2010/01/05 MINUTES OF THE LAST MEETING

The Minutes from the last meeting were approved on the motion of Mr D Manson and seconded by Mr B Moreland.

2010/01/06 PLANNING APPLICATIONS

The following Weekly Lists were made available to Members at the Meeting: 27th November, 4th, 10th and 22nd December 2009.

As Mr J Dickson and Mr D Thomson were in attendance to discuss their planning applications, the Chairman welcomed them both to the meeting and brought this agenda item forward.

2010/16/PCD Erect a 2.5kw micro wind turbine on a 6.5m mast, Hvidahus, by James T Dickson. Mr Dickson explained that the main purpose of the wind turbine is to provide heat to the house. The turbine positioned at the front of the property means it will get the wind from the east and west, there will be no flicker effect and it’s the least obtrusive to the neighbours. He went on to say that the noise level is minimal and it’s to be situated 4m from the house and 17m from the road.

Members don’t object to the application, but have slight concerns about the visual intrusion and safety aspect as the turbine is close to the road but will be guided by the planning process.

2010/2/PCO – To provide access road and main services installations (in detail-FFP) and 14 No House sites (in outline-PPP), Camp, Brae by Dennis Thomson Builders. Mr Thomson attended the meeting to discuss his planning application. Members don’t object to the housing development as the land is zoned for housing. They do have concerns about the noise and disruption during the construction phase and want to limit the rock-breaking to 5 ½ days per week. Keeping Saturday afternoon and the whole day on Sunday clear.

2010/4/PCD – Change of use from grazing land to community allotments, Fraser Peterson Centre, Firth, Mossbank, by Islands Council, Waste Services - No objections.

2010/01/06 PLANNING APPLICATIONS

2009/037/VF – To modify an existing marine salmon farm by changing site size, location and orientation, West of , by HAH Shetland Ltd – Letter received from NAFC Marine Centre informing us that this application was granted consent on 11 November 2009.

Works Licences

2009/049/VF – To modify an existing marine fish farm by amending cages to four 100m- circumference cages, Site 2, Collafirth Voe by Hjatland Seafarms Ltd (retrospective) – No objections, however, Members have concerns about getting retrospective applications. A lot of businesses like this know the planning process.

2009/046/VS – To modify an existing marine mussel farm by siting an additional two longlines and by extending the mooring containment area, Pinchdyke, Olnafirth by Olnafirth Sea Farms Ltd – as there was a deadline of 11/01/10, the Clerk e-mailed this to Members and there were no objections.

2009/043/VS – To modify an existing marine mussel farm by changing permitted equipment and mooring containment area, Fowlawick, Olnafirth by Blueshell Mussels Ltd – as there was a deadline of 11/01/10, the Clerk e-mailed this to Members and there were no objections.

2010/01/07 MATTERS ARISING FROM MINUTE

7.1 Access Road to Laxobiggin Cemetry – The Chairman is going to speak to Mr Bertie Johnson next week regarding the extension to the cemetery and the access road down to the cemetery.

7.2 Scottish Ambulance Service – The Chairman reported that a second ambulance will be coming to Shetland by the end of next month.

7.3 Local Development Plan: Pre Main Issues Report Consultation – the Clerk reported Members views to Ms Hannah Nelson of SIC Infrastructure Services Department.

7.4 Playpark Lights – Mossbank – The Clerk has spoken to Magnus Malcolmson of SIC and he explained that having lights in playparks are proven to cause more accidents. There is a cost and maintenance element and an unsociable element – not keen to encourage people to go to the playpark in the evenings.

7.5 Moorfield Estate, Brae High School – Fence in need of repair – the Clerk has spoken to Mr James Mackenzie of Shetland Amenity Trust and they have repaired the fence. They’re looking into the possibility of getting a dog litter bin. He’s spoken to Mr James Johnson of SIC regarding the lighting and there isn’t going to be anything done with this.

7.6 Barge moored off Pierhead restaurant, Voe – Mr W Anderson hasn’t been in contact with DCC regarding this yet.

7.7 SIC Corporate Plan: Action Plan for the Maintenance, Improvement and Use of the Road Network – the Clerk sent a letter to the SIC with Members comments following the last meeting.

