Table Agenda Item No. 05 : Inclusion of QC/QA related services as part of the LoA for extending to all without restriction –request for broad banding of LoA to include services –By Dr. Reddy Laboratories Ltd, Formulations Tech Ops-IX- Reg.

Dr. Reddy Laboratories Ltd, Formulations Tech Ops-IX , unit in VSEZ has submitted the proposal for Inclusion of QC/QA related services as part of the LoA for extending to all SEZ units and DTA units without restriction.

The proposal of the unit was placed in the UAC meeting held on 29.9.2016 and the Unit approval committee after deliberation has approved the proposal for inclusion of additional activity i.e. Advanced instrumentation Lab(R&D) for rendering QC/QA related services under broad banding exclusively for Dr. Reddy‖ s Laboratories Limited (FTO-IX) a unit in VSEZ only and not for other SEZ and DTA units.

Subsequently, Dr. Reddy‖ s Laboratories Limited (FTO-IX) has submitted the request and requested for grant of permission to extend the QC/QA related services to other units in SEZs and units in DTA.

The proposal was placed in the UAC meeting held on 25.01.2018 and UAC after deliberations had decided to refer the matter to the DoC for necessary clarification/consideration.

Accordingly, the matter was taken up with DoC vide this office letter dated 08.08.2018.

In response to this office letter, DoC vide letter dated 21st August, 2018 has informed that BoA has and approved the similar issue for inclusion of additional activity QC/QA to other SEZ units and DTA units subject to conditions to Dr. Reddy Lab, Srikakulam vide meeting held on 9.11.2018.

In view of the above, DC VSEZ has advised to re examine the request of VSEZ unit for re consideration. Further DoC has also advised to inform them that the final outcome in the matter .

In light of the above, If approved, we may place the request of the Dr. Reddy Lab, IX, unit at VSEZ in the UAC meeting for re consideration.

Table Agenda Item No. 06 : LoA No.9/SEZ/301/VSEZ/2015 dt.9.09.2012 – Request for Extension of the validity of LoA by M/s. Rashmita information systems Pvt. Ltd-Reg

M/s. Rashmita information systems Pvt. Ltd vide letter dated 18th Oct,2018 has submitted request for renewal of LoA in Form F1 as per the amendment to SEZ rule 19(6A)(1) dated 19.09.2018.

Ltd was granted Letter of Approval vide 9/SEZ/301/VSEZ/2015 dt.9.09l.2012 for authorized operations of service activities in software development support & supply Hardware supply & support The unit has commenced the operations on 01.11.2013. The unit has requested to extend of the Letter of Approval for further period of five years period i.e. 01.11.2018 to 31.10.2023..

As per SEZ Amendment rules, 2006.in terms of Rules(6A)(1), the units which intend to renew the validity of Letter of Approval shall submit before two months from the date of expiry of the Letter of approval the completed application in form F-1 along with requested document, to the Development Commissioner, duly signed by the proprietor or managing partner or if it is a company, by the Managing Director or the Directors(s) or any person who has or have been duly authorized for this purpose by a resolution of of the Board of Approval of Directors of the Company.

Provided that in case an application is not submitted before the said period of two months, such application shall be placed before the Approval committee and the said committee, if it is satisfied that there was sufficient cause for not filing the same before the said period, may direct for entertainment of such application.

In this instant case, the unit has submitted the application for renewal of Letter of Approval on 18th Oct,2018 in Form F1 from the date of expiry of the LoA since the unit has not submitted the request before two months in advance from the date of expiry of LoA. The same is placed before UAC for consideration whether to entrain the application or not.

Accordingly, the proposal of the unit is placed in the UAC meeting for consideration.

