1. Divisional Railway Manager (Commercial)/East Central Railway/ Danapur for and on behalf of President of , invites complete and sealed applications from eligible applicants for granting license for construction, operation and management of minor static catering units (Modular Catering Stall) for selling of Tea, Biscuits, approved Mineral water in sealed bottle & other approved packed items at D, E & F category stations over Danapur division in the prescribed format.

2. Important instructions to applicants are furnished in Annexure-A. Applicants are advised to read the instructions carefully before filling applications.

3. The prescribed format of application is given in Annexure –B.

4. The details of catering units ( name of stations, platform number, category of persons for which stalls are reserved and yearly license fee) for which applications are invited are furnished in Annexure- C.

5. Details of category of persons are furnished in Annexure –D.

6. The eligibility Criteria (Essential & Desirable) & documents to be submitted along with applications in support of eligibility criteria and the weightage to be given on each parameter of the criteria are furnished in Annexure –E.

7. Other documents to be submitted are furnished in Annexure – F.

8. Selection procedure is furnished in Annexure –G.

9. Details of submission of applications are furnished in Annexure- H.

10. Important terms and conditions of the license are furnished in Annexure-I.

Important Applications not being accompanied by prescribed documents in support of any / all conditions of Essential Criteria ( as per Annexure-E shall be summarily be rejected.

Annexure-A

Important instructions to applicants.

1. Eligible applicants should apply in prescribed format furnished in Annexure-B. Applicants are advised to type the format of application in A-4 size white paper and apply. 2. Applicants should not be less than 18 years of age. 3. One application form should be submitted for one unit/stall. If an applicant desires to apply for more than one unit/stall, the applicant should submit applications accordingly, i.e. for two stalls two applications and so on. An individual/Firm/Company/Co-operative will be allowed to hold maximum two units/stalls at one station and maximum of 10 units/stalls per Zonal Railway. 4. Each application form should be accompanied by documents in support of Eligibility Criteria, i.e. conditions of Essential Criteria and Desirable Criteria as detailed in Annexure - E. Applicants should also submit other documents as detailed in Annexure - F. However, weightage (points) will be given on eligibility criteria only. 5. Applications received without documents in support of any/all conditions of Essential Criteria shall be summarily be rejected. 6. Application will be received from 10.12.2014 to 09.01.2015 as detailed in Annexure – H. 7. The Railway Administration reserves all right to modify/cancel/discharge the whole or part of allotment process at any stage without assigning any reason. 8. Railway reserves the right to accept or reject any application without any assigning reason. 9. Minorities include the communities namely Muslims, Christians, Sikhs, Buddhists, Zoroastrians (Parsis). 10. Government employee or railway servant or any other member of his/her family is not eligible to participate in allotment process. 11. Advertisement notice alongwith all annexure are available on Indian Railway website www.ecr.indianrailways.gov.in. 12. All documents in support of eligibility criteria (Essential & Desirable) should be valid on the day of submission of application. 13. All documents should be attested by a Gazetted Officer. 14. In case of any difference in and English Versions meaning conveyed by English version will be prevail. 15. For stalls reserves for specific category as per Annexure-C , applicants of that category should only apply.

Annexure- E Eligibility Criteria and documents to be submitted Essential Criteria - (I)

Annexure-F

Other documents to be submitted

(i) Individual applicants shall submit a copy of PAN Card or photo Identity Card issued by Central/State Governments or Voter Identity Card or Driving license or Passport.

(ii) In case of firm , registered under partnership Act 1932, the applicant shall enclose copies showing details of partners along with certificate of registration, details of their business and partnership deed.

(iii) In case of company, the applicant shall enclose copies showing Memorandum and Articles of Association along with certificate of incorporation, and date of commencement of business etc.

(iv) In case of Co-operatives, the applicant shall enclose a copy of registration, by laws and business details.

If more than one Company/Firm/Co-operative Society apply for allotment of stall, the selection will be considered on the basis of :

(a) Period of experience in catering services. (b) Financial outstanding to mobilize resources to Employ the requisite staff and to run the unit.

