The Judges have completed the JUNE 2015 civil jury term. One civil case reached verdict during the June civil term and the summary is as follows:
Tracey Thompson v. Elwood Smith (2013 CV 037950 CV):
This case involved a motor vehicle and motor cycle accident that occurred in June of 2011 adjacent to a parking lot on Derry Street, Harrisburg. The Plaintiff was operating a motorcycle on Derry Street and the Defendant was operating a motor vehicle coming out of a parking lot. Plaintiff's injuries included multi- ple fractures of her hip, multiple fractures of her wrist and lacerated liver. She had internal fixation sur- gery on her hip and wrist. She also had surgery to put in a blood filter to reduce the possibility of an embolism.
The Defense admitted liability and the jury was only deciding the extent of the damages. The Plaintiff called by videotape, the treating orthopedic surgery, a treating pain management specialist, a vocational expert and a life care plan expert. The Defendant had the Plaintiff examined by their own doctor (defense medical exam a/k/a IME). The Defense expert (orthopedic surgeon) said that approximately a year after the accident when the fractures were healed that she had no residual problems. The Plaintiff's pain man- agement expert opined that she would have permanent pain. The vocational expert testified due to her chronic pain she would likely leave the workforce 5-6 years earlier than normal and produced a future lost income claim.
The jury returned a verdict in favor of Plaintiff as follows:
Past Medical Expenses: $ 74,147.58
Future Medical Expenses: $ 104,906.00
Future Loss of Income: $ 290,400.00
