IMPLEMENTATION STATUS B.1 Procurement Status The package wise procurement status as per discussion and inputs provided by PMU is as under:  The „signing of contract‟ for Package-1 happened on July 31, 2015 and the contractor (M/S NECCON) was mobilized from 17 September 2015. All the 20 new 33/11kV sub-stations sites have been handed over to contractor, however work has been suspended at 33/11kV Bapapung substation due to pending forest clearance. Because of techno-economic considerations, the sub-station proposed at Namsung was shifted to Podumani and thereafter to the current location at Bapapung, Panbari Road, Digboi, Tinsukia district. The original site selected for construction of the Bapapung S/S has been shifted to the adjacent land to avoid any tree cutting. No trees and shrubs are present at the current selected site. The contractor has hired a monitoring agency to conduct environmental monitoring. For Package 1 environmental monitoring has been undertaken once for Lot I & Lot II substations and twice for Lot III substations except for 33/11kV Kaliapani substation and 33/11kV Bapapung substation where monitoring is yet to be initiated.  For Package 2, after receiving ADB‟s approval, PMU issued the notice of award of contract to M/s T & T Projects on 23 December 2015. Work is in progress under Package 2. The contractor has hired an agency named “EQM consultant” for conducting environmental monitoring. Till December 2018 environmental monitoring was carried out at 33/11kV Molaibari,33/11kV Rajgarh, 33/11kV Kamalpur and 33/11kV Gaurisagar substations. For other subproject components of Package 2, environmental monitoring is still to be initiated by the contractor.  In Package 3, after receiving ADB‟s approval on bid evaluation report of Lot-1, the contract was signed on April 12, 2016 with Hi-Tech Corporation JV Technology Products and is in effect. In case of Lot 1: Factory inspection tests are completed. Delivery of testing vehicles has been completed, however the number has reduced from 19 to 18. This Package is now completed. In case of Lot 2, Contract was awarded on 28th September 2015 and mobile substation delivery is completed, one is stationed at Veterinary substation ground under GEC I and the other at Teok substation under Jorhat Electrical Circle.

 In Package 4, after receiving ADB‟s approval for retendering, the bid was floated on 9th May 2016. The proposal received was evaluated and placed before the Technical Purchase Committee (TPC) meeting on 15 December 2016. The report was sent to ADB‟s approval. The ADB‟s approval was received on the last week of January 2017 and same was placed in the APDCL Board for approval. The Board meeting conducted in March 2017 approved the same. The notice of award was issued to the Contractor Tata Consultancy Services on 29 March 2017 and the contract signed on 7 June 2017. Approval of GTPs and supply completed as reported by APDCL. Installation work is in progress. in progress by 94%. i. 7 Nos. New 2X5 MVA, 5. 33/11kV Powai substation: Material/equipment 33/11kV Substations; supply, civil work and erection work of equipment is Lot 1 in progress by 76%. 6. 33/11kV Philobari substation: Material/equipment supply, civil work and erection work of equipment is in progress by 87.61%. 7. 33/11kV Dhola substation: Material/equipment supply, civil work and erection work of equipment is in progress by 84%. Note: No subproject is present in reserved forest. No impact on water body is anticipated. No tree cutting is anticipated. ii. New 33kV Lines  Route survey is complete for all associated 33kV and (95.467km) 11kV lines for new 33/11kV substations under Lot- iii. New 11kV Lines (64.717 1(Bhagjan, Gangabari, Gelapukhuri, Mahakali km); (Chabua), Powai, Philobari and Dhola). iv. 1 No. Railway track crossing in the 33kV  Construction activity for 33kV and 11kV railway Line;

The work for crossing in the 11kV new 11kV railway crossings is in progress by 23%. Line; 1. 33/11kV Gharamara (Kaliapani) substation: Site for Kaliapani (Gharamara) sub-station is finalized and handed over to the contractor. Addendum IEE for Kaliapani substation was prepared and submitted to ADB. After approval by ADB, the same was uploaded on ADB website. Material/equipment supply, civil work and erection work of equipment is in progress by 71%. 2. 33/11kV Bapapung (Podumoni) (Namsung) substation: The site for Namsung substation was shifted to Podumoni. But because of techno- economic constraints, the site for proposed sub- station was selected at Bapapung, Digboi, Tinsukia district. In order to avoid any tree cutting the site selected for Bapapung substation was again shifted to the adjacent land in Kherjan Forest Village, adjacent to Upper Dihing Reserve Forest. Forest clearance will be required for the use of this land. The IEE will be updated for Bapapung substation once the forest clearance is obtained. Dibrugarh Electrical Circle After obtaining NoC from DFO and Veterinary Department (21.11.2017 & 01.12.2017 respectively), Lot 2 i) 2 Nos. New 2X5 MVA, Digboi Division, the substation site was handed over 33/11kV sub-stations; to contractor, but work was suspended and APDCL has been advised to resume construction only after receiving the forest clearance and necessary approval of addendum IEE from ADB. The process of settlement of rights under schedule tribes and other traditional forest Dwellers (Recognition of Forest Rights Act, 2006) on the forest land proposed for construction of 33/11kV Bapapung substation was initiated on 3rd November 2018. Once the declaration is received, application for forest clearance will be submitted. Note: Kaliapani substation is not on reserved forest land. However, the proposed site for Bapapung substation is in Upper Dihing Reserve Forest East Block (Kherjan Forest Village). All the necessary clearances are to be obtained in accordance with law. No impact on water body is anticipated. Tree cutting (if involved) will be assessed by the forest department. ii) New 33kV Lines (31.076  Route survey is complete for 33kV lines at Kaliapani km) and Bapapung substations.

