OPINION

This is an appeal by the Barrett Township Board of Supervisors (Supervisors) from a decision by the Barrett Township Zoning Hearing Board (ZHB) on July 31, 2017.

The Buck Hill Falls Company and the Buck Hill Water Company (Buck Hill) made a written request to the Barrett Township Zoning Officer for a ruling on whether a bulk water filling station would be an accessory use to Buck Hill’s Pennsylvania Public Utility

Commission (PUC)-regulated water utility. The zoning officer responded with a letter dated March 28, 2017 stating that the water filling station was a new use that would not be permitted on Buck Hill’s property in the Conservation zoning district.

Buck Hill filed an appeal to the ZHB on April 24, 2017 from the zoning officer’s denial of a water filling station as an accessory use. The ZHB held a hearing on the question on June 12, 2017. The ZHB granted the appeal in its decision of July 31,

2017, ruling that the bulk sale of water was authorized by the PUC tariff of the Buck Hill

Water Company. Since the bulk sale of water was authorized as part of the water

company’s principal water system use, it would not be considered an accessory use.

The Supervisors appealed this decision on August 30, 2017. The parties then

filed a stipulation that the court would receive PUC records concerning Buck Hill Water

Company’s tariff as additional evidence pursuant to the Municipalities Planning Code,

53 P.S. § 11005-A. As a result of taking that evidence I am now making findings of fact

based upon the original record as supplemented by the PUC documents.

The parties were given additional time to file briefs which they have done.

FINDINGS OF FACT

1. Buck Hill Falls Company and Buck Hill Water Company own the land and all of

the water company assets involved in this appeal. N.T. 06/12/2017, p. 8.

2. The property consists of a tract of 1,566 acres on the west side of

Pennsylvania Route 191 in Barrett Township. It is located in a Conservation (C) zoning

district. It consists of forested woodland with streams and springs and steep slopes.

3. The water company was incorporated in 1902 and has provided a public water

system to its users since that time. N.T. 06/12/2017, pp. 9-10. The water company and

its infrastructure predate the Barrett Township zoning ordinance. N.T. 06/12/2017, p.

76.

4. The water company has three sources of water for its customers. The primary

source of water for its residential and commercial customers is the Buck Hill Creek. The

company also draws water from a source known as the “Big Spring.” It also has a well that is used under its PUC Permit. N.T. 06/12/2017, pp. 13-14.

5. The Big Spring is a natural spring that the company has enclosed with two chambers. From there, the company pipes water downhill to the public water system.

6. The Buck Hill Water Company currently operates under a PUC tariff, providing water service to residential, commercial and bulk water customers. N.T. 06/12/2017, p.

7. The Basin Commission authorizes the water company to sell up to 15,500,000 gallons of water per month to its customers. The Pennsylvania

Department of Environmental Protection authorizes the water company to sell more,

25,000,000 gallons of water per month. N.T. 06/12/2017, p. 17.

8. On average, the water company only sells approximately 3,000,000 gallons of water per month. N.T. 06/12/2017, pp. 11, 17.

9. The PUC tariff authorizes the water company to charge $4.06 per 1,000 gallons of bulk rate water sales. Buck Hill Water Company Schedule of Rates and

10. An Opinion and Order of the PUC was issued on September 18, 1998 that stated:

BY THE COMMISSION: On August 28, 1998, Buck Hill Water Company (Buck Hill) filed Supplement No. 15 to Tariff Water –Pa. P.U.C.No. 3, to become effective August 19, 1998, Supplement No. 15 to Tariff Water –Pa. P.U.C. No. 3 adds a rate for the sale of bulk water.

