Publié par l’observatoire européen de l’audiovisuel il n’est pas rare que la commission européenne adresse aux etats membres des lettres de demande d’informations, afin de s’assurer qu’ils mettent en œuvre correctement tous les aspects des directives de l’ue dans le délai qui leur est imparti. Les lettres adressées en mars 2011 à la Belgique, à la Bulgarie, à la république tchèque, au danemark, à la Finlande, à la France, à la grèce, à l’irlande, à l’italie, à malte, aux Pays-Bas, à la roumanie, à l’espagne, à la suède, à la slovaquie et au royaume-uni, puis début septembre à l’autriche, à chypre, à l’estonie, à l’allemagne, à la hongrie, à la Lettonie, à la Lituanie et au Luxembourg, s’interrogeaient sur la compatibilité des lois de ces différents pays avec les dispositions de la directive services de médias audiovisuels. elles s’inscrivent ainsi dans les procédures prévues pour clarifier les mesures de transposition adoptées et ne doivent en aucun cas être confondues avec les procédures d’infraction engagées par la commission à l’encontre de la slovénie et de la Pologne, au motif que ces deux etats n’ont pas transposé l’ensemble ou certaines parties de la directive. Pour un observateur neutre, néanmoins, l’éventail des questions et le niveau de détail des informations demandées par la commission européenne indiquent que la transposition de la directive smav dans le droit et les pratiques de chaque pays est une tâche aussi ardue que celle qui consiste à garantir le respect des dispositions et de l’esprit du texte. des difficultés particulières peuvent se présenter du fait que la réglementation des services de médias audiovisuels est à plusieurs égards une entreprise « duelle » qui s’adresse à des « faux- jumeaux ». Les etats membres sont relativement familiers de « l’aîné » des jumeaux, c’est-à-dire des services de médias audiovisuels linéaires, car ils ont eu plusieurs années pour apprendre à cerner ces services sous le régime de la directive télévision sans frontières. ils disposent en la matière de règles nationales qui n’appellent qu’un simple ajustement à certains aspects nouveaux du cadre réglementaire européen. Le « cadet » des jumeaux, les services de médias audiovisuels non linéaires, constitue en revanche un casse-tête, notamment parce que les etats membres ignorent encore comment il va évoluer concrètement. va-t-il se fortifier et connaître le succès, au point, peut-être, de surpasser rapidement son frère ? ou aura-t-il encore longtemps besoin d’être choyé ? sera-t-il docile et facile à orienter, ou égocentrique et turbulent ? ce volet non linéaire est également difficile à appréhender parce qu’il n’a pas encore été soumis à une régulation spécifique en termes de contenus, et qu’on ne sait pas précisément comment les systèmes nationaux pourront être étendus ou modifiés pour en tenir compte. ce qui est certain, c’est que la réglementation des services de médias audiovisuels devra englober © 2011, Observatoire européen de l’audiovisuel, Strasbourg (France) 4 La régLementation des services audiovisueLs à La demande : chaos ou cohérence ? ces deux « jumeaux » et former un tout : les services linéaires seront soumis à des règles plus strictes que les services non linéaires, mais les deux séries de réglementations, considérées dans leur globalité, devront garantir l’existence d’une situation de concurrence équitable, de la même façon que les deux pièces d’un ensemble doivent nécessairement être assorties.

This research examines a video sharing web site called LiveLeak to be able to analyze the possibilities of democratic and horizontal social mobilization via Internet technology. In this sense, we take into consideration the Gilles Deleuze and Félix Guattari’s philosophical conceptualization of “rhizome” which provides a new approach for activities of online communities. In the light of this concept and its anti-hierarchical approach we tried to discuss the potentials of network communication models such as LiveLeak in terms of emancipating use of media and democratic communication. By analyzing the contextual traffic on the LiveLeak for a randomly chosen one week (first week of December 2013) we argue that this video sharing web site shows a rhizomatic characteristic. Keywords: LiveLeak, Rhizome, Social Networking. 1 Introduction Rapid developments in communication technologies and its social reflections, which took place especially in the 20th century, have drawn the attention of social scientists. At one extreme, Frankfurt School and its followers advanced a pessimistic approach to new media targeting specifically manipulation and standardization of the message. On the other hand, an optimistic approach formulated by Marshall McLuhan attributes an emancipating and democratic meaning to new media. Apart from these orthodox Marxist criticism and technologically deterministic liberal aspects, writers such as Bertolt Brecht [1] and Walter Benjamin [2] set forth different approaches that regard the energy and socially transforming effect of the new media, emphasizing the socialist and emancipating mission of massification in the age of mechanical reproduction.

The country’s information and communication technology (ICT) infrastructure is well developed, and prices for connections are low, ensuring that much of the population enjoys access to the internet. However, a number of website restrictions, such as those related to online piracy or “abhorrent” content, limit the content available to users. The March 2019 terrorist attack on mosques in Christchurch, New Zealand, prompted internet service providers (ISPs) to block certain websites and the government subsequently introduced a new law that criminalized the failure to delete “abhorrent” content. Other legal changes—including court decisions expanding the country’s punitive defamation standards, an injunction silencing digital media coverage of a high-profile trial, and a problematic law that undermines encryption—shrunk the space for free online expression in Australia. Finally, an escalating series of cyberattacks sponsored by China profoundly challenged the security of Australia’s digital sphere. Australia is a democracy with a strong record of advancing and protecting political rights and civil liberties. Recent challenges to these freedoms have included the threat of foreign political influence, harsh policies toward asylum seekers, and ongoing disparities faced by indigenous Australians.
