2 Legrad-1 Geothermal waters exploration block

1. INTRODUCTION

1.1 Description of the single procedure for issuing a licence for the exploration of geothermal waters and a production licence for geothermal waters

For the purposes of this Bidding Round Documents, geothermal waters are considered geothermal waters from which accumulated heat can be used for energy purposes (hereinafter: geothermal waters), in accordance with the Act on the Exploration and Production of Hydrocarbons (Official Gazette, No. 52/18 and 52 / 19) (hereinafter: the Act). Pursuant to the provisions of Article 54 of the Act, the issuance of a production licence for geothermal waters shall be conducted on the basis of a single procedure, which begins with the selection of the most favourable bidder for the issuing of a licence for the exploration of geothermal waters and ends with the conclusion of a contract for the production of geothermal waters. Accordingly, the subject-matter of the bidding round includes the entire above mentioned single procedure and all its stages. In the process of selecting the most favourable bidder for issuing the licence for exploration of geothermal waters in the Legrad-1 exploration block, a single procedure is conducted for the said exploration block. For the exploration block for which bids are submitted that satisfy meet the conditions set out in this Bidding Round Documentation for the selection of the most favourable bidder for the exploration of geothermal waters in the Legrad-1 exploration block for the issuing of a production licence for geothermal waters for energy purposes (hereinafter: Bidding Round Documentation), the Ministry of Environment and Energy (hereinafter: Ministry), based on the proposal of the Commission for the selection of the most favourable bidder in the bidding round for the selection of the most favourable bidder for the exploration of geothermal waters in the Legrad-1 exploration block, for the issuing of a licence for the exploration of geothermal waters (hereinafter: Commission), renders a decision on issuing of a licence for the exploration of geothermal waters. Accordingly, the bidders shall submit their bids for the exploration block in question where they intend to conduct the exploration of geothermal waters.

2. GENERAL INFORMATION

2.3 List of economic entities with which the Ministry would be in conflict of interest

Pursuant to Article 80 of the Public Procurement Act (Official Gazette, No. 120/16), the issuer of the exploration licence for exploration of geothermal waters and the production licence for geothermal waters shall not enter into agreements on the production of geothermal waters with the following economic entities:

The aforementioned economic entities shall not participate as a bidder or a consortium member and shall not be a subcontractor for the selected bidders in the bidding round procedure for the purpose of selecting the most favourable bidder for the exploration of geothermal waters in the Legrad-1 exploration block.

3. INFORMATION ON THE BIDDING ROUND SUBJECT

3.1 Description of the bidding round subject

The subject of this bidding round is the selection of the most favourable bidder for the exploration of geothermal waters in the Legrad-1 exploration block for the purpose of issuing a production license for geothermal waters. The subject matter of the bidding round procedure includes the entire single procedure for the issuing of the exploration licence for exploration of geothermal waters and the production licence for geothermal waters with all the phases thereof.

3.2 Technical specifications of the bid

3.2.1 Geographical location of the bidding round subject

Legrad-1 exploration block is located in the municipalities of Legrad and Đelekovec in Koprivnica-Križevci County.

The borders of the subject exploration block are defined by the geographic coordinates of its endpoints in Table 1. The map of the Legrad-1 exploration block is shown in Figure 1.

3.3 Summary of geological settings and geothermal potential of the Legrad area

The Legrad area is located in the marginal north-western part of the Drava Depression as one of the four major depressions in the Croatian part of the Pannonian Basin. The Legrad area in the Drava Depression is shown in Figure 2.

3.3.1 Geological settings of the Drava Depression The Drava Depression consists of two rock complexes. Pre-Neogene basement is composed of magmatic - metamorphic complex of Paleozoic and sediments of Mesozoic and Paleogene age, while sedimentary basin infill is defined by deposits of Neogene and Quaternary. The carbonate-clastic complex of Mesozoic in pre-Neogene basement is characterized by a different lithological composition: limestones, dolomites, breccias, conglomerates and their varieties. The carbonate-clastic complex of Mesozoic is bounded by pre-Neogene top Tg (E-log marker) in the bottom and by Pt E-log marker on the top. The sedimentary basin infill consists of clastic rocks and marls with different variations of Neogene and Quaternary age. Also, there might be an occurrence of Lithothamnium limestones in Middle Miocene (mainly Badenian). Neogene-Quaternary sediments of basin infill within Drava Depression are distinguished into three lithostratigraphic units, ie formations. The first and oldest Moslavačka gora Formation is defined by tectonic-erosion unconformity Pt / Tg in the basement and Rs5 E-log marker on the top. It is defined by heterogeneous