This Supplement was filed to formally include in Buck Hill’s tariff rates for bulk service supplied through an emergency connection between Buck Hill and a neighboring water utility, National Utilities-Mountainhome Division (Mountainhome). Mountainhome is currently unable to provide sufficient water from its own facilities to adequately supply its customers. The emergency connection was made at the request of the Pennsylvania Department of Environmental Protection and Mountainhome, and is the subject of a separate written agreement between Buck Hill and Mountainhome. After our review of the proposed tariff filing, it does not appear that the filing is unlawful, unjust, unreasonable or contrary to the public interest. Although we cannot approve the proposed tariff changes retroactively to August 19, 1998, as requested by Buck Hill, we will waive the 60-day notice period under Section 1308(a) as permitted by statute, and will permit the tariff filing to become effective on September 18, 1998; THEREFORE, IT IS ORDERED: That Buck Hill Water Company’s Supplement No 15 to Tariff Water – Pa. P.U.C. No. 3, establishing a bulk sales tariff rate, is permitted to become effective on September 18, 1998 as filed. BY THE COMMISSION, /s/ James J. McNulty Secretary

11. Buck Hill is considering the addition of a bulk water filling station for tanker

trucks as part of its water system. N.T. 06/12/2017, p. 38.

12. The water filling station is in the planning stages. Buck Hill has not submitted

applications to construct such a facility to the PUC or to Barrett Township. N.T.

06/12/2017, p. 47-48.

13. Brick Linder, an engineer working on behalf of Buck Hill, sent a written

request to the Barrett Township Zoning Office on February 20, 2017 for “a zoning

determination for the Buck Hill Water Company to construct a water filling station along

Route 191, Barrett Township, Monroe County, PA.” The request stated in part that:

The BHFC desires to construct a bulk water filling station to provide bulk water to tanker trucks for off-premise distribution. The water will be collected, transported and used by bulk water companies unrelated to BHFC. There will be no bottling, packaging, retail distribution or retail sales at the facility or by the BHFC. The only filling will be of tanker trucks to be removed from the site. The primary purpose of Big Spring is to provide potable water supply to the Buck Hill Water Company (BHWC) and that will remain unchanged. The only water that will be made available for bulk water transport will be excess water not needed/used by the BHWC for system supply. The filling station will be a facility where raw water from Big Spring will be pre-treated and where tanker trucks (10,000-gal or so) will be filled. Only excess water from Big Spring not used for routine customer water supply will be available for bulk water hauling, and the bulk water supply to tankers is intended to be a secondary use of the Big Spring source. The sole purpose of the filling station is to fill tanker trucks (which will be leaving the site) and not for processing other than routine disinfection. The BHWC is a subsidiary of the BHFC and is a PUC company (License No. 210260) that supplies the Buck Hill Falls Community and surrounding areas… The facility and project will include the design, permitting and construction of the following items: 1. Installation of a supply pipe from the existing raw water supply pipe to the filling station 2. An access drive and truck maneuvering area 3. a building for water treatment, control and operation (less than 500-sf) 4. a ground-level storage tank for storing treated water.

14. Buck Hill did not present evidence of how much bulk water it intended to sell through the bulk water filling station. Sales could conceivably be up to the permitted amount of 15,500,000 gallons per month.

15. Shawn McGlynn, Barrett Township Zoning Officer, responded to Mr. Linder’s request by letter dated March 28, 2017 advising him that:

The proposed use, water filling station, cannot be considered an accessory use, or an extension of an existing use, because the water filling station will not be essential for the residents of Barrett Township as required in accordance with §1003, F,1, a, of the Township’s Zoning Ordinance. The water filling station use would be a new, primary, use of the land for the collection and distribution of water elsewhere.

16. Buck Hill appealed the zoning officer’s determination in an appeal dated April

24, 2017. Attached to the appeal was Mr. Linder’s submission to the zoning officer,

which included photographs depicting a pump-station building containing pumps and

water treatment equipment. Zoning Hearing Board Appeal Application of Buck Hill Falls

17. The ZHB issued a decision on July 31, 2017 reversing the decision of the

zoning officer.

DISCUSSION

The Supervisors raise three issues on appeal. The first is whether the ZHB erred

in deciding that zoning regulation of Buck Hill’s bulk water business was preempted by

state law. Where the court takes additional evidence in a zoning appeal, it must review

the case de novo. Coal Gas Recovery, L.P. v. Franklin Twp. Zoning Hearing Bd., 944

A.2d 832, 838 (Pa. Commw. Ct. 2008).