7.8 Proposed Future Governance of Shetland Charitable Trust – The Clerk wrote to the Charitable Trust with Members Comments. The Chairman reported that around half of the Community Councils and some members of the public responded to this. The overwhelming view is that the SIC shouldn’t be a dominant factor of the Charitable Trust, but this has not been debated yet.

7.9 Salmon Farm Cages Piping at Burravoe, Brae – Mr A Hall has spoken to Environmental Health and they can’t do anything unless there is a pollution concern. He’s also spoken to SEPA, they don’t think they can do anything, but they’re going to check the pipes. The Chairman gave him a contact number for Mr Colin Dickie who works at Community Development Company to follow this up.

7.10 Wethersta Industrial Estate – following our request for the Enforcement Officer to come out to Wethersta to have a look at the industrial estate and a request also for the planning conditions attached to each site, Mr Norman Sineath from SIC Infrastructure Services has informed us the following-

 Site 1 is owned and operated by the SIC.  Site 2 is being leased by Blueshell Marine Ltd and is being used to store fishing related equipment, SIC can’t find a record of planning permission for this.  Site 2b is being leased to Neil Pearson, planning permission exists and is due to expire at the end of this month, he has met the SIC and is intending to re-apply for planning permission.  Sites 3 and 4 are operated by Dennis Thomson.  Site 5a is leased to John Hallam and is being used to store portacabins and other materials – there is no record of any planning permission for this.  Site 5b is owned by Fraser Leask and is being used to store portacabins and other materials – there is no record of any planning permission for this.  Site 6a is owned by Clive Mouat.  Site 6b is leased to Kenny Scott and there is no planning permission for items presently stored on this site.  Site 6c has recently been granted planning permission to Olnafirth Seafarm, althought there is nothing presently on this site.

The Clerk made this list available to all Members. It was suggested to get a Member from the Brae area to help find out who is missing from this list and get it updated. The Chairman agreed to speak to Mr Norman Sineath and report back to Members.

2010/01/08 POLICE REPORT

Constable Mark Bryant was unable to attend the meeting and sent through a list of the police incidents in the and Northmavine area for December 2009 and January 2010.

Police incidents for 01/12/2009 to 31/12/2009 – 44 incidents within this area this month. 5 road traffic crashes. 1 road traffic offence, not speeding. 0 speed checks were logged as being carried out this month, although checks were carried out with no offences. 26 miscellaneous incidents relating to advice, court papers, etc. 2 vandalisms. 1 Detected. 1 ongoing enquiry. 1 complaint of noisy neighbours. 1 child protection enquiry. 3 reports of drink drivers. 2 detected. 1 breach of the peace. Enquiries ongoing. 2 house breakings. Enquiries ongoing. 1 incident of found drugs.

2010/01/08 POLICE REPORT

Police incidents for 01/01/2010 to 27/01/2010 – 54 incidents within this area this month. 5 road traffic crashes. 10 road traffic offences, not speeding. 7 speed checks were logged as being carried out this month, with 9 drivers warned and 2 drivers reported for speeding. 16 miscellaneous incidents relating to advice, court papers, etc. 2 incidents relating to drugs dog scanning at Voe and Scatsa. 1 vandalism. Ongoing enquiries. 1 incident of theft of a motor vehicle, detected. 8 complaints of disturbances and noisy neighbours. 1 complaint of an abandon vehicle. 1 child protection enquiry. 1 report of drink driving. Not detected. 1 theft from a motor vehicle, enquiries ongoing.

2010/01/09 COMMUNITY LEARNING AND DEVELOPMENT

Ms Maureen Stewart was unable to attend the meeting as she has three Blueprint for Education meetings that she may have to attend. The Community Work team have been asked to attend these meetings as facilitators and sometimes have to attend both staff and parent meetings and her area has 9 schools.