lithological composition, and in chronostratigraphic terms includes Lower and Middle Miocene and the lowest part of Upper Miocene (part of Lower Pannonian). The formation is lithologically composed of conglomerates, breccias, marly sandstones, sandstones, Lithothamnium limestones, calcareous marls, clayey marls with their varieties. Ivanić-Grad Formation is bounded by E-log markers Rs5 and Z 'and represents the approximate equivalent of Upper Pontian deposits. The formation is characterized by sandstones with sandy, clayey and silty marls. The appearance of calcite marls often occurs in the bottom part of the formation. Kloštar Ivanić Formation is defined between by the E-log markers Z 'and Δ and is lithologically characterized by sandy and clayey marls and sandstones of Lower Pontian. Bilogora Formation encompasses a sequence of Upper Pontian deposits bounded by E-log markers Δ and α'. The formation is lithologically defined by the appearance of sands to unconsolidated sandstones, marly clays, clayey or sandy marls. The last and youngest Lonja Formation is defined by sediments of Pliocene and Quaternary. Formation consists of heterogeneous rock composition, but mainly dominated are sandstones, sandy and clayey marls, sands, gravels and clays with occasional occurrences of coal layers. The formation is determined by α' E-log marker in the bottom, while the top formation is defined by the terranean surface. Figure 3 Schematic general lithostratigraphic column of Legrad area The area of Drava Depression, encompassing wider area of Legrad, is characterized by very complex structural-tectonic relations due to defined fault systems of different generations and directions of dip and the newly formed structure. Three fault systems are dominating across the area with directions of dip: southwest-northeast, northwest-southeast, and north-south. Legrad area is situated nearly by the intersection of Drava fault and Periadriatic lineament. The most significant role in the neotectonic movement creation is played by seismogenic Drava fault with right-lateral strike-slipe movement. Drava fault represents a zone of parallel, steep reverse faults and it is defined as a regional fault along Mura and Drava Depression. Formation of Drava fault was in syn-rift phase (1st transtension phase) of the Pannonian Basin evolution. By its activation, some of the important structures were made such as Legrad High or highs like Kalnik and Bilogora threshold and elevations such as Kalnik and Bilogora. Legrad structure with east-west direction, is located on the lowest, northeastern part of the Legrad High.

3.3.2 Geothermal potential of the Legrad area The geothermal potential of the Legrad area was discovered by drilling exploration well for the purpose of finding hydrocarbons. A sequence of Neogene and Quaternary sediments and

Mesozoic carbonate-clastic complex were drilled on the northeastern slope of Legrad High. The total depths of the wells of Legrad area reach from 1975 to 4600 m (MD - measure depth) with measured temperatures at the bottom of the wells in the range from 105⁰ to 212⁰ C. By well testing one of Legrad exploration wells, the geothermal potential in dolomite breccias of Mesozoic carbonate-clastic complex was determined. A flow of high temperature water was achieved, which indicates a high enthalpy reservoir. Also, additional geothermal potential is represented by fine-grained sandstones and untested interval of breccia-conglomerates and conglomerate sandstones with shale of Moslavačka gora Formation.

3.4 Available geological, geochemical and geophysical data

All bidders that pay the bid fee referred to in Section 6.1 of these Bidding Round Documentation shall acquire the right to use the data related to this geothermal waters exploration block for the purpose of participating the in bidding round procedure, i.e. for the purpose of submitting a bid for the exploration block for which the bid fee was paid. Available data for the Legrad-1 exploration block is shown in Tables 2 and 3 as well as Figure 4.

3.5 Conditions for conducting exploration activities

After obtaining a licence for exploration of geothermal waters from the Ministry, the selected most favourable bidder shall explore geothermal waters pursuant to the provisions and conditions stipulated in the licence for exploration of geothermal waters and shall adhere to all provisions of the Act and by-laws as well as all other regulations of the Republic of Croatia. The aim of the exploration activities in the Legrad-1 exploration block is to determine the existence, position and shape of geothermal water reservoirs in order to determine the quantity and quality of geothermal water reserves and exploitation conditions, in accordance with the provisions of the Act.

Special conditions and limitations which shall be adhered to during the performance of exploration works in the Legrad-1 exploration block are stated in Schedule I of these Bidding Round Documentation and issued by state administration authorities, units of local and regional self-government and legal persons with public authorisations.

3.6 Type and scope of exploration activities

The petroleum economic entity submitting the bid for Legrad-1 exploration block, as the bidder shall, as an integral parts of the bid, prepare a total exploration works program by type and scope, including a list of expenses, as well as a detailed plan of the works to be performed in each calendar year of exploration. The indicated amounts and types of exploration works represent the minimum requirements for the bid to be considered complete and for the bid to be taken into consideration.

3.7 Period and validity of the licence for exploration of geothermal waters

Pursuant to the provisions of Article 64 of the Act, the licence for exploration of geothermal waters is issued for the period required for the performance of exploration activities, but not exceeding five years, with the possibility of extending the validity of the licence for exploration of geothermal waters a maximum of two times, whereby each extension shall not exceed six months.