IEE for this substation was submitted to ADB for i) 3 Nos. New 2X5 MVA, approval. The addendum to IEE report is approved 33/11kV sub-stations; and is uploaded on the website. Material/equipment supply, civil work and erection work are in progress by 95.03% Note: No subproject is located in reserved forest. No impact on water body is anticipated. No tree cutting is anticipated. ii) New 33kV Lines with  Route survey of the incoming 33kV line for Doloujan, terminal equipment Phulongoni and Rangagorah is complete and (56.142km); approved. iii) New 11kV Lines 11  The route survey for four 11kV feeder lines at 33/11kV (51.084km) ;

SAFEGUARD IMPLEMENTATION STATUS 2.1 Activities performed during July - December 2018 The Safeguard Specialist provided services during the reporting period and has conducted a detailed review of progress and gaps on implementation of social and environmental measures in the project. This also included follow-up for updating status on pending land status of all sub- stations with IA divisions and apprising the PMU of latest developments. The activities carried out by the Social & Environmental Consultant team during July - December 2018 are provided below.  Follow-up with concerned officials to collect status on confirmed sub-station locations, acquisition of private land and transfer of government land in favor of APDCL.  Submission of Bi-Annual Environmental Safeguard Monitoring report for the period January – June 2018.  Submission of Site Visit Report, Quarterly Progress Report and Monthly Progress Report.  Updating of Initial Environmental Examination Report.  Directed the contractor to submit the final alignment of 33kV and 11kV distribution line, route survey map indicating the RoW, marking the locations and type of features likely to be affected the progress.  Collection of information for further updating of Initial Environmental Examination Report.  Supporting client and follow up on the process of FRA and Forest Clearance for 33/11/kV Bapapung Substation. 2.2 Safeguard Review Findings i. Sub-station site selection at Bapapung is complete. The selected site for 33/11kV Bapapung substation is on forest land, thus forest clearance is required and the process of obtaining the same is still to be initiated. The process for obtaining consent as per the Forest Rights Act, 2006 has already been initiated at the office of District Collector, Tinsukia. The details of sub-stations sites finalized till this reporting period is in Table 1. 2.3 Details of Site Visits and Stakeholder Consultation The social & environment team along with the technical team has undertaken site visit from October 10th – 12th, 2018 to 33/11kV Kaliapni substations under Lot-2 of Package – 1 under Dibrugarh Electrical Circle, 26th – 28th November 2018 to 33/11kV Borjuli, Borsala, Singri, Bedeti and Bindukuri substations under Lot-3 of Package – 1 under Tezpur Electrical Circle and October 31th – 3rd November 2018 to 33/11kV Dhola , Gangabari and Philobari substations under Lot-2 of Package – 1 under Tinsukia Electrical Circle. The site visit objectives were (a) check land possession status of Kaliapani Borjuli, Borsala, Singri, Bedeti, Bindukuri Dhola, Gangabari and Philobari sub-station land; (b) assess environmental suitability of the locations; (c) Contractor compliance to EMP at site of (d) advise PMU/IA on social and environmental safeguard compliance with ADB SPS 2009. 2.3.1 33/11kV Kaliapani Substation During the site visit construction of Boundary wall works was in progress and no workers from the contractor M/S NECCON POWER & INFRA LTD were found at site. Test charges of the transformers are completed, and the final commissioning will be initiated within a short period. be clean properly. Contractors were advised to keep all the safety equipment‟s like gumboots, helmets, boot, first aid box etc. at the substation premises. Empty oil drums should be stored properly, and contractors were advised to do the same properly. 2.3.3 33/11kV Singri Substation Boundary wall and wall fence completed, and the civil works of the S/S has been completed. Proper sanitary facility was observed during the site visit. Transformer oil drums were not stored properly which may contaminate the ground level. Contractors are advised to keep the drums properly. 2.3.4 33/11kV Borsala Substation Boundary wall and wall fence completed, and the civil works of the S/S has been completed. However, boundary wall paint was yet to be initiated. Proper sanitary facility was observed during the site visit. Proper drainage facilities under the cable trenches were completed. Workers were provided LPG cylinder for cooking. Test charges of the transformers are completed, and the final commissioning will be initiated within a short period. 2.3.5 33/11kV Bindukuri Substation All the civil works and electrical work has been completed and the S/S has been commissioned on 13/04/2018 and it is now in operation stage. Though personal protective equipment (PPE) like gloves, gumboots, helmets are provided for the staff, these are not adequate and contractors were advised to provide the PPE accordingly. Two numbers of fire extinguishers have been installed at the site. Contractors were also advised to store sand buckets and danger sign hording at the S/S premises. 2.3.6 33/11kV Bedeti Substation Boundary wall, wall fence and other civil works of the S/S are completed. However, boundary wall paint was yet to be initiated, contractor was directed to use lead free paint only. Proper sanitary facility provision was observed during the site visit. Proper drainage facilities under the cable trenches were completed. Installation of fire extinguisher, sand buckets and safety hoardings is pending. The Contractor‟s representative stated that all the PPE equipment would be made available before the time of commissioning of the S/S. 2.3.7 33/11kV Dhola Substation Construction of boundary wall and control room building works was in progress. Contractor was advised to comply with safety measures, working conditions, environmental management plan requirements and employment legislation as stipulated under the contract and relevant national and state laws, ADB safeguards policy & regulations. Contractor advised to provide the construction workers with PPE such as helmets, gloves, gumboots, etc. 2.3.8 33/11kV Gangabari Substation During the site visit APDCL official staff General Manager, Deputy General Manager, Sub Division Officer and Contractors were present at the site. Contractor was advised to finish the pending works such as fire wall, boundary wall works, control room, building, etc. within given timeline. 2.3.9 33/11kV Philobari Substation Absence of drinking water and sanitation facility was observed at the substation site. Bathroom fittings were present but not installed. PPE (Personal protective equipment) were available at the site. Control room compound was not managed properly. The substation is commissioned and during the visit the compound was witnessed to be covered with small vegetation, the person in charge was advised to clean up the compound from excessive vegetation. 2.3.6 Actions Taken: Though the contractors are aware of the stipulations on compliance with the Environmental Management Plan as outlined in the contract agreement; they still need to be advised at intervals to strictly follow the guidelines. The PMU is constantly guiding the contractors on various directives such as proper storage of construction material, disposal of waste and clearing of excessive vegetation. In addition, contractors are being urged to submit the compliance reports on EMP implementation for substations under construction on time. The

