    DEFENSE BUSINESS BOARD Submitted to the Secretary of Defense The Chief Management Officer of the Department of Defense: An Assessment DBB FY 20-01 An assessment of the effectiveness, responsibilities, and authorities of the Chief Management Officer of the Department of Defense as required by §904 of the FY20 NDAA June 1, 2020 DBB FY20-01 CMO Assessment 1 Executive Summary Tasking and Task Force: The Fiscal Year (FY) 2020 National Defense Authorization Act (NDAA) (Public Law (Pub. L. 116-92) required the Secretary of Defense (SD) to conduct an independent assessment of the Chief Management Officer (CMO) with six specific areas to be evaluated. The Defense Business Board (DBB) was selected on February 3, 2020 to conduct the independent assessment, with Arnold Punaro and Atul Vashistha assigned to co-chair the effort. Two additional DBB board members comprised the task force: David Walker and David Van Slyke. These individuals more than meet the independence and competencies required by the NDAA. Approach: The DBB task force focused on the CMO office and the Department of Defense (DoD) business transformation activities since 2008 when the office was first established by the Congress as the Deputy Chief Management Officer (DCMO), and in 2018 when the Congress increased its statutory authority and elevated it to Executive Level (EX) II and the third ranking official in DoD. The taskforce reviewed all previous studies of DoD management and organizations going back twenty years and completed over ninety interviews, including current and former DoD, public and private sector leaders. The assessments of CMO effectiveness since 2008 are focused on the performance of the CMO as an organizational entity, and is not an appraisal of any administration or appointee.

This legislation would repeal the excise tax on investment income of private colleges and universities. Under current law, certain private colleges and universities are subject to a 1.4 percent excise tax on net investment income. This provision applies to private colleges and universities that have endowment assets of $500,000 per Full Time Equivalent (FTE) student. State colleges and universities are not subject to this provision even though many enjoy very strong endowments. H.R. 4438 would correct the ill-conceived decision to tax higher education that was made in 2017. Endowments are used prudently to support the higher education mission of an institution, and a tax on them invariably lessens what can be spent on students and on providing access to a high-quality education.

    2020 Election Recap Below NACCHO summarizes election results and changes expected for 2021. Democrats will continue to lead the House of Representatives…but with a smaller majority. This means that many of the key committees for public health will continue to be chaired by the same members, with notable exceptions of the Appropriations Committee, where Chair Nita Lowey (D-NY) did not run for reelection; the Agriculture Committee, which has some jurisdiction around food safety and nutrition, whose Chair, Colin Peterson (D-MN) lost, as well as the Ranking Member for the Energy and Commerce Committee, Rep. Greg Walden, (R-OR) who did not run for reelection. After the 117th Congress convenes in January, internal leadership elections will determine who heads these and other committees. The following new Representatives and Senators are confirmed as of January 7. House of Representatives Note: All House of Representative seats were up for re-election. We list only those where a new member will be coming to Congress below. AL-1: Republican Jerry Carl beat Democrat James Averhart (open seat) Carl has served a member of the Mobile County Commission since 2012. Speaking of years, what a difference one year makes. Last Fall, continued low commodity prices and the election projections promised a rough year ahead. While the price of oil hasn’t changed much, the attitude both in Washington, DC and in our ranks certainly has. In April, after years of low commodity prices and an unprecedented regulatory deluge, the offshore industry desperately needed to see some hope for the future. A few short months later, the Trump administration has shown that has truly embraced an “all-of-the-above” energy strategy. Recogniz- ing that the offshore industry provides jobs, growth and revenue and strengthens our national security, the administration contin- ues to implement the right policies that will open our resources to safe and sustainable development. The Department of Interior has begun work on a new Five Year Program, one that will fully consider our offshore resources, including those in the Atlantic and Arctic. As other coun- tries continue to develop their own offshore resources, it is imperative that the U.S. open up the more than 94% of the OCS that is off limits for oil and gas development. Relatedly, Inte- rior is reviewing the permits for safe and modern seismic surveys that were previously denied during the final days of the Obama administration. Updated seismic data, particularly in the Atlantic where data is more than 30 years old, will allow stakeholders to have a fully informed debate.