Buck Hill began this litigation by asking the Barrett Township Zoning Officer

whether a bulk water filling station would be an accessory use to Buck Hill’s existing

water utility service. Zoning Officer Shawn McGlynn determined that the bulk water

filling service was a new business, a use not permitted in the Conservation zoning

district. Mr. McGlynn did not review the Buck Hill PUC tariff in making his

determination.

The ZHB reversed the decision of the zoning officer following Buck Hill’s appeal.

The ZHB concluded:

…2. The PA PUC-approved tariff for the water company is based on applicable PUC laws and regulations that preempt the provisions of the Barrett Township Zoning Ordinance, particularly as to the legal scope of the principal use of the water company. …4. As evidenced by the Applicant’s existing tariff, the Applicant’s (sic) is authorized to sell bulk water by operating a tank truck bulk water filling station as part of the existing water system’s principal use as a PUC-regulated public water system utility.

ZHB Conclusions of Law, 2, 4.

The actual Buck Hill Water Company PUC tariff was not part of the ZHB record at the time of its decision. The ZHB relied upon the testimony of Mike O’Shea, President of

Buck Hill, to the effect that Buck Hill operated under a PUC tariff that authorized the bulk sale of water at the rate of $4.06 per 1,000 gallons. N.T. 06/12/2017, p. 12.

The parties have stipulated to the inclusion of pages of the Buck Hill Water

Company’s PUC filings. Those pages show that Buck Hill obtained PUC approval of a change to its tariff in 1998 to allow it to charge customers for bulk water sales at the rate of $1.90 per 1,000 gallons. Supplement No. 15, 10th Revised Page No. 4A, Schedule of

Rates and Charges. A later page in this record shows “Bulk Water Sale: Bulk rate sales of water shall be charged at the following metered rate per quarter. $4.06/1,000 gallons.”1 Supplement No. 24, Tariff Water- Pa. P.U.C. No. 3, Fourteenth Revised Page

The Supervisors first argue that the identification in the tariff of an amount Buck

Hill may charge for bulk water sales does not mean that it has carte blanche to sell bulk water to all and sundry. They argue that Buck Hill’s bulk water sales are limited by the facts set forth in the 1998 PUC decision authorizing Buck Hill’s bulk water sales in the

first instance. There the PUC discussed the fact that Buck Hill needed PUC bulk water

sales authorization to permit Buck Hill to supply water through an emergency

connection to a neighboring water utility, National Utilities-Mountainhome Division,

which was then unable to provide sufficient water to its customers.

Buck Hill contends that the Barrett Township Zoning Ordinance is preempted by

state law because the water company is a utility regulated by the PUC. Pennsylvania’s

appellate courts have long recognized that the PUC has comprehensive regulatory

jurisdiction over companies such as Buck Hill Water Company.

An early decision to this effect is York Water Co. v. York, 95 A. 396 (Pa. 1915),

where the Supreme Court addressed the relationship between the Public Service

Company Law, Act of July 26, 1913, P.L. 1374,1 and the Third Class City Code then in

effect. Pursuant to provisions of that Code, the City of York by ordinance attempted to

require the water company to install meters at the company's expense when a

consumer requested it. The water company obtained an injunction against enforcement

of the ordinance and the city appealed. The Supreme Court affirmed:

There can be no reasonable doubt that the legislative intention was to make the Public Service Act the supreme law of the State in the regulation and supervision of public service corporations, and this being so, it follows as a necessary sequence that all laws inconsistent with the powers thus conferred must be held to be repealed or supplied thereby.... The Public Service Company Law was intended to establish a complete and uniform system throughout the State for the enforcement of such powers as were conferred upon the Public Service Commission by that statute...... Under the guise of a police regulation cities cannot undertake to determine the reasonableness of rates charged by public service corporations, nor can they prescribe regulations relating to the facilities, service and business of such corporations. These are the functions of the Public Service Commission and must be so regarded. The legislature has so declared and what the lawmaking

body does within the limit of its powers becomes a rule of action binding upon all branches of government, state or municipal, and upon the people as well.