Annexure 3

GRIEVANCE REDRESS MECHANISM APDCL does not have any specific Environment or Social Safeguards Policy regarding generation/distribution subprojects currently. SPS 2009 requires APDCL to establish a Grievance Redress Mechanism (GRM) having suitable grievance redress procedure to receive and facilitate resolution of affected peoples‟ concerns, complaints, and grievances about the subproject‟s environmental performance. The grievance mechanism will be scaled to the risks and adverse impacts on environment due the subproject type, size, type of area (sensitive area) and impacts. It should address affected people's concerns and complaints promptly, using a transparent process that is gender responsive, culturally appropriate, and readily accessible to all segments of the affected people at no costs and without retribution. This GRM will consist of a Grievance Redress Committee (GRC) headed by the Project Head. The committee will consist of the following:

i. Project Head, APDCL ii. Sub District Magistrate/District Revenue Officer or their nominee iii. Representative of local Panchayat/Council iv. Representative Women representative of village/council v. Representative of EPC contractor vi. AGM of Environment and Social Management Unit (ESMU) at PMU or nominee GRM will provide an effective approach for resolution of complaints and issues of the affected person/community. Project Management Unit (PMU) shall formulate procedures for implementing the GRM, while the PIU shall undertake GRM‟s initiatives that include procedures of taking/recording complaints, handling of on-the-spot resolution of minor problems, taking care of complainants and provisions of responses to distressed stakeholders etc. paying particular attention to the impacts on vulnerable groups. Grievances of affected persons (APs) will first be brought to the attention of the Project head of the PIU. Grievances not redressed by the PIU will be brought to the Grievance Redress Committee (GRC) set up to monitor subproject Implementation for each subproject affected area. The GRC will determine the merit of each grievance and resolve grievances within two weeks of receiving the complaint. The proposed mechanism does not impede access to the country‟s judicial or administrative remedies. The AP has the right to refer the grievances to appropriate courts of law if not satisfied with the redress at any stage of the process. The PIU will keep records of all grievances received including: contact details of complainant, date that the complaint was received, nature of grievance, agreed corrective actions and the date these were affected, and outcome. The GRC is formed in all the concerned Zones for Tranche-4 subprojects. The GRC formation letters are attached below:
