Also on Wednesday, Federal Reserve Governor Daniel Tarullo’s resignation takes effect, though no successor has been named. In other news, Acting FTC Chair Maureen Ohlhausen has announced plans for an Economic Liberty Task Force to work with states to address anti-competitive occupational licenses at the state level. Foreign Policy President Trump has a full week of foreign policy meetings, beginning today with Egyptian President Abdel Fattah al-Sisi. On Wednesday, he will meet with King Abdullah of Jordan, a meeting that is expected to set the stage for a meeting later this month with Palestinian leader Mahmoud Abbas. In addition to the perennial discussion of the Israel-Palestinian conflict, the Egyptian and Jordanian meetings are expected to focus on defeating ISIS and addressing the Syrian refugee issue. Al-Sisi in particular expects a much warmer reception from Trump than in the prior administration. On Thursday and Friday, the President will host Chinese President Xi Jinping at Mar-a-Lago. The meeting will likely focus on North Korea’s nuclear program and disputes over trade and territory in the South China Sea. Jared Kushner’s instrumental work coordinating President Xi’s visit with Chinese Ambassador, Cui Tiankai has shined a light on his emerging role as the go-to back-channel diplomat for foreign nations seeking better communications and understanding with his father-in-law. Defense Secretary Mattis visited London and held a joint press conference with his British counterpart, where he affirmed Secretary Tillerson’s statement last month that military force is “on the table” to stop North Korea’s nuclear weapons program. Mattis has also asked The White House to lift Obama Administration restrictions on providing support to Saudi Arabia and the United Arab Emirates for their operations in Yemen against the Iranian-backed Houthi rebels. Finally, Fiona Hill was named White House National Security Council Senior Director for Europe and Russia. Economic Growth President Trump announced the creation of a new White House Office of American Innovation (OAI), to be led by Jared Kushner, which will lead efforts on reorganizing the government and streamlining the bureaucracy. The effort is similar to initiatives started by most modern presidents, and OAI’s chances of success will depend largely on being able to get buy-in from career staff at departments and agencies, a difficult task to achieve from The White House. After the failure of GOP efforts to replace Obamacare, the Administration is re-focusing on tax reform and infrastructure, but the fight over how to pay for these initiatives could derail the effort. To understand what tax reform could look like, look at the consolidated tax plan Trump’s Transition team laid out between the election and Inauguration Day and the personnel he’s putting in place to drive the initiative. ________________________________________________________________________________________________________________________ Page 2 TAP The Administration Project 3 April 2017 _________________________________________________________________________________________________ Trade A draft version of a Trump Administration letter to Congress on how it wants to renegotiate NAFTA has been leaked. The proposal seeks more modest changes than Trump advocated on the campaign and would retain several controversial issues, “including an arbitration panel that lets investors in the three nations circumvent local courts to resolve civil claims.” Separately, President Trump signed two executive orders focused on trade. The first order calls for a report to examine if trade deficits between the U.S. and its major trading partners are caused by “cheating or other inappropriate behavior.” Once this report is complete, any determination that a nation is cheating could lead the Administration to call for protective tariffs or other measures. The second order to strengthen penalties on foreign products traded unfairly. While the Administration claims these orders are not directed at China, they are expected to be a point of discussion during President Xi’s upcoming visit. Energy and Environment President Trump signed a long awaited executive order calling for a review of the Clean Power Plan, removing the requirement that federal officials consider the “social cost of carbon”, an Obama era requirement attempting to place a dollar amount on the long-term negative impacts of carbon emissions when making federal policies, and rolling back several other Obama era energy directives. Trump has directed the EPA to replace the Obama Administration’s Waters Of The U.S. Rule by the end of 2017. In response Trump’s executive order, Interior Secretary Ryan Zinke formally lifted the moratorium on coal leases on federal land. Healthcare New Jersey Governor Chris Christie will serve as the Chairman of a White House Commission to combat opioid addiction. Christie has been highly engaged on the issue of drug addiction and dedicated his final year in office to tackling the issue. FDA Commissioner nominee Scott Gottlieb will testify on Wednesday in front of the Senate Health, Education, Labor and Pensions (HELP) Committee. In the past, Gottlieb has opposed efforts to expand clinical trials and argued for simplifying the FDA approval process. Education Education Secretary Betsy DeVos and Ivanka Trump toured the National Air and Space Museum to encourage young girls to pursue careers in STEM subjects. At a separate event, DeVos called for expanding school choice programs and increasing educational options for students. Justice The Senate Judiciary Committee is expected to vote today on advancing the nomination of Neil Gorsuch as Associate Justice of the Supreme Court to the full Senate. While the nomination will clear the committee, the threat of a filibuster is likely to lead