The Shetland Halls Association website has now gone live and the web address is www.shetland- communities.org.uk/SHA/. All the community offices are working with the halls in their areas to try to get more information to add to the website. They would welcome comments and suggestions from members on the content. They hope to get more halls on board to using the What's On diary which will be really useful for informing the public about hall events and to help halls in planning ahead. Mrs Lara Jamieson the Clerical Assistant in the North Mainland Community Office is co-ordinating the work on the website and they hosted the Shell STEP student who did the work during the summer to set up the basic website structure. There are 14 halls in Ms Stewart’s Community Work Area and she says they do wonderful work in promoting community spirit.

2010/01/10 CORRESPONDENCE

10.1 Laggan-Tormore Project – Addendum to Environmental Statement – This was forwarded onto Members in December. The SIC requested any comments by 20th January 2010, Members were all notified and no comments were received. This was reported back to the SIC. The Chairman told Members that he has spoken to Ms Janet Barclay of the SIC regarding this and they are in contact with SOTEAG.

10.2 Association of Scottish Community Councils – An e-mail has been received from Mr Terry Tweed, a Community Councillor with Craigmillar Community Council in Edinburgh asking what our experience has been when dealing with the Association of Scottish Community Councils? The Clerk is to e-mail him back to inform him we’ve had no experience dealing with them. Clerk to progress.

10.3 ASCC Special Meeting – Windfarm Community Benefit Fund – This was held on Friday 15th January 2010 – the Clerk e-mailed this information to Members in December. No DCC Members are going to attend these meetings in the meantime, however, they feel it’s important that at the appropriate time there is a discussion with the developer regarding the Community Benefit Fund, how it’s to be distributed and to what extent it’s distributed out.

10.4 Skips – the Yell Community Council – An e-mail was received from them wondering if any Community Councils have spare skips they could allocate to Yell until the end of the financial year? The Clerk is to write back to them to say we have no spare skips at present. Clerk to progress.

10.5 Community Council Insurance – ASCC – Certificate of Employers’ Liability Insurance has been received. The ASCC recently received the renewal documents for the Community Councils’ policy. They paid the premium of £1,455.30, which has been calculated as £80.85 for each Community Council – this will be deducted from the next annual funding. This was agreed.

10.6 NHS Shetland – A letter has been received from Mr Ian Kinniburgh, the new Chairman of the Shetland NHS Board and he’s asking if we’d like him to attend one of our meetings. The Clerk is to invite him to the June meeting. Clerk to progress.

10.7 The Public Catalogue Foundation – Oil Paintings in Public Ownership – An e-mail was received explaining that they are a registered charity which is creating the first comprehensive inventory of publicly owned oil paintings in Britain. They are wanting to know if we have any oil paintings. The Clerk is to e-mail them back to let them know that we have none. Clerk to progress.

10.8 Job Outline for Community Council Clerk – ASCC – A draft job description has been sent for Community Councils to check and make amendments as necessary. Clerk to check this and get back in touch with the ASCC with any changes. Clerk to progress.

10.9 Voe Hall – Renewable Energy Project – Mr Peter Johnson from the Voe Hall has been in touch as they’re in the process of applying to the Community Energy Scheme for a grant towards the cost of a wind turbine and energy efficiency improvements to the building. They are asking if we could help by writing a letter of support for their project and would also like to apply for financial assistance from DCC. They are holding an Open Day on Saturday 6th March 2010 to enable interested members of the community to come along and discuss the proposals.

Members had concerns about where the letter of support was to go to as they want to see the planning application first. Mrs B Cheyne agreed to speak to Mr P Johnson to clarify where this letter would be sent to. Clerk to send the grant application form to the hall. Clerk to progress.

10.10 Shetland Visitor 2010 – The Shetland Times – A letter was received asking for Members to check that the information regarding Delting is up-to-date for their new edition of the Shetland Visitor magazine. Members made alterations. Clerk to get back to the Shetland Times with these changes. Clerk to progress.

13.1 The SIC Schools Service – Following the Services Committee approval for the Schools Service to move into the Informal Consultation stage of the Blueprint for Education, one of their Senior Officers will be attending the March meeting.