(v) Individual applicants shall submit a copy of age proof certificate.

(vi) A copy of undertaking in affidavit on non-judicial stamp paper showing that the applicant is not a Government employee or railway servant or any other member of his/ her family.

Annexure-G

Selection Procedure

The Selection Committee will scrutinize applications and allotment will be made on fulfilment of criteria in both Essential and Desirable Category. If applicants do not fulfil any/ all conditions of Essential Category, their applications shall be rejected. If applicants do not fulfil any / all conditions of Desirable Category, their applications will not be rejected, but will be awarded zero points in that particular parameter, which is not fulfilled. However, the selection will be done on evaluation of all parameters. The committee will award points based on the weightage and tabulate and compile its recommendation for the approval of the competent authority. In case more than one applicant securing equal points, draw of lots will be conducted for selecting the applicant. The eligible applicant will be called for interview and the call letter will be issued individually at their address as given in the application. In case of non-appearance of any candidate, one reminder will be issued giving a period of 07 days thereafter no claim will be accepted in the regard. The call letter for interview will not be taken as a final allotment. Decision of the Screening Committee shall be final and binding on applicants.

Annexure-H

Submission of application form

Dully filled applications along with all documents as asked for should be enclosed in a cover. On the cover ‘Application for obtaining license for Modular Catering Stall, Stall No. ………… at ………… ………………..Railway station’ should be written on the top. The cover should contain name and address of the applicant. The cover should be addressed to Senior Divisional Commercial Manager,, East Central Railway, Danapur, PO- Khagaul, District.- Patna (Bihar), PIN- 801105 and dropped in a box kept in the office of Senior Divisional Commercial Manager,, East Central Railway, DRM Office, Danapur during working hours on working day from 10.12.2014 to 09.01.2015 . Applications can also be sent by pot / courier service so as to reach the above address latest by 18:00 hrs. of 09.01.2015. Railway Administration will not be responsible for postal delay. Applications received after the stipulated time and date will not be considered.

Annexure – I

Important Terms and conditions of the license agreement.

1. The successful applicant will deposit security deposit equivalent to 5% of the assessed annual sales or Rs.10,000/- whichever is higher and shall execute license agreement with the Railways. 2. The Licensee shall provide hygienic and good quality catering services. 3. The Licensee shall obtain Food License and medical fitness certificate for himself and his vendors as per rules. 4. The tenure of license of stalls will be for a period of five years with a provision for renewal after every five years for a further period of 05 years on satisfactory performance and payment of all dues and arrears and withdrawal of court case, if any. Renewal will not be a matter of right. 5. Annual Confidential Report off licensees will be maintained by Railways in which unsatisfactory performance / penalty imposed by railways will be entered, which will be basis for granting renewal. 6. Cooking will not be permitted on platform or in stall. 7. Licensee shall construct stalls on modular design as approved by the Railways at his own cost. Superior quality of materials should be used in fabrication / construction of stalls. 8. The menu and tariff for stalls will be decided and notified by the Railways, which will be subject to revision by the railways from time to time. The licensee shall sell catering items at prescribed rates only. 9. Licensee will pay water and electricity charges based on actual consumption. 10. The licensee shall pay all other taxes /duties as imposed by the Railways/Central Government/State Government/local bodies from time to time. 11. Railways will conduct regular and surprise checks at various levels to ensure hygiene, high quality, cleanliness, use of standard ingredients for preparation of food etc., charging as per prescribed tariff, availability of agreement , food license, identity card, medical cards in stalls and also for ensuring that the licensee is operating stalls as per terms and conditions of the agreement. 12. For unsatisfactory performance of the licensee, warning/fines will be imposed. An imposition off fine / warnings on more than 05 occasions will result in rejection of application of renewal. 13. Repeated complaints of similar nature will be viewed seriously and stern action will be taken against licensee. 14. The licensee shall be governed by Catering Policy -2010 amended from time to time and other orders issued by Railways. 15. Subletting of stall (s) is not permitted. 16. The successful applicant shall be ready to operate the stall within the stipulated period as notified by the Railways, otherwise the allotment will be cancelled.