4. GROUNDS FOR BIDDER EXCLUSION AND CONDITIONS FOR THE LEGAL AND BUSINESS, FINANCIAL, TECHNICAL AND PROFESSIONAL CAPACITIES OF THE BIDDER

4.1 Grounds for exclusion of bidders

The Ministry shall exclude the bidder from the bidding round procedure at any moment should it determine there are impediments to exercising the rights pursuant to the provisions of Article 17 of the Act. 1. The bidder shall provide evidence that there are no impediments to exercising the rights referred to in Article 17(1)(1) of the Act, i.e. that the bidder or the person who is a member of the management or supervisory body or who is authorised for representation, decision- making or supervision of the subject bidder has not been convicted for any of the criminal acts referred to in Article 17(1)(1) of the Act.

The aforementioned is evidenced as follows: - by a verified statement of the person legally authorised to represent the bidder, which shall not be older than three months.

2. The bidder shall provide evidence that there are no impediments to exercising the rights referred to in Article 17(1)(2) of the Act, i.e. that the bidder is not violating the payment obligations referred to in Article 17(1)(2) of the Act.

The aforementioned is evidenced as follows: - by a certificate issued by the Tax Administration evidencing that the bidder has no outstanding debt on the basis of public levies in the Republic of Croatia - by a response of the petroleum inspection of the ministry competent for energy that the bidder has not been found to perform illegal exploration and/or production of mineral resources - by a certificate of the ministry competent for energy and the ministry competent for finance evidencing that the bidder has no outstanding debt on the basis of the fee for the exploration and/or production of mineral resources in the Republic of Croatia - by a certificate of the authority competent for managing of state assets that the bidder has no outstanding debt on the basis of forest and/or forest land use, i.e. agricultural land use for the purpose of producing mineral resources in the Republic of Croatia - by a certificate of the ministry competent for environment and nature protection or corresponding inspection evidencing that the bidder has no outstanding obligations concerning decommissioning and the protection of the environment and nature in the Republic of Croatia.

In case the competent ministries or state inspection authorities are unable to issue one of the above mentioned certificates, the bidder shall provide evidence that the bidder has requested the respective certificate and that the competent ministries or state inspection authorities are unable to issue the requested certificate.

3. The bidder shall provide evidence that there are no impediments to exercising the rights referred to in Article 17(1)(4) of the Act, i.e. that the bidder is not in the process of liquidation, bankruptcy proceedings or that it has not suspended its business activities in the Republic of Croatia.

The aforementioned is evidenced as follows: - by an excerpt from the court or crafts register.

In the case of a joint bid, all consortium members shall separately evidence their capacities referred to in this item of the Bidding Round Documentation.

The bidder with an establishment outside the Republic of Croatia shall be registered for exploration and/or production of geothermal waters with the competent authority of the country of establishment and shall meet the conditions referred to in Article 17 of the Act, and shall provide corresponding certificates issued by the competent authorities in the country of seat of the bidder or the corresponding certified statements if such certificates are not issued as evidence.

The excerpts and certificates evidencing the fulfilment of the conditions referred to in this item of the Bidding Round Documentation shall not be older than six months from the date of bid submission, except for the statement referred to in Section 4.2.1(b) of the Bidding Round Documentation.

4.2 Conditions for the legal and business, financial, technical, and professional capacity of the bidder

4.2.1 Conditions of the legal and business capacity The bidder shall evidence that the bidder as a physical person or legal entity is registered for exploration and production of geothermal waters. The aforementioned is evidenced as follows: - excerpt from the court register evidencing the bidder is registered for performing exploration and production of geothermal waters.

4.2.2 Conditions for the bidder's financial capacity The bidder shall evidence financial capacity and enclose the financial plan for performing the planned petroleum exploration and production works according to the submitted program of the explorations works per type and scope with the list of expenses. The aforementioned is evidenced as follows: - evidence of credit standing of the bidder on the BON-1 form issued by the Financial Agency - evidence of solvency on the BON-2 form or a corresponding form issued by a commercial bank performing the payment transactions of the bidder - evidence of using the energy facility, which is evidenced with letters of support or other evidence on the established collaboration. In case the Financial Agency is unable to issue the BON-1 form, it is mandatory to enclose a certificate issued by the Financial Agency stating that the Financial Agency is unable to issue the BON-1 form. In the event the bidder has an establishment outside the Republic of Croatia, the bidder shall submit revised financial reports instead of BON-1 form.

4.2.3 Conditions of bidder's technical and professional capacity

The bidder shall evidence its technical and professional capacity for the implementation of the planned program of total exploration works by type.

The aforementioned is evidenced as follows: - professionally-based program of total exploration works by type and scope, including a list of expenses, and a detailed plan of the works to be performed in each calendar year of exploration, prepared in accordance with the provisions of the Act, the special conditions and limitations set out in Schedule I of the Bidding Round Documentation and the bidder selection criteria referred to in Section 5.5 of the Bidding Round Documentation - a short description of all projects related to the exploration and production of geothermal waters in the past five years - recovered quantities of geothermal waters on an annual basis - number of employees with employment agreements of indefinite duration working on the exploration of geothermal waters (registration and deregistration form for the employees, employment agreement, electronic employment record book) and number of other employees involved in exploration of geothermal waters with short CV - internal work safety and environmental protection procedure.

