DECATUR LOOKING TO BUILD ON MIDWEST INLAND PORT POTENTIAL As reported on herald-review.com by Chris Lusvardi H&R Staff Writer on Jul 21, 2016: DECATUR — The development of the Midwest Inland Port is leading to new opportunities for businesses in the Decatur area. The latest opportunity comes following the announcement Wednesday of a joint venture between transportation service company OmniTRAX Inc. and Topflight Grain Cooperative. OmniTRAX plans to begin managing the newly renamed Decatur Central Railroad LLC, a short-line railway connecting the Topflight facility in Cisco with plants at Archer Daniels Midland Co., Tate & Lyle and other processing companies in and around Macon County. As it begins to operate the railway, OmniTRAX hopes to drive more business to and further rehabilitate the line, said Kevin Shuba, CEO of OmniTRAX, which is one of the largest privately held transportation service companies in North America and an affiliate of The Broe Group. “The Decatur Central Railroad is a great opportunity for OmniTRAX due to strong eXisting commodity flows, real estate driven eXpansion prospects and the potential to add new diversified business,” Shuba said. “Rail is the cheapest way to ship products.” Topflight is increasingly using rail to transport its products as it operates about 20 facilities in Macon, Piatt, Douglas, Logan and Champaign counties, said Scott Docherty, CEO/general manager of Topflight Grain. “Rail is an important part of what we do,” Docherty said. “We continue to handle more volume.” Other area companies have already begun to realize the potential benefits from the area’s rail service that is highlighted through the Midwest Inland Port. -

Washington, D.C. 20590-0001 RE: Exemption Request from 49 C.F.R. § 395.3 - Railroad Maintenance-of-Way Drivers Responding to Unplanned Events Dear Acting Administrator Mullen: The Association of American Railroads (AAR) and American Short Line and Regional Railroad Association (ASLRRA) (the Associations), on behalf of themselves and their member railroads, request that the Federal Motor Carrier Safety Administration (FMCSA) grant an exemption under 49 C.F.R. § 381.300 et seq. from the FMCSA hours of service (HOS) operation restrictions at 49 C.F.R. § 395.3(a)-(b).1 The railroads request that this exemption be granted for five years as prescribed in § 381.300(b). This request covers approximately 20,000 individual drivers and 11,000 commercial motor vehicles (CMVs). As background, the Associations submitted a similar exemption request from § 395.3 requirements on October 11, 2018, at Docket No. FMCSA-2018-0367, requesting relief from FMCSA HOS restrictions for railroad Maintenance-of-way (MOW) employees responding to unplanned events (Attachment 1). On February 21, 2020, the Associations withdrew that pending request (Attachment 2). This revised exemption request addresses the same topic as the Associations’ October 2018 petition, but requests a narrower exemption which parallels that recently granted by FMCSA to other railroad industry groups at Docket No. FMCSA-2019- 1 AAR is a trade association whose membership includes freight railroads that operate 83% of the line-haul mileage, employ 95% of the workers, and account for 97% of the freight revenues of all railroads in the United States; and passenger railroads that operate intercity passenger trains and provide commuter rail service. -
