The roots of the Wild Magnolias go back to, at least, the 1950s as one of New Orleans most popular and colorful Indian “Krewes”. The Krewes fall under the guidance of a Chief, and Bo Dollis has been the Chief of the Wild Magnolias since the mid-60s. With a voice reminis- cent of Sam Cooke and the flamboyance you’d expect at any given Mardi Gras, Bo and the Wild Magnolias rose to great heights in the 70s in a reign that continues to this day. The Wild Magnolias run as a recording act started in 1970 with the “Handa Wanda” 45 for the Crescent City imprint. In addition to a traditional Mardi Gras percussion lineup featuring everything from drums to beer bottles, Bo and the Wild Magnolias pulled in some prominent local talent as backup including Willie Tee and Snooks Eaglin. The cut became a Mardi Gras staple and lead to the French imprint Barclays (with distribution via Polygram) to sign the Krewe for this, the finest recording in the Wild Magnolias long and storied career. The album took Bo Dollis and the Wild Magnolias from a New Orleans phenomena to a global force with the lead single “Smoke My Peace Pipe (Smoke it Right)” appear- ing on the Billboard charts. The Magnolias have even had a lasting effect on the world of hip hop with “Corey Died On The Battlefield” and “(Somebody Got) Soul, Soul, Soul” being sampled by artists such as Schoolly D, 3rd Bass, Geto Boys and the Jungle Brothers. With this reissue culled from the original master Get On Down turns every Tuesday into Fat Tuesday. Both bands had the same musicians; both existed at nearly the same moment in time (c. 1970). But Eden Rose is now seen, quite rightly, as something unique, a chimera from the misty past, a time during which the winds of change were blowing on the fixed universe of music. Rules were blown away, stagnant structures were swept aside, and musical conventions emancipated, this freshness and spontaneity the essence of a style that hadn’t yet been formalized. As for Eden Rose, they took off once they teamed up with guitarist extraordinaire Jean-Pierre Alarcen, who had worked with Jacques Dutronc and played in Le Systeme Crapoutchik. The result was this batch of psych-inspired, decidedly grooving, upbeat instrumental tracks, with wailing (at times) fuzzed-out guitar and distinguished Hammond organ aplenty, over driving beats. A unique sound, brilliant, bright, and singing from the first note to the last. And man, if my ears don’t deceive me, the main theme from ‘Walking In the Sea’ (before it spins off into Jimi Hendrix territory) sure sounds like a lovely jazzy riff on Serge Gainsbourg’s ‘Je t'aime... moi non plus,’ which had been released the year before this album hit the racks. Two bonus tracks are from the band’s only single that contained non-LP tracks. Booklet has the band’s story in English and French, and is printed on FSC recycled, chlorine-free, 100% post-consumer fiber paper manufactured using biogas energy. Within our capitalistic society, much if not all the music we consume is to be regarded as commodities. Musical products are subject to numerous processes, rules and regulations, one of which being copyright. Essentially, copyright enables the musical product as commodity, and as David Hesmondhalgh puts it, has become the main means of commodifying culture. A musical practice that is particularly at odds with copyright is sampling, which makes use of previously recorded material through recombination and re-contextualisation. For the use of samples, a proper copyright license must be in place, whether the sample-based song is being monetized on or released for free. However, hip hop producers often do not comply in licensing the use of copyrighted material in their music, which challenges not only the copyright regime, but also copyright as a means of commodification. Over the years, copyright has become an extensive set of rights, resulting in the criminalization of unlicensed use of samples, but not in prevention, as technological advancements have made sampling a more widespread and accessible practice. Within this thesis, the sample-based work of Madlib as released on his Madlib Invazion label is used as a case study to map the current copyright regime, the costs of licensing and the risks of unlicensed sampling.

Keyes, Chair The black brass band parade known as the second line has been a staple of New Orleans culture for nearly 150 years. Through more than a century of social, political and demographic upheaval, the second line has persisted as an institution in the city’s black community, with its swinging march beats and emphasis on collective improvisation eventually giving rise to jazz, funk, and a multitude of other popular genres both locally and around the world. More than any other local custom, the second line served as a crucible in which the participatory, syncretic character of black music in New Orleans took shape. While the beat of the second line reverberates far beyond the city limits today, the neighborhoods that provide the parade’s sustenance face grave challenges to their existence. Ten years after Hurricane Katrina tore up the economic and cultural fabric of New Orleans, these largely poor communities are plagued on one side by underfunded schools and internecine violence, and on the other by the rising tide of post-disaster gentrification and the redlining-in- disguise of neoliberal urban policy.