Table Agenda Item No. 07 : Request M/s. Worldwide Sorting Private Limited for inclusion of HSN Codes for the authorized Activity in LoA Letter No.9/SEZ/302/VSEZ/2016 dt.16.08.2017-Reg

M/s. Worldwide Sorting Private Limited was granted permission for inclusion of the additional activity. i.e. Manufacture services – to Manufacture Jewellery made up of Gold and silver studded with diamonds and other precious stones with ITCHS codes and Annual capacities

Based on the approval of the unit is carrying on the operations, now the unit has informed that recently they have filed a bill for export of Jewellery studded with other precious stones, at that time Customs while processing has observed that the ITCHS code indicated pertains to the Jewellery studded with Diamonds/silver but not related to other precious stones and the ITC HS code for jewellery studded with other precious stones was not indicated in the LoA as such they have advised them to include the ITHS code for other precious stones for clearance of the same. As per the instructions of the Customs, the unit has submitted a request for indication of ITCHS code for Jewelry studded with other precious stone. The request has been processed/considered for indication of the ITCHS code 71131940, 71131960, 71131990, 71131130 and 71131190 which are pertaining to gold jewellery studded with other precious semi precious stones, parts, others , other articles of jewellery and others respectively.

Brief Profile of the Company:

Company was originally incorporated HCL Overseas Limited onn 21.11.1991. The name of the company has been changed from HCL Overseas Limited. to HCL Consulting Limited on 14.07.1994 & subsequently to HCL Technologies Limited on 06.10.1999. There are eleven Directors in the company viz., Mr. Sivaprasad Sivasubramaniam Nadar (Chairman & Chief Strategy Officer), Mr. Deepak Kapoor, Mr. James Philip Adamczyk, Ms.Nishi Vasudeva, Mr. Ramanathan Srinivasan, Mr. Robin Ann Abrams, Ms. Roshni Nadar Malhotra, Dr. Sosale Shankara Sastry, Mr. Subramanian Madhavan, Mr. Sudhindar Krishan Khanna & Mr. Thomas Sieber. Agenda No. 02: Request for permission to procure 400 KL HSD without payment of duty for authorized operations for one year w.e.f 14.11.2016 –Dr. Reddy’s Lab Ltd, SEZ Developer- Reg.

Dr. Reddy’s Lab Ltd, SEZ Developer vide letter dated 05.10.2018 has requested for permission for procurement of 400 KL HSD for a period of one year. The Developer has been granted permission for procurement of HSD for a quantity of 400 KL for one year vide this office letter dated 06.02.2018.

The Developer has submitted the HSD requirement duly certified by the Chartered Engineer.

In terms of SEZ Rules 2006, Rule 12 (2). for Import and procurement of goods by the Developer:―The Developer shall make an application, after obtaining approval for the authorized operation under rule 9, to the Development Commissioner, along with the list of goods and services, including machinery, equipment and construction materials required for the authorized operations, duly certified by a Chartered Engineer for approval by the Approval Committee.‖

Accordingly, the proposal is placed before UAC for consideration.

Agenda Item No. 10 : Request of M/s. Rare Rocks unit in APIIC Ltd. Buliding Products SEZ Prakasam District for inclusion of additional product in the LoA under broad- banding.

M/s. Rare Rocks unit in APIIC Ltd. Buliding Products SEZ Prakasam District vide letter dated 09.10.2018 has submitted request for permission for inclusion of the additional product in the Lo A i.e. Engineered Stone.

The unit has informed that they are receiving enquiries for supply of Quartz (Engineering Stone) material from their customers and they wants to execute these orders in this context and they entend to set up the required machinery for manufacture of Engineered Stone. The unit has submitted the details of investment, employment, Exports, Imports NFE and Employment.

The above request of the unit has been placed in the UAC meeting held on 22.10.2018 and the Committee deliberated and advised to seek the details of ITCHS Codes from the Unit in respect of the proposed product.

In response to the unit vide letter dated 23.10.2018 has submitted the ITC-HS Code of finished Engineered Stone i.e. 68101990.

In terms of Rule 19(2), approval Committee may also approve proposal for broad banding, diversification, enhancement of capacity of production, change in the items of manufacture or service activity, if it meets the requirement of rules 18.