York Water Co., 95 A. at 397 (citations omitted).

The Pennsylvania Supreme Court again addressed this question in Duquesne

Light Company v. Upper St. Clair Township, 105 A.2d 287 (Pa. 1954). There the PUC gave the Duquesne Light Company, an electric utility company, approval to build a transmission line through a residential area of Upper St. Clair Township. The PUC issued the necessary certificates of public convenience to Duquesne Light Company, which proceeded with the construction of the new line. The township sought to block the construction of the utility line towers on the grounds that their presence would violate the township's zoning ordinance. The township issued a notice of work stoppage to Duquesne Light Company, advising that a building permit must be secured and threatening the imposition of daily fines and the arrest of contractors if construction continued without a permit.

The Duquesne Light Company filed suit to enjoin the township from enforcing its zoning ordinance. The common pleas court enjoined the township. The Supreme

Court affirmed, citing the PUC's authority under section 901 of the then-existing Public

Utility Code to “supervise and regulate all public utilities doing business within the

Commonwealth,” and holding that “the policy of the Commonwealth in entrusting to the

Commission the regulation and supervision of public utilities has excluded townships from the same field.” Duquesne Light Company, 105 A.2d at 292. The court noted:

The Public Utility Code demonstrates without question that the Legislature of the Commonwealth of Pennsylvania has therein expressed its policy to commit the regulation of utilities to the Public Utility Commission and to impose a duty upon

utilities to render efficient service. It is clear that the proposed transmission line is necessary for the rendition of efficient service to the public and that that necessity transcends the legitimate objectives of any one of the political subdivisions of the Commonwealth. We believe that this is the reason why the General Assembly entrusted the regulation of public utilities to a commission of state-wide jurisdiction. Local authorities not only are ill-equipped to comprehend the needs of the public beyond their jurisdiction, but, and equally important, those authorities, if they had the power to regulate, necessarily would exercise that power with an eye toward the local situation and not with the best interests of the public at large as the point of reference.

Id. at 293.

The Supreme Court again cited these principles when a county ordinance sought to regulate the placement of electric lines within the county:

This reasoning is irrefutable. The necessity for conformity in the regulation and control of public utilities is as apparent as the electric lines which one views traversing the Commonwealth. If each county were to pronounce its own regulation and control over electric wires, pipe lines and oil lines, the conveyors of power and fuel could become so twisted and knotted as to affect adversely the welfare of the entire state. It is for that reason that the Legislature has vested in the Public Utility Commission exclusive authority over the complex and technical service and engineering questions arising in the location, construction and maintenance of all public utilities facilities. Einhorn v. Electric Company, 410 Pa. 630, 190 A.2d 569; Duquesne Light Co. v. Upper St. Clair Tp., 377 Pa. 323, 105 A.2d 287; Lower Chichester Twp. v. PUC, 180 Pa. Super. 503, 119 A.2d 674.

Chester County v. Philadelphia Elec. Co., 18 A.2d 331 (Pa. 1966).

The Commonwealth Court has recently ruled that a city ordinance which imposed restrictions on the location of gas meters in an historic district was preempted by the

Public Utility Code in UGI Utilities, Inc. v. City of Reading, 2017 WL 558066 (Pa.

Commw. Ct. 2017). There the court said:

The law is well established that the Public Utility Code vests exclusive authority over the regulation of public utility facilities in the PUC. County of Chester, supra at 332-33. …Local ordinances which conflict with PUC regulations or orders are preempted and cannot be applied to the regulated

utility. PECO Energy Co. v. Township of Upper Dublin, 922 A.2d 996,1005 (Pa. Cmwlth. 2007).

UGI Utilities, 2017 WL 558066 at *4.

