NAIC ANNUITIES MODEL – LB 22

 Following a multiyear drafting effort, the NAIC adopted revisions to its model regulation governing annuity transactions early this year.  The NAIC Suitability in Annuity Transactions Model Regulation was first adopted in 2003, and was enacted as statute in Nebraska.  It was initially designed to ensure that agents made suitable recommendations to those purchasing annuities and that those recommendations were based on relevant information obtained from the customers. It originally applied only to senior transactions and was later expanded to any annuity recommendation.  The new model:  (1) imposes a variety of direct obligations on agents,  (2) created supervisory obligations for carriers, and  (3) established training requirements for agents.