5. BID INFORMATION

5.1 Content and form of the bid

5.1.1 Content of the bid Pursuant to the Article 60 of the Act the bid needs to contain the following:

1. GENERAL PART: • name or corporate name of the bidder • bidder's PIN or VAT number • bidder's address • bidder's phone number • bidder's e-mail address • an excerpt from the register kept by the competent authority indicating that the bidder is registered for the exploration and production of geothermal waters

2. LIST OF REQUREMENTS AND EVIDENCE FOR THEIR FULFILLMENT • an indication of the personal, professional, technical and financial conditions which the bidder, according to the Bidding Round Documentation and the Bidding Round Notice,

shall fulfil and the documents evidencing their fulfilment in accordance with Section 5.2 of the Bidding Round Documentation.

3. EVIDENCE OF ABSENCE OF IMPEDIMENTS • evidence that there are no impediments referred to in Article 17 of the Act, in accordance with Section 4.1.

4. PLAN AND PROGRAM OF THE EXPLORATION ACTIVITIES • a program of total exploration works by type and scope, including the list of expenses, drafted in accordance with the Bidding Round Documentation • a detailed plan of operations that shall be performed in each calendar year of exploration • the deadline by which the exploration is to be conducted • the total amount of funds required to perform the planned exploration works and the manner of providing such funds • the deadline by which the geothermal water production is intended to start within the exploration block • a plan for the decommissioning of the exploration block with the decommissioning costs

The bid shall include all information, documentation and documents indicated in the content of the bid; otherwise it shall not be taken into consideration. If the information, documentation and documents that shall be indicated or submitted as evidence are requested in several items of the content, the requested information shall be indicated once in the bid, i.e. one copy of the requested documentation or document shall be submitted. In that event, the location of the requested information, documentation or document in the bid shall be indicated when preparing the remaining items from the content.

The information and evidence submitted as part of the bid shall be prepared in such a manner so as to enable clear and unambiguous scoring.

5.2 Form of the bid

. The bid shall be prepared in paper form, printed or written with permanent ink. . The bidder shall, in addition to the bid in paper form, submit a bid on a data storage medium (e.g. USB). . The bid shall be saved as a document in pdf or another generally available format. . The data storage medium shall be submitted in closed plastic film bound with the tender. Cover of the plastic film needs to be marked with the number in the same way as other pages of the bid. Alternatively, the data storage medium may be submitted as a separate part of the bid, labelled and indicated as a part of the bid in the bid content. . The bid submitted on the data storage medium shall be considered a copy of the tender. . In the event of discrepancies between the original and copy of the bid, the original of the bid shall be considered authentic. . The bid shall be prepared in such a manner so that it forms a whole. If the bid may not be prepared in such a manner so that it forms a whole due to the scope or other objective circumstances, the bid shall be prepared in two or more parts. . The bid shall be band together in a way to prevent further removal or insertion of pages (for example with guarantor or seal at the cover back). In case the bid is composed of two or more parts, each part shall be band together in a way to prevent further removal or insertion of pages. Parts of the bid such as samples, catalogs, storage medium or similar, which cannot be band, shall be marked with title and listed in a bid content. If the bid is composed of multiple parts, in a bid content is shall be written of how many parts the bid is composed. . Pages of the bid shall be numbered in a way that makes visible the ordinal number of the page and the total number of pages of the bid, for example 1/57 or 57/1. If the bid is composed of multiple parts, pages must be marked in the manner that each subsequent part starts with the ordinal number that follows the number where the previous part stopped. If a part of the bid has already been previously numbered (for example, in the case of catalogues), the bidder is not obliged to number this part of the bid again. . The bid and all requested schedules shall be drafted in Croatian language and Latin script. In case some of the documents and/or proves which shall be delivered in accordance with this Biding Round Documentation are drafted in foreign language, the bidder is obliged to deliver verified translation of those documents/proves into Croatian language, translated by authorized court interpreter. . The bids shall be drafted by using indelible ink. All amendments to the bid must be visible and contain date of the amendment and must be verified with bidders’ signature. All documents that shall be delivered in accordance with the Biding Round Documentation shall be delivered as originals or as certified copies.

5.3 Bid submission manner and the end date for submission

The bid prepared in the manner described in Section 5.1 of the Bidding Round Documentation shall be submitted in written form in a closed envelope to the address:

In case the bid is not submitted as previously described, the bid shall not be open and shall be marked as invalid and returned to the bidder. Prior to the end date for submitting the bids, the bidder may amend, alter or withdraw the bid. After the end date for submitting the bids, the bid cannot be amended but only additionally explained as requested.

The end date for submitting the bids is 1st September 2020, by 12:00 hours. All bids submitted after the end date shall not be open and shall be marked as invalid and returned to the bidder.

5.4 Calculation of the royalty

Royalty shall be calculated in accordance with Article 51 of the Act and Article 10, paragraph 2 of the Regulation on compensation for the exploration and production of hydrocarbons (Official Gazette, No. 25/20).