The Supervisors acknowledge that the PUC statute and rules preempt local ordinances where the PUC regulates an area. However, they contend that this general rule does not apply here because of Buck Hill’s tariff. They argue that Buck Hill has not obtained permission from the PUC to sell bulk water to the public and until it does so it is subject to the Barrett Township Zoning ordinance. They contend that the Buck Hill tariff only allowed Buck Hill to sell bulk water to the neighboring water utility, National

Utilities-Mountainhome Division, which Buck Hill identified in its petition in 1998. This approval allowed Buck Hill to supply bulk water to National Utilities through an existing pipe connection, which would not require the construction of a building.

The Public Utility Code provides definitions for “Service” and “Tariff” as follows:

“Service.” Used in its broadest and most inclusive sense, includes any and all acts done, rendered or performed, and any and all things furnished or supplied, and any and all facilities used, furnished or supplied by public utilities …in the performance of their duties under this part to their patrons, employees, other public utilities, and the public… “Tariff.” All schedules of rates, all rules, regulations, practices, or contracts involving any rate or rates…

66 Pa. C.S. § 102.

The first question posed in this case then is who has jurisdiction to interpret the scope of the Buck Hill tariff, the zoning officer, the ZHB and the courts or the PUC? The extent of the PUC’s jurisdiction has frequently been addressed by our appellate courts:

In Lansdale Borough v. Philadelphia Electric Co., 403 Pa. 647, 650–51, 170 A.2d 565, 567 (1961) the Supreme Court, after an extensive review of prior cases concerning PUC jurisdiction, concluded: ‘Initial jurisdiction in matters concerning

the relationship between public utilities and the public is in the PUC-not in the courts. It has been so held involving rates, service, rules of service, extension and expansion, hazard to public safety due to use of utility facilities, installation of utility facilities, location of utility facilities, obtaining, alerting, dissolving, abandoning, selling or transferring any right, power, privilege, service, franchise or property and rights to serve particular territory.’ The exclusive regulatory jurisdiction conferred on the PUC in these areas permits evaluation and control of utility activities as they affect public service. No other entity can interfere with the commission's performance of its function by making additional or different requirements of a utility or by conducting an independent appraisal of a utility's service to the public.

Behrend v. Bell Tel. Co., 363 A.2d 1152, 1157–58 (Pa. Super. 1976).

The Commonwealth Court has interpreted the “tariff” of the utility as follows:

A tariff is a set of operating rules imposed by the State that a public utility must follow if it wishes to provide services to customers. It is a public document which sets forth the schedule of rates and services and rules, regulations and practices regarding those services. It is well settled that public utility tariffs must be applied consistently with their language. 66 Pa.C.S. § 1303. Public utility tariffs have the force and effect of law, and are binding on the customer as well as the utility. Pennsylvania Electric Co. v. Pennsylvania Public Utility Commission, 663 A.2d 281, 284 (Pa. Commw. Ct. 1995), PPL Elec. Utilities Corp. v. Pennsylvania Public Utility Com'n, 912 A.2d 386, 402 (Pa. Commw. Ct. 2006).

State Farm Fire & Cas. Co. v. PECO, 54 A.3d 921, 926 (Pa. Super. 2012).

The interpretation of the meaning and extent of the PUC tariff belongs with the

PUC, not the zoning hearing board or this court. Whether the PUC only authorized

Buck Hill to sell bulk water to National Utilities, by means of an existing connection

between the two companies, or opened the spigot to allow Buck Hill to sell millions of

gallons of water to the public at the rate set by its tariff is within the jurisdiction of that

agency, not the ZHB or this court.

The Supervisors next argument is that the Municipalities Planning Code (MPC)

does provide jurisdiction for the zoning officer to enforce the Barrett Township zoning

ordinance against a PUC-regulated water company under limited circumstances, and that these circumstances apply here. They contend that the ZHB erred in disregarding the Municipalities Planning Code, 53 P.S. § 10619, which provides as follows:

§ 10619. Exemptions

This article shall not apply to any existing or proposed building, or extension thereof, used or to be used by a public utility corporation, if, upon petition of the corporation, the Pennsylvania Public Utility Commission shall, after a public hearing, decide that the present or proposed situation of the building in question is reasonably necessary for the convenience or welfare of the public. It shall be the responsibility of the Pennsylvania Public Utility Commission to ensure that both the corporation and the municipality in which the building or proposed building is located have notice of the hearing and are granted an opportunity to appear, present witnesses, cross-examine witnesses presented by other parties and otherwise exercise the rights of a party to the proceedings.

53 P.S. § 10619.

This section allows Barrett Township to regulate a new building on Buck Hill’s property under the township zoning ordinance unless the water company has first petitioned for a certificate of public convenience from the PUC and given the township the opportunity to be heard at a hearing held by the PUC.

The Commonwealth Court interpreted this section in Del-Aware Unlimited, Inc. v.

Pennsylvania Pub. Util. Comm'n, 513 A.2d 593, 595 (Pa. Commw. Ct. 1986). There, an environmental group appealed a PUC ruling concerning a pumphouse which was proposed to pump Delaware River water to cool the nuclear generating station in

Limerick, Montgomery County. The (PUC) order determined that the proposed site of the Bradshaw pumphouse was reasonably necessary for the convenience or welfare of the public, thus exempting it from local zoning ordinance provisions under Section 619 of the Pennsylvania Municipalities Planning Code.

The court upheld the PUC determination, finding that the PUC had properly

evaluated the environmental impacts of placing the pumphouse at the proposed location

and that the proposed site of the pumphouse was reasonably necessary for the public

convenience or welfare. Id. at 639-40.

Buck Hill has not sought a certificate of public convenience for the construction of

its bulk water transfer station, so the Barrett Township Zoning Ordinance does apply to

Buck Hill’s application and the zoning officer had jurisdiction to rule upon the

application. The ZHB argues that Buck Hill has not applied for a building permit and did

not present concrete plans for a building on the premises. Therefore, it reasons,

Section 619 does not apply. However, Mr. Linder’s application package stated that

Buck Hill proposed to construct “a building for water treatment, control and operation

(less than 500-sf)” and a ground-level storage tank for storing treated water.” Linder

letter, ZHB Board Exhibit 1. He also submitted pictures of a bulk water transfer station

with pumps and water treatment equipment inside. The zoning officer correctly

determined that Buck Hill’s proposed bulk water filling station included the construction

of a new building.

Finally, the Supervisors argue that Buck Hill’s bulk water filling station would not

be an accessory use. The Barrett Township Zoning Ordinance defines an accessory

use as:

ACCESSORY USE.- A use customarily incidental and subordinate to and located on the same lot, occupied by the principal use to which it relates.

The question of what constitutes an accessory use was addressed by the

Commonwealth Court in Sky's the Limit, Inc. v. Zoning Hearing Bd. of Smithfield Twp.,

18 A.3d 409 (Pa. Commw. Ct. 2011). There owner of an airport wanted to permit camping on the premises for pilots and passengers of aircraft using the airport.

In order for camping to be allowed at the Airport, STL has to prove that camping is an accessory use to the Airport and that camping is customarily incidental to the operation of an airport. Whether a use is customarily incidental to a principal use requires an intensive fact-based analysis and an evaluation based upon a reasonable person standard. Hess v. Warwick Township Zoning Hearing Board, 977 A.2d 1216 (Pa.Cmwlth.2009), petition for allowance of appeal denied, 605 Pa. 703, 990 A.2d 731 (2010). In Hess, we explained that:

“Customarily incidental” is best understood as invoking an objective reasonable person standard. Under this standard, we may look not only at how frequently the proposed accessory use is found in association with the primary use ... but also at the applicant's particular circumstances, the zoning ordinance and the indications therein as to the governing body's intent regarding the intensity of land use appropriate to the particular district, as well as the surrounding land conditions and any other relevant information, including general experience and common understanding, to reach a legal conclusion as to whether a reasonable person could consider the use in question to be customarily incidental. This approach respects the need for an understandable legal standard and the flexibility that is a necessary component of the analysis.

