Appendix 2-1 [The Patent Office Gazette (public notice) issued on June 23, 1995] Trademarks Indicating a Place of Origin of Wines or Spirits of WTO Member Countries as Stipulated in Article 4(1)(xvii) of the Trademark Act The following appellations of origin of wines or spirits that are registered internationally under Article 5(1) of the “Lisbon Agreement for the Protection of Appellations of Origin and their International Registration (1958)” shall be deemed to fall under a mark indicating a place of origin of wines or spirits in a member of the WTO prohibited to be used on wines or spirits not originating in the region of that member referred to in Article 4(1)(xvii) of the Trademark Act that entered into effect on July 1, 1995, except when the international registration has been cancelled or when there are other special reasons. Herein is the announcement to that effect. (Lists on public notice are omitted) (Explanation) In utilizing Appendix 2 1. Purport for preparing this material In the recent revision of the Trademark Act pursuant to the Act for Partial Revision of the Patent Act, etc. (Act No. 116 of 1994), Article 4(1)(xvii) was newly added in accordance with Annex IC “Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement)” of the “Marrakech Agreement Establishing the World Trade Organization (WTO),” which accords additional protection to geographical indications of wines and spirits. This material, which was prepared as examination material related to Article 4(1)(xvii) of the Trademark Act, provides a list of appellations of origin of wines and spirits of countries that are both members of the Lisbon Agreement as well as of the WTO, which was extracted from the appellations of origin that are internationally registered based on the “Lisbon Agreement for the Protection of Appellations of Origin and their International Registration.” Though Japan is not a signatory of the Lisbon Agreement, pursuant to that treaty, the appellations of origin of member countries must be internationally registered by WIPO after a request has been submitted by the responsible authority of the pertinent country. The appellations of the origin which have been internationally registered must be protected by all member countries. Under the Lisbon Agreement, appellations of origin are defined as “the geographical name of a country, region, or locality, which serves to designate a product originating therein, the quality and characteristics of which are due exclusively or essentially to the geographical environment, including natural and human factors (Article 2(1) of the Lisbon Agreement),” and the product must be protected in the country of origin to be protected by each country that is signatory to the Agreement. Therefore, appellations of origin under the Lisbon Agreement may include geographical indications that are defined as follows: “indications which identify goods as originating in the territory of a Member, or a region or locality in that territory, where a given quality, reputation or other characteristic of the goods is essentially attributable to their geographical origin (Article 22(1) of the TRIPS Agreement).” In addition, as a condition, the name must be accorded protection in the country of source. These conditions are considered to be in line with the stipulations of the TRIPS Agreement, which does not hold countries responsible for the protection of geographical indications that are not protected by the countries of origin that are members. Of the appellations of origin that are internationally registered based on the Lisbon Agreement, we have provided a list of appellations of origin for wines and spirits produced by countries that are members of the Lisbon Agreement as well as of the WTO. This list is to be used as examination material for examination concerning Article 4(1)(xvii) of the Trademark Act. However, this material contains only limited examples of place of origin of wines and spirits that are produced overseas and may potentially fall within the scope of Article 4(1)(xvii). Thus the stipulations of Article 4(1)(xvii) are not limited to this list of place of origin. Therefore, if a trademark is considered to comprise a “mark indicating a place of origin of wines or spirits in a member of the WTO prohibited to be used on wines or spirits not originating in the region of that member” based on an opposition or on other materials, Article 4(1)(xvii) of the Trademark Act will be applicable even if it was not listed in this material. 2. Items included in this material The information regarding the appellations of origin of goods that are internationally registered and included in this material was obtained by translating “No d’enregistrement (registration number),” “Appellation d’origine (appellation of origin),” “Produit (product),” and “Aire de production (origin)” which were published in “LES APPELLATIONS D'ORIGINE,” the gazette for the Lisbon Agreement. The registration number, appellation of origin, product and origin are listed in the order of the registration number. However, with regard to the international registration of the appellation of origin based on the Lisbon Agreement, there are cases where items including the appellation of the origin are amended after registration, or where the international registration itself is cancelled. This should be taken into consideration when referencing this material. Also, with regard to the appellation of origin, Article 4(1)(xvii) will be applied when the indication is considered to be a translation of the appellation of origin. This must also be given due consideration. The above items were tentatively translated by those responsible for preparing this material. Thus when Article 4(1)(xvii) of the Trademark Act is actually applied, please also refer to the original document. 3.