Minimal amount of the variable part of the royalty amounts to 3% of the market value of the obtained quantities of geothermal waters.

The bidders are obliged to present their bids in the amount equal or higher of the amount stated in this point.

5.5 Criteria for the selection of the most favourable bid

Criteria for the selection of the bid is economically most favourable bid. Pursuant to the provisions of Article 61 of the Act, the criteria according to which the decisions on the selection of the most favourable bidder shall be made, i.e. scoring shall be performed as follows:

a) technical, professional and financial capacity of the bidder or consortium; b) the manner in which the bidder or consortium intends to conduct activities that are the subject of the licence for exploration of geothermal waters; c) the overall quality of the submitted bid; d) the financial conditions offered by the bidder for the purpose of being granted the licence for exploration of geothermal waters; e) any lack of efficiency and responsibility that the bidder demonstrated in other countries, while previously performing the activities that are the subject of the licence. A detailed description and scoring of the criteria and sub-criteria are indicated in Table 4.

The scoring shall be performed according to the content of the planned program included in the bid as well as the technical, financial and professional capacity of the bidder. . Duration of the exploration period is considered to be the period within which the final report on exploration and decommissioning of the exploration block in case geothermal water reservoirs have not been discovered shall be submitted, i.e. the period within which the study on geothermal water reservoirs shall be drafted and submitted for review and a decision on the determined quality and quantity of geothermal water reservoirs shall be obtained. . The scoring of the bidder's references related to compliance with environmental protection and working safety rules shall be conducted by the Committee on the basis of information and documentation provided by the bidder as evidence of complying with the subject regulations. . The Committee shall determine the sustainability of the plan for financing the exploration and production of geothermal waters on the basis of delivered information and documentation, which describe (such as own sources, loans, funds and similar) and evidence the financing sources (such as a certification on the financial sources of the bidder, letters of intent issued by the local community, banks or other investors and similar) Criteria related to any lack of efficiency or responsibility which the bidder has demonstrated in other countries, while performing activities which are subject of the licence, is fulfilled by submitting verified statement which confirms efficient and responsible performance of the activities which are subject of the licence in other countries, signed by the authorized representative of the bidder not older than three months.

The fulfilment of the criteria shall be determined according to the information stated in the bid and the submitted documentation.

Based on the criteria set out in Table 4, the Committee shall evaluate and rank the bids in the correct form. A ranking of the bids shall be prepared for the subject matter of the bidding round procedure, i.e. for the exploration block for which the most favourable bidder for geothermal water exploration is selected.

If two or more bids in the correct form are ranked equally according to the criteria for the selection of the most favourable bid, other relevant and objective non-discriminatory criteria shall be taken into account in order to reach a final decision.

5.6 Bid validity period

The bid validity period shall be at least 90 (ninety) days from the end date for submitting bids. The Ministry may require an extension of the bid validity period and accordingly the bid guarantee referred to in Section 7.1 of the Bidding Round Documentation.

6. OTHER INFORMATION REGARDING BIDDING ROUND

6.1 Bid fee

Each petroleum economic entity interested in submitting a bid shall pay a bid fee in the amount of HRK 10,000.00 (in words: ten thousand kuna) for the exploration block for which it is submitting a bid. The bid fee shall be paid to the State budget, IBAN: HR1210010051863000160, model: HR64 and reference number: 9733-49649-PIN of the payer and payment description: “Pristojba za nadmetanje Legrad-1“. All bidders that pay the bid fee shall acquire the right to use the data indicated in Section 3.4 of these Biding Round Documentation concerning the Legrad-1 exploration block for the purpose of participating in the bidding round procedure, i.e. for the purpose of submitting a bid.

6.2 Requests regarding clarification and amendments related to Bidding Round Documentation

No later than eight days prior to the end date for submitting bids, bidders may submit requests for clarification of the Bidding Round Documentation to the address:

Croatian Hydrocarbon Agency shall make available the requested clarifications of the Bidding Round Documentation to all bidder at latest six days prior to the end date for submitting bids.

7. BID GUARANTEE

7.1 Type and instrument of bid guarantee

The bidders are obliged to deliver a bid guarantee together with their bids in the amount of 750.000,00 HRK (in words: seven hundred and fifty thousand kuna) in a form of the bank guarantee. The bank guarantee shall be issued by the first class bank that is acceptable to the

Ministry and holds an operating licence in any of the following countries: Republic of Croatia, any other EU member state, any country that has signed the Agreement on Government Procurement (GPA) or any country that has signed and ratified association or bilateral agreements with the European Union or the Republic of Croatia, and is entitled to do so in accordance with the legislation of these countries. The bid guarantee must be irrevocable and unconditional at first demand, and it must remain valid for ninety (90) days from the end date for submitting bids. For the purpose of this Bidding Round Documentation, the first-class bank refers to an eminent bank or credit institution with a high credit rating issued by an eminent credit agency. The bank guarantee shall be issued in favor of: Ministry of Environment and Energy, Radnička cesta 80, 10 000 Zagreb. The Ministry shall collect the bid guarantee in case the bidder withdraws from the bid during the term of validity of the bid or if the bidder presents false data or prove.

7.2 Proceedings regarding bid guarantee

The Ministry shall return the bid guarantee to the selected most favorable bidder and other bidders immediately upon completion of the proceedings for selection of the most favorable bidder, and copy of the bid guarantee shall be stored.

7.3 Guarantee for execution of work obligations in the exploration period

The bidder shall submit guarantee for execution of work obligations in the exploration period, within time period of 30 days upon issuing the licence for exploration of geothermal waters, in the amount of 10 % of the planned activities on the geothermal waters exploration block, in the form of a bank guarantee which shall be issued in accordance with conditions set out in Section 7.1 and which shall be valid until the end of exploration period.

7.4 Guarantee for decommissioning

The selected bidder shall submit in accordance with the Act and within time period prescribed under the licence for exploration of geothermal waters, guarantee for decommissioning costs in the exploration block in the form of a bank guarantee which shall be issued in accordance with conditions set out in Section 7.1. Amount of the bank guarantee shall be in accordance with the decommissioning plan and decommissioning cost set out in Section 5.1.1 (4).

8. PROCEEDINGS WITH PERSONAL DATA

All personal data of natural persons delivered in the bids shall be used exclusively and only for the purpose of evaluating the bids. Natural persons whose personal data are delivered in the bids shall fill in and sign form in Schedule II of this Bidding Round Documentation.

Napominje se da je predloženi istražni prostor geotermalnih voda u području primjene Prostornog plana Koprivničko-križevačke županije ("Službeni glasnik Koprivničko-križevačke županije" broj 8/01, 6/07., 13/12. i 5/14., dalje u tekstu: PPŽ), Prostornog plana uređenja Općine Legrad ("Službeni glasnik Koprivničko-križevačke županije" broj 11/07., 18/14. i 19/19... dalje u tekstu: PPUO Legrad) i Prostornog plana uređenja Općine Đelekovec ("Službeni {glasnik Koprivničko-križevačke županije" broj 4/07. i 12/12., dalje u tekstu: PPUO Đelekovec). || - ' Prema PPŽ-u predvi/đa se iskorištavanje postojećih i prenamjena starih naftno-plinskih bušotina u geotermalne (Križevčanka 1-Križevci, Križevačko Vratno, Lunjkovec - Kutnjak, Dravka 1, F1D, F8 - Ferdinandovac, Molve 32-Repaš, Leščan -Đurđevac), Gotalovo, Legrad, a mogući su razni oblici korištenja resursa (energetske, gospodarske, rekreacijske svrhe), ali tek nakonjizrade studija o tehničkoj i ekonomskoj opravdanosti navedenih zahvata, studije utjecaja na okoliš te detaljne razrade načina korištenja prostora, sukladno odredbi članka 3.3.2 tog Planet s tim da! je pozicioniranje pojedinih istražnih bušotina moguće uz poštivanje ograničenja određenih istim Planom. ii 'i PPUO Legrad Člankom 72. stavak 14. dozvoljava istraživanje ugljikovodika i geotermalnih voda dozvoljava na području cijele Općine Legrad, dok PPUO Đelekovec Člankom 70. stavak 3. planira eksploatacijsko polje geotermalne vode u traženim granicama, ali pod nazivom Legrad - belekovec. Imajući i|| vidu sve havedeno, kao i odredbu članka 124. stavka 2. Zakona o prostornom uređenju11 1 (Narodne novine br. 153/13., 65/17., 114/18., 39/19. i 98/19.) daje se tražena suglasnost za predloženi istražni prostor geotermalne vode "Legrad-1", s obzirom na prostorno plinsko određenje, uz uvažavanje navedenih i ostalih prostorno-planskih ograničenja i lokalne i regionalne razine. Međutim, napominje se da se predmetni istražni prostor južnim dijelom preklapa s eksploatacijskim poljima ugljikovodika „Legrad" i „Kutnjak - Đelekovec" več određenog ovlaštenika, a ju cijelosti se nalazi unutar istražnog prostora ugljikovodika DR-02 (iz kojeg nije izuzet), a za koji je Odlukom Vlade Republike Hrvatske dozvola za istraživanje i eksploataciju ugljikovodika izdana drugom ovlašteniku, te je u daljnjem postupku potrebno voditi računa o zaštiti interesa svih strana.

Ministarstvo zaštite okoliša i energetike temeljem članka 58. stavka 5. Zakona o istraživanju i eksploataciji poziva tijela državne uprave, jedinice lokalne i područne (regionalne) samouprave na čijem području se nalazi predloženi istražni prostor i pravnih osoba s javnim ovlastima da se očituju na granice predloženog istražnog prostora.

U skladu sa Zakonom o poljoprivrednom zemljištu („Narodne novine16, br. 20/18, 115/18 i 98/19. u daljnjem tekstu Zakon ), a radi omogućavanja proizvodnje hrane, zaštite zdravlja ljudi, životinjskog i biljnog svijeta, nesmetanog korištenja i zaštite prirode i okoliša provodi se zaštita poljoprivrednog zemljišta (tla) od oštećenja, u smislu zaštite od umanjenja i/ili gubitka proizvodne sposobnosti za poljoprivrednu proizvodnju.

Korištenje prostora izvan građevinskog područja namijenjeno je prioritetno, a dijelom isključivo u funkciji poljoprivredne proizvodnje, s težnjom očuvanja što većih i kontinuiranih proizvodnih površina, posebice površina pod višegodišnjim nasadima.

Temeljem članka 4. i 5. Zakona regulira se korištenje, odnosno zaštita poljoprivrednog zemljišta od oštećenja, dok se člankom 22. ograničava prenamjena bonitetno najvrijednijeg poljoprivrednog zemljišta, osobito vrijednog obradivog (Pl) i vrijednog obradivog (P2) poljoprivrednog zemljišta.

Predmetni zahvat mora biti usklađen sa Prostornim planom uređenja Grada/Općine. Ministarstvo zaštite okoliša i energetike, Uprava za zaštitu prirode zaprimila je sukladno članku 58. stavku 3. Zakona o istraživanju i eksploataciji ugljikovodika (Narodne novine, br. 52/18, 52/19) vaš zahtjev za izdavanje posebnih uvjeta, ograničenja i suglasnosti za istraživanje geotermalnih voda u istražnom prostoru ,,Legrad-l“ radi izdavanja dozvole za pridobivanje geotermalnih voda. Uvidom u dostavljenu dokumentaciju utvrđeno je da se unutar granice navedenog istražnog prostora nalaze područja zaštićena temeljem Zakona o zaštiti prirode (Narodne novine, br. 80/13, 15/18, 14/19, 127/19), posebni rezervat „Veliki Pažut“, regionalni park ,,Mura-Drava“ te područja ekološke mreže, područje očuvanja značajno za vrste i stanišne tipove (POVS) HR 5000014 Gornji tok Drave i područje očuvanja značajno za ptice (POP) HR 1000014 Gornji tok Drave prema Uredbi o ekološkoj mreži (Narodne novine, br. 80/19). Temeljem odredbi Zakona o zaštiti prirode u ovoj fazi Uprava za zaštitu prirode nema posebnih uvjeta dok je u daljnjim fazama provedbe zahvata potrebno provesti ocjenu prihvatljivosti za ekološku mrežu odnosno ishoditi potrebno dopuštenje u smislu odredbi Zakona o zaštiti prirode.

Uprava za procjenu utjecaja na okoliš i održivo gospodarenje otpadom Ministarstva zaprimila je od Uprave za energetiku Ministarstva zahtjeve za utvrđivanje posebnih uvjeta, ograničenja i suglasnosti u postupcima provođenja nadmetanja za odabir najpovoljnijeg ponuditelja za istraživanje geotermalnih voda u istražnim prostorima radi izdavanja dozvola za pridobivanje geotermalnih voda. Predmetni zahtjevi odnosili su se na sljedeće istražne prostore: Lunjkovec- Kutnjak, Legrad-1, Kotoriba, Ferdinandovac-1, Emestinovo, Pčelić, Merhatovec, Virovitica, Babina Greda 1 i Babina Greda 2.

U vezi zaprimljenih zahtjeva, obavještavamo vas da ova Uprava ne sudjeluje u postupcima izdavanja posebnih uvjeta, ograničenja i suglasnosti na granice predloženog istražnog prostora za potrebe provođenje nadmetanja za odabir najpovoljnijeg ponuditelja za istraživanje geotermalnih voda radi izdavanja dozvole za pridobivanje geotermalnih voda, kako ste nas zatražili na temelju članka 58. stavka 3. Zakona o istraživanju i eksploataciji ugljikovodika („Narodne novine", broj 52/18 i 52/19).

Nadalje, napominjemo da ova Uprava uobičajeno posebne uvjete zaštite okoliša propisuje u postupcima procjene utjecaja zahvata na okoliš i ocjene o potrebi procjene, sukladno odredbama Zakona o zaštiti okoliša („Narodne novine", broj 80/13, 153/13, 78/15, 12/18 i 118/18, dalje u tekstu: Zakon) i Uredbe o procjeni utjecaja zahvata na okoliš („Narodne novine", broj 61/14 i 3/17, dalje u tekstu: Uredba). U konkretpim slučajevima, sukladno točki 10.3. Eksploatacija mineralnih i geotermalnih voda iz kojih se može koristiti akumulirana toplina u energetske svrhe i točki 10.12. Istražne i druge duboke bušotine izuzev bušotina koje služe za ispitivanje stabilnosti tla/geotehničke istražne bušotine Priloga 11. Uredbe, provodi se postupak ocjene o potrebi procjene i to prije ishođenja lokacijske dozvole ili drugog akta za realizaciju zahvata sukladno posebnom propisu.