977 A.2d at 1224.

The proponent of the use must introduce evidence of a significant percentage of principal uses which are accompanied by the accessory use. “(P)roof of customary incidence has entailed a showing that a significant percentage of like principal uses in the area have accessory uses of the nature and extent in question. Champaine v.

Zoning Hearing Board of East Bradford Township, 374 A.2d 752 (Pa. Commw. Ct.

1977). For example, in Gross v. Zoning Board of Adjustment, 227 A.2d 824 (Pa. 1967), a restaurant was determined to be customarily incidental to the operation of a bowling

alley because the record established that a very substantial percentage of bowling

alleys in the area had restaurant facilities of the same nature and extent as that

proposed by the applicant.

Buck Hill only introduced evidence of one other water company, the Brodhead

Creek Regional Authority in Stroud Township, that was offering bulk water sales in

addition to residential and commercial sales. This does not constitute a significant

percentage of water companies in the Commonwealth.

Buck Hill has cited Borough of Fleetwood v. Zoning Hearing Board, 649 A.2d 651

(Pa. 1994) in support of its position. However, that case is not helpful to its cause. The

question there was whether gas pumps were an accessory use to a convenience store.

The court held that they were, but based their decision on the fact that 146 of Turkey

Hill’s 203 convenience stores had gas pumps. There was also evidence that the

estimated number of patrons who purchased convenience store items exceeded the

numbers of patrons who purchased gasoline only. Id. at 655.

Here, Buck Hill is currently selling approximately 3,000,000 gallons of water per

month, primarily to residential customers. If the bulk water transfer station is allowed as

an accessory use, Buck Hill has a DRBC permit to allow it to sell 12,500,000 more

gallons per month. These sales would be transported by tanker trucks transporting

10,000 gallons per truckload, a much more intensive use in a Conservation zone than

the existing underground pipe system serving residential customers. A use cannot be

considered accessory when it is in actuality the principal use of the building. Appeal of

Hasley, 30 A.2d 187, 189 (Pa. Super. 1943).

Buck Hill has the option at this juncture to seek a certificate of public convenience from the PUC for its bulk water sales. That approval would not be subject to the Township zoning power, as the ZHB properly found. However, if Buck Hill pursued that option, the Township would have an opportunity to be heard on its concerns about development in its Conservation zoning district and the PUC could adopt appropriate safeguards. Buck Hill opted instead to seek zoning approval in a

Conservation district for a business that may dwarf the residential water company that now exists.

CONCLUSIONS OF LAW

1. The ZHB erred in determining that the zoning officer was preempted from acting on Buck Hill’s zoning request.

2. The zoning officer properly determined that the bulk water transfer station as proposed was not an accessory use under the zoning ordinance.

The Monroe County Conservation District (MCCD) is accepting quotes for Legal Services (Solicitor) to assist the District with our Legal Services and Affairs.

SCOPE OF WORK/TECHNICAL SPECIFICATIONS. The MCCD is seeking proposals from qualified and licensed entities to provide MCCD with the following detailed services.

General Requirements. The successful proposer shall be the legal advisor to the Monroe County Conservation District Board of Directors and the District Manager. Services include but are not limited to, and on an as-needed/as-requested basis:

Interested proposers should have a basic understanding of the function of Conservation Districts, Conservation District Law, delegated responsibilities under the Pennsylvania Department of Environmental Protection and the State Conservation Commission, and the District oversight responsibilities of the State Conservation Commission. While MCCD receives legal assistance for programs related to our delegated responsibilities, it is important that the proposer has a firm grasp of each entities scope of authority.

As county employees, matters of Human Resources and Personnel will all fall under the scope of the corresponding county department.

Contract Period. MCCD is seeking legal assistance on an as-needed basis, and at the discretion of the MCCD Board of Directors.
