975.8 R2gp 1805 Georgia land lottery, fortunate drawers and grantees, Graham, Paul V. "The Act of 11 May 1803 established the general process by which the land lottery would operate. The law outlined the creation of three counties and thirteen districts: five districts in Baldwin County, three districts in Wayne County, and five districts in Wilkinson County. Each district was to be surveyed into lots, containing 202.5 acres each in Baldwin and Wilkinson counties and 490 acres each in Wayne County. In the end, 4580 land lots were surveyed. All square (or whole) lots, as well as all islands containing more than 100 acres, were included in the land lottery drawing. All fractions were held out and sold at public auction in 1806" Lot 383, Nicholas Colbert, Oglethorpe, fortunate drawer and grantee; 4 Dec 1805, grant date; BaD2GB:257, grant book.

975.8163 R28f, v.2. Elbert County, Georgia, Deed Books K - R, 1806 - 1819, Michael Martin Farmer. p. 1/ p. 3 28 Mar. 1805, Sally S. Bibb to Richard Colbert both of Elbert Co., for $400, tract bought by William Bibb, deed, of the estate of John Colbert, dec’d., 150 acres, adj. Dry Fork of Vans Creekon E., Peasant Bibb on W., sold to Wm. Bibb, dec’d by heirs of John Colbert, decd., viz: Charles Goss, Marthie Colbert, Nicodemus Colbert, Frankey [Fanny] Colbert, & Thomas Colbert, guardian for Philip Colbert, received 18 Nov. 1796. Sally, executrix of will of Wm. Bibb, decd. (signed) Sally S. Bibb. Test: Payton Bibb, Wm. Allen, J.P. Regd. 3 Mar. 1806. Apparently, Richard Colbert bought 150 acres that had been sold to Bibb when John Colbertson estate was settled. This documents the following and brings up more questions and observations: · Richard is not mentioned as a son in John Colbertson’s will. Who is he? I have seen other references to a Richard Colbert. Is he a cousin? There are other Colberts in Wilkes Co. a bit further south. · Change of the Colbertson name to Colbert. · Charles is the husband of Mary Goss named in the will. · Philpot in the will is Philip Colbert thereafter. · Philip/Philpot was a minor in 1796. · Martha and Fanny had not married by 1796. · Nancy, the youngest, is not mentioned. · John Colbert, son, is not mentioned. He is an executor of his father’s will, with his mother, Martha/Patty. · Mary, Martha, Nicodemus, Fanny, Thomas--is this the birth order. · John’s wife, Martha, is likely deceased in 1796 and this sale was the selling of the property to settle John’s estate. See also James Golliher’s heirs, court record 1818. However, the will bequeaths everything to Martha/Patty, wife. · Upon her demise the estate is to be equally divided among his children: Thomas, John, Mary Goss, Nicodemus, Philpot, Martha, Fanny. · Upon his death, Nancy, the youngest, was given a slave, feather bed, furniture as dowry as well as expense of her education of two years but was not included in the equal division of the estate upon the widow’s death. · Unmarried children would receive 20 pounds at their marriage before widow’s demise or if they marry after her demise, 20 £ before his estate was divided equally.

975.8163 R28f, v.2. Elbert County, Georgia, Deed Books K - R, 1806 - 1819, Michael Martin Farmer. p.33/p.190. 26 Oct. 1805 “John Daniel of Elbert Co., for $120, to Jane Childs, on Dry Fork of Vans Creek in sd. co., adj. Richard Colbert, mouth of Spring Branch, up branch to Thomas Colbert, Benjamin Allen, 34 acres, 26 Oct. 1805, (signed) J. Daniel. Wit: Jas. Alston, Sr., B. Allen. Elizabeth, wife of John Daniel, rel. [released] dower rights, 16 Dec. 1806. Wm. Allen, J.P. Regd. 21 July 1807.” · There is a later (1819) reference to a Daniel and Colbert relationship where in John Colbert is bequeathed land as son-in-law of James Daniel dec’d. · Van’s Creek, Elbert Co., had been Wilkes Co. earlier. It is Culbertson territory.

184824 Wills (original loose papers), 1790-1852 Wilkes, GA Ordinary Court [This is the film that has the John Colbertson/Colbert original 1789 will.] There was a John Colbert listed in a will for James Daniel, 1819/prov’d1821, which I note here as it may be useful in Colbertson research. See film for more complete detail.

· Considerable property, i.e., plantations, slaves, etc. left to heirs. · Sons--Cunningham Daniel, John Daniel--plantations on which they reside, plus items. · Son William Daniel’s widow and daughter, Elizabeth William Daniel · dau, Jane Daniel--slaves, furnishings, cows, sheep, $1,000 (invested by designated persons). If she marries the investment is divided or given to her at the discretion of the executors. Possession of the family home, east end, where she lives. If she marries, the entire home goes to David Daniel for his disposal. · Dau, Sarah [Daniel] Ellington and children by Josiah Ellington, slaves and $550. · Son-in-law John Colbert, slaves, previous property given. [I wonder if the dau married to John Colbert was deceased.] No mention of children. · Son, Samuel Daniel given land, slaves · Son, Thomas Daniel given land, slaves. · Son, Richard Daniel’s widow, Nancy Daniel and child, Francis, 100 acres where he lived, $1800, slaves. · Son, David Daniel, plantation, slaves, furniture, animals, tools.
