SKATEBOARDING AND ROLLER SKATING Effective May 5, 2011 Laguna Beach Municipal Code Chapter 10.15 establishes regulations relating to skateboarding and roller skating Municipal Code Section 10.15.050 provides that the City Council of the City of Laguna Beach may designate specific public property locations at which skateboarding and roller skating shall be prohibited; The City Council of the City of Laguna Beach does hereby prohibit skateboarding and roller skating on the public streets and adjoining public sidewalks at the following locations: 1. Third Street between Park Avenue and Mermaid Street; 2. Diamond Street north of Carmelita Street; 3. Crestview Drive; 4. Temple Hills Drive; 5. Bluebird Canyon Drive, between Morningside Drive and Cress Street; 6. Morningside Drive, between both intersections of Rancho Laguna Road and Bluebird Canyon Drive; 7. Summit Drive, between Katella Street and Bluebird Canyon Drive; and 8. Alta Vista Way, between Bonita Way and Solana Way. MUNICIPAL CODE CHAPTER 10.15 10.15.010 Definitions. For purposes of this chapter, the following words shall be defined as follows: (1) “Roller skate” means any shoe, boot or other footwear, or device that may be attached to the foot or footwear, to which one or more wheels are attached, including wheels that are “in line,” also known as roller blades, for the purposes of moving, rolling or propelling a person, through body movement or gravity, along a sidewalk, pavement or other surface. (2) “Skateboard” means a board or platform of any composition or size to which two or more wheels are attached and which is intended to be ridden or propelled, through body movement or gravity, by one or more persons standing, kneeling or lying upon it, through body movement or gravity, and to which there is not affixed to it any seat or any device or mechanism to turn and control the wheels. “Skateboard” shall include all wheeled objects, including without limitation coasters, scooters and other devices used for transportation or sport that are propelled by body movement or gravity and that are not classified as “bicycles” in the California Vehicle Code. 10.15.020 Skateboarding and roller skating on public property – not pedestrians. Persons using, propelling or riding on skateboards or roller skates on public streets, public sidewalks, public parking lots and other public property, while in motion, are not considered pedestrians for purposes of traffic rules and regulations. Page 1 of 3 10.15.030 Skateboarding and roller skating on public property – prohibited during darkness. Skateboarding and roller skating is prohibited on all public streets, public sidewalks, public parking lots and other public property from sunset to one hour after sunrise on the following day. 10.15.040 Skateboarding and roller skating on public property – helmet required. Persons using, propelling or riding on skateboards or roller skates on public streets, public sidewalks, public parking lots and other public property shall wear a helmet conforming to the safety standards specified by the applicable laws of the State of California. 10.15.050 Skateboarding and roller skating on public property – prohibited at specified locations. The city council may, by resolution, specify certain public streets, public sidewalks, public parking lots and other public property, or portions thereof, on which skateboarding and roller skating shall be prohibited. 10.15.060 Skateboarding and roller skating on public property – acrobatics prohibited. No person shall perform acrobatics while operating a skateboard or roller skates on public streets, public sidewalks, public parking lots or other public property. “Acrobatics” includes but is not limited to jumps, spins, loops, 360’s, handstands, and any other movement, stunt or trick not essential to the ordinary use of the skateboard or roller skates as a transportation device. 10.15.070 Skateboarding on public property – upright position. Persons using, propelling or riding on skateboards on public streets, public sidewalks, public parking lots and other public property shall do so only in the upright position. Riding a skateboard in a sitting, prone, kneeling or luge position is prohibited. 10.15.080 Skateboarding and roller skating on public property – stop required. Persons operating a skateboard or roller skates approaching a stop sign shall stop at the limit line, crosswalk or other designated marking. 10.15.090 Skateboarding and roller skating on public property – yielding to traffic in same direction. Persons may operate skateboards or roller skates on public streets and roadways; provided, however, all such persons shall not cross the centerline of streets or roadways, if marked, shall remain on the right half of the street or roadway, and shall yield to vehicles approaching from the rear by moving to the right curb or shoulder of the street or roadway. 10.15.100 Skateboarding and roller skating on public property – speed. No person shall operate a skateboard or roller skates at a speed in excess of twenty-five (25) miles per hour or the speed posted for vehicular traffic, whichever is less. 10.15.110 Skateboarding and roller skating on public property – uncontrolled intersections. Persons operating a skateboard or roller skates, when approaching an uncontrolled intersection, shall yield to vehicles that are so near the person as to present a hazard and shall not cross the intersection at a speed in excess of ten (10) miles per hour. Page 2 of 3 10.15.120 Skateboarding and roller skating on public property – prohibited on specified public sidewalks. No person shall operate a skateboard or roller skates on any sidewalk within the central business district (Aster Street to Legion Street, Coast Highway to the Irvine Bowl Festival grounds), sidewalks adjacent to Pacific Coast Highway, sidewalks on Glenneyre Street from Forest Avenue to Calliope, sidewalks on Cliff Drive from Coast Highway to Beverly Street, the Main Beach Boardwalk, all areas within city parks, or such other areas as may be designated by resolution of the city council. 10.15.130 Skateboarding and roller skating on public property – yielding to pedestrians. Persons operating a skateboard or roller skates shall yield to the right-of-way of pedestrians and persons in wheelchairs whenever and wherever they are encountered, shall proceed with due care and at a safe speed, and in no event shall skateboards or roller skates be operated nearer than five (5) feet to a pedestrian or person in a wheelchair. 10.15.140 Skateboarding and roller skating on public property – placing obstacles or ramps prohibited. No person shall place ramps, jumps, cones, trash cans or other objects or devices on public streets, public sidewalks, public parking lots or other public property in connection with the operations of skateboarding or roller skating. 10.15.150 Skateboarding and roller skating on public property – manner of operation. No person shall operate a skateboard or roller skates recklessly or in such a manner or at such a speed as to cause or threaten to cause injury to himself or herself or to others, to generate loud or unreasonable noise, to create an obstruction or to present a hazard to the free use of public property by pedestrians or motorists, or to cause or threaten to cause damage to public property. No person shall operate a skateboard or roller skates on public planters, retaining walls, walls, railings, curbs, barriers or other similar structural features. 10.15.160 Skateboarding and roller skating on private property – prohibited without permission of owner. No person shall operate a skateboard or roller skates on private property, including without limitation driveways, planters, retaining walls, walls, railings or other structural features of any kind, without the permission or authorization of the property owner. 10.15.170 Skateboarding and roller skating on public property – attaching to or towing by vehicle prohibited. A person operating a skateboard or roller skates shall not attach the same or himself or herself to any motor vehicle on the roadway. In addition, a person shall not knowingly drive a motor vehicle that is towing a person riding upon a skateboard or roller skates. 10.15.180 Skateboarding and roller skating – penalty for violations. It shall be unlawful for any person to violate or fail to comply with the provisions of this chapter. Any person violating the provisions of this chapter shall be guilty of an infraction and shall be subject to fines as established by resolution of the city council. Page 3 of 3 .