Osim gore navedenog, obavještavamo vas da se postupci procjene utjecaja zahvata na okoliš i ocjene o potrebi procjene utjecaja zahvata na okoliš provode sukladno Zakonu i Uredbi, te da kad se radi o zahvatima iz nadležnosti Uprave za energetiku, suglasnost na idejni projekt za sve naftno-rudarske projekte, koju se donosi temeljem članka 132. Zakona o istraživanju i eksploataciji ugljikovodika, nije uvjet za provedbu predmetnih postupaka.

Poštovani. prema Vašem zahtjevu za dostavu posebnih uvjeta, ograničenja i suglasnosti za provođenje nadmetanja za odabir najpovoljnijeg ponuditelja za istraživanje geotermalnih voda u istražnom prostoru „Legrad-l”, KLASA:310-01/20-03/01. URBROJ:517-06-3-1-20-4 zaprimljenom 20. siječnja 2020. radi izdavanja dozvole za pridobivanje geotermalnih voda, dostavljamo slijedeće očitovanje.

Istražni prostor „Legrad-l" smješten je u krajnjem sjevernom dijelu Koprivničko- križevačke županije s ukupnom površinom od 20,89 km2. U obuhvatu su naselja Legrad i dijelovi Malog i Velikog Otoka te manje područje gornjeg toka rijeke Drave i Mure.

Za svaki zahvat izvođenja istražne bušotine potrebno je provesti OPUO postupak prema točki 10f12. Priloga II. Uredbe o procjeni utjecaja zahvata na okoliš (..Narodne novine” br. 61/14 i 3/17).

Posebna ograničenja prilikom utvrđivanja pojedinačnih rezervi geotermalnih voda vezana su uz preklapanje istražnog polja s POVS i/ili POP područjem ekološke mreže gdje je za iste istražne bušotine potrebno provesti Prethodnu ocjenu zahvata na ekološku mrežu sukladno Zakonu o zašiti prirode („Narodne novine" br. 80/13, 15/18, 14/19 i 127/19). Ukoliko se već provodi OPUO postupak. Prethodna ocjena se provodi objedinjeno. Prema istom Zakonu o zaštiti prirode, ukoliko se zahvat izvođenja istražne bušotine nalazi unutar zaštićenog područja prirode, potrebno i ishođenje posebnih uvjeta zaštite prirode od nadležnog županijskog tijela za zaštitu okoliša i prirode, odnosno Ministarstva zaštite okoliša ako se radi o j posebnom rezervatu. U privitku dostavljamo kartograme odnosa istražnog prostora „Legrad-]'" u odnosu na područje ekološke mreže i zaštićenog područja prirode te je vidljivo da je istražni prostor u obuhvatu POP područja očuvanja značajnog za ptice HR1000014 - Gornji tok Drave koje še dijelom preklapa sa POVS područjem očuvanja značajnim za vrste i stanišne tipove HR5000014 - Gornji tok Drave te u najsjevernijem dijelu ulazi u POVS područje HR2000364 Mura. Na kartogramu je vidljivo i na koji način se predmetni istražni prostor preklapa s višestruko zaštićenim područjem prirode u kategoriji Regionalnog parka Mura-Drava, ali i posebnog rezervata Veliki Pažut. Rijeka Drava zaštićena je i međunarodnim kategorijama zaštite kao Prekogranični rezervat biosfere Mura-Drava- Dunav. Ujedno je moguće da istražni prostor dodiruje i značajni krajobraz Mura te je potrebno obratiti pozornost na sve navedeno, kao i eventualne prekogranične utjecaje, prilikom provođenja OPUO postupaka koji bi trebali rezultirati odredenim mjerama zaštite prirode i okoliša nositelju zahvata.

Prilikom odabira potencijalnih istražnih lokacija potrebno je voditi računa o tome da se istražni prostor „Legrad-F nalazi i na području vodonosnika pitke vode te istraživanja unutar predviđenih granica ne smiju uzrokovati ekološke niti ekonomske štete na području planiranog istražnog prostora.

Pri odabiru potencijalnih lokacija izvođenja istražnih bušotina i određivanju granica polja, prije svega je potrebno, osim mjera zaštite okoliša i prirode uvrštenih u strateške planske dokumente više razine, provjeriti uvjete korištenja i zaštite prostora, namjenu površina i ostala ograničenja prostomo-planske dokumentacije županijskog Prostornog plana Koprivničko-križevačke županije (’httD://%vww.pro.sLorno-kkz.hr/prostorni-Dlanovi/nrostomi- plan-koprivnicko-krizevacke-zupaniie'). kao i prostornih planova niže razine, jedinica lokalne samouprave (prekogranični prijelazi, planirani mostovi, pristaništa, lovišta i dr.) na predloženom istražnom prostoru kako bi se isključila područja -rezervirana za infrastrukturne i druge namjene i uvjete korištenja.
