Lentz-Smith ___________________________ Barry Gaspar An abstract of a dissertation submitted in partial fulfillment of the requirements for the degree of Doctor of Philosophy in the Department of History in the Graduate School of Duke University 2019 Copyright by Meggan Farish Cashwell 2019 Abstract “‘To Restore Peace and Tranquility to the Neighborhood’: Violence, Legal Culture and Community in New York City, 1799-1827” examines the various ways ordinary people, legal officials, lawmakers, and editors negotiated the boundaries between inclusion and exclusion, or what historians call “belonging.” It uses legal cases and crime publications to analyze contradictory visions of the public good within the context of key political and social changes in the city, state, and nation. The dissertation moves from the operations of violence on the ground to the ideological implications of violence in the era of gradual emancipation. New Yorkers—male and female, free and unfree, native and immigrant—could and did participate in legal proceedings. Complainants and witnesses relied on the processes of law rather than actual verdicts to establish order in their personal lives and in their communities. This dissertation contends that people made and remade community through the adjudication and interpretation of violent conflict. Violence was indicative of daily exchanges and disagreements, all of which were linked to how people envisioned themselves and the “other,” or what scholars refer to as “reputation.” Gendered and racialized identities developed from negotiations that transpired inside and outside legal forums. White women, free blacks, and enslaved and iv indentured persons continually redefined notions of femininity and blackness through the violence they employed. Concepts of reputation and race and gender formation intersected in legal forums and in broader discussions about how men and women should conduct themselves in the nineteenth century. At a moment when lawmakers debated the nature of citizenship, crime publications intentionally highlighted violent offenses to offer a particular vision of who citizens should be and to marginalize the working classes, immigrants, and African Americans. The institution of slavery and the violence inherent to it became a means for editors to portray African Americans as socially inferior and to guard the city’s moral reputation against abolitionists. On June 27, 1807, several thousand mourners assembled in Norfolk, Virginia, to witness Robert MacDonald’s internment. Two weeks later, some of Elma’s belongings were found. Authorities discovered the worst. her lifeless body was soon removed from a nearby well. Murder was the word on everyone’s mind and it quickly made news throughout the city. A suspect was chosen almost immediately. Levi Weeks. Levi Weeks. Levi was a 24-year-old carpenter who worked for his successful brother, Ezra, on some of the finest mansions in New York City. He was able to assemble an impressive team of three lawyers for his defense: Alexander Hamilton, Aaron Burr and Henry Brockholst Livingston. Keep in mind, this was just 4 years before Hamilton and Burr exchanged fire on the dueling ground. Though there was surely a bit of tension, things were yet to boil over and the men were civil. In fact, these were three of the finest lawyers in the city and they made an outstanding team. The Trial. The People v. Levi Weeks was spoken about constantly in the papers. It was the major point of gossip throughout New York City.

    February 25, 2013 Speaker Christine Quinn New York City Council 224 West 30th Street, #1206 New York, NY 10001 Chair Robert Tierney NYC Landmarks Preservation Commission 1 Centre Street, 9th floor New York, NY 10007 Re: Impending Demolition of 54 MacDougal Street in Proposed South Village Historic District Dear Speaker Quinn and Chair Tierney: I write to bring to your attention the impending demolition of yet another historic structure in the proposed South Village Historic District, a nearly two-hundred year old house and rear structure at 54 MacDougal Street. I urge you to take immediate action to prevent further destruction to this historic and imminently endangered neighborhood. Demolition permits have just been filed for this structure at King Street. According to GVSHP’s research, the house was built to two-and-a-half stories with the sloped roof and dormers characteristic of a federal house some time before 1827, and extended to a full three stories in 1874. Demolition permits have also been filed for a one-story rear structure behind it, likely a backhouse. While modestly altered over the years, this structure clearly maintains the basic elements of an early 19th century lower Manhattan house. Though it began as a residence, over the years the structure has housed model railroad supply companies, art galleries, and antique stores. Its historic look and feel even made it a perfect setting for “Rosenberg’s Jewelry Store” in the 1997 film “Men In Black.” Located at the head of King Street, 54 MacDougal is visually prominently and serves as one of many recognizable “gateways” to the South Village.