the Senate Republican Leadership to invoke the “nuclear option” if they are not able to secure 60 votes to avoid a Democratic filibuster. Senate Majority Leader Mitch McConnell has made clear there will be a floor vote by Friday. Last week, U.S. District Judge Derrick Watson of Hawaii extended his ruling blocking President Trump’s travel and refugee executive order from temporary to indefinite, and Attorney General Jeff Sessions announced that the federal government may withhold criminal justice grants from jurisdictions that do not fully cooperate with federal immigration laws. ________________________________________________________________________________________________________________________ Page 3 TAP The Administration Project 3 April 2017 _________________________________________________________________________________________________ What's On TAP for Banking and Finance? • Officials Say Flynn Discussed Sanctions
Officials say Flynn discussed sanctions The Washington Post February 10, 2017 Friday, Met 2 Edition Copyright 2017 The Washington Post All Rights Reserved Distribution: Every Zone Section: A-SECTION; Pg. A08 Length: 1971 words Byline: Greg Miller;Adam Entous;Ellen Nakashima Body Talks with Russia envoy said to have occurred before Trump took office National security adviser Michael Flynn privately discussed U.S. sanctions against Russia with that country's ambassador to the United States during the month before President Trump took office, contrary to public assertions by Trump officials, current and former U.S. officials said. Flynn's communications with Russian Ambassador Sergey Kislyak were interpreted by some senior U.S. officials as an inappropriate and potentially illegal signal to the Kremlin that it could expect a reprieve from sanctions that were being imposed by the Obama administration in late December to punish Russia for its alleged interference in the 2016 election. Flynn on Wednesday denied that he had discussed sanctions with Kislyak. Asked in an interview whether he had ever done so, he twice said, "No." On Thursday, Flynn, through his spokesman, backed away from the denial. The spokesman said Flynn "indicated that while he had no recollection of discussing sanctions, he couldn't be certain that the topic never came up." Officials said this week that the FBI is continuing to examine Flynn's communications with Kislyak. Several officials emphasized that while sanctions were discussed, they did not see evidence that Flynn had an intent to convey an explicit promise to take action after the inauguration. Flynn's contacts with the ambassador attracted attention within the Obama administration because of the timing.

  • The People Shaping the Trump Administration
The People Shaping the Trump Administration Despite Running on a Pledge to ‘Drain the Swamp’ and Crack Down on Special Interests, Donald Trump Has Filled His Transition Team With Lobbyists and Others With Potential Conflicts November 16, 2016 – Donald Trump rode to the White House by raging about alleged rampant corruption in Washington and pledging to “drain the swamp.” Each of the five points in the ethics platform he issued in October focused on diminishing the influence of lobbyists.1 These included a promise to impose a five-year ban on former executive branch officials lobbying the federal government. Trump further promised to crack down on special interest-influence by expanding the definition of lobbyist to include consultants and others who trade on inside government information and expertise.2 But Trump’s nascent transition team, which will shape his administration, is swarming with lobbyists and other special interests. Many of the lobbyists are working for the transition on areas for which they currently are lobbying the federal government. Meanwhile, many of those who aren’t lobbyists appear to have potential conflicts of interest. Vice president-elect Mike Pence reportedly said on November 15 that the transition team would be purged of lobbyists, but the transition team has not made the point official.3 Even if true, that remedy would not address cases such as a defense contractor working on defense interests, or a lawyer for health care interests working on health care reform. Here are brief summaries of individuals who have been reported in the media as overseeing agencies or policies for Trump’s transition team.

Administration of Donald J. Trump, 2020 Remarks in a Teleconference With Banking Industry Leaders on Financial Assistance to Small Businesses and an Exchange With Reporters April 7, 2020 The President. Well, thank you very much. And thank you, everybody, for being with us. It's been an incredible period of time for the banking industry and all that you're doing for small business. Steve is telling me that it's been literally record-setting, the amount of money that's been done. And if you want, I'll start all over again. I guess they didn't have the mic on. So I'll start all over again. Why not? But I want to thank everybody for being here. It is a great tribute to the banking business. The money that's been done and the money that's been essentially loaned—these are great loans for the banks, and they're great loans for small business, and we appreciate it. We're looking forward to speaking with the top CEOs from the banking industry and finance industry. Some of you I know very well and great relationships with. You do an incredible job. Respected all over the world. You're the biggest and the best. And we're meeting to further deepen our partnership to help American families, workers, and small businesses during the pandemic, which is something that nobody ever dreamed of. You know, I say it, and I say it a lot: We had the greatest economy in history, the greatest economy that we've ever had, the greatest economy that anybody has ever had.