The operation will be located on Brandix India Apparel City Special economic Zone in Visakhapatnam, Andhra Pradesh and will render the services of Storage, CFS and inventory management.

The company is committed to an initial investment of around Rs. 50 lakhs for this project. This investment consists of providing financing for equipment, working capital and start-up costs. The company will lease 2,300 square foot storage facility from the BIAC Park.

M/s K.S.R.Freight Forwarders Pvt. Ltd. has submitted Memorundum of Association and Article of Association.

The Co-Developer of the SEZ, i.e., M/s MN Industrial Parks Pvt. Ltd., Atchuthapuram has allocated built-up area admeasuring 2,312 SFT in Staging Unit III (BUAC Oricessubg area), located at Plot No. 8B on lease basis.

Agenda Item No.04: Request of M/s Adhishtan Investment India (Pvt) Ltd, A Co-Developer of Brandix Apparel City Pvt Ltd, Developer, Atchutapuram , Visakhapatnam for construction of centralized kitchen (422 sqmtrs) in Non processing area for providing subsidized food to BIAC SEZ employees - Reg.

M/s. Adhishtan Investment India (Pvt) Ltd, Co-Developer of Brandix Apparel City Pvt Ltd, Developer, Atchutapuram , Visakhapatnam has requested for approval of list of goods required for construction of centralized kitchen (422 sqmtrs) as part of authorized operations.

M/s. Adhishtan Investment India (Pvt) Ltd. has informed that employment of over 18,000 has been generated withinBrandix India Apparel City Private Limited (BIAC-SEZ)where most of the units’ operation on double shift basis. Therefore, in order to accommodate the welfare needs of such a large workforce, canteen services are provided within each unit where all meals are prepared and transported to BIAC by a number of 3rd party vendors. BIAC and all its tenants in order to safeguard the health of its associates have implemented strict policies and hygiene guidelines to all such 3rd party vendors. Due to the volume of the number of meals required per shift, and due to said safeguard measures of hygiene, it has been a challenge to secure reliable 3rd party vendors near BIAC-SEZ.

Further they have informed that Current food vendors except Touch Stone Foundation – Akshaya Patra, do not operate at satisfactory hygiene standards and AkshayaPatra, currently provide approximately 5,000 meals a day to Brandix Units from their kitchen, which is about 40km from BIAC. This distance did pose limitations in the type of food Akshaya Patra could prepare for BAIC-SEZ employees mainly due totravel time of meals from the kitchen which lead to some food items food going stale before consumption, however even with this challenge no other 3rd party vendor was able to provide food as satisfactory, ensuring basic hygiene needs, as Akshaya Patra. However, this arrange too will be limited with Akshaya Patra’sstrategic decision to shift their kitchen operations to Visakhapatnam City(Gambhiram)

Therefore, given that the new location will be approximately 75kms away from BIAC travel time is expected to be approximately 2 hours, making it impractical to supply food from the new location.

Therefore, with a view to continue in providing wholesome and hygienic food as part of the welfare of employees within BIAC-SEZ, Adhistan has decided in providing a facility for the ensuring that this welfare need of units are met. In order to do this Adhistan will construct a kitchen of their own as per the design and specification required by a food preparer such as Akshaya Patra Foundation, in the quality and standards of hygiene acceptable to BIAC-SEZ. Akshaya Patra will be contracted to operate the kitchen and prepare the meals for associates in BIAC-SEZ.

As per the SEZ Instruction 50, dated 15th March 2010, Ministry of Commerce and Industry has issued a Consolidated list of default authorized operations which can be undertaken by the Developer/ approved Co-Developer by default from the date of notification – “Employee welfare facilities like Crèche, Medical center and other such Facilities”.

Further they have informed that they have reviewed quotations for the construction of the kitchen and purchase of kitchen equipment, which will be essential to maintain the said expectations of quality and hygiene. With the establishment of this central kitchen in lieu of the welfare of all associates in BIAC, Akshaya Patra Foundation will be enabled to supply approximately 10,000 to 12,000 meals per day.

