 2017, 55, 38 – 60, http://dx.doi.org/10.17159/2309-8708/2017/n55a4 “We do not want the Commission to allow the families to disappear into thin air”1: A consideration of widows’ testimonies at the Truth and Reconciliation Commission and the Farlam (Marikana) Commission of Inquiry Abstract Cynthia Kros Using Gayatri Spivak’s famous question about whether History Workshop the “subaltern” can speak, this article addresses the University of the testimonies given to the Farlam Commission of Inquiry Witwatersrand by the widows of miners who had been killed in police Johannesburg shootings while engaged in an unprotected strike at Lonmin’s platinum mine at Marikana in August 2012. Keywords The widows were required to face down the dominant Mlangeni, TRC, Marikana, narrative disseminated by mine management and political widow, Farlam other business as well as state interests, which held Commission, Lonmin, that the police had acted in self-defence after the subaltern, narrative strikers had threatened to attack them. I argue that the widows consciously sought to undo the dominant narrative through their testimonies, assuming the role of a new kind of “political widow” as theorised by Mamphela Ramphele (1996). The article begins with a detailed consideration of the testimony of Sepati Mlangeni whose husband had been murdered by an agent of the apartheid state, delivered to the Truth and Reconciliation Commission (TRC) in the 1990s. It is also a country run by a government which has itself become increasingly lawless. This is so despite all the commitments to legality set out in the Constitution. Not only is the post–apartheid South Africa founded upon the principle of legality, but courts whose independence is guaranteed are vested with the power to ensure that these principles are upheld. Prosecuting authorities are enjoined to exercise their functions “without fear, favour, or prejudice”. The same duty is laid upon other institutions established by the Constitution, among them the public protector and the auditor general. Everyone is endowed with the right to “equal protection and benefit of the law”. We are all also entitled to “administrative action that is lawful, reasonable, and procedurally fair”. Unlike the old South Africa – no doubt because of it – the new Rechtsstaat was one where the rule of law would be supreme, power would be limited, and the courts would have the final say. This edifice, and these ideals, are under threat. Lawlessness on the part of the state and those who run it is on the increase. The culprits run from the president down to clerks of the court, from directors general to immigration officials, from municipal managers to prison warders, from police generals to police constables, from cabinet ministers to petty bureaucrats. -

This monograph explores corruption in the SAPS prior to and after democratisation in 1994, contextualising the discussion with reference to international and domestic literature on the subject. It explores the causes of police corruption in the Protector or predator? South African context and assesses the efforts taken by the SAPS in response to this Tackling police corruption in South Africa challenge. Practical recommendations are made as to how the SAPS can significantly reduce incidents of police corruption by enhancing internal accountability, promoting P a culture of organisational integrity and mobilising community support. Consolidating r decades of research on the subject, this monograph represents the most comprehensive edator? analysis of police corruption in South Africa to date. It also offers an approach that could assist in transforming the SAPS into a police agency that all South Africans want, one that is widely respected for its integrity and professionalism.