  • Presidential Administration Under Trump Daniel A
Presidential Administration Under Trump Daniel A. Farber1 Anne Joseph O’Connell2 I. Introduction [I would widen the Introduction: focusing on the problem of what kind of president Donald Trump is and what the implications are. The descriptive and normative angles do not seem to have easy answers. There is a considerable literature in political science and law on positive/descriptive theories of the president. Kagan provides just one, but an important one. And there is much ink spilled on the legal dimensions. I propose that after flagging the issue, the Introduction would provide some key aspects of Trump as president, maybe even through a few bullet points conveying examples, raise key normative questions, and then lay out a roadmap for the article. One thing to address is what ways we think Trump is unique for a study of the President and for the study of Administrative Law, if at all.] [We should draft this after we have other sections done.] Though the Presidency has been a perennial topic in the legal literature, Justice Elena Kagan, in her earlier career as an academic, penned an enormously influential 2001 article about the increasingly dominant role of the President in regulation, at the expense of the autonomy of administrative agencies.3 The article’s thesis, simply stated, was that “[w]e live in an era of presidential administration.”, by 1 Sho Sato Professor of Law at the University of California, Berkeley. 2 George Johnson Professor of Law at the University of California, Berkeley. 3 Elena Kagan, Presidential Administration, 114 HARV. • Corporate and Foreign Interests Behind White House Push to Transfer U.S
Corporate and Foreign Interests Behind White House Push to Transfer U.S. Nuclear Technology to Saudi Arabia Prepared for Chairman Elijah E. Cummings Second Interim Staff Report Committee on Oversight and Reform U.S. House of Representatives July 2019 oversight.house.gov EXECUTIVE SUMMARY On February 19, 2019, the Committee on Oversight and Reform issued an interim staff report prepared for Chairman Elijah E. Cummings after multiple whistleblowers came forward to warn about efforts inside the White House to rush the transfer of U.S. nuclear technology to Saudi Arabia. As explained in the first interim staff report, under Section 123 of the Atomic Energy Act, the United States may not transfer nuclear technology to a foreign country without the approval of Congress in order to ensure that the agreement meets nine nonproliferation requirements to prevent the spread of nuclear weapons. These agreements, commonly known as “123 Agreements,” are typically negotiated with career experts at the National Security Council (NSC) and the Departments of State, Defense, and Energy. The “Gold Standard” for 123 Agreements is a commitment by the foreign country not to enrich or re-process nuclear fuel and not to engage in activities linked to the risk of nuclear proliferation. During the Obama Administration, Saudi Arabia refused to agree to the Gold Standard. During the Trump Administration, Saudi Crown Prince Mohammed bin Salman (MBS) went further, proclaiming: “Without a doubt, if Iran developed a nuclear bomb, we will follow suit as soon as possible.” There is strong bipartisan opposition to abandoning the “Gold Standard” for Saudi Arabia in any future 123 Agreement.

  • The Policies Kushner Should Push
Al-Shabaka Policy Memo THE POLICIES KUSHNER SHOULD PUSH FOR By Zaha Hassan Jared Kushner, President Trump’s son-in-law and senior advisor, as well as envoy Jason Greenblatt and deputy national security advisor for strategy Dina Powell, are in Israel and Palestine today in an attempt to restart the stalled Israeli-Palestinian “peace process.” According to the White House, their discussions with Israeli Prime Minister Benjamin Netanyahu and Palestinian President Mahmoud Abbas will in part focus on economic steps that the parties believe help create conditions for peace. Yet more economic development initiatives are not a substitute for political change, particularly when tensions are seething in the West Bank, including Jerusalem, and when Gaza is facing a politically constructed humanitarian catastrophe. “Economic development Despite Trump’s early enthusiasm to reach a peace deal, it is now anyone’s guess whether the US intends to advance initiatives are not a specific terms of reference for a final status agreement. Dozens of meetings have already been held between Greenblatt substitute for political and the two sides, yet the administration is still reluctant to publicly state its unequivocal support for a settlement freeze change.” and its commitment to the two-state framework. With reports surfacing that Netanyahu recommended to Trump that the large blocs of Israeli settlement-colonies in the West Bank be annexed to Israel in exchange for Israel ceding Wadi Ara, territory heavily populated with Palestinian citizens of Israel, to the Palestinian Authority, the time is now for Trump’s Middle East team to speak loud and clear about the role it intends to play in negotiations.