They have submitted the list of default authorized operations approved by the Board of Approval, New Delhi. The list of materials required for the construction of Central Kitchen duly certified by Chartered Engineer.

In view of the above, the request of M/s.Adhishtan Investments India (Pvt). Limited for permission to procure/import of the following goods/material for a value of Rs. 275.90 Lakhs required for construction of centralized kitchen in the non-processing zone as part of authorised operations is placed before the Approval Committee for consideration.

100th UAC Meeting (21.12.2018) VISAKHAPATNAM Department of Commerce vide Notification No.G.S.R.982(E) dated:16th December’2010 has issued amendment to Form ―C‖ of the SEZ Rules’2006, at Serial No 3 relating to General Conditions‖ for item (viii) the following item shall be substituted, namely:-

―The validity of this approval shall be co-terminus with validity of the Letter of Approval issued to the Developer and the progress of the implementation will be submitted to Government of India for every six months‖

As per the above amendment, the validity of the Letter of Approval granted to the Co- developer will be co-terminus with the validity of the Letter of Approval issued to the Developer. The above amendment implies that the validity of the Letter of Approval granted to the Co- developer will not lapse as long as the Developer holds a valid Letter of Approval in respect of the development of the SEZ.

M/s.Adhishtan Investments India Pvt. Limited was granted approval on 20.08.2009 with an initial validity period of three years i.e., upto 19.08.2012. The above amendment came into force on 16.12.2010 and the SEZ has become operationalised on 30.06.2008. As such the approval granted to M/s.Adhishtan Investments India (Pvt) Limited, Co-developer stands valid as on date and continues to be valid till the Developer holds the valid Letter of Approval.

Meanwhile, M/s.Brandix India Apparel City Private Limited keeping in view that the proposal of co-developer has been deferred and keeping in view of the urgency has submitted a request for permission to procure the materials/goods required for construction of swimming pool in the non-processing zone.

In view of the above, the request of M/s.Adhishtan Investments India (Pvt). Limited for permission to procure/import of the following goods/material for a value of Rs. 195.52 Lakhs required for construction of swimming pool in the non-processing zone as part of authorised operations is placed before the Approval Committee for consideration.

M/s VV Minerals, unit in VSEZ vide letter dated 12.07.2018 has requested for modification of authorized operations in the LOA by enhancing the capacity of Ilmenite.

In this connection the unit has informed that they have exported 32,258 MT of Ileminte against permitted quantity of 40,000 MTs. In addition , the unit intends to export 60,000 MT of Ilmenite to one of their customer in Australia.

It is informed by the unit that they have been permitted to export 4,00,000 MTs of heavy mineral in a span of 9 years against which they exported only 1,35,405 MTs of Garnet and

The unit has submitted that they are agreed to pay any duty that may be stipulated by the State and Central Govt. It is indicated that Ilmenite is not radioactive and it associates with other minerals in the naturally occurring beach sand and it is not a restricted item classified under SCOMET items of export.

M/s VV Minerals has been granted permission to process and trade Garnet, Ileminite, Rutile and Zircon for 40,000 MT/per year vide this office letter dated 12.05.2014.

Meanwhile the unit has requested to enhance the capacity of Ileminite from 40,000 to 83000 MT vide their letter dated 30.05.2018. The request of the unit has been placed in the UAC meeting dated 22.06.2018 and UAC decided to refer to DoC for clarification on the applicability of Export Duty on Illemenite .

Now the unit has requested to enhance the annual capacity of Illemenite from 40,000 to 100000 MTs. In terms of Rule 19(2), approval Committee may also approve proposal for broad banding, diversification, enhancement of capacity of production, change in the items of manufacture or service activity, if it meets the requirement of rules 18. Accordingly, the proposal is placed before UAC for consideration. ***
