Au Act Respecting an Agreement between Canada and British Columbia Regarding the Canada Pension Plan

ER MAJESTY, by and with the advice and consent of the H Legislative Assembly of the of British Columbia, enacts as follows:—

Short title. 1. This Act may be cited as the Canada-British Columbia Pension Agreement Act.

Power to enter 2. The Provincial Secretary is authorized to enter into and affix his Agreement. signature to a Memorandum of Agreement as set forth in the Schedule and made on the first day of January, 1966, between the and the Government of the Province of British Columbia, for and on behalf of Her Majesty the Queen in right of the Province and for and on behalf of the Government of the Province of British Columbia.

Arrrendment 3. The Agreement may, with the approval of the Lieutenant-Governor in Council, be amended from time to time as may be agreed upon with the Government of Canada by the Provincial Secretary for and on behalf of Her Majesty the Queen in right of the Province.

Statute" deemed to he 4. To the extent to which any Statute is required to be amended for amended. the purposes of the Agreement, it shall, for the relevant period provided in the Agreement, have effect and have the full force of law as if every required amendment had been expressly made therein.

Power of ProwInc ral 5. The Minister of Finance, for and on behalf of Her Majesty the Government Queen in right of the Province, is empowered to do every act, to exercise every power, and to make or cause to be made every payment necessary or proper for the purpose of implementing in every respect every obli- gation assumed by the Province under the Agreement.

The Lieutenant-Governor in Council may make regulations to enable Her Majesty the Queen in right of the Province to implement any obligation assumed under the Agreement and for the collection of any moneys for the purposes of implementing the Agreement. 7. Any amount or amounts that the Government of British Columbia becomes liable to pay to the Government of Canada as a result of the Agreement shall be a charge upon and be paid out of the Consolidated Revenue Fund.

Retroactivity. 8. This Act shall he deemed to have come into full force and effect on the first day of January, 1966, and is retroactive to the extent necessary to give full force and effect to the provisions hereof on and after that date.

SCHEDULE

MEMORANDUM OF AGREEMENT made in duplicate on the first day of January, 1966. concerning the inclusion in pensionable employment of employment by Her Majesty in right of the Province of British Columbia. BETWEEN THE GOVERNMENT OF CANADA, herein called "Canada". repre- sented by the Minister of National Revenue of Canada, OF THE FIRST PART, AND THE GOVERNMENT OF THE PROVINCE. OF BRITISH COLUM- BIA, herein called "British Columbia". represented by the Provincial Secretary of British Columbia. OF THE SECOND PART. WHEREAS employment by Her Majesty in right of a province or by an agent of Her Majesty in right of a province is excepted employment under paragraph (i) of subsection (2) of section 6 of the Canada Pension Plan: AND WHEREAS under paragraph (e) of subsection (1) of section 7 of the Canada Pension Plan the Goscrnor in Council may make regulations for including in pensionable employment, pursuant to an agreement with the government of a province, employment in Canada by Hcr Majesty in right of a province or by an agent of Her Majesty in right of a province: AND WHEREAS under paragraph tal of subsection (1) of section 7 of the Canada Pension Plan the Governor in Council may make regulations for including in pensionable employment any employment outside Canada or partly outside Can- ada. being employment that would he pensionable employment if it were in Canada; AND WHEREAS under paragraph lb) of subsection ( I) of section 7 of the Canada Pension Plan the Governor in Council may make regulations for including in pensionable employment the entire employment tinder one employer of a person who is engaged by the employer partly in pensionable employment and partly in other employment; AND WHEREAS the parties hereto desire to enter into such an agreement and the Minister of National Revenue of Canada and the Provincial Secretary of British Columbia have been respectively authorized by the parties hereto to enter into this agreement and to execute these presents. NOW, THEREFORE. THIS AGREEMENT WITNESSETII that in considera- tion of the premises and of the mutual covenants and agreements herein contained, the parties hereto covenant and agree each with the other as follows: I. The provisions of the Canada Pension Plan and the Regulations made there- under and in force from time to time shall form part of this agreement. 2. British Columbia agrees that employment by Hcr Majesty in right of the Province of British Columbia or by an agent of Her Majesty in right of the said Province, other than employment as 3

(a) a Member of the Legislative Assembly of the Province of British Co- lumbia: (h) a Member of the Executive Council of the Province of British Columbia; (c) Leader of the Opposition in the Legislative Assembly of the Province of British Columbia; (d) Speaker or Deputy Speaker in the Legislative Assembly of the Province of British Columbia, shall he included in pensionable employment under the Canada Pension Plan and the Regulations mule thereunder and in force from time to time. 3. British Columbia agrees. with respect to persons in the employment of Her Majesty in right of the Province of British Columbia or an agent of Her Majesty in right of the said Province, other than persons in the employment excepted under section 2, and in accordance with the provisions of the Canada Pension Plan and the Regulations made thereunder and in force from time to time, (1) to make or cause to be made deductions from their remuneration, (2) to pay or cause to he paid contributions as an employer of such persons, (3) to remit or cause to be remitted to Canada the said deductions and con- tributions. (4) to make or cause to be made returns in the forms provided therefor, and (5) without restricting the generality of the foregoing, to furnish or cause to be furnished information with respect to such persons as may be relevant for the administration and operation of the Canada Pension Plan. 4. Canada agrees to include in pensionable employment by Regulation under the Canada Pension Plan employment by Her Majesty in right of the Province of British Columbia or by an agent of Her Majesty in right of the said Province other than the employment excepted by section 2, during the currency of this agreement. 5. (1) This agreement shall come into force and be effective on the first day of January, 1966. and subject to the observance of the agreements and covenants herein contained, shall remain in force until terminated in accordance with subclause (3). (2) It is hereby understood and agreed that, subject to the Canada Pension Plan and the Regulations made thereunder and in force from time to time, this agreement may be amended at any time by mutual consent of the parties. (3) Either party may, by giving notice in writing to the other party, terminate this agreement and such notice shall give an effective date of the last day of a calen- dar year for such termination which date shall be not less than six months from the date of such notice. This Bill is intended to authorize the making of the Agreement that appears in the Schedule with the Government of Canada. The Agreement provides for the inclusion in pensionable employment under the Canada Pension Plan of employ. ment by Her Majesty the Queen in right of the Province with the exceptions noted.